1 DETAILS:
2 On 8/10/19, at 1527 hours, I spoke with over the telephone. is Kevyn
3 Weintraub's father. I told that his son had been involved in an altercation in Palm Springs requiring
4 his hospitalization. agreed to provide me with the following voluntary statement. and his son
5 have been very close to each other while was raising him. Kevyn grew up as a water polo athlete and
6 carried this athletic ability into adulthood. Kevyn lives in but came to California on
7 7/31/19 while en-route to a water polo event being held in another country. Kevyn told that the event
8 was cancelled and asked to stay with for a vacation that was expected to last a couple weeks. was
9 aware that Kevyn was having problems at home in
10 but did not elaborate.
11
12 agreed to let Kevyn stay and although things started out going well, they quickly turned for the worse
13 after Kevyn picked up marijuana from a legal marijuana dispensary. After picking up the marijuana,
14 Kevyn started smoking it non-stop throughout the day and night causing Kevyn to deprive himself of sleep.
15
16 Over the days leading up to 8/8/19, Kevyn became increasingly agitated, rude, and displayed very
17 aggressive behavior towards and friends who Kevyn started calling "faggots". had to ask
18 Kevyn to leave his residence in the days before 8/8/19 after Kevyn purposefully missed his flight home.
19
20 I shared with that Kevyn had been shot by the police after he violently assaulted a police officer. I
21 asked if that sounded like something Kevyn would be capable of and said Kevyn was absolutely
22 capable of doing what he is accused of.
23 r
24 Around this time, Kevyn attacked biting him in
25 the neck and punching him in the face which almost knocked out. required admission to an
26 emergency room and had to get stitches. After this incident, Kevyn started taking medication and went on
27 to have a career in the Air Force. As far as knew, Kevyn hadn't had any other
28
29
30 described his relationship with Kevyn as loving and they were "best-friends" and "teammates".
31 However; Kevyn's aggressive behavior recently was putting a strain on their relationship. Since Kevyn
32 left residence, Kevyn had been sending multiple hateful text-messages to

4 Hello?
5
6 INVESTIGATOR DICKEY: Hi, is this
7
8 Yes.
9
10 INVESTIGATOR DICKEY: it's Investigator it's Investigator Dickey with the
11 Riverside County Sheriffs Department.
12
13 Yes, sir.
14
15 INVESTIGATOR DICKEY: Hmmmm, do you have a minute to talk right now?
16
17 You know, I -- I -- I do. I'm sure it's important coming from
18 you, so of -- of course.
19
20 INVESTIGATOR DICKEY: Hmmmm, well, it is, and I don't want you to panic, but we are
21 calling about Kevyn, and Kevyn is fine for the most part. He's alive, but he's actually at Desert -- at
22 a hospital here in the desert area of Riverside County.
23
24 Sure.
25
26 INVESTIGATOR DICKEY: Hmmmm, and the reason why I'm calling is because there was
27 an incident two days ago. Do you know anything about this?
28
29 I sure don't. I -- I know he was visiting me, and we had -- he
30 had some problems, and I actually asked him to leave my home, and I thought he had flown home
31 on -- on Tuesday. I haven't heard a thing since -- since then about him.
32
33 INVESTIGATOR DICKEY: Well, I will tell you -- I'll tell you all about it, but I -- I want to
34 get -- well, first see if I could ask you a few questions, and then I'll -- I'll -- I'll tell you as much as I
35 can.
36
37 Phil, I'm going to make sure I have the right person. What's your birthday?
38
39 I appreciate it. Mine is July 11th, 1946.
40
41 INVESTIGATOR DICKEY: All right. I'm not going to ask you for a social
42 security number, because of those scam phone calls, but can I get your address?
43

1 I'm going to have to -- you -- you are with the sheriffs
2 department; correct? Is that -- you -- you -- who you are official.
3
4 INVESTIGATOR DICKEY: Yeah. Yeah, I am. I -- Kevyn actually gave me your phone
5 number, and he gave me the phone number to , but she's not answering the
6 phone --
7
8 Yeah.
9
10 INVESTIGATOR DICKEY: -- right now, so, hmmmm, ahhh --
11
12 That's about right.
13
14 INVESTIGATOR DICKEY: He asked me to call her first and then call you.
15
16 Oh, I -- I -- I appreciate whatever I can do to help, because
17 he's been contacting his family this week, but nobody really knew quite where he was, so this is
18 very enlightening, so I appreciate it.
19
20 INVESTIGATOR DICKEY: No problem. Do you want to skip the address part?
21
22 Okay.
23
24 INVESTIGATOR DICKEY: Or do -- or do -- should I come hack to that?
25
26 No. I mean, if -- if it's something that is helpful for you, of
27 course. I -- I mean, this is an open book. This is --
28
29 INVESTIGATOR DICKEY: Yeah.
30
31 -- important stuff. I'm at
32
33 (tapping)
34
35 INVESTIGATOR DICKEY: Oh, you're close. I could come talk to you in person. For
36 some reason, I thought you were going to be in LA with that phone number.
37
38 (tapping)
39
40 All right. What's --
41
42 Yeah. No. No. I've had it for -- you know, for 25 years.

3 .
4
5 (tapping)
6
7 INVESTIGATOR DICKEY: Okay. And I already have your phone number, so I don't need
8 that. Hmmmm, what I just wanted to ask you is -- and you did mention something I was going to
9 ask you about.
10
11 What's going on with Kevyn right now? You said there was a problem. Do you mind
12 talking to me about that?
13
14 Ahhh, no, not at all, but you -- can you give me an update?
15 You say he's in a facility now -- a little -- little more descriptive?
16
17 INVESTIGATOR DICKEY: I -- I -- I -- if -- if we're having a -- you know, a -- a good
18 conversation, and we're both talking, and, you know, sharing information, absolutely. He said I was
19 authorized to do that, but I'm not going to --
20
21 Well --
22
23 INVESTIGATOR DICKEY: -- go into a big story about what's going on if somebody's just
24 going to tell me I don't want to talk to you. I'd rather you just tell me you don't want to talk to me.
25
26 No.
27
28 INVESTIGATOR DICKEY: And I get off the phone.
29
30 Sure. I wouldn't do that.
31
32 INVESTIGATOR DICKEY: What -- what's going on with --
33
34 Actually --
35
36 INVESTIGATOR DICKEY: Just tell me what's going on with him right now. What's going
37 on in his life? What's happening?
38
39 Well, the -- the cliff notes is we -- you know, we had a terrific
40 relationship. He lived in . He came out to visit me for two weeks. He was going to
41 be in a sports competition this week actually in Kor -- south Korea -- a water Polo competition that
42 he did not go to his -- his team did not enter at the last minute.

1 So he said, "Well, Dad, I'll come see you for two weeks of vacation I took off."
2
3 INVESTIGATOR DICKEY: Okay.
4
5 And -- so he came out here last week.
6
7 (tapping)
8
9 Picked him up at the airport, and as --
10
11 (tapping)
12
13 -- marijuana's legal here, you know, he asked me if I could take him to the dispensary, so I
14 did. You know, he's on vacation, so he's entitled. He's -- he's not a drinker. And I took him -- took
15 him to the -- and -- so he purchased some pot, and proceeded to start, you know, smoking casually,
16 and first couple of days were fine. This was the end of last week. No. It's this week.
17
18 INVESTIGATOR DICKEY: He flew -- he flew on the 5th; right? We found a plane ticket
19 for the 5th; is that correct?
20
21 The 5th was, hmmmm, let me look, Officer. I -- I -- look at
22 my -- the calendar and see. He missed air couple of flights, so that's why I'm a little confused, and
23 I -- I -- I was still -- was already back home. The 5th was the flight I put him on to go home early.
24
25 INVESTIGATOR DICKEY: Oh.
26
27 And he -- he said he missed that.
28
29 INVESTIGATOR DICKEY: Okay. Got you. So when did he -- when did he get here to
30 California -- if you remember?
31
32 He got here on Tuesday, July 30th in the afternoon.
33
34 INVESTIGATOR DICKEY: Oh, okay. All right, sir. I didn't mean to interrupt you. You
35 were telling me about he got marijuana, and the first few days, he was fine. What happened after
36 that?
37
38 Well, he just -- he kept smoking, and he -- he started to get
39 very agitated and -- and irritable.
40
41 INVESTIGATOR DICKEY: Yeah.
42
RIVERSIDE COUNTY- LAW ENFORCEMENT AGENCIES

EVERSIDE SHERIFF'S DEPARTMIENT/CHU-WEST Page 6
1 And it was uncomfortable to be around. He started saying
2 some, you know, unpleasant things, about -- kind of, about everything, and about me -- started to
3 degrade me a little bit.
4
5 We went into Los Angeles. We had a weekend planned this last weekend to go and visit
6 family, and then a couple of friends of mine and play some golf, and --
7
8 (tapping)
9
10 -- he -- he gets in an altercation at the golf course to where my -- my two friends that know
11 him very well, they took -- they left. They picked up.
12
13 And they said, "I'm -- I'm not -- I'm not -- I'm not going to take this."
14
15 And they left the course. Ahhh --
16
17 INVESTIGATOR DICKEY: Are we talking just verbal?
18
19 -- right then.
20
21 INVESTIGATOR DICKEY: Or are we talking pushing? What are we talking?
22
23 Verbal. Verbal, yeah.
24
25 INVESTIGATOR DICKEY: Okay.
26
27 No. No. Yeah, no physicality. Just -- just verbal lashing out,
28 and be -- belittlement, and things like that in -- in anger.
29
30 INVESTIGATOR DICKEY: Yeah.
31
32 So they left. They -- they -- they left, and then I played golf
33 with him. We go back here to the desert.
34
35 (tapping)
36
37 He -- he's still very irritable the whole -- whole -- whole way. Anything would set him off,
38 you know, just were really, really, you know, wired, kind of, tight -- tightly.
39
40 And he stayed over -- Sunday night, he stayed here, and, apparently, he didn't sleep. I mean,
41 I got up at 3:30 in the morning to use the -- use the restroom, and he was in his room. Everything
42 was all taken off. He wasn't on the couch that's in the living room. He was out -- he was out at the
43 pool about 3:30 in the morning smoke -- smoking pot.

2 And I said, "What's up? What's -- what's the matter?"
3
4 He says, "I can't sleep in there. It's too hot."
5
6 I said, "Well, you could have said something to me. I could have turned down the air
7 conditioning so -- anyways, all right, well, listen, I'm going to go back to bed, and you know, I'll try
8 to get some sleep."
9
10 8:00 o'clock in the morning -- this is on this last Monday -- he's -- he's -- he's out in the
11 backyard, and he's smoking.
12
13 (tapping)
14
15 But he's -- he's in tears. He's bawling, and he -- he's in tears, and I felt terrible. I put my
16 hand on his shoulder.
17
18 I said, "What's the matter, son? What's going on?"
19
20 "I don't know, Dad, I'm really upset. I just -- I -- I'm not -- I'm not doing well."
21
22 I said, "All right. Well, whatever I can do to help, you know. You want some -- some
23 water? You want to eat something?"
24
25 "No. No. No. I'll be okay."
26
27 Anyway, it just, sort of, went on into the afternoon where he just got really angry and, you
28 know, aggressive.
29
30 And I said, "You know, honestly," I said, "I can't -- I can't live like this."
31
32 I said, "This isn't -- this isn't acceptable. I'm not going to go on like this and -- and hear this
33 in my own house."
34
35 I said, "I'm -- I'm going to ask you to leave."
36
37 And he said, "Well, do you want me to go?"
38
39 And I said, "Well, do you want to go?"
40
41 "Well, if -- you know, if you want me to."
42

And I said, "I mean, I can't go on like this. This isn't -- this isn't going to work, so we're
2 almost -- we're almost at the end of this."
3
4 I -- I said, "I'll get" --
5
6 He said, "Well, you handle it, then. I'm -- I'm -- I'm not doing anything."
7
8 So I got him a -- a -- a flight Monday night, and then he -- he got (inaudible).
9
10 (tapping)
11
12 INVESTIGATOR DICKEY: You -- you -- you made the --
13
14 (inaudible).
15
16 INVESTIGATOR DICKEY: You're saying that he was telling you if you want me to leave,
17 you need to make my arrangements back home?
18
19 Yes. Exactly.
20
21 INVESTIGATOR DICKEY: Okay.
22
23 Exactly. So he was, sort of, out -- out of -- out of -- out of --
24 out of, you know, sort of, out -- out of the pre -- present.
25
26 During the day, he was in his room. He was in his bathroom, and then his fl ight -- it was
27 getting close to his flight, and I'm -- you know, he -- he had this issue about being rushed, and
28 people rushing on him.
29
30 He said, "You can't rush me."
31
32 And on the golf course, he said, "I'm on vacation. I can take all the time I want."
33
34 I said, "No. This is a public golf course, Kevyn. You -- you -- there's etiquette. You can't
35 take all the time, you know, and you have to keep the pace, or -- or it affects everybody."
36
37 So I wasn't going to tell him, you got to hurry up. You're going to miss your flight. I -- I
38 thought he -- I thought he'd punch me.
39
40 So I said, "I just want to let you know, your flight's in about an hour-and -a-half, you know.
41 You got -- you got to roll -- roll it out here pretty soon."
42

1 He said, "Ahhh, that's all right. Don't worry about it. I got my -- my -- my pick-up

3
4 (tapping)
5
6 All right. Well, long story short -- five minutes -- 55 minutes before flight -- and I'm in
7 Palm Desert, you know, that's 30, 35 minutes from the airport -- he hasn't left yet.
8
9 INVESTIGATOR DICKEY: Okay.
10
11 And then I said, "Kevyn, what's -- what's going on?"
12
13 He said. "My -- my -- my flight is (inaudible)."
14
15 So -- so he goes out to an Uber. Couple minutes, he comes back in.
16
17 "I forgot" --
18
19 "Hey, what's -- what's the matter?"
20
21 "I forgot my sunglasses."
22
23 I said, "All right. Well, you -- you better -- you better look for them, you know, quickly," I
24 said, "because every minute's important now."
25
26 Anyway, he comes in. He can't find them. He leaves. I wish him well, ahhh, you know,
27 send -- send him off told him I loved him, sorry it didn't work out, and I hope to work things out in
28 the future, and then he left, and 20 minutes later, he called me.
29
30 He said, "I need my fl ight -- my locator number."
31
32 And this -- I'm telling you this important, because it's a detail, and I went in and have to
33 make arrangements to the (inaudible).
34
35 He said, "What's that?"
36
37 I says, your -- your locator number."
38
39 "I don't need that. I just -- I just need the time I fly, Dad."
40
41 1 said, "Okay. I'll put it on your bathroom sink."
42

7
8 I said, "Let me get it."
9
10 And then he swear -- he swore at me, "F you, and, oh, forget it."
11
12 Hung -- hangs up on me -- 25 minutes later, he calls, and he -- he text me.
13
14 He says, "I missed my fl ight. It's your fault, and I'm just having to walk around the streets

16
17 INVESTIGATOR DICKEY: What day was this?
18
19 And -- this -- Tuesday, would be -- would be Tuesday night,
20 the 5th.
21
22 INVESTIGATOR DICKEY: Okay.
23
24 So then I thought -- I didn't hear anything from him, and I
25 thought he caught his flight out on Tuesday.
26
27 And then the last communication was -- I went to the movies Tuesday night, and I got out
28 around 10:00 clock, you know. I turn my phone back on. I must have had 35 text -- or I'll call them
29 text messages -- they're on an app called WhatsApp.
30
31 INVESTIGATOR DICKEY: Okay.
32
33 WhatsApp it's the phone's everything app. Maybe, 35
34 really sick, sick texts.
35
36 INVESTIGATOR DICKEY: And --
37
38 And, out here -- it's 1:00 in the morning --

14

16

22
23 He says, you know, "I'm better than you at everything."

26
27 And he says, "Go -- go -- go -- hope you have fun playing golf with your fagot friends."
28
29 (tapping)
30
31 And I thought, you know, this is all at 1:00 -- I figured at 1:00 in the morning for him. I cut
32 it all off, and cut out the contact with -- with my texting, and cell, and e-mail.
33
34 (tapping)
35
36 And then I started hearing from (unintelligible), my ex-wife who -- who lived the

38
39 She's. "So what's going on with Kevyn? I heard from, you know. your sister that he's very

7 "What's going on? Kevyn tried to reach me."
8
9 And she called back.
10
11 She said, "I've tried every which way to reach him, and he's not answering."
12
13 So that was a -- a dead-end.
14
15 (tapping)
16
17 And that's it. In other words, nobody'd heard from him, and I had heard nothing at all.
18 Lastly, I go into the bathroom after he left the -- the house, and there must have been 50 Post-it
19 notes all over the mirror, and pictures of my -- my father and family on walls -- Scotch-taped all
20 over -- again, sick notes.
21
22 "You're" -- you know, "You're -- you're a troubled person," you know.
23
24 "You -- you," ahhh -- "You," ahhh -- "You have problems and it's all -- everything's your

26
27 INVESTIGATOR DICKEY: What day was that?
28
29 -- you should be ashamed of yourself."
30
31 Well, that was Monday night after he left here in the Uber, and I went in there and saw all
32 the Post-its. It must have taken him an hour-and-a-half to -- to write and post all those things out,
33 so -- I took pictures of them, but I -- I couldn't wait to throw them away. They were disgusting, so
34 that's -- that's -- that's what left off, and it was pretty trag -- it was pretty tragic.
35
36 INVESTIGATOR DICKEY: Okay.
37
38 So --
39
40 INVESTIGATOR DICKEY: Okay.
41
42 Actually, one other -- one other -- one other thing -- about 20
43 years ago -- he was 23 -- didn't know what he wanted. He hadn't found himself. He was, kind of, in
RIVERSIDE COUNTY- LAW ENFORCEMENT AGENCIES

1 and out of college. He was delivering pizzas in Beverly Hills and also smoking a lot of pot, and,
2 you know, being stoned, and delivering pizzas to movie stars, and -- and everything.
3
4 And he got -- one night driving around in the middle of the night just lost, and threw his cell
5 phone out the window on the freeway, and finally showed up at my house, and stayed thick in the
6 night.
7
8 And I convinced him -- my -- my niece said, "You need to take him to the emergency, you
9 know. He -- he's -- he's having problems. He's sick."
10
11 I said, "All right."
12
13 Because I didn't know what -- what -- I've never experienced anything like this -- took him
14 over to Cedars Hospital, and we're walking into the emergency room.
15
16 And he said, "Dad-- give me a hug, you know, a hug bye."
17
18 So I hugged him goodbye, and he bites -- he bites my neck like -- like Dracula, and he's
19 (inaudible) like in a headlock, and -- and then he -- and then he throws a right cross at me that
20 almost knocks me out, and -- and it was unbelievable. We had a knock-down-drag-out fight around
21 the parking lot, and, you know, I'm yelling for my life, and the security guard finally came out, and
22 he took off.
23
24 They took me to the ER -- stitches in my face. He's wandering the streets of, you know,
25 Cedars Hospital in Beverly Hills. My niece comes over -- finds him walking around, convinced to
26 give himself in.
27
28 (tapping)

20 I'm going to let you know why we're involved, because it is a serious matter, and I'm going to

22
23 Sure.

34
35 Of course.
36
37 INVESTIGATOR DICKEY: So here's what we know -- some things we don't know, but
38 here's what we do know: On Thursday afternoon around 4:00 in the afternoon, Kevyn was walking

6 INVESTIGATOR DICKEY: -- invoked his right to remain silent -- didn't want to provide a
7 statement -- which is totally fine, and we do not want to convince him otherwise.
8
9 Uh-huh.
10
11 INVESTIGATOR DICKEY: But this is the things that I told him -- he did ask me some

13
14 And I said --

20 Uh-huh.
21
22 INVESTIGATOR DICKEY: Normally, if -- somebody being an adult -- we won't share

24 people that start calling 911 about -- as what they describe as, "A crazed person with a knife."
25
26 Hmmmm, the Palm Springs Police Department gets these 911 calls -- and -- and, just so you

41 physical altercation. I know some details. It wouldn't be prudent for me to go into all of it, but I

9 He's alive. I -- I -- I'll say tine in terms of the -- the -- the medical staff has told us that he is going

11
12 Okay.
13
14 INVESTIGATOR DICKEY: He -- he's conscious, breathing, ahhh ahhh, I will let him

16 for him here in a few minutes with you.
17
18 Okay.
19
20 INVESTIGATOR DICKEY: But that is -- in a nutshell -- exactly where we're at.
21 Hmmmm, he's been here since Thursday. He has been unable to commune -- in and out of
22 consciousness -- if you will, medication, and this is the first time that I've had a chance to come see
23 him since he had surgery earlier, and he was in a -- a position to actually be coherent and talk to me
24 today.
25
26 Okay.
27
28 INVESTIGATOR DICKEY: And this is the first time that I have gotten information about
29 who we could call for him.
30
31 Ahhh, so that's where we're at, and why I'm involved is because I'm going the investigation
32 that's two-fold -- Number 1, to present to the District Attorney's office the facts and evidence of
33 whether or not the Palm Springs police officer that shot Kevyn was justified under law by doing
34 that.
35
36 Uh-huh.
37
38 INVESTIGATOR DICKEY: This will be a -- a months-long investigation, if not longer,
39 which will conclude with me presenting all of the evidence, and witness statements, and video tape
40 evidence that exists, and then the District Attorney's office will make a determination of whether the
41 officer's actions were within the law. Or --

19 INVESTIGATOR DICKEY: So it's, kind of, a two-fold.

22
23 INVESTIGATOR DICKEY: So that's where we're at. He's in custody. He's not free to
24 leave, but he hasn't been booked in jail. Hmmmm, and he will remain in the hospital until his
25 medical care is determined to be to the point where he can be transported, and it won't be a -- you

27
28 Right.
29
30 INVESTIGATOR DICKEY: As soon as that happens, hmmmm, he'll get bailed in --

20 I mean, I was on the golf course this morning, and my friends talked to me about a -- a little

21 being honest with him about why we're here and what we're doing.
22
23 (inaudible).
24
25 INVESTIGATOR DICKEY: My job is to collect facts, okay. And that is why, you know,
26 just this simple phone call is collecting facts, because some people like to distort truths, and -- and
27 it's not fair to your son and it's not fair to the officers if we start distorting --
28
29 Yeah.
30
31 INVESTIGATOR DICKEY: -- the truth.
32
33 Uh-huh.
34
35 INVESTIGATOR DICKEY: And -- so my -- my -- I'm just wondering a couple things here
36 that you had mentioned.
37
38 Uh-huh.
39
40 INVESTIGATOR DICKEY: Hmmmm, it -- does any of this -- are you -- are you surprised
41 by any of this? Is this something -- when I tell you this story -- are you -- do you feel like -- that's
42 not something your son would have done or is this -- does this sound like something that -- in your

1 opinion -- that your son -- at this moment in time, and everything that's been happening this last
2 week was -- ahhh, exactly capable of doing?
3
4 By all means.
5
6 INVESTIGATOR DICKEY: Okay.
7
8 It -- without -- without -- without question, I -- I was fearful
9 that something would set him off -- somebody would -- and -- and it would be trouble, and he
10 needed to get help immediately, but -- but I just -- I was afraid to confront him, and I -- again, and
11 challenge him on -- on that.
12
13 And -- and I even advised him, "Hey, you know, you're smoking too much. This is
14 ridiculous."
15
16 (tapping)
17
18 And he said, "I'm on vacation. I can do whatever I want."
19
20 And I don't know what his problems are back home, and he's -- his wife is -- had some
21 issue -- infidelity issues -- between -- between us, and he's quite angry with her, and she's -- she's
22 been telling him -- she's -- he smokes too much pot when he's, you know, not working -- he has a
23 few days off, and he's kept it -- kept it from her, and -- and -- and, you know, he's not -- he's just
24 become very angry and -- and -- you know, and life hasn't been that difficult, but he's certainly upset
25 about -- something internally is really -- it -- you know, it -- it exploded.
26
27 INVESTIGATOR DICKEY: Okay. And -- and I don't know if you know much about this,
28 but if you did some reading on this. It's -- it is common for people -- men in their 20s, mostly, that
29 go to college -- and when you told me that story -- more or not than not as I do this job and talk to
30 fathers and mothers just like you, and brothers, and sisters, and -- and daughters, sons -- that --
31
32 Uh-huh.
33
34 INVESTIGATOR DICKEY: -- the story involves something like that. There's something
35 that curves in a population of the people where everything is normal, and they mid -- they hit their
36 mid-20s, and they have say psychological breakdown.
37
38 Uh-huh.
39
40 INVESTIGATOR DICKEY: Some of them recover from it. Some of them don't. Some of
41 it is sur -- suppressed for ten years, 15 years, 20 years before it manifests again, but --
42
43 Uh-huh.

2 INVESTIGATOR DICKEY: -- if you don't know anything about this, you're not alone, and
3 I -- and I'm just telling you this because as a father myself, it would kill me to have to go through
4 this, and -- but just know that this -- you know, this -- you're not alone, and this is actually a very --
5
6 Yeah.
7
8 INVESTIGATOR DICKEY: -- a very, very common problem that occurs, that, you know,
9 when things are going great in life, you never really have to worry about it. Why do research on
10 something when it doesn't affect your family?
11
12 Right. Right. Well, I'm finding out this week now from some
13 of my closest friends -- everybody seems to have somebody in their family -- a -- a son -- a son or a
14 daughter -- that has had serious issues. They're on meds and they've had to deal with for a very long
15 time.
16
17 And they're all -- been -- been very supportive of me, and -- and you know, backing me, and
18 help -- and have been very helpful with me in handling it -- even though I -- I feel helpless.
19
20 And, you know, I just know that I've been a -- I'm not going patting myself on the back, but
21 I know I've been a -- a wonderful father, and, you know, we were best friends, roommates,
22 teammates, everything when I got custody of him at 13, and his mother was pretty awful, and he,
23 kind of -- well you know, one big thing -- it's our fault, and I caused all this -- these problems.
24
25 And it's hard for me to hear -- hear that, because my father wasn't very close with me, and I
26 just didn't want that to happen with my own son, so I did everything to the opposite for us to be --
27 be close.
28
29 In fact, friends would compliment me, saying, "You know, if I'm half as close to my son as
30 you are, I -- I'll be happy."
31
32 And that -- that's what's making -- going to make a man feel better than hearing it, so, you
33 know, I'm -- I know I'm a good person, and -- and a good father -- is the most important thing to me.
34
35 And I've been a good husband. Unfortunately, I've had three wives. They've all kicked me
36 out, but I got to say it's nothing that I did. It's -- it's making bad choices after ten years, and they
37 changed their mind, but certainly wasn't nothing that -- that I did badly, but I'm -- I'm having a heck
38 of a -- heck of a year.

6
7 INVESTIGATOR DICKEY: Well, there's a couple things we can do here. It would be
8 easiest -- and I'm only being honest with you -- that you waited until he was received by the jail to
9 have visitation. If -- if you were able to --
10
11 Now?
12
13 INVESTIGATOR DICKEY: If you were able to muster up that for yourself. It's a --
14

16
17 INVESTIGATOR DICKEY: -- very complicated, convoluted process, that I don't even how

2 just had to happen, I would have to go to some pretty high levels in my ocean to get approval for

4
5 And by the time that happened, he might already be booked in jail, but --
6
7 Yeah, you know, we're -- we're not going to have to do that.
8 I -- I certainly can respect that and wait until he's a different pla -- place and not in the hospital with

15
16 INVESTIGATOR DICKEY: Okay. And I don't know how this is going to go on, because,
17 apparently, he had surgery. They just wanted to check and irritate -- is my understanding -- and --
18 and just make sure everything was fine. They did, and then something happened where -- when he
19 woke up, he found out that they didn't want to push further and pull out any fragments, and he
20 wasn't happy with that.
21
22 Uh-huh.
23
24 INVESTIGATOR DICKEY: So he asked them to fix that, so, right now, the hospital

26 whether they're going to deny that.
27
28 I see.
29

1 You know, I think it might be helpful. I -- I took pictures of
2 them. He wrote two -- two little notes -- notes to the two guys that we played golf with -- or were
3 going to.
4
5 And he wrote some, like, little dissertations that I would never have shown these men. I
6 kept them, but I took pictures of those notes just -- just to -- to protect myself so if somebody
7 said -- you know, wanted to know who the sick one is, ahhh, I had some proof that I'm not making
8 this up.
9
10 So, yeah, I'm going to send you just a couple pictures. They're little. If you zoom in --
11 they're, kind of, a little hard to read, but you get the gist of what I said they were saying. They were
12 all just disgraceful, religious-based and, you know, all types of, ahhh, social (unintelligible) social,
13 ahhh, ahhh, sort of social choices -- things like -- you know, maybe, things like that with (inaudible)

18 need something later on, but otherwise, I'd -- I'd rather just keep those private.
19
20 INVESTIGATOR DICKEY: You got it. I understand. Ahhh, one thing I was going to ask
21 you, and you stirred my memory. There was information -- evidence to show that he was making
22 homosexual remarks on Palm Canyon in Palm Springs. Is -- do you -- would you describe that as
23 him doing that because he actually has those feelings of -- of not -- of -- of -- of being angry at
24 homosexuals? Or is that more, like, when, like -- when -- when kids were kids and they used to call
25 each other, you know, derogatory terms of just -- you know what I mean? Just just using it --
26
27 Yeah.
29 INVESTIGATOR DICKEY: -- as, like, a bad word? Or --
30
31 Yeah.
32
33 INVESTIGATOR DICKEY: -- does he -- does he really feel like he hates homosexuals, or
34 he's --
35
36 Yeah. I -- I wouldn't -- I wouldn't describe him that way as --
37 as being very -- very gay-bashing or anti -homosexual. He -- it really doesn't come up very much.
38
39 So when he said you know, enjoy playing golf with my fagot friends, it really took me by
40 surprise, because that's -- that's not really something he -- he ever re -- refers to or -- or I would say
41 has a -- a bad attitude -- or towards. I -- I wouldn't say that that's any -- anywhere in his normal

3 INVESTIGATOR DICKEY: And -- okay. And one more thing is -- and you don't have to
4 tell me if you don't want to, but it actually adds context, and it means a lot. Is he saying it to -- to
5 your friends that are homosexual? Or are they not homosexual, and they've got wives, and he
6 knows they've got wives, and he's just trying to use rude words?
7
8 Oh, good question. Ahhh, you know, he wouldn't be saying
9 them to -- to my friends, because I'm not -- I don't have that many friends that are of that persuasion,
10 and I -- I -- he's not aware of -- of any of that, so no. He hasn't said anything directly to anybody
11 that, you know, that we know.
12
13 INVESTIGATOR DICKEY: Okay. So, I guess, what I'm getting at is he's calling your
14 friends these names, like, fagot, but they're not homosexual, so he's --
15
16 Oh, no.

25
26 INVESTIGATOR DICKEY: Right. Just trying to think about what the best resolution
27 would be to that. I will tell you -- because I'm obligated that if you ever felt that somebody was a
28 threat to your safety -- not that a piece of paper necessarily protects you, but that there are options
29 available for you to go get a restraining order at the court.
30
31 Hmmmm, and that would list you as the protected person and him as the restrained person.
32 That way, he couldn't come within a certain amount of yardage of you or your house. That way, if
33 he did, the police could come and just arrest him.
34
35 Whereas, if you don't have that and he shows up, the police can ask him to leave, but,
36 hmmmm, only when you say I don't want him here. It's only trespassing. It's a misdemeanor. If
37 you get a restraining order, and he violates that, he can go to jail.
38
39 And I can tell you that in this situation, that if he bails, you get a restraining order and he
40 violates it, he would most likely go back to jail with no bail. I -- we would --
41
42 Yeah.

1 INVESTIGATOR DICKEY: -- probably -- we would probably --
2
3 Right.
4
5 INVESTIGATOR DICKEY: -- arrange -- arrange for that to occur, so --
6
7 I'm going to hold -- I'm going to hold off on that. I know how
8 that work. I've had -- you know, I've worked with them before -- not for him, but, ahhh, I'm -- I'm
9 going to hold off and just -- and hope for the best, and just look over my shoulder.
10
11 INVESTIGATOR DICKEY: Okay. Hmmmm.
12
13 And --
14
15 INVESTIGATOR DICKEY: He -- he did want -- this is what spurred this whole
16 conversation. He asked if he could speak with you. He's not in the room with me right now. He's
17 in another room. I told him --
18
19 I --
20
21 INVESTIGATOR DICKEY: -- that I needed to call you first, explain what's going on, and I
22 will leave that up to you. Hmmmm, it's entirely up to you -- based on what you're telling me -- I'm
23 not sure -- I -- I don't want to tell you what to do, but -- he -- he said he wanted to -- to call you. I'll
24 leave it up to you. If you want him to call you, great, but I definitely just don't want a situation to
25 where he goes from being calm right now to upset, and it doesn't seem like everything you --
26
27 Can I tell you -- can I -- can I tell you that -- that -- to relay a
28 message to, basically --
29
30 INVESTIGATOR DICKEY: Sure.
31
32 -- say -- if he says can I call my dad, and you say, we've all
33 agreed that we think it would be best if we waited until tomorrow. Let's get through the night,
34 and -- and wait until at least tomorrow, and see how he feels.
35
36 And -- and I'd be -- I'd certainly be open to talking to him. And I'll know in two seconds
37 how the conversation is going -- if I want it to continue, and I'm not going to, you know -- certain
38 things I'm not going to hear or listen to, and -- and -- and to continue to communicate with him if it's
39 all screwed up.
40
41 INVESTIGATOR DICKEY: Yeah. The only issue with that, is that would require me to be
42 here tomorrow to do that.

1 Okay.
2
3 INVESTIGATOR DICKEY: I don't know if that's going to be a possibility or not --
4 depending on what happens tonight -- if we get another case, so I don't want to make it, like, do it
5 now, or I won't be able to do it, but it's -- it's -- if I tell you -- I don't want to make you a promise I
6 can't keep, and I can't promise to be here tomorrow to facilitate that phone call, so --
7
8 Sure, it's sun -- it's Sunday, and I -- you know, you're a
9 working man, and you got a family. Let's -- I still don't -- I'd rather not talk to him --
10
11 INVESTIGATOR DICKEY: Yes.
12
13 -- right now -- with things going on in my life and -- and
14 today and tonight -- I -- if -- if you can do it tomorrow, great.
15
16 (tapping)
17
18 Otherwise, it -- it'll -- it'll happen as soon as it's possible to happen. I'll be -- I'll be
19 open -- you know, I'll be open to that.
20
21 INVESTIGATOR DICKEY: Okay. All right. Sounds good. Thank you very much, and
22 you've got all the information, and I'm sure, you know, at some point down the road, we'll be talking
23 about.
24
25 Gee, Officer, that was quite a conversation. I -- I appreciate
26 it. It's -- it's -- it's really sad, scary, but at least, he's okay, but way -- the way it started out, it was --
27 it was pretty tragic-sounding.
28
29 But this whole thing -- I'm sorry it had to come -- come -- come to this. It really is -- this is
30 the type of stuff that, you know -- bad as it gets -- this is why a lot of people don't -- don't have
31 children.
32
33 INVESTIGATOR DICKEY: Yeah.
34
35 You know, you risk this. You risk the -- these types of things,
36 and, yeah, we went 43 years and have -- and have this happen is -- is a shame, but I appreciate it.
37 You have a -- have a good evening, and I -- and we'll talk again.
38
39 INVESTIGATOR DICKEY: Yeah, I'm sorry this happened, sir, and we'll talk soon.
40
41 Thank you. Thank you, Officer Dickey. All right. Bye now.
42
43 INVESTIGATOR DICKEY: Bye.

Offficer Dickey, here a pics of the offensive/degrading sexual and
religious insulting 'post-it' notes Kevyn spent quite of bit of time
preparing/pasting in his bathroom prior to his departure. He has
not shown these thoughts in the past. I also should mention he
threw feces (I'm hoping it was my dog's!) in my swimming pool, as
well. My lifelong friend, , is a psychiatric RN, that has
known Kevyn quite well since he was age 13, has asked me to give
you here cell # as she feels she would be able give
you input relative to this outbreak. Thank you kindly for your
service and conversation with me earlier. I can only pray now and
hope for the best. He is my one and only cherished child. Sincer
isit
here. FYI, we have played water polo together (yes, I still play too)
since he was age 14!
