CASE SUMMARY Supplemental Report 2001P-5023 NARRATIVE SUPPLEMENTAL REPORT: On Thursday 01/23/2020 at approximately 1939 hours, I was on uniformed patrol, in a marked PSPD patrol unit #15, for the City of Palm Springs, in the County of Riverside. I was listening to the radio as Officer Colantuono was making at traffic stop and the driver of the vehicle was refusing to stop the vehicle and a pursuit began. Officer Colantuono advised he was northbound on south Sunrise Way, south of my location. I responded to the area and Officer Colantuono advised via radio that the vehicle was traveling against traffic and headed westbound on E. Baristo Rd. and that the driver of the vehicle had exited the vehicle and fled into an open desert to the south. As I arrived at the location of the vehicle stop at approximately 1940 hours, Officer Colantuono advised he was physical with the suspect, and I observed the suspect's vehicle facing east in the center of E. Baristo rd. facing Officer Colantuono's patrol vehicle with a female adult standing in the open driver door of the vehicle with her hands in the air. I immediately detained the female who later identified herself as ("") in handcuffs without incident and escorted her to the north curb and told her to sit down. was compliant and cooperative while I contacted her. Once was detained, Officer Colantuono advised via radio that the suspect was detained. I obtained in summary, the following audio recorded statement from : told me she and her husband later identified as Johnnie Miguel Flores Robles, which will be referred to as in this report, were at Spotlight 29 casino in Indio earlier in the evening and decided to come to the Spa Casino in Palm Springs. said she had approximately 4 beers and had difficulty remembering anything about the drive from Indio to Palm Springs. said she could not recall anything about the time while her husband was being pursued, but said he ADMINISTRATION K. CASE SUMMARY Supplemental Report 2001P-5023 NARRATIVE was driving fast and then he just stopped and got out of the car and had no recollection of there being a police car behind the vehicle. said once her husband exited the vehicle she got into the driver's seat and attempted to turn the car around but noticed there was a police car with its emergency lights activated in front of the vehicle. said she stopped and exited the vehicle with her hands in the air because she thought she was getting pulled over. While speaking to , she told me she has some mental health issues and anxiety that affect her memory and is currently undergoing treatment. was articulate while speaking and apologetic while she was trying to remember what had just happened. After I obtained her statement, Flores Robles was advised the vehicle, a Maroon 2019 Kia Optima 4 door sedan that was registered in her name, was being towed by Mohica towing and Officer Colantuono advised me Flores Robles could be released from the scene. I Later responded to PSPD station to upload the digital audio file into evidence. For further information, please refer to Officer Colantuono's crime report. MISSING-R Recovered Missing-Other Jurisdiction 2001P-5023 SOURCE: Self-Initiated Traffic Stop. M.O/P.O.E: Arrestee Johnnie Miguel FLORES-ROBLES was on active parole of 69 P.C. FLORES-ROBLES drove a vehicle upon a roadway with willful and wanton disregard for the safety of the public and property. FLORES-ROBLES committed 4 moving traffic violations while evading police. FLORES-ROBLES fled the vehicle on foot failing to stop and comply with lawful orders given by a uniformed Officer during the performance of his duties. FLORES-ROBLES was also operating a motor vehicle upon a highway/roadway with a suspended/revoked driver's license. VICTIM'S STATEMENT: State of California. WITNESS' STATEMENT: Officer Jimenez, Officer K. Morneau, Officer K. Merenda, and Officer M. Delaney were on-scene and assisted with the investigation. OFFICER'S STATEMENT: On Thursday January 23, 2020 I was assigned uniformed swing shift patrol, driving a marked PSPD patrol unit (48-17), in the City of Palm Springs within the County of Riverside. At 1938 hours I was conducting routine patrol in the area of Compadre Road and East Ramon Road which is also located in the City of Palm Springs, County of Riverside. While driving westbound on East Ramon Road in the #2 lane of travel I observed a dark colored 4 door sedan (later identified as a Kia Optima Bearing California License Plate ) drive past me (westbound) at high rate of speed in the #1 lane of East Ramon Road in violation of 22350 of the California Vehicle Code (Speed law). Upon seeing this I maneuvered my marked patrol unit into the #1 lane of East Ramon Road and attempted to conduct a lawful traffic stop by activating my overhead red and blue emergency lights. FLORES-ROBLES continued to drive westbound in the in the #1 lane of East Ramon Road at approximately 60+ miles per hour. Determining FLORES-ROBLES was not going to stop I activated my sounding/audible siren which was in good working order. FLORES-ROBLES continued to evade/flee at a high rate of speed. It should be noted that East Ramon Road is a major thorough fare within the City with a high volume of vehicular traffic. FLORES-ROBLES continued westbound in the #1 of East Ramon Road as he approached the controlled intersection of East Ramon Road and South Farrell Drive. The electronic traffic signal was a solid circular red for both east and westbound traffic. FLORES-ROBLES proceeded through the intersection, making no effort to stop or slow down in violation of 21453(a) of the California Vehicle Code. FLORES-ROBLES continued westbound in the #1 lane of East Ramon Road. As I provided radio updates to PSPD Dispatch, I noticed FLORES-ROBLES was quickly approaching the controlled intersection of South Sunrise Way and East Ramon Road. This is a busy intersection within the City with high volume of vehicular and pedestrian traffic. In the area is a shopping center which consist of grocery store, pharmacy, coffee shop, and restaurants. Prior to arriving at the intersection FLORES-ROBLES merged from the #1 lane of East Ramon Road to the right turn pocket for northbound travel on South Sunrise Way. FLORES-ROBLES failed to signal in violation of 22108 of the California Vehicle Code. The electronic signaling device for east and westbound traffic of East Ramon Road at South Sunrise Way was a solid circular red. FLORES-ROBLES proceeded to make his northbound turning movement against the red light, again making no attempt or effort to stop or slow his speed of travel in another violation of 21453(a) of the California Vehicle Code. FLORES-ROBLES traveled northbound in the #1 lane of South Sunrise Way approaching the intersection of South Sunrise Way and Boys and Girls Club, which is controlled by an electronic traffic signal. The light for both north and southbound traffic was a solid circular red. There were two vehicles one in each the #1 and #2 lane of South Sunrise Way legally stopped for the traffic signal. MISSING-R Recovered Missing-Other Jurisdiction 2001P-5023 colliding into these stopped vehicles, entered the left (westbound) turn pocket, and proceeded through the controlled intersection against the red traffic light. This was a violation of 21453(a) of the California Vehicle Code. After traveling through the intersection at a high rate of speed FLORES-ROBLES began traveling northbound in the southbound lanes of traffic in violation of 21651(b) of the California Vehicle Code. During this time of the evening and the location (South Sunrise Way) there was a high volume of vehicle traffic. I observed at least 3 vehicle's traveling southbound make abrupt turns to avoid colliding head-on with FLORES-ROBLES. FLORES-ROBLES continued to drive on the wrong side of the road, at a high rate of speed for approximately 673 feet. FLORES-ROBELES then approached the controlled intersection of East Baristo Road and South Sunrise Way. The electronic traffic signal for both north and southbound traffic was a solid circular red. FLORES-ROBLES proceeded through this intersection, in violation of 21453(a) of the California Vehicle Code. FLORES-ROBLES once again made no effort to slow or stop, showing his willful and wanton disregard for the safety of the public and property. FLORES-ROBLES continued westbound on East Baristo Road. FLORES-ROBLES began slowing the vehicle down and opened the driver's side door. FLORES-ROBLES exited the driver's side vehicle, as it was still traveling westbound, causing him to stumble and roll multiple times along the asphalt. FLORES-ROBLES stopped himself from any further rolling, sprang to his feet, and with his left middle finger, "Flipped," myself and Officer K. Morneau off as he proceeded to run southbound into a dark vacant desert lot posing an Officer Safety risk. At this point in the investigation, I had yet been able to provide PSPD Dispatch with a vehicle's license plate. I had no knowledge or information if this vehicle was stolen or used during the commission of a violent crime. I had no knowledge of the driver or knowledge if he was wanted and or armed. MISSING-R Recovered Missing-Other Jurisdiction 2001P-5023 of the desert lot, and the shopping complex to the south I chased after FLORES-ROBLES, on foot, yelling at him multiple times, "Stop Police." FLORES-ROBLES failed to stop, yelled back at me, "Fuck You!" and continued running southbound further into the desert. This caused me great concern due to my limited visibility, and the fact the FLORES-ROBLES had yet to be searched. As the foot chase continued I was able to catch up with FLORES-ROBLES in the southwest corner of the desert lot. I yelled to FLORES-ROBLES, "Show me your hands!" which he refused. I then wrapped my arms around FLORES-ROBELS' upper torso near his rib area. Due to my forward moving momentum and the area in which I grabbed him, both FLORES-ROBLES and I fell to the desert ground. FLORES-ROBLES fell onto his left side as I maintained his right side and partial upper back control. Once on the ground FLORES-ROBLES continued to move around. I yelled to FLORES-ROBLES to stop resisting but FLORES-ROBLES refused and continued to move his arms around. This caused me to believe FLORES-ROBLES was attempting to retrieve a weapon to use against me or free himself from my grasp in an attempt to further complete his escape. With this fear in my mind and the fact the FLORES-ROBLES still had not been searched and the location in which the struggle ensued was extremely dark, I began thinking about the force options to employ to safely and effectively place FLORES-ROBLES in-custody. I thought about the use of my Oleoresin Capsicum (O.C.) spray but due to the close proximity in which FLORES-ROBLES and I were in the O.C. spray would have only caused further complications while trying to affect the arrest. I thought about the use of my baton, but this would cause me to have to lose my already maintained control of FLORES-ROBLES. I thought about the use of my Taser, but again I would have had to released control of FLORES-ROBLES, get to about 10-15 feet away to have the Taser be properly effective. After going through a multitude of less than lethal force options, based upon my body control, and my past training in Brazilian jiu jitsu, and FLORES-ROBLES' physical and violent behavior I determined the safest and most effective way to affect the arrest was to ADMINISTRATION BY OFFICER DATE/TIME APPROVED BY DATE APPROVED CASE STATUSASSIGNED TOUNIT/SHIFTOFFICER L. MISSING-R Recovered Missing-Other Jurisdiction 2001P-5023 place FLORES-ROBLES into our department approved carotid control hold which I have been successfully trained, tested on, and implemented in the field. I began to maneuver my body, by using my legs to gain full control of FLORE-ROBLES' back. Once I had back control I slide my right arm up towards FLORES-ROBLES' neck. I placed my right bicep on FLORES-ROBLES' right carotid artery. I bent my arm at the elbow to allow FLORES-ROBLES' chin to sit properly within the crease. Once in this position I pulled my arm into my body so that my right forearm applied pressure to FLORES-ROBLES left carotid artery. Once I felt this was properly applied I grabbed a hold of my left bicep with my right hand, palm down, and crossed my left arm behind FLORES-ROBLES head. I then began applying equal pressure in attempts to stop the oxygenated blood to the brain. As the proper application was applied I could feel FLORES-ROBLES' once firm, rigid, tense body begin to loosing up. I noticed and felt FLORES-ROBLES' left arm which was attempt to pull my right arm away fall to his chest. At this time I knew the carotid control hold was successful and FLORES-ROBLES was rendered unconscious which took about 15 seconds. Once unconscious the carotid was released and FLORES-ROBLES was placed into handcuffs. FLORES-ROBLES regained consciousness in about 3 to 5 seconds and was talking, saying, "Okay I give up you got me." At this time Medical Aid and supervisor notification were made pursuant to department policy. FLORES-ROBLES was placed into custody pursuant to 2800.2(b) of the California Vehicle Code along with 148(a)(1) of the California Penal Code. Officer J. Jimenez arrived at my location at this time and took custody of FLORES-ROBLES. FLORES-ROBLES was assisted to his feet and he was able to walk on his own power to Officer J. Jimenez's marked patrol unit. FLORES-ROBLES was treated on-scene by AMR and PSFD. FLORES-ROBLES was transported to Desert Regional Medical Center by AMR for further medical evaluation. Officer T. Gilbert and Officer K. Wilson followed and stood by with FLORES-ROBLES awaiting medical clearance. During this time Officer K. Merenda was with the vehicle and additional occupant later identified as . Officer K. MISSING-R Recovered Missing-Other Jurisdiction 2001P-5023 which returned to . Officer K. Merenda obtained a recorded statement from about the incident. (See Officer Merenda's supplemental report for further). Officer's on-scene searched the area in which FLORES-ROBLES traveled both on foot and in the vehicle in an effort to locate any evidence which may have been discarded during his attempt to escape which yielded negative results. A search of the vehicle was completed at which time FLORES-ROBLES California Identification Card was located on the driver's seat. A records check revealed FLORES-ROBLES had suspended/revoked driver's license for a prior DUI. A further check revealed FLORES-ROBLES was on active CDC Parole for 69 P.C. FLORES-ROBLES was also listed as an at risk missing out of Indio Police Department (Case #1909I-4526). Officer J. Jimenez took digital photographs of the exterior and interior of the vehicle which were later uploaded into the evidence computer at PSPD. Officer M. Delaney completed a CHP 180 and towed the vehicle pursuant to 22651(h) of the California Vehicle Code. The vehicle was towed to Mohica Tow yard. FLORES-ROBLES was additional charged with of 14601.2(a) of the California Vehicle Code as well as a parole hold pursuant to 3056 of the California Penal Code. I responded to PSPD where I completed a probable cause declaration for the listed charges. Upon being medically cleared FLORES-ROBLES was transported back to PSPD. With my audio/digital recorder I contacted FLORES-ROBLES in holding cell "A," and read him his Miranda Rights, via my statement of rights card, which I keep in my front right breast pocket verbatim. FLORES-ROBLES understood his rights by saying, "Yes Sir." FLORES-ROBLES did not wish to speak about the incident. The interview was stopped and no further questions were asked. I took digital photographs of FLORES-ROBELS. As I was taking these photographs I noticed FLORES-ROBLES had sustained small abrasion to the right side of his forehead and cheek which would have been consistent with him rolling out of the moving vehicle. These photographs were uploaded into the evidence computer at PSPD. FLORES-ROBLES was subsequently transported to Smith Correctional Facility by Transport Officer Ortiz without further incident. A CHP 187 Form was completed and attached. I reviewed FLORES-ROBLES criminal history and learned he had multiple contacts and arrest for DUI, speeding over 100 MPH, Robbery, Stolen Vehicle, Resist/Delay Police Officer, and Parole Violations.
