DESCRIPTION VALUE n7TAILS: .1 August 8, 2019, I was assigned to uniformed patrol in marked PSPD unit 17. At approximately 16:20 hours, I responded with lights and sirens to Bank of America at 588 S. Palm Canyon in the City of Palm Springs, within the County of Riverside regarding an Officer involved shooting. I arrived and saw Officers in the dirt area south of the Bank rendering medical aid to a subject later identified as Kevyn Weintraub. I immediately began putting up Police caution tape. I then began checking the surrounding area for potential witnesses. While I was on the northeast corner of Indian and Camino Parocella I was contacted by a subject identified as who said he witnessed the incident. I walked over to my patrol car and took a recorded statement from him. said he was sitting on the brick wall on Indian Canyon on the east side of the bank when he heard yelling said he looked over towards the Cigar shop (Cigar Imports 530 S. Indian Canyon) and saw everyone running out. said 4 or 5 guys from the Cigar shop were getting ready to fight Weintraub (I confirmed with that Weintraub was the subject he was referring to by pointing him out just prior to him being transported). knew they were trying to fight because they were arguing, running after Weintraub and calling him names. Weintraub was also heard calling the other subjects names. saw the subjects from the Cigar shop run Weintraub away from the area but as soon as they retreated back to the shop, Weintraub would go back to the shop to "mess" with them again about 3 or 4 times. Weintruab then walked away to where was seated and was telling "those guys are nothing but pussies, it took all those guys to fight one guy." Weintraub then walked away and that's when saw Police arrive in the area. said Weintruab had a knife 4-- his hand that was approximately 10 inches in length and appeared to be a fixed blade. saw Weintraub pull !knife out a couple of times during the incident and saw the subject from the Cigar shop run away. did not see what occurred when Police made contact with Weintraub. It should be noted that although was referring to subjects at the Cigar shop. Cigar Imports was closed for business at the time of this incident. Gentleman's Barber shop at 520 S. Indian was open at the time of this incident and upon further investigation it was determined that the initial incident took place at this location. I responded to Gentleman's Barber shop for potential witness statements. I spoke to a customer who was identified as who said he was the one that called 911. advised that he arrived at Gentleman's Barber shop for a haircut and parked his vehicle on the west side of S. Indian Canyon. As was walking east across the street he saw all the guys in the Barber shop coming out with Weintraub' yelling back and forth. said the guys from the Barber shop would walk back in and Weintraub would come back after them again. said next thing he knew, he saw Weintraub with a knife in his hand ( demonstrated to me that the knife was held in Weintraub's hand, blade down as if to use the knife in a downward stabbing motion) chasing the other guys back into the Barber shop. advised that the overall size of the knife was approximately 6 inches and it appeared to be a fold out knife. said he called 911 to report the incident. saw Weintraub walk away towards Bank of America and saw him talking to saw Officer arrive in the area. saw Weintraub run away west from the Officers, then east. then saw one of the Officers tackle him in the dirt south of Bank of America. said next thing he knew, Officers were everywhere for 0 ,1 unknown reason to him. Weintraub was in the middle of the street during the incident causing passing motorists to have to drive around him. described Weintraub as a white male in his 20's wearing camouflage shorts, black tank top shirt, flip flop sandals, and a black backpack.
