SUPPLEMENTAL
OFFICER STATEMENT:
On Thursday, August 08, 2019, I was assigned to the Detective Bureau in the City of Palm Springs,
County of Riverside, in the State of California. At approximately 1620 hours, I was in a room used for
interviewing with an arrestee. At the time I had my police handheld radio turned down in order to better
communicate with the subject. As I was walking the subject back to his holding cell from the interview
room, I could hear the sound of a multitude of sirens coming from the parking lot of the police
department parking lot. I asked Officer Ramos, who was still in the jail area, what had happened. Officer
Ramos informed me there by( just been a report of "Shots Fired" at 588 5 Palm Canyon Drive.
I then ran out of the south doors of the department to my unit and drove lights and sirens to the scene
of the incident. While driving to the scene, I heard over the radio that Officer Burton had been injured
and was going to require medical attention. Upon my arrival at approximately 1630 hours, my
immediate attention was drawn to Officer Burton, to make sure he was ok. After verifying Officer Burton
had not suffered any life threatening wounds, I proceeded to take several digital photographs of his
injuries. Officer Burton appeared to have injured his nose, as it appeared swollen and was bleeding from
both nostrils. Additionally, Officer Burton had several open wounds to his right and left hands which
were also actively bleeding. I then left Officer Burton in the care of American Medical Response (AMR).
As I was talking to Officer Burton during my initial arrival a male witness approached me from the Hair of
the Dog bar, located at 555 5 Palm Canyon Drive and informed me he witnessed the entire incident. I
then found the male in the bar and identified him as The following is a summary of
statement to me:
was standing at the bar countertop, which faces south, when he saw one police unit, driven by a
male officer, park at the entrance to the complex parking lot at Camino Parocela and S Palm Canyon
Drive. Another police unit, driven by a female officer, appeared at approximately the same time and
parked across the street on the southeast corner of the intersection in front of Motel 6 (660 S Palm
Canyon Drive). The male officer approached a white male adult, in his mid-twenties, wearing a grey in
color shirt, dark backpack, and a baseball style hat, standing on the northwest corner of Camino Parocela
and 5 Palm Canyon Drive.

As the male officer approached the subject, the subject quickly began to walk across S Palm Canyon
Drive on the north side of Camino Parocela. The male officer told the subject to "Stop" and the subject
continued to walk away from the officer. At this time the male officer grabbed the subject's backpack
and the subject responded by trying to shrug the male officer off and run away. Since the male officer
and subject continually moved from west to east across the intersection, lost visual of the two.
then repositioned himself to a southeast facing window of the bar to have a better view of the incident.
By the time had repositioned himself, he saw the male officer and the subject in a small dirt area at
the connecting point of S Palm Canyon Drive and S Indian Canyon Drive. described the male officer
as being on top of the subject in a "Mount" type position.
The female officer then ran over to the confrontation and attempted to control the subject's legs by
wrapping them with her arms. As the male officer was in the mount position, the subject was repeatedly
punching up at the officer. estimated the male officer was punched at least two times in the face
with closed fist punches. then saw what he thought was the female deploying her Taser, but said it
appeared to be ineffective because the subject was continuing to fight both officers. said the female
officer then took her firearm and shot what he described as a "Warning shot" in the dirt. told me
this seemed to have gotten the attention of the subject because he then allowed the two officers to hold
him down until additional arriving officers detained the subject.
told me he never saw either officer overstep their boundaries with the subject and didn't see either
officer strike the subject. told me he has trained for mixed martial arts (MMA) so he is familiar with
fighting and in his opinion the subject was trying to fight the officers to escape. further explained by
saying the subject had no intention of giving up. was worried for the safety of the officers after
seeing the female officer physically struggle to control the subject's legs due to the violence displayed by
the subject.
had no further information and said he would be more than willing to testify if need be.
