I retained the above listed items and later booked into evidence at the Cabazon 27 Sheriff's Station with the assistance of Inv. R. Paz. 28 29 VEHICLES FOUND WITHIN PRIMARY SCENE 30 V-1 31 32 33 34 35 36 37 38 V-2 2017, marked black and white Ford Explorer, PSPD patrol unit #42, CA. license plate #1541898. V- 39 2 was parked facing west on the asphalt roadway edge of E. Camino Parocela, west of S. Palm 40 Canyon Dr, Palm Springs. The vehicle contained police emblems and the words "Palm Springs 41 Police" spanning across the driver and passenger doors. The vehicle had an emergency light bar 42 mounted on the rooftop. The vehicle had a rifle rack in between the front driver and passenger seat. 43 A shotgun was mounted and secured in the rifle rack. V-1 was parked facing north in the southbound number two lane straddling the left turn lane of S. Palm Canyon Dr. north of E. Camino Parocela, Palm Springs. V-3 2018, marked black and white Ford Explorer, PSPD unit #13, CA. license plate #1547006. V-3 was parked facing south in the number two southbound lane of S. Palm Canyon Dr. north of E. Camino Parocela, Palm Springs. The vehicle contained police emblems and the words "Palm Springs Police" spanning across the driver and passenger doors. The vehicle had an emergency light bar mounted on the rooftop. The vehicle had a rifle rack in between the front driver and passenger seat. No weapons were located in the rifle rack. V- 4 was parked facing south in the number one lane of S. Palm Canyon Dr., north of E. Camino Parocela, Palm Springs. V- 19 5 was parked facing south in the southbound number one lane of S. Indian Canyon Dr. north of E. 20 Camino Parocela, Palm Springs. The trunk of the vehicle contained various 24 police equipment. 25 26 27 AREA & SCENE DESCRIPTION: 28 This scene is located within the city of Palm Springs, County of Riverside. This area of Palm Springs is a 29 commercial zone with various businesses on both sides of the roadway. 30 31 S. Palm Canyon Dr. is a one-way only roadway traveling southbound, intersecting with E. Camino Parocela 32 and continuing southbound. S. Indian Canyon Dr. is also a one-way only roadway traveling northbound. S. 33 Indian Canyon Dr. begins at E. Camino Parocela. S. Palm Canyon Dr. and S. Indian Canyon Dr. meet at E. 34 Camino Parocela, however, only S. Palm Canyon Dr. continues south past E. Camino Parocela. 35 36 S. Palm Canyon Dr. north of E. Camino Parocela contains one left turn lane, which directs traffic to 37 northbound S. Indian Canyon Dr. avoiding entry into E. Camino Parocela. Heavy construction was occurring 38 at the left turn lane of S. Palm Canyon Dr. leading to S. Indian Canyon Dr. The left turn lane was blocked off 39 with orange construction cones. It appeared new curbing had been erected and large sections of asphalt had 40 been removed exposing soft dirt. Various constructions direction signs were also present. 41 42 Bank of America bank is located at 588 S. Palm Canyon Dr. This business is located between S. Palm Canyon 43 Dr. and S. Indian Canyon Dr., north of E. Camino Parocela. Due to the construction, the pre-existing sidewalk 44 south of the Bank of America was removed exposing soft dirt. David Sandoval #3655 Case #11192200009 PAGE 5 1 2 There were no visible streetlights along S. Palm Canyon Dr. or S. Indian Canyon Dr. The intersection contains 3 multiple lights located on the same post as the traffic signals. On the date of this investigation, August 8, 2019, 4 the weather was hot and I began processing the scene at 1930 hours into the night. 5 6 I have attached a copy of the 2018 Google Earth aerial/satellite photograph of the scene for orientation 7 purposes only. This photograph does not depict or intended to depict the aerial/satellite view of the location 8 on the date of the incident and/or investigation. (Refer to attached aerial/satellite photograph for further 9 details) 10 11 DETAILS: 12 This report pertains to the officer-involved-shooting of Kevyn Matthew Weintraub, which occurred on 13 Thursday, August 8, 2019, at 588 S. Palm Canyon Dr., in the City of Palm Springs. The purpose of this report 14 is to document the processing of the scene and evidence collection. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 At approximately 1930 hours, Forensic Technician Ginesi began taking overall digital photographs of the 31 area, scene and the exterior/interior of the five Palm Springs Police units (V -1-V-5). . During the examination 32 and processing of the scene, I pointed out the above listed items of evidence (DS001-DS010) that I wanted 33 documented, photographed and collected. Forensic Technician Ginesi set numerical placards for evidence. 34 35 36 37 38 39 40 41 42 43 On Thursday, August 8, 2019, at approxiniately 1800 hours, I was contacted by Central Homicide Unit (CHU) Sgt. Thurm and requested I respond to 588 S. Palm Canyon Dr. in the city of Palm Springs reference an officer involved shooting. I arrived at approximately 1900 hours, and met with remaining members of the Central Homicide Unit and personnel from the Palm Springs Police Department. I obtained the known facts during the briefing and was tasked with processing the crime scene. Inv. Dickey will cover the details of the briefing in the primary report. Sergeant Thurm assigned Investigator Dickey as primary, Investigator Trudeau as second, and Investigator Paz and I were assigned to process the scene. Riverside County Forensic Technician Ginesi arrived and was assigned to assist in processing and collection of evidence. The processing of the crime scene consisted of overall photographs of the scene in its initial state and the placing of numeric placards next to the items of evidence that were going to be collected. It should be noted a walk thru of the scene was not conducted, as the evidence items were readily identifiable from the roadway next to V-1. The collection of evidence began at 0140 hours. All of the above-mentioned evidence was located within a small soft dirt area where asphalt had been removed due to construction. A black single latex glove was located on the dirt (DS001) south of the newly erected curbing. Southwest of DS001 I located two black latex gloves (DS002) in the dirt. Southeast of DS002 I located an empty Taser cartridge (DS003) on top of a dark colored backpack (DS004). The contents of the backpack were removed, laid out and photographed. Two notepads (DS004A) were separated and booked separately from the backpack due to the content of the writing. Southwest of DS004 I located a black Adidas T-Shirt (DS005) in the dirt. An inspection of the T-Shirt revealed a Taser probe was attached to the T-Shirt. The Taser probe was phOtographed and collected (DS005A). David Sandoval #3655 Case #R192200009 PAGE 6 I West of DS005 I located a single left sandal (DS006) in the dirt. West of DS006 I located two black latex 2 gloves in the dirt (DS007). Southwest of DS007, I located a single right sandal (DS008) in the dirt. South of 3 DS008 I located a clear tubing earpiece (DS009), slightly visible as it was partially covered with soft dirt. This 4 type of earpiece is commonly used by law enforcement personnel and is attached to the hand held radio. The 5 earpiece provides audible information directly into the ear without the public intercepting information being 6 broadcasted. West of DS009 I located a camouflage baseball hat (DS010) with the words "Salty crew" affixed 7 to the front. 8 9 Forensic Technician L. Land arrived during the processing of the scene and assisted Forensic Technician 10 Ginesi. Utilizing a metal detector, Forensic Technician Land searched for a casing; however, a casing was not 11 located. The processing and collection of evidence at the scene was completed at 0223 hours. Forensic 12 Technician Ginesi gave me the collected, packaged and sealed evidence items. Forensic Technician Ginesi 13 will provide a supplemental report with details regarding the collection of evidence items. 14 15 In addition to having Forensic Technician Ginesi document and digitally photograph the scene, I also 16 requested aerial photography utilizing the Riverside County Sheriff's Department drone. Inv. J. Hammond 17 arrived on scene. Utilizing a drone, Inv. Hammond took aerial digital photographs of the scene. (Refer to 18 supplemental report for further details). 19 20 Palm Springs Police personnel removed the perimeter crime scene tape providing public access on S. Palm 21 Canyon Dr. and S. Indian Canyon Dr. I departed the scene on Friday, August 9, 2019 at approximately 0300 22 hours, and drove to the Palm Desert Sheriff's Station to book the evidence. Inv.
