,n Thursday 8/8/19 at approximately 1627 hours, I was working uniformed Swing shift patrol in the City of Palm
Springs, County of Riverside. I responded to the area of 588 S. Palm Canyon (Bank of America) to assist with an
Officer Involved Shooting.
OFFICER STATEMENT:
Upon arrival to the scene, I contacted a White male adult in the parking lot of 611 S. Palm Canyon. The male
subject identified himself with a driver's license as (Hereafter refer to as
stated that he witnessed some of the incident and he wanted to provide me with his statement.
statement was audio recorded using my department issued audio recorder. The following is a summary of
his statement: stated that he and his family are visiting the Coachella Valley and they are staying in the City
of Indian Wells. and his family visited the Tram today and they were on their way back to Indian Wells when
he witnessed the incident.
stated he was driving a Toyota 4runner (CA- ) southbound on S. Palm Canyon approaching E.
Camino Parocela in the, "Middle lane." stated his wife was in the front passenger seat and his two young
children were in the back seat. stated that as he drove towards the intersection, his wife (later identified as
) alerted him that the Police, "had someone on the ground." stated he saw a subject
lying on his back on the ground in the dirt area south east of his location. stated that the subject was lying
with his head to the east and his feet to the west. stated that a male Police Officer was on the subject's left or
south of the subject and a female Police Officer was towards the subject's head or north east of the subject.
-Isked if he was able to describe the Police Officers. stated that he was not able to describe the male
_ Alice Officer, but he remembered the female Police Officer being of, "Bigger build" and Hispanic. stated
that he saw both Officers struggling with the subject. said he saw the male subject trying to get up from the
ground and the Officers were trying to hold him down. stated that he couldn't see much of the subject's
hands, but he could see the subject kicking his legs. stated that both of the Officers were on their knees and
the female Officer was trying to use her hands and body weight to hold the subject down. stated that he saw
the female Officer pull out, "Some kind of gun." clarified that he did not actually see the female Police
Officer pull out a handgun, but he did see the female Officer with a handgun in her right hand.
stated that he was driving slowly towards the intersection and he debated about getting out of his vehicle to
assist as it looked like the "Female was not wanting to get too close to the confrontation." stated that was
when he, "Heard the gun." stated that the gun looked like it was, "Pointing down and to the right."
stated that from the time he saw the female Officer with the gun to the time he heard the shot being fired was
approximately 5 tol 0 seconds. also stated that he was parallel to the Officers when he heard the shot, but he
did not see any of the Officers actually shoot their guns. stated that he continued to drive his vehicle
southbound on S. Palm Canyon and then made a left turn onto E. Camino Parocela where he entered the driveway
to Motel 6 (660 S. Palm Canyon). stated he stood by the location and continued to look in the direction of
the Officers and the subject. stated that he saw both Officers attempting to get restraints on the subject and
he saw additional Officers begin to arrive at the location. stated that he did not know if the subject was shot
or not, but stated there was definitely a "Struggle" even after the shot was fired. stated he drove his vehicle to
the parking lot of 611 S. Palm Canyon where he stood by to speak to a Police Officer. was not able to
provide me a description of the subject on the ground, but he stated that the subject was wearing shorts. did
have any additional information regarding this incident and that concluded my interview with him.

( I contacted wife at the same location. and were interviewed separately. My
interview with was also audio recorded with my department issued audio recorder. The following is
a summary of her statement: stated that she and her husband were traveling southbound on S.
Palm Canyon approaching E. Camino Parocela. stated that she could see two Police Officers trying
to, "Subdue" a person on the ground. stated the Officers and subject were in the middle of the road
in the dirt area. She stated that the reason why she thought the Officers were trying to subdue the person on
the ground was because the person on the ground was "Flailing around." I asked what she meant by
"Flailing" and she stated the person was moving their arms and legs, "Erratically." was not sure if
the person on the ground was male or female, but she thought the person was wearing tan clothing.
stated that she saw a female Officer was kneeling next to the subject on the ground. stated
that she remembers seeing a, "Stun gun." then stated that she did not see any of the Officers holding
a stun gun or deploying a stun gun, but she remembers seeing the wires from a stun gun and that was the
first thing that caught her attention. She stated that she remembered seeing a male Officer trying to hold the
subject down with his body and knee. stated that she saw the female Officer, "Pull her gun" and the
gun was not aimed at anybody, but more pointed in the direction of the subject's legs. stated that as
they continued to drive south on S. Palm Canyon, they drove past a Police vehicle and that was about the
same time she heard one shot being fired. did not see any of the Officers shoot their weapons, she
only heard it. stated that she and her husband turned left on E. Camino Parocela and pulled
into the Motel 6 (660 S. Palm Canyon). Shortly after that, they drove across the intersection to 611 S. Palm
Canyon where they parked and waited for the Police to contact them. did not have any additional
) information regarding this incident and that concluded my interview with her at that time.
