NARRATIVE
SOURCE:
On 1-10-20, I was working on uniformed patrol in a two man unit with Field Training Officer
Crampton, in a marked PSPD patrol vehicle in the City of Palm Springs and County of
Riverside. At about 2244 hours, I heard Officer Alcaraz advise over the police radio he had
a suspect fleeing from him in a vehicle, in the area of 425 S. Sunrise Way in the City of
Palm Springs and City of Riverside.
OFFICER STATEMENT:
After hearing over the police radio Officer Alcaraz had a vehicle fleeing from him, I
responded to his location to assist him with apprehending the suspect. While en route, the
last updated information over the radio was the vehicle came to a stop at the intersection of
Airline Dr. and Plaimor Ave in the City of Palm Springs and County of Riverside. I
responded to that location to assist.
Upon arrival, I observed the high risk vehicle stop was being conducted in a northbound
direction. I took a position in the high risk vehicle stop of the west side of the roadway, in the
front yard of the residence on the south west corner of the intersection. While officers were
giving commands to the suspect, Robert Martini, I heard Martini yell to the officers "Fuck
You."
During the high risk stop, I could clearly see Martini in his vehicle. None of the windows had
tint and I could clearly see in the driver's window and all of the passengers windows. All of
the windows were up and officers did not have access to enter the vehicle to apprehend
Martini. I could see Martini rummaging through the passenger compartment of the vehicle.
Based on him not listening to officers commands and believing he was looking to retrieve a
weapon to use against officers, Officer Crampton provided me with a 40mm less lethal,
serial in the event it was necessary to use to assist with taking the Martini into
custody.
I positioned myself perpendicular to the driver's side of the vehicle and was about 25 feet

from the driver's side of the vehicle. I had a clear view of the entire vehicle and Martini's
position in the vehicle. This allowed me to observe Martini's movements and confirm his
location in the vehicle.
Martini continued to refuse officers commands at which point Sergeant Andre authorized
the discharge of the 40mm less lethal projectile. I discharged the less lethal projectile into
the front driver's side window, while Martini was in the rear of the vehicle rummaging
through property, in an attempt to give officers an entry point into Martini's vehicle. After the
less lethal projectile went through the front window, Martini crawled to the front of the
vehicle, located the less lethal blue foam projectile and threw it out of the broken window.
He then proceeded back to the rear of the vehicle. The first less lethal shot did not
completely break the window, it just punctured a hole. Once Martini was back in the rear of
the vehicle, I discharged two more less lethal projectiles into the front window in an attempt
to knock all of the glass out of the window. These projectiles were unsuccessful as they
did not clear the glass from the window and only made the hole larger on the front driver's
window. The projectiles also punctured a hole through the front passenger window.
After the discharge of the less lethal, Martini lead officers an a second pursuit as he fled
again in his vehicle.
Martini was eventually apprehended. For the full details of the investigation refer to the
initial offense and supplemental reports completed under this case number.
I recovered the three spent less lethal casings and booked them into the PSPD property
room as evidence. I was able to locate two of the less lethal projectiles, one Martini threw
out of the window, and the other on the front passenger floorboard of Martini's vehicle. I was
unable to locate the third projectile in the vehicle or at the scene. I booked the two
projectiles into the PSPD property room as evidence.

SOURCE: Self - Initiated traffic enforcement stop.
M.O/P.O.E: Robert E. Martini was driving under the influence of a CNS stimulant. Martini
led PSPD Officers in a vehicle pursuit, refused to obey lawful orders, and kicked Police K9
Rico.
VICTIM STATEMENT: State of California.
WITNESS STATEMENT: None
OFFICER STATEMENT: On 01/10/2020 I was working a patrol assignment in full duty
uniform and in a marked patrol vehicle (unit 32), in the City of Palm Springs, County of
Riverside. At approximately 2244 hours, I was conducting a patrol check of the Starbucks
parking lot, located at 425 S Sunrise Way, when I observed a white Chevrolet Uplander
() parked in front of Starbucks facing eastbound. The Chevy reversed
from the parking stall and almost struck a vehicle which was driving northbound in the
adjacent aisle of the parking lot.
The vehicle stopped to avoid the collision and the Chevy drove southbound, swerving
around the vehicle and almost hitting the vehicle again head on. The Chevy continued
southbound and swerved around my patrol vehicle to avoid striking me head on. I saw that
the driver was the sole occupant of the Chevy. He was later identified as Robert Martini by
his California Driver License. Martini did not have a visible reaction to almost striking my
vehicle.
Fearing that Martini was driving impaired, I conducted a 3-point turn to follow behind the
Chevy to conduct a traffic enforcement stop.
I positioned my patrol vehicle behind the Chevy and I activated my patrol vehicle's
emergency lights. The Chevy initially yielded near the CVS which is in the same parking lot.
Immediately after exiting my patrol vehicle, Martini decided to flee the traffic stop. He drove
to the south exit of the parking lot and turned westbound onto E Ramon Rd.

I followed Martini with my patrol vehicle's emergency lights still activated. I then turned on
the siren to my patrol vehicle. I informed PSPD Dispatch that Martini had fled and that I was
pursuing him. During this pursuit, I updated PSPD Dispatch with the road conditions, the
pursuit speeds and Sergeant Lu requested air support which was not available.
Martini drove southbound on Calle Amigos (residential street with a 25 MPH speed limit).
Martini drove in an excess of 40 miles per hour, in violation of CVC 22350(a). Martini then
turned westbound on Calle Amapola Ave, southbound on Thornhill Road and then
eastbound on Sunny Dunes Rd at approximately 60 miles per hour. Martini proceeded to
turn northbound onto S Sunrise Way, failing to stop at the posted red light.
Martini continued northbound on S Sunrise Way. and continued straight (north) in the left
turn lane failing to stop at a red light in violation of CVC 21453(a). The Chevy then turned
off its lights and drove in violation of CVC 24250. At this point, I was driving at approximately
60 miles per hour and the Chevy was gaining distance away from my patrol vehicle. Officer
Arden was waiting at the intersection of S Sunrise Way and E Baristo Rd., to assume the
secondary responsibility of this pursuit. Due to the distance that Martini had gained on my
patrol vehicle due to his excessive speeds, Officer Arden got behind the Chevy and took the
first position of the pursuit as I continued in the pursuit as the secondary unit. The Chevy
turned eastbound on E Andreas Rd. The Chevy continued east in a residential area at over
40 mph and failed to stop at the following stop signs: Cerritos Dr, Sunset Way, and Farrell
Dr. in violation of CVC 22450(a). Martini did not slow down for the posted stop signs.
Martini then turned northbound on Airlane Dr., stopping on the west side of the road in front
of 235 Airlane Dr. This pursuit was approximately 2.5 miles (from CVS to Airlane Dr) and
lasted 3 minutes. Additional officers arrived on scene and a high risk traffic stop was
conducted.
At about 2247 hours, Officer Arden used his patrol vehicle's announcement speaker and
identified us as Palm Springs Police Officers. Officer Arden gave Martini repeated
commands to show us his hands, and to exit his vehicle with his hands up.
The commands given by Officer Arden were loud, clear, and very well easy to follow.

Martini failed to obey these commands, reaching around in his car with both of his hands
and he crawled to the back seat of his vehicle. Martini displayed he was able to hear these
commands as he responded, "Fuck you!" from the inside of his vehicle. Officer Arden and
K9 Officer Steed also announced that a Police K9 would be used to "bite" him if he did not
exit his vehicle with his hands up.
Martini continued to disobey commands and while at the back seat of his vehicle, Officer
Gross deployed the less lethal 40 mm to break Martini's front driver side window in order to
utilize the K9 Rico. The window partially shattered, but did not provide enough space for K9
Rico to enter (Refer to Officer Gross' report for documentation on the use of the 40mm).
Fearing that Martini would flee the traffic stop a second time, per the request of Sgt. Andre,
Sgt. Raso set up spike strips on E Plaimor and N Sybil Rd.
Officer Arden stopped giving commands at about 2309 hours when Martini started his
vehicle and fled the traffic stop a second time. Martini drove through the spike strips and his
front tires were flat.
Officer Arden and K9 Officer Steed pursued Martini for less than a mile and he yielded in the
parking lot of 400 S Farrell Dr., facing eastbound (Refer to Officer Arden's report for this
portion of the pursuit.)
Martini was given additional commands to show us his hands and to exit his vehicle with his
hands up but he still disobeyed commands. Martini was also re-advised that a Police K9
would be used to apprehend him if he did not comply during these announcements.
Officer Gonzalez and Officer Gilbert responded with the PSPD "Bearcat" armored vehicle
and placed it in front of Martini's vehicle to block him in and prevent him from leaving. At
this point, the glass to Martini's front driver side and front passenger side windows had
completely shattered. A final announcement was given to Martini to exit with his hands up
or the K9 would be deployed. Martini ignored the announcement and K9 Officer Steed
utilized K9 Rico to apprehend Martini (Refer to K9 Officer Steed's supplemental report). K9
Officer Steed observed Martini kick K9 Rico on the back 3 times with his right heel during

Martini later exited the vehicle through the front passenger side door and he was detained in
handcuffs and arrested without further incident (Refer to K9 Officer Steed's report for details
regarding his K9 deployment).
Martini was treated for his injuries (see Officer Steed's report) by Palm Springs Fire
Department (PSFD) and by American Medical Response (AMR). Martini was transported to
Desert Regional Medical Center. Martini had a cat in the vehicle which Officer Enriquez
transported to the Palm Springs Animal Shelter.
Officer Granados took digital photographs of Martini's vehicle and the vehicle was later
stored for CVC 22651(h) (1). A&A Towing took possession of Martini's vehicle.
Officer Miller responded to DRMC and conducted a DUI investigation on Martini. Martini
admitted to Officer Miller that he had used Methamphetamine. Officer Miller's DUI
investigation revealed that Martini was driving while under the influence of Drugs to Officer
Miller's DUI report for further details)
I responded to DRMC to continue my investigation. While in a hospital room Officer Steed
read Martini his Miranda rights from a PSPD Miranda advisement form. Martini did not
initially respond to his rights so Officer Steed read him his rights a second time.
I asked Martini if he had understood his rights and he responded, Yeah, I guess so, Yeah."
During this interview Martini provided the following statement.
Martini admitted to almost "hitting" a vehicle in the Starbucks parking lot. Martini admitted to
knowing that he was stopped by the police. Martini saw my patrol vehicle lights and he had
knowledge that we were police officers. Martini did not stop because he was "scared" and
he is scared of authority figures. Martini admitted to hearing the commands given by officers
and stated he did not exit the car because he has never been in this situation before.
Martini admitted to using "meth" which is a slang / street term for methamphetamine. I

asked Martini if him being under the influence was the reason why he had not stopped and
he said, "Yeah, probably."
Martini admitted to Officer Steed that he kicked K9 Rico in an attempt to get him off while K9
Rico bit him.
I asked Martini if while in the vehicle if he was struck with the 40 mm. Martini appeared to
be confused with my question but he later responded, "No." Refer to audio recording for
further details regarding Martini's statement.
Martini was admitted to DRMC for medical treatment and he was released per PC 849.
Based on my investigation, Martini leading PSPD Officers' in a pursuit, kicking K9 Officer
Rico, his unsatisfactory SFTS performance and failing to obey officer commands, I
determined Martini to be in violation of CVC 2800.2, PC 148(a)(1), PC 600(a), and CVC
23152(f).
I responded to PSPD and authored a PC 836 for Martini's arrest for the above mentioned
violations.

On January 10, 2019, I was working uniformed patrol in marked Palm Springs Police
Department patrol vehicle #06, in the City of Palm Springs, in the County of Riverside. At
approximately 2244 hours, Officer Alcaraz stated via radio he was attempting to stop a possible
DUI driver in the area of 425 S. Sunrise Avenue. I responded to the location to assist Officer
Alcaraz.
OFFICER STATEMENT:
While on route to assist Officer Alcaraz in his traffic stop of the possible DUI driver, Officer
Alcaraz advised via radio that the driver failed to yield and a vehicle pursuit ensued. The
vehicle eventually yielded in the 200 block of Airlane Dr. I arrived on scene to assist with the
high-risk traffic stop.
During this portion of the the high-risk stop, the driver, later identified as Robert Martini by his
California Driver License, was uncooperative and displayed erratic behavior while I observed
him moving around the interior of his vehicle. Martini fled the scene a second time and the
second portion of this pursuit continued. Ultimately, Martini yielded at 400 S. Farrell Dr. Where
a second high-risk traffic stop took place of which I responded to and assisted with. Martini
again ignored commands and was apprehended by K9 Rico with instruction by K9 Officer
Steed. Martini exited the vehicle and was detained in handcuffs by Officer Arden and I.
Martini was transported by ambulance to Desert Regional Medical Center (DRMC) due to his

5) INITIAL OBSERVATIONS OF SUBJECT:
PERSONAL CONTACT (Observations on scene and in the hospital):
During my observations on scene during both high-risk traffic stops, I observed Martini's
behavior was erratic, his movements were abnormal and abrupt, he was rapidly sifting through
his property in all areas of his vehicle. Once he was detained in handcuffs, Martini made the
spontaneous statement that he had ingested "meth." Martini's speech was slurred throughout
this police contact. Based on my training and experience, Martini displayed the physical
objective signs of being under the influence of alcohol and/or drugs.

One Leg Stand: Martini was unable to get out of the hospital to perform this test.

8) CLINICAL SIGNS:
HORIZONTAL GAZE NYSTAGMUS (HGN):
Martini had equal tracking, equal pupil size and no resting Nystagmus, thus I ruled out any
head injuries. Martini does not wear corrective lenses.
Based on a 1998 San Diego field study conducted by the National Highway Traffic Safety
Administration (NHTSA), a person who exhibits 4 out of 6 or more clues (3 per eye) for HGN
has a 88% accuracy of being a .08% BAC or greater.
1. Lack of Smooth Pursuit: Martini was not able to track a stimulus smoothly while placed 12-15
inches in front of his face with both eyes.
2. Distinct and Sustained Nystagmus at Max Deviation (HGN at 45 degrees): Martini displayed
distinct and sustained Nystagmus (involuntary jerking of the eyeballs) prior to maximum
deviation in both eyes.
3. Early Angle of Onset of HGN: Martini displayed Nystagmus in both eyeballs prior to 45
degrees onset was immediate.
Martini exhibited 6 out of 6 clues for HGN.
Additional Indicators:
Martini also moved his head and not only his eyes and had to be instructed again. Martini had a
difficult time following the stimuli.

9) SIGNS OF INGESTION: Dry white substance coating Martini's lips appeared he ingested
methamphetamine orally as he later admitted to.
10) STATEMENTS: Martini admitted to orally ingesting methamphetamine in the morning by
licking the substance off the palm of his hand.
11) DRE'S OPINION: Based upon my training and experience and the result of my DRE
evaluation, it is my opinion Martini is under the influence of Poly-category - CNS Stimulant and
CNS Depressant.
12) TOXICOLOGICAL SAMPLE: I advised him of the Trombetta Advisement and the
Chemical Advisement. Martini stated he was willing to provide a blood sample.
Blood Technician drew two vials of blood from Martini's left arm at 0119
hours, which I witnessed and later booked into evidence.
13) MISCELLANEOUS: None.
Based on the above information, the objective signs I observed of Martini, the clues and
indicators during the HGN test and inability to perform SFSTs, I believe Martini to be in violation
of 23152(f) CVC - DUI Drugs. I advised Officer Alcaraz of my observations and he included this
charge in his original report. I completed DMV 367 Admin Per Se form and provided a copy of
the form to Martini prior to my departure from the hospital, leaving Martini in the custody of K9
Officer Steed.

NARRATIVE
SOURCE:
On January 10, 2020, I was working uniformed patrol, in marked unit #39, in the City of
Palm Springs, in the County of Riverside. At approximately 2244 hours, I heard Officer
Alcaraz initiate a vehicle pursuit while attempting to conduct a traffic stop.
OFFICER STATEMENT:
I responded to the area of N. Sunrise Way and E. Baristo Rd. to assist. As I was parked at
the intersection facing westbound, I had my overhead red and blue lights and sirens
activated, which contained a solid forward facing red light. I observed a white in color
Chevrolet minivan traveling northbound on N. Sunrise Way and a police unit with its
overhead red and blue lights activated following it (Officer Alcaraz). As the van approached
the intersection of N. Sunrise Way and E. Baristo Rd. it turned its headlights off. The vehicle
passed me. I could see Officer Alcaraz was a significant distance behind the vehicle, so I
decided to assume the primary pursuit position. Officer Alcaraz began to call the details of
the pursuit over the radio.
While following the vehicle eastbound on E. Andreas it ran several stop signs and turned his
headlights off again as it crossed over left of center of the roadway multiple times in
violation of C.V.C. 21650- Right of Way. Eventually, the vehicle came to a stop at the
intersection of Airlane Dr. and Plaimor Ave. facing northbound on the southbound lanes.
We conducted a High-risk stop at this point.
Refer to Officer Alcaraz's report for additional details regarding this portion of the pursuit.
While the vehicle was stopped, the driver, who was later identified as Robert Martini, began
reaching to the front passenger floor board of the vehicle. I identified ourselves as police
officers, and gave multiple commands to show us his hands. He did not comply and began
climbing around the inside of the van as he reached down below the seats. Eventually, he
picked up a cat and sat in back seat. At one point as I gave commands with multiple officers
on scene, he held up his cat in the back window of the vehicle for us to see. During the time

NARRATIVE
we were conducting the high-risk stop, I gave at least 20-30 verbal commands over my
patrol unit's loud speaker. He did not comply with the commands and eventually climbed
back into the driver seat, started the vehicle and began to drive away. I gave chase as we
went westbound on Plaimor Ave. There was a patrol unit to the west of us on Plaimor Ave.,
which was positioned facing north and south to block vehicle traffic from entering into the
area we were conducting the high-risk stop. Martini drove his vehicle around the north side
of the unit over a set of spike strips Sergeant Raso had deployed. I continued around the
police unit and continued to follow Martini.
Martini traveled westbound on Plaimor Ave. all while swerving all of the road almost
appearing to not be in control of the vehicle. At this point, I estimated his speed to be
approximately 30 MPH. He then proceeded southbound of Easmor Ci. while driving in the
same manner at approximately 20-30 MPH. I continued to follow as he continued
westbound on Livmor Ave. without stopping at the stop sign in violation of C.V.C. 22450(a)-
Stop sign. Martini proceeded westbound on Livmor Ave. He picked up speed until he got to
the intersection of N. Farrell Dr. He proceeded to go southbound on N. Farrell Dr. again not
stopping at the stop sign (C.V.C. 22450(a)). Martini continued southbound on N. Farrell Dr.
at approximately 40-50 MPH. I heard K-9 Officer Steed communicate over the radio that he
was requesting to take over the primary pursuit position. I yielded to the right hand side of
the road and allowed him to pass me. Almost immediately after K-9 Officer Steed gained
the primary position, Martini pulled into the parking lot of the commercial complex located at
400 S. Farrell Dr. At this point, he came to a stop again and we conducted another High-risk
stop. He failed to comply with multiple commands and was eventually taken into custody
with the use of PSPD Police K-9 Rico (Refer to Officer Steed's report for additional
information). Once out of the vehicle, I applied handcuffs to Martini, made sure they were
double locked, and properly secured.
The total distance of the second portion of the pursuit was approximately 0.9 miles.

NARRATIVE
SUPPLEMENTAL REPORT
On Friday January 10, 2020, I was working uniformed K9 swing shift patrol, driving a
marked PSPD K-9 unit, in the City of Palm Springs, within the County of Riverside. At
approximately 2244 hours, I was patrolling the area of 595 E Palm Canyon (Motel 6), when I
heard Officer Alcaraz conduct a traffic stop on a vehicle bearing California License plate
. Shortly after, Officer Alcaraz advised over the radio that the driver of the vehicle
was not yielding and a pursuit ensued of a possible impaired driver.
I know from my training and experience, that subjects who evade the police either on foot or
in a vehicle are wanted or have just committed a serious crime and will do anything in their
power to elude capture (such as shoot, run or fight with law enforcement). I quickly and
safely made my way towards Officer Alcaraz' location, with a code 3 response, as he
actively pursued the driver. The driver was later identified as Robert Martini. Martini led
officers on a brief pursuit and eventually yielded at the 200 block of Airlane Dr. A high risk
stop began and I arrived on scene a short time later.
While on scene, I learned Officer Crampton recognized the driver as Robert Martini. Martini
decided to barricade himself inside of his vehicle and ignore police commands.
Approximately 15-20 commands were given to Martini via a police amplified loud speaker.
These commands were given approximately 15-20 feet away from Martini's vehicle and
consisted of the following, "This is the Palm Springs Police. You need to exit your vehicle
now with your hands up. You are considered armed and dangerous. If you do not surrender
we will send in a police dog to find you and when he finds you he will bite you." This first
high risk stop lasted approximately 20-30 min and during that duration. Martini moved from
the front and the back of his vehicle several times picking up unknown items and changing
his clothing. From my training and experience, I know subjects who evade the police and
barricade themselves inside of a vehicle will potentially plan to ambush police, with some
sort of weapon, as they approach the vehicle.
Dispatch also advised Martini has contacts for 69PC- Threat or physical harm to police

officers, as well as, convictions for 245(a)(4)PC-Assault with a deadly weapon with force
with possible great bodily injury 2800.2CVC- felony evasion and 422PC- Threaten Crime
with intent to terrorize.
Due to Martini's violent history with the police, the distance between our police vehicles from
Martini's vehicle, the fact that Martini was barricaded and potentially planning an ambush, I
knew that a Taser, O.C, or Baton would be ineffective and the safest tool to apprehend
Martini would be the use of my Police Service Dog "Rico". "Rico" is trained in criminal
apprehension, tracking and handler protection. Officer's on scene formulated a plan to
break the driver's side window of the vehicle so that "Rico" could gain access to Martini
(See Officer Gross' supplemental for further). During the formulation of this plan, Martini
decided to further disobey Police Commands, drive his vehicle again and lead Police on
another pursuit which ultimately concluded in the parking lot of 400 S Farrell Dr.
Martini parked his vehicle in the middle of the parking lot approximately 30 feet east of S
Farrell Dr and faced east. I had my police unit set up directly behind him and again retrieved
my police dog "Rico". Martini continued his unpredictable and frightening behavior by
continuing to rummage through the front and back of his van picking up unknown items and
changing clothes. Martini began putting on extra layers of clothing as if he was preparing to
protect himself from the apprehension of the police dog. Another 15-20 commands were
given to Martini via a police amplified loud speaker. These commands were given
approximately 15-20 feet away from Martini's vehicle and consisted of the following, "This is
the Palm Springs police. You need to exit your vehicle now with your hands up. You are
considered armed and dangerous. If you do not surrender we will send in a police dog to
find you and when he finds you he will bite you." Martini again refused to exit his vehicle and
we decided to block his vehicle with an armored vehicle so that he could not attempt to
evade us again.
At this point, the window to Martini's front driver side was completely cleared of broken
glass and a final announcement was given to Martini to surrender. Officers Crampton,

NARRATIVE
Gross and I fanned out north of the vehicle behind cover so we could observe and deploy
"Rico" from a more advantageous position. Martini refused to comply and at approximately
2318 hours I deployed "Rico". I observed "Rico" jump up through the driver's side window
and enter Martini's vehicle and bite Martini's right forearm. I had a clear and unobstructed
view of "Rico" and Martini through the middle window of the van. Martini was tossing,
turning and struggling with "Rico". I called out to Martini and advised him to bring my police
dog to me and Martini refused by not complying with my orders or responding to my
commands. "Rico" and Martini continued to struggle and "Rico" did not re-bite and
maintained his initial bite. I again called out to Martini and told him, "You need to bring my
police dog to me. I consider you armed and dangerous and I am not going in there to get
my dog." Martini continued to fight with "Rico'' and I observed Martini kick "Rico" on his back
3 times with his right heel during the bite. I called out to Martini one last time for him to bring
"Rico'' out to me and I heard Martini reply, "Okay! Okay! I'm coming out now!" Martini stood
up in his van with "Rico" still on the initial bite and dragged "Rico" out of the van through the
passenger side door.
At approximately 2320 hours,I ordered Martini in a prone position away from his vehicle and
approached him with other officers. I grabbed ahold of "Rico's" collar while other officer's
on scene assisted with Martini. Once other officers had control of Martini and he was no
longer a threat to the Public or Officers, "Rico" was released from the bite. "Rico" was on
the bite for approximately two minutes and paramedics were already staged in the area and
arrived on scene at approximately 30 seconds after Martini was detained. Martini received
only first aid for his injuries by medics and was later transported to Desert Regional Medical
Center for an "okay to book' by AMR for the dog bite.
I responded to DRMC a short time later to continue my investigation. While at DRMC,
Martini was taken into a private room by medical staff to clean the area of the dog bite.
Martini was compliant and was handcuffed to the bed during treatment. Once Martini's
sweater was removed, I noticed that Martini sustained approximately three injuries to his
right forearm. The two puncture marks that were underneath his forearm were

NARRATIVE
approximately a 1 inch in diameter. The other puncture mark that was on the top of his
forearm was approximately three inches in diameter. DRMC personnel cleaned the area
but could not treat it at this time. The medical staff informed me, due to the injury sustained
from the dog bite, Martini was going to possibly require surgery and had to be admitted. I
took digital photographs of his injury and later booked them into the evidence computer at
PSPD.
Due to Martini being admitted to the hospital, Officer Alcaraz and I decided to interview
Martini at the hospital. While in a hospital room, I read Martini his Miranda rights from a
PSPD Miranda advisement form. Martini did not initially respond to his rights so I read him
his rights a second time.
Officer Alcaraz asked Martini if he had understood his rights and he responded, Yeah, I
guess so, Yeah." During this interview Martini provided me with the following statement.
Martini stated he knew the police were outside of his vehicle and requesting him to exit.
Martini stated he does not like authority figures and was scared of the situation. Martini also
stated he heard me tell him that a police dog would be used to bite him of he did not
surrender. I asked Martini how many times the police dog bit him and he said, "A bunch of
times". I ask Martini if he was only bit on the right forearm and he said, "Yes". I then
concluded my interview. Officer Alcaraz recorded this interview on his digital audio recorder
and later booked it into evidence.
I informed the hospital staff that my investigation was concluded with Martini and to contact
PSPD when they are going to release him from the hospital.
I responded back to PSPD, contacted Officer Alcaraz and requested that he add the
additional charges of 148(a)(1)PC and 600(a) PC, due to the fact that Martini disobeyed my
lawful commands for him to surrender and attempted to harm my police K-9 Rico by kicking
him.

NARRATIVE
On Friday, January 10, 2020, I was working as a uniformed swing shift supervisor for the
Palm Springs Police Department, in the City of Palm Springs, County of Riverside. At about
2247 hours I responded to the area of N. Airlane Drive and E. Plaimor Avenue following the
termination of a vehicle pursuit of a white, 2007, Chevrolet van ().
I parked my patrol vehicle and blocked the roadway in front of 2927 E. Plaimor Avenue and
deployed a set of stop strips across the road from the rear of the vehicle and into the
driveway of the residence across the street, 2928 E. Plaimor Avenue. Officers were
attempting to conduct a high risk stop once the vehicle finally yielded in front of 235 N.
Airlane Drive; however the driver of the vehicle was disobedient and after refusing to comply
with officers' orders and exit the vehicle for several minutes, the driver started his vehicle
and accelerated away in an effort to flee from officers yet again.
At about 2309 hours, the Chevrolet van proceeded to drive north on Airline Drive and turned
onto E. Plaimor Avenue, driving over the strategically placed stop strips which immediately
deflated both of the front tires of the vehicle. The vehicle then continued to drive westbound
on Plaimor Avenue, now driving on the front wheels, fleeing from pursuing officers.
I immediately retracted the stop strips, and later packaged and booked them into evidence
at the Palm Springs Police Department.

SUPPLEMENTAL REPORT:
On Monday, January 13, 2020, I was assigned as a Detective in the Property Crimes Unit of
the Palm Springs Police Department, in the City of Palm Springs, within the County of
Riverside. I was assigned primary responsibility of this case for filing purposes.
INVESTIGATION:
I reviewed all reports prepared in this case. I learned that the suspect in this case was
identified by California driver license as Robert Emilio MARTINI. Based on Officer Alcaraz's
investigation, he found MARTINI to be in violation of 2800.2 (a) CVC, 23152 (f) CVC, 600
(a) PC, and 148 (a) (1) PC. MARTINI was released to Desert Regional Medical Center per
849 PC for medical treatment.
On Monday, January 13, 2020, I contacted Desert Regional Medical Center and inquired
about MARTINI'S status. I was advised by his nurse that he was due to be released either
later today (Monday, January 13, 2020) or tomorrow (Tuesday, January 14, 2020). Either
way, I was advised that MARTINI would need to have medical needs attended to after
release. For this reason, I contacted Smith Correctional Facility in Banning and spoke with
the Medical Supervisor who advised me that they will accept MARTINI for the booking
process and then transfer him to Robert Presley Detention Center in Riverside for housing

NARRATIVE
I advised her that I would have to
contact our dispatch center and see if there is anyone available to transport him. I asked
her if we could just wait until morning. told her they would give the bed
away if we did not transport our in custody tonight.
I contacted dispatch and asked them to re-open the call for service. I briefed them on the
process for MARTINI and where they could find the paperwork that was already filled out. I
then contacted the watch commander and advised him of the situation. He said he would
contact my sergeant to verify that the information I provided him was correct.
A short time later I received a call back from the watch commander and I was advised that
they would send an officer out to Desert Regional Medical Center to take MARTINI into
custody.
I called back the number had called me on. I reached another female named
who advised me went home, but she could assist me. I explained to her that an
officer would be en route shortly to take MARTINI into custody. I asked not to say
anything to MARTINI since he did not know we were going to arrest him. said she
would advise the nurse that we were en route.
Officer Colantuono responded to Desert Regional Medical Center and took MARTINI into
custody for the above mentioned charges at approximately 2038 hours. Officer Colantuono
turned MARTINI over to Transport Officer Ortiz who transported MARTINI .
On Thursday, January 16, 2020, Community Service Officer Vasquez relieved Transport
Officer Ortiz at approximately 0445 hours. MARTINI had to be monitored by PSPD until he
was transferred into the DCU unit.

NARRATIVE
At approximately 0940 hours, I contacted Robert Pressley Detention Center (RPDC) and I
spoke with Sergeant Mooney. He advised me that due to the amount of medical transports
they were already working, they did not have the staffing to relieve our officer. Furthermore;
I was advised that most likely, it would be more than 24 hours before MARTINI would be
booked into the facility due to the limited number of beds and the high number of patients
waiting to occupy those beds. Sgt. Mooney advised me he would have Sgt. Vasquez of the
Riverside County Sheriff's Department assigned to the Detention Center Unit at RUHS
contact me when a bed is available so I would know when to start the booking process.
Once MARTINI is accepted into the unit, we would stand by with him until a RPDC Deputy
relieved our officer. We would then have to drive the paperwork to RPDC so the booking
process could be completed. I thanked Sgt. Mooney for his assistance.
CRIMINAL HISTORY:
A search of MARTINI'S criminal history revealed that he had previous convictions for 484
(a) PC, 647 (f) PC, 273.5 (a) PC, 594 (a) PC, 2800.2 (a) CVC, 422 PC, 11377 (a) HS, 245
(a) PC, and prior arrest for 69 PC. MARTINI told Officer Alcaraz that he did not comply
because he had never been in a pursuit before. MARTINI had a previous conviction for
2800.2 (a) CVC. MARTINI also had contacts on two separate occasions for 69 PC. I also
learned that MARTINI was on probation at the time he committed the above mentioned
charges. MARTINI'S probation was for 594 (a) PC (INM1800055) and it began on January
9, 2018 and ends on January 8, 2021. Part of MARTINI'S Summary Probation terms list: 1)
Obey all laws, ordinances, and court orders. MARTINI'S actions were in violation of his
probation; therefore I am adding the charge of 1203.2 (a) PC - Probation Violation.
MARTINI said he does not like authority and he showed this with his actions towards not
only police, but also police K-9 Rico.
I am forwarding this case to the Riverside County District Attorney's Office for consideration
on filing the above mentioned charges against Robert Emilio MARTINI.

On Wednesday January 15, 2020 I was assigned uniformed swing shift patrol, driving a
marked PSPD patrol unit (48-17), in the City of Palm Springs, County of Riverside. At 2019
hours I was dispatched to Desert Regional Medical Center (1150 North Indian Canyon
Drive), which is also located in the City of Palm Springs, County of Riverside for a warrant
service.
OFFICER'S STATEMENT:
I arrived on-scene at 2019 hours and contacted discharged patient Robert MARTINI in room
#14 located on the second floor in the East Tower of the hospital. I was advised MARTINI
had and active 836 P.C. for his arrest which was authored by Officer Alcaraz. Once I
received the discharged orders from the nursing staff, I placed MARTINI in-custody for the
outstanding 836 P.C. without incident . MARTINI was subsequently transported to Riverside
University Health System, in Moreno Valley by Transport Officer Ortiz for booking and
further medical treatment.
