HomeMy WebLinkAbout25222' RESOLUTION NO.25222 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC CONVENIENCE OR NECESSITY WOULD BE SERVED BY THE ISSUANCE OF A TYPE 20 (OFF -SALE BEER & WINE) ALCOHOLIC BEVERAGE CONTROL LICENSE FOR SPROUTS FARMERS MARKET LOCATED AT 5200 EAST RAMON ROAD BUILDING B WITHIN CENSUS TRACT NO. 447.02. WHEREAS, Terri Dickerhoff of CGR Development has initiated the application process for a California Department of Alcoholic Beverage Control (ABC) Type 20 (Off -Sale Beer & Wine) license to sell beer and wine at Sprouts Farmers Market located at 5200 East Ramon Road Building B, Census Tract No. 447.02, Zone PDD 291, APN: 677-420-058; and WHEREAS, The California Department of Alcoholic Beverage Control (ABC) has determined that there are three (3) existing Type 20 license within Census Tract No. 447.02, while only one (1) alcohol license would be allowed based on off -sale retail licenses to population in the County in which the applicant's premise is located; and WHEREAS, The California Department of Alcoholic Beverage Control (ABC) has determined that is the addition of the requested license would cause an "undue concentration" of alcohol -related licenses in the Census Tract No. 447.02; and WHEREAS, Pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license within an area of undue concentration; and WHEREAS, Sprouts Farmers Market is a new grocery store, which will be located with a multi -tenant commercial complex, The Springs. The business specializes in farm - fresh produce purchased from local growers, and it is proposing to conduct the sale of beer and wine for off -site consumption in conjunction with the operation of the grocery store. The issuance of a Type 20 (Off -Sale Beer & Wine) liquor license will allow the business to serve the public convenience due to the following findings: 1) The site is located on an active commercial corridor at the intersection of two major throughfares which provides an opportunity to offer "one stop shopping" and serve a wide range of clients who visit the premises for different purposes; and 2) the corporate identity of Sprouts Farmers Market is different from that of the existing grocery store in the same commercial complex. The business offers unique retail envitoriment and products which will contribute to diversifying the products and services that area currently has to offer. 1 Resolution No. 25222 Page 2 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the foregoing Recitals are true and correct and are incorporated herein by this reference. SECTION 2. That the public convenience or necessity would be served by the issuance of a Type 20 (Off -Sale Beer & Wine) alcoholic beverage license for the sale of beer and wine at Sprouts Farmers Market located at 5200 East Ramon Road Building B, Census Tract No. 447.02, Section 17.
