NARRATIVE
On September 9th, 2019 I was working uniformed patrol in the City of Palm Springs, County
of Riverside. At approximately 2226 hours Officer Colantuono and I responded to E
Vista Chino in regards to a domestic disturbance.
While en route to the location Dispatch advised the reporting party, , advised
his new boyfriend, Jonathan Cooper, refused to leave the location per his request. I arrived
on scene after Officer Colantuono and observed as he spoke with Cooper through the front
screen door of the residence. Refer to Officer Colantuono's report for additional details.
After a brief moment both Cooper and exited the residence willingly so that we
could speak with them. As I spoke with I saw that Cooper sat in a chair adjacent to
the front door. As I began to obtain pertinent information from I saw that Cooper
suddenly stood up without warning and seemed to clench both his hands into fists. Cooper
appeared to walk away from Officer Colantuono and ignored his request to come back. I
asked to stay in his position and began to walk towards Officer Colantuono and
Cooper. I overheard Officer Colantuono ask Cooper to interlace his fingers and place his
hands on the back of his head as he intended to conduct a cursory search. I saw that
Cooper initially began to comply but appeared to keep his right hand clenched into a fist.
Refer to Officer Colantuono's report for additional details. Cooper is of a muscular build
standing approximately 6'3" tall weighing well over 200 pounds. Cooper's stature is such
that physically he is a much larger man than Officer Colantuono and I.
Suddenly without warning Cooper tensed his entire body and appeared to attempt to pull
away from Officer Colantuono as he maintained control of his left wrist. Cooper appeared
to rotate his body in an attempt to face Officer Colantuono as I grasped a hold of his right
wrist and initiated a "Twist lock", a department approved arrest and control technique. I
yelled "Stop resisting" as Cooper attempted to pull away from both Officer Colantuono and
I. Cooper flailed his right arm with a great amount of force causing me to momentarily lose
my grasp. Officer Colantuono, Cooper, and I seemed to lose our balance during the
struggle and fell to the ground.

NARRATIVE
Cooper immediately attempted to get back to his feet and made it to his hands and knees
as Officer Colantuono and I ordered Cooper to lay on his stomach. I observed that Cooper
used his left hand to grasp at the area of Officer Colantuono's duty belt. Officer Colantuono
is right hand dominant and carries his sidearm on the right side of his duty belt, which was
in the immediate vicinity of where Cooper grasped. I feared Cooper could possibly attempt
to manipulate Officer Colantuono's sidearm. From a standing position I used my left hand
to grasp the area of Cooper's left bicep to pull his arm away from Officer Colantuono.
Simultaneously I placed my right hand on top of Cooper's lower back while driving my right
knee into the left side of his torso. Using my right knee I struck Cooper's left torso
approximately 4-5 times. Cooper initially seemed not to react to the strikes I delivered, but
he later physically responded by attempting to rotate away to shield his body. While doing
so Cooper lost his balance and lay chest down on the concrete.
Cooper attempted to pull his left arm from my grasp as I attempted to place it behind his
back. Officer Colantuono communicated to me that he had applied a carotid control hold.
Moments later Cooper was rendered unconscious. Refer Officer Colantuono's report for
additional details. I was then able to secure Cooper into handcuffs without further incident.
Cooper was rolled into a recovery position and regained consciousness within
approximately 3-5 seconds. Cooper immediately proceeded to flail about on the floor as if
he was still engaged in a physical altercation. Officer Colantuono and I maintained control
of Cooper until other Officers arrived on scene to assist.
As Cooper still lay on his stomach he proceeded to strike his own head and face into the
concrete. I implored Cooper to stop the behavior to which he replied "Just kill me." I
attempted to place the curved laced portion my right boot under Cooper's neck to prevent
him from being able to continue to be able to hurt himself. I saw that Cooper began to
bleed from area of his face as a result of striking the pavement.
With the assistance of members from AMR and PSFD Cooper was loaded onto a gurney

NARRATIVE
SOURCE:
On 09-09-2019, I was working a uniformed patrol assignment for the Palm Springs Police
Department, in the City of Palm Springs, within the County of Riverside. At about 2226
hours, I was dispatched to E. Vista Chino to assist Officer Colantuono with a
witness statement.
I contacted reporting party and witness and obtained the following
summarized statement. The statement was audio recorded.
told me he phoned for law enforcement because Johnathan Cooper was at the
residence and he wanted him to leave. He said Cooper had hanged out with him earlier and
had left. When Cooper returned, he was acting differently and strange. He said when the
police came to the residence, Cooper's dog starting barking at officers. Cooper and him
walked outside onto the patio area and Cooper started acting like a "dick" to officers and
was "talking crap." He said the cops were "truly honestly" trying to be nice to Cooper before
he became combative. He then said Cooper didn't believe the officers were real police
officers. At one point, one of the officers told Cooper to turn around and place his hands on
his head. As the officer grabbed onto Cooper's hands, Cooper jerked away and pushed an
officer and began to fling his arms. said he became scared at this point and walked
away. He said he heard the officers tell Cooper to stop resisting several times and that the
officers "followed protocol." He did not see the rest of the confrontation because he was
scared and walked off. He heard Cooper yelling and at one point, he took out his phone and
started to record. believed the officers were acting appropriate and that Cooper
was not. believed the officers handled the situation well and were acting "nice" to
Cooper before he became combative.

"CALECPA" form that was in Spanish and said he read and spoke Spanish and
signed that he consented. I obtained an audio recording of the video from his cell phone

NARRATIVE
and a video recording with my digital phone. On the video, I hear Cooper yelling loudly. I
could not see the physical confrontation.
I obtained digital photographs of the patio area where the confrontation happened. I also
obtained digital photographs of Officer Colantuono and Officer Aguilera persons.
I responded to Desert Regional Medical Center. I obtained digital photographs of Cooper
but he began to become uncooperative with the photographs. I observed redness on his
neck area. I observed raised bruising / swelling above his right eye. Refer to Digital
Photographs.
I transported Cooper to Smith Correctional Facility after he was medically cleared. I
removed Cooper from the hospital restraints and I placed handcuffs on him. I checked for
proper comfort and fit and double-locked. I placed him in the back of my unit on the driver
side and secured him in a seatbelt. While en route, Cooper began to shout obscenities and
spit on officers through the cage between the front seats and back. At one point, he was
able to get out of his seatbelt and he began to stand up in the back of the unit. He banged
his head on the glass part of the cage behind the driver seat and began to kick the caged
windows of the unit. He yelled incoherently. At the jail, Cooper was taken out of the unit by
Riverside County Sheriff Deputies. I advised Sergeant Nelson that Cooper had been
rendered unconscious through the carotid restraint and was medically cleared. Cooper
began to be combative with deputies and was taken to the ground. He was placed in a
restraint chair by deputies.

SOURCE:
On Monday September 9, 2019 I was assigned uniformed swing shift patrol, driving a
marked PSPD patrol unit (48-17), in the City of Palm Springs within the County of Riverside.
At about 2226 hours I was dispatched to East Vista Chino which is also located
in the City of Palm Springs, County of Riverside in reference to a verbal dispute.
M.O/P.O.E:
Arrestee Jonathan COOPER by the means of physical force resisted two uniformed officers
during the performance of their lawful duties causing visible injury.
VICTIM'S STATEMENT:
State of California.
WITNESS' STATEMENT:
Officer Valdivia contacted the reporting party and obtained a recorded
statement.
OFFICER'S STATEMENT:
I arrived on-scene at about 2227 hours. I noticed the address in question was located in a
multi housing complex at the far southwest corner. The front door to unit was open but
the metal security screen door was closed. While standing in the front foyer/patio area I was
able to see most of the living area of unit . I could see a White male adult, wearing a
white shirt and light colored pants sitting on a chair in the living room. This subject verbally
identified himself as . stated he was the one who called the police.
I was speaking with through the security screen door when he invited me into his
residence. I opened the unlocked security screen door and entered past the threshold of the
residence. I was immediately greeted by an aggressive Sable colored German Shepherd
Dog, named "Texas." Fearing that I would be bitten I retreated back outside and shut the
security screen door. Once I was back outside an additional White male adult, bald, about
6'00, 200 pounds, wearing a red shirt and black shorts (Later identified as Jonathan
COOPER) appeared from the bathroom area and contacted me at the door. I requested
COOPER to gain control of the dog due to its behavior and secure it within a room.

COOPER refused to maintain control of the dog and requested I provide him with
identification. COOPER did not believe I was a Police Officer and requested I provide him
with my department ID number. It should be noted I was in a full duty patrol uniform, with a
metal name plate, badge, and duty full patrol belt during this time. COOPER proceeded to
tell me that police officers have a 20 to 30 minute response time and there was no way I
arrived so quickly. COOPER then disappeared back into the bathroom area causing me to
lose sight of him. This caused me to fear for my safety and the safety of , because
COOPER already displayed defiant/resistive behavior at the door refusing to cooperate with
my request (putting the dog away). Cooper had free range to areas within the home that had
not been searched making it plausible for COOPER to arm himself with a weapon. This
placed COOPER at an advantageous position over me as well as Officer Aguilera.
I continued to negotiate with COOPER through the security screen door requesting him to
secure his dog or to step outside the residence so that we could talk. COOPER refused to
comply with either request. After multiple requests were made, which COOPER refused to
comply with, stated the he would come outside and speak with Officer Aguilera and
myself.
exited out the residence. Officer Aguilera spoke with approximated 15 feet
away from the front door. Shortly after exited the residence COOPER exited out
the front door holding a pair of black socks. As COOPER exited his dog Texas followed
causing COOPER to immediately gain control of him and put Texas back inside the front
hallway area. While outside I noticed COOPER was sweating profusely and his right hand
was closed and shaking. COOPER sat down on a metal patio chair located just south of the
front door. COOPER began putting on his right sock as though he was going to leave. I
began speaking with COOPER attempting to gain information such as COOPER's full name
and DOB.
COOPER only provided me with his last name. When asked his first name COOPER
stopped putting on his right sock and with a long emotionless stare, looked directly forward
(east) and said, "I don't know." COOPER then got out of the chair and walked towards the
north patio stucco wall. COOPER stood with his back against the wall and continued to
stare directly forward. I noticed COOPER's body becoming tense, his breathing became

rapid, and his muscles in his arms contracting and his forearm veins were bulging. I noticed
COOPER began to tighten his right fist as well as his jaw. Based upon my training and
experience I believed COOPER was becoming agitated and was mentally preparing to fight.
Upon seeing these body cues I told COOPER to sit back down on the chair. COOPER
continued to stare directly forward and would not say anything or comply with my orders. I
again told COOPER to sit back down and again there was no change in COOPER's
behavior. Officer Aguilera, who was speaking with Ramirez at the time, heard me give
COOPER multiple commands. Officer Aguilera to discontinued his investigation and
assisted me with COOPER who was noncompliant.
Once Officer Aguilera was at my aid I requested COOPER to place his hands behind his
head. COOPER began to comply with my orders and placed his hands behind his head. As
COOPER did this I noticed he had something concealed in his right hand/fist. Unknown if it
was a weapon I immediately grabbed control of his right fist with both of my hands and
attempted to retrieve the item. COOPER clinched his fist tighter around the object (later
determined to be a beaded necklace). As I struggled to open COOPER's right fist he spun
his body around 180 degrees causing him and I to be face to face.
COOPER is about 6'03 and weighs 200 plus pounds. I am only 5'06 170 pounds. This
provided COOPER with a significant size and strength advantage over me.
While standing face to face with COOPER I quickly attempted to grab and gain control on
his upper body to avoid being struck either in the face or body. In doing so with the use of
both his hands COOPER pushed me on my upper torso causing me to stumble backwards
a few feet. COOPER then attempted to flee back into the residence. Fearing that COOPER
was attempting to retrieve a weapon, his dog, or barricade himself I reached and grabbed a
hold of COOPER's left arm and attempted to keep him from entering the residence.
COOPER used his mere size and strength pulling me closer into his body.
I could hear Officer Aguilera give COOPER multiple commands, "Stop Resisting!" COOPER
failed to comply and continued with his violent struggle. Officer Aguilera and I attempted to
get COOPER to the ground to better gain control of him. COOPER continued to fight both

Officer Aguilera and I flailing his arms and pushing us causing both Officer Aguilera and I to
collide and fall into the security screen door and patio furniture. As this violent struggle
ensued in the front patio of the residence, which caused me to lose my baton, COOPER,
Officer Aguilera and I all fell to the cement ground.
COOPER was now laying on his stomach with his head facing towards the north and his
feet towards the south. I was positioned and controlled the top of COOPER's head and
shoulder area and Officer Aguilera was positioned and controlled the left side of COOPER.
Even though COOPER was on the ground at this point he still continued to fight. COOPER
attempted to push himself up off the ground (in a push up style fashion), grabbed at my
uniform, hands, and duty belt.
Attempting to gain some pain compliance I saw Officer Aguilera deliver a knee strike to the
left side (rib) area of COOPER. The strike(s) appeared to have no effect on COOPER as he
continued his violent struggle. (See Officer Aguilera's supplemental for further). At this time
Officer Aguilera and I had already been involved in an approximately one minute
violent/forceful struggle with COOPER with no progress in getting him into custody.
I knew that if both Officer Aguilera and I continued on this path I would have exerted all my
energy leaving me in vulnerable state allowing COOPER the opportunity to use any of my
tools against me (i.e. gun, Taser, o.c. spray). With these thoughts and fears going through
my head I began thinking about my force option that would safely affect the arrest of
COOPER.
I thought about the use of my Oleoresin Capsicum (O.C.) spray but due to the close
proximity in which COOPER, Officer Aguilera, and I were in. The O.C. spray would have
only caused further complications while trying to affect the arrest. I thought about the use of
my baton, but it fell out of my baton ring during the initial struggle with COOPER. I thought
about the use of my Taser but I would have had to remove myself from the upper body
control I had of COOPER, get to about 10-15 feet away, to have the Taser be properly
effective. This would also be troublesome due to the close proximity Officer Aguilera was to
COOPER at the time.

After going through a multitude of less than lethal force options, based upon my body
position, my past training in Brazilian Jiu Jitsu and COOPER's physical and violent behavior
I determined the safest and most effective was to affect the arrest was to place COOPER
into our department approved carotid control hold which I have successfully tested, trained
on and applied.
As Officer Aguilera maintained control of COOPER's left side I was able to slide my right
arm towards COOPER's neck. I placed my right bicep on COOPER's left carotid artery. I
bent my arm at the elbow to allow COOPER's chin to sit properly within the crease. Once in
this position I pulled my arm into my body so that my right forearm applied pressure to
COOPER's right carotid artery. Once I felt this was properly applied I grabbed a hold of my
right fist with my left hand, rolled my body to the right and began applying equal pressure in
attempts to stop the oxygenated blood to the brain.
As the carotid control hold was applied I could feel COOPER's breathing begin to slow down
and his violent struggle begin to stop and his rigid, tense body begin to loosing up. Based
upon this feeling I knew the carotid control hold was successful and COOPER was rendered
unconscious. The application took about three to five seconds to render COOPER
unconscious. This was the only time COOPER was not fighting/struggling with Officer
Aguilera or I. COOPER was placed into handcuffs and regained consciousness in about two
to three seconds. Once COOPER came to he continued to fight with Officer Aguilera and I.
COOPER was kicking both his legs and attempted to roll onto his back. Even though
COOPER was handcuffed he continued to grab at my hands and duty belt.
Palm Springs Fire were requested to respond to my location to complete a preliminary
assessment of COOPER. Sergeant R. Raso was also notified of the carotid control hold
and later responded to the scene. Along with additional Officers to assist with COOPER who
still continued to fight.
COOPER was being restrained by three officers as well as personnel from Palm Springs
Fire Department (PSFD). Due to his behavior and the possibility of Excited Delirium
COOPER was administered Versed by PSFD to allow for safer transport to Desert Regional
Medical Center. COOPER still remained agitated and fighting after given a single dose.

COOPER was transported to DRMC via AMR and was accompanied by Officer Nanez for
an "Okay to Book." Officer Valdivia contacted and obtained a recorded statement.
Officer Valdivia took digital photographs of the scene, COOPER, Officer Aguilera and
myself. (See Officer Valdivia's supplemental for further).
At the conclusion of the physical altercation I sustained redness and a visible abrasion to
the brim of my nose and abrasion above my right eyebrow which was photographed by
Officer Valdivia. Additionally COOPER did not sustain injuries during the altercation.
COOPER did self inflict an injury to his forehead and chin by banging his head multiple
times on the cement ground. This injures were photographed by Officer Valdivia.
Once COOPER was medically cleared he was transported to Larry Smith Correctional
Facility by Officer Nanez and Officer Valdivia. COOPER still remained uncooperative and
again resisted Officers and Deputies when COOPER arrived at the County Jail Facility.

NARRATIVE
On 9/11/19 at approximately 0745 hours, I learned I had been assigned to take primary
responsibility for this case. I reviewed the reports prepared by Officer Colantuono, Officer
Aguilera, and Officer Valdivia and found that the suspect, Jonathan Cooper, had been
contacted and arrested after physically resisting officers.
I reviewed contacts and criminal history for the suspect and found no prior contacts with the
Palm Springs Police Department and no prior convictions in the State of California. I
located prior arrests in the State of Arizona but I was unable to determine the status of
those cases.
I completed the required paperwork and forwarded this case, along with a Declaration in
Support of Arrest Warrant prepared by Officer Colantuono, to the Riverside County District
Attorney's Office for review and filing of the listed charge.
