DETAILS:
On 8/18/19, I (Investigator Dickey # 4204) conducted follow up investigation on the above case. I
received and reviewed the Palm Springs Police report attached to this report as attachment "A". This
report serves to incorporate the PSPD report into the case file.

OFFICER STATEMENT: On Thursday, 8/9/2019, I was working uniformed patrol in the City of Palm Springs,
County of Riverside. At approximately 1630 hours I responded to an officer involved shooting in the area of S.
Palm Canyon Dr., and E. Camino Parocela. At approximately 1635 hours I arrived on scene and observed Palm
Springs Fire Department Medical Personnel and AMR (American Medical Response) Paramedics treating a white
male adult, later identified as Kevyn Weintraub (03/01/1976), who had sustained a gunshot wound to his right
thigh. AMR paramedics placed Weintraub on a gurney and started to load him inside of an AMR ambulance. Sgt.
Fieux told me to stand by with Weintraub. I took a seat in the rear of an AMR ambulance while AMR medical
personnel treated and transported Weintraub to the Desert Regional Medical Center (DRMC).
Once at DRMC Weintraub was taken into the Emergency room (ER) and DRMC medical staff began treating
Weintraub. I observed as DRMC staff cut off Weintraub's clothing and removed the taser darts which had
penetrated his skin. I observed a DRMC nurse remove the taser darts from Weintraub's person and place them in a
clear plastic container. I took possession of the clear plastic container from the DRMC nurse. I then collected
Weintraub's clothing which had been cut from his person by DRMC medical staff and placed on the ground.
Weintraub's camo shorts were damp with blood. I felt what I believed to be a wallet in one of pockets of
Weintraub's shorts. I located a North Carolina driver's license inside of the pocket of Weintraub's shorts, I observed
the North Carolina driver's license belonged to Weintraub as his name and photo was depicted on it. I relayed
Weintraub's information to PSPD dispatch. I then placed all of Weintraub's clothing and possessions inside of a
brown paper back and took possession of them.

eibvided the following spontaneous statement: "I was just defending myself. He had his arm around my neck and
his finger's in my mouth. He was on top of me trying to choke me. I thought I was going to die so I bit him."
After the CT scan Weintraub looked at me again and provided another spontaneous statement: "Do you know the
officer?" I replied by saying "Yes I do." Weintraub spontaneously said "Please tell him I am sincerely sorry, Please
tell him." I acknowledged Weintraub by nodding my head.
Riverside County Sheriffs Detectives arrived in the ER trauma room and started their investigation. I then handed
the Riverside County Sheriffs Detectives the clear plastic container containing the taser dart which had been
removed from Weintraub's person and the brown paper bag which contained Weintraub's bloody clothing and
possessions. Weintraub was then moved to the intensive care unit (ICU). I followed Weintraub as he was taken to
room 3506 of the ICU. I remained with Weintraub until I was relieved by Officer Buduan at 0720 hours.
