At about 1729 hours I was dispatched to 150 South Indian Canyon Drive (Hotel Zoso) in reference to a Keep the Peace as hotel staff removes a guest from property. M.O/P.O.E: Arrestee Mario RODRIGUEZ touched the victim's, Evelyn Lopez's, buttocks underneath her clothing and against her will. When Lopez confronted RODRIGUEZ about being touched, RODRIGUEZ again grabbed Lopez's breast, against her will. RODRIGUEZ knowingly resisted arrest by the means of force and violence to deter a police officer in the performance of his/her duties. VICTIM'S STATEMENT: I contacted the victim who verbally identified herself as Evelyn Lopez. Lopez was standing with a Hispanic female adult (later identified as ) near to the pool at the location. Lopez was wearing a . Lopez spoke in calm normal tone of voice. The following was a summary of her statement; Lopez and , , were hanging out by the pool at Hotel Zoso celebrating Cinco De Mayo. While at their pool lounge chairs, they saw a White male adult (later identified as Mario RODRIGUEZ), wearing a black shirt, board shorts, and a beard while smoking a cigar. Lopez who was craving a cigarette, approached RODRIGUEZ who was standing near the pool edge. Lopez asked RODRIGUEZ if he a cigarette that she could have. Lopez engaged in a brief conversation with RODRIGUEZ who was now standing face to face, approximately two feet away. During the conversation about sparing a cigarette, RODRIGUEZ, without any permission from Lopez, reached inside the top of her waistband of her loose fitting shorts with his right hand. As RODRIGUEZ's hand was inside her shorts, against her will, he caressed down the left side of her leg and squeezed her buttocks causing Lopez to feel uncomfortable and fearful for her safety. Upon discovering what had happened both and Lopez were involved in a verbal confrontation with RORIDGUEZ about him touching an intimate part of Lopez's body. Lopez said the argument progressed and RODRIGUEZ told both and Lopez that it was wrong for being The verbal argument escalated at this point due to Lopez feeling attacked . Lopez said she and continue to argue with RODRIGUEZ when possibly RODRIGUEZ's wife or girlfriend (unknown name) approached Lopez and and requested that they just ignore RODRIGUEZ because he was intoxicated. Lopez said as the unidentified female attempted to intervene, RODRIGUEZ leaned forward, reached out with his right hand, grabbed for Lopez's breast touching her right breast over her clothing. Lopez pushed RODRIGUEZ away and notified Hotel Security. Lopez had no further contact with RODRIGUEZ or the unidentified female. Lopez desired prosecution for the sexual battery and signed a private person's arrest form. WITNESS' STATEMENT: I contacted Hotel Zoso Security . was wearing a . The following was a summary of statement; said while working in the capacity of a he was contacted by Hotel Zoso employees requesting his assistance in handling of an unruly guest in the pool area. made contact with the subject (identified as RODRIGUEZ) in the pool area of the Hotel. said RODRIGUEZ immediately became confrontational with him and the staff of the hotel. RODRIGUEZ began verbally accosting them, and with his middle finger making the gesture of "flipping," them off. As this was occurring was notified by that she was assaulted by RODRIGUEZ moments earlier. Based upon RODRIGUEZ demeanor displayed towards the staff, requested that the Police be contacted to aide in the removal of RODRIGUEZ from Hotel property. made no further contact with RODRIGUEZ until Police arrived on-scene. After obtaining a brief statement from he walked me over to Lopez who was still standing in the pool area where the assault occurred. I contacted Lopez who was standing next to , as I was attempting to obtain Lopez's statement RODRIGUEZ approached , Lopez, and myself on foot. RODRIGUEZ was now standing approximately four feet from Lopez and me causing me to divert my attention and delay my investigation into the possible crime of a sexual battery. RODRIGUEZ is described as a White male adult, about 5'10" weighing approximately 260 to 300 pounds. I am described as a White male adult, approximately 5'06" weight about 170 pounds. As RODRIGUEZ remained standing there with his arms crossed, I verbally requested RODRIGUEZ to walk away and I would be with him once I concluded my investigation. RODRIGUEZ refused and said, "I have the right to hear what she said." I told RODRIGUEZ that he could not remain standing there and needed to walk away. Once again RODRIGUEZ refused and again told me, "I have the right to hear what she said." I told RODRIGUEZ for the third time he needed to walk away for he would be subject to arrest due to the fact he was delaying my lawful investigation. RODRIGUEZ once again remained standing there, with his arms crossed, refusing to leave. Upon the third refusal, I stopped my initial interview with Lopez, approached RODRIGUEZ, grabbed a hold of his right elbow and right forearm with both of my hands, and attempted to bring his arm to the rear of his back and place him in a handcuffing position. RODRIGUEZ immediately tightened up his muscles and clinched both his hands to make a fist. I knew based upon my working experience that RODRIGUEZ was not going to comply and began to resist arrest by the means of physical force. RODRIGUEZ who is already bigger and outweighs me, was sweaty, and covered with sun block, causing added difficulty in attempting to control and place him in handcuffs. I yelled to RODRIGUEZ to stop resisting and place his hands behind his back. I again grabbed hold of RODRIGUEZ's right elbow and forearm but RODRIGUEZ was so overpowering that he was able to walk towards the metal railing dragging me behind him. I was alone at this time in the contact and was having difficulty in restraining RODRIGUEZ. saw that I was in need of assistance and assisted by grabbing a hold of RODRIGUEZ's left arm. and I both struggled with placing RODRIGUEZ's hands behind his back and RODRIGUEZ continued to forcible resist, pulling his arms away from my grasp and at one time swinging his right elbow towards my direction. Knowing RODRIGUEZ was stronger and bigger than me any future attempts to place him in handcuffs while he was still standing would fail. At this point I made hip to hip contact and attempted to take RODRIGUEZ to the ground in attempts to gain a positional advantage. The attempt to get RODRIGUEZ on the ground failed as well. RODRIGUEZ was able to use his brute strength and maintain his balance on his feet. While still standing RODRIGUEZ again was able to pull me back to the metal railing and maintain a firm unbreakable grip. Officer S. Sandoval arrived on-scene as the struggle between RODRIGUEZ and I continued. I again yelled to RODRIGUEZ to stop resisting and place his hands behind his back. RODRIGUEZ again refused to comply, still tensing his arm muscles, clinching his fist, and pulling his arms from my grasp. At one point during the struggle RODRIGUEZ freed his arm, turned towards me, and "squared" his body up to me. At this time I believed that RODRIGUEZ was going to punch me in the face due to the close proximity I was in, about one foot. I was able to regain control of RODRIGUEZ's right forearm and wrist which he immediately pulled back towards the metal railing and maintained his grip. Officer S. Sandoval and I were about one and a half minutes into this forceful/violent struggle with RODRIGUEZ and had made no progress with getting RODRIGUEZ into custody. At this time I knew that if both Officer S. Sandoval and I continued on this path I would have exerted all my energy leaving me in vulnerable state allowing RODRIGUEZ the opportunity to use any of my tools against me (i.e. gun, baton, o.c. spray). With these thoughts and fears going through my head I began thinking about my force option that would safely affect the arrest of RODRIGUEZ. Civic Drive 69 PC; Obstruct/Resist Executive Officer; Fel. 243.4(E)(1) PC; Touch Person Intimately Against Will For Sexual Arousal/Etc; Misd. 1905P-1028 I thought about the use of my Oleoresin Capsicum (O.C.) spray but due to the close proximity in which RODRIGUEZ, Officer S. Sandoval, and I were in. Along with the multiple patrons at the pool that the O.C. spray would have only caused further complications while trying to affect the arrest. I thought about the use of my baton, but this would cause me to have to lose my already maintained control of RODRIGUEZ and swing my baton in close proximity of civilians. I thought about the use of my Taser, but again I would have had to release control of RODRIGUEZ, get to about 10-15 feet away to have the Taser be properly effective. After going through a multitude of less than lethal force options, based upon my body and arm control, and my past training in Brazilian jiu jitsu, and RODRIGUEZ's physical and violent behavior I determined the safest and most effective was to affect the arrest was to place RODRIGUEZ into our department approved carotid control hold which I have been successfully trained on. As Officer S. Sandoval maintained control of RODRIGUEZ's left arm, I took control of his back, and in doing so RODRIGUEZ leaned his shoulders and upper body forward in an effort to knock me off his back. I was able to maintain control of RODRIGUEZ's back at which time, I slid my right arm up towards RODRIGUEZ's neck. I placed my right bicep on RODRIGUEZ's right carotid artery. I bent my arm at the elbow to allow RODRIGUEZ's chin to sit properly within the crease. Once in this position I pulled my arm into my body so that my right forearm applied pressure to RODRIGUEZ's left carotid artery. Once I felt this was properly applied I grabbed a hold of my right fist with my left hand and began applying equal pressure in attempts to stop the oxygenated blood to the brain. As the proper application was applied I could feel RODRIGUEZ's grip to the metal railing become weaker. I could feel RODRIGUEZ's once firm, rigid, tense body begin to loosing up almost becoming weightless. Once RODRIGUEZ was safely detained in handcuffs, I re-contacted Lopez and obtained the remainder of her statement. Based upon the information provided and the fact Lopez desired prosecution and signed a private person's arrest, which I accepted, along with RODRIGUEZ's violent behavior. I placed RODRIGUEZ in-custody pursuant to California Penal Code 243.4(e)(1) and California Penal Code 69. RODRIGUEZ was transported to Desert Regional Medical by Officer K. Merenda. RODRIGUEZ was treated for any injuries sustained during the altercation as well as the carotid control hold. RODRIGUEZ was medically cleared and given an "okay to book." RODRIGUEZ was subsequently transported to Smith Correctional Facility by Officer K. Merenda without further incident. RODRIGUEZ is five-feet-ten-inches tall and approximately two-hundred-and-sixty-pounds. I am five-foot-one-inch tall and one-hundred-and-sixty-five-pounds. I was not able to physically overcome RODRIGUEZ' resistance. RODRIGUEZ' skin was also wet with sweat, which made it difficult for me to maintain my grip on him. I was able to free RODRIGUEZ' grip from the rail twice, only to have him pull forward and re-grip the rail, while I was still holding onto his left forearm and wrist. Officer Colantuono jumped on RODRIGUEZ' back and applied a department approved carotid control hold. I maintained control of RODRIGUEZ left arm and could hear RODRIGUEZ making muffling noises. I could see RODRIGUEZ' grip loosening from the rail, and used my arms to push him forward towards the rail, to prevent him from turning or walking away. I could feel RODRIGUEZ' muscles starting to relax, and he suddenly let go of the rail and began to fall backwards. I maintained my hold on RODRIGUEZ and guided his body to the ground to prevent him from injuring himself. RODRIGUEZ lost consciousness and landed on his back. Officer Colantuono's body prevented RODRIGUEZ' head from hitting the ground. Officer Colantuono and I turned RODRIGUEZ onto his abdomen and secured him in handcuffs. I immediately turned RODRIGUEZ on his left side, to ensure he was breathing. I could see RODRIGUEZ chest rise and fall and could hear him breathing from his mouth. Within four or five seconds, RODRIGUEZ opened his eyes and began to move his legs and lift his head. I could see RODRIGUEZ had fresh blood on his right cheek, and a red abrasion above his left eyebrow. I later determined the blood on his cheek, was likely due to RODRIGUEZ biting his tongue when he lost consciousness. RODRIGUEZ told me he wanted to stand up, because the floor was hot. I assisted RODRIGUEZ to a sitting position, but waited for additional Officers to help me stand him up, due to his large size. At approximately 1738 hours, I responded to 150 S. Indian Canyon Dr. (Hotel Zoso) in reference to Officers in a physical altercation. OFFICER STATEMENT: I arrived to the location and walked to the back of the hotel towards the pool where the altercation had happened. I contacted Officer Colantuono who asked that I escort a male, identified as Mario Rodriguez, to the front of the hotel and wait for the Palm Springs Fire department to render aide due to him being placed in a department approved carotid control hold. I escorted Mario to the front of the hotel so that he could be treated by the fire department. Civic Drive CA0331100 CASE SUMMARY Supplemental Report 1905P-1028 NARRATIVE SUPPLEMENTAL REPORT: On 05/05/19 I was on duty, in full uniform, in marked patrol unit #10, in the City of Palm Springs, in the County of Riverside. At approximately 1540 hours, I responded to 150 South Indian Canyon Drive (Hotel Zoso) in the City of Palm Springs within the County of Riverside, reference Officers involved in a physical altercation. Upon arrival to the Hotel, I was directed by staff that the altercation was near the pool area. I arrived and saw a bald white male adult with a heavy build and a goatee detained in handcuffs sitting on the floor. I was directed by Officer Colantuono that one of the females he was speaking with was a possible witness to the incident. I then spoke with the female whom identified herself as (identified and confirmed by her California Driver's License) the following is a summary of her statement: stated that she was at the pool area of the Hotel with her . While at the pool noticed that a couple male (the male described above) and female near them were smoking cigars. They approached the couple starting conversation with them in hopes that could smoke with them. The couple was friendly towards them and they began to talk cordially. At some point in time the male later identified as Mario Rodriguez touched by trying to unfold her shorts by sticking his fingers inside the shorts touching her skin. When asked, stated that did not notice at first and believes that he did it inappropriately. said "Don't touch her that way!" and Rodriguez replied by saying that it was ok because he is a hair dresser. At this point stated that realized what was going on and began to argue with Rodriguez regarding his actions. The argument began to get more intense as Rodriguez began to say offensive things to them as he was trying to defend his actions. Shortly after stated that the Police arrived and tried to get Rodriguez to calm down by attempting to separate him from the couple. This case stems from an incident of sexual battery on May 5, 2019, when Mario Rodriguez touched the victim's buttocks and breast against her will. Rodriguez then used force to resist a police officer in the performance of his duty. Following his arrest, Mario Rodriguez was booked before posting bail. After reading the initial reports, I examined the criminal history of Mario Rodriguez and found he is neither on supervised release nor the subject of any restraining orders. I also found Rodriguez is not required to register per California Penal Code 290 and has no firearms registered in his name. During our conversation, which was recorded, she told me she had never seen or spoken with Mario Rodriguez prior to asking him for a cigarette. Lopez said Rodriguez had been in the company of another woman but believed she might have been absent during her contact with Rodriguez. Lopez said after she asked Rodriguez for a cigarette, he grabbed her "butt" and made two or three more attempts to go beneath her shorts. Lopez said after Rodriguez groped her butt, she and , , began to argue with Rodriguez. During their argument with Rodriguez, Lopez said Rodriguez called her a " and criticized her for Lopez said Rodriguez told her she needed a "real man," bragged about his wealth and declared his support for President-Elect Donald J. Trump. Lopez also told me Rodriguez called her "a bitch," and an "immigrant," before calling her a Concerned Mario Rodriguez's behavior might be the result of some perceived or actual characteristic of Evelyn Lopez, I asked her if she believed his behavior stemmed from his belief she was or something else. Lopez answered by saying, "No;" instead, Lopez believed Mario Rodriguez's behavior was the consequence of his being a "Perv," who likely "gets away with a lot." Lopez said a police officer told Rodriguez to "calm down" approximately seven times but that Rodriguez ignored these requests. Lopez said the police officer told Rodriguez he was speaking to her and that he needed to calm down. Lopez said the police officer attempted to calm Rodriguez by agreeing to suspend his conversation with her and speak with him; however, once given this opportunity, Rodriguez said he would not discuss the matter where others could listen. Lopez said the police officer finally told Rodriguez that if he would not calm down he would be arrested but Rodriguez continued to interrupt him. Lopez said the police officer finally attempted to arrest Rodriguez, who resisted the officer despite the officer telling six or seven time to stop resisting. I asked Lopez how she knew the police officer was not a security officer and she told me the police officer was in uniform and standing right next to them. Lopez said the security officers at the hotel were only wearing shirts and shorts. Lopez said she desired prosecution for Mario Rodriguez sexually battering her. During our conversation, which was recorded, she told me Evelyn Lopez had been speaking with Mario Rodriguez for a short time before she joined them. Lopez initially thought they were having a friendly conversation before she heard Rodriguez say that he had money. said following Rodriguez's remark about money, he saw him put one or more fingers inside the waistband of her shorts. said Rodriguez fingers went into the top of her shorts near her hips or the sides of her legs. said that upon seeing Rodriguez reach inside Lopez's waistband, she confronted Rodriguez by asking what he was doing. said Rodriguez subsequently told her he was a hairstylist and that what he did was acceptable behavior. said she believed Rodriguez was attempting to portray himself as a gay man in an effort to reduce her anger. When asked how she knew it was a police officer, told me he was in uniform and she knew immediately that it was a police officer. When asked if the officer was professional, said he was and that he tried to talk to Rodriguez several time without success. said the police officer told Rodriguez to place his hands behind his back several times but he refused. had no additional information and I ended our phone call. Following our conversation, I booked a recording into evidence. Based on the statements of all parties, I believe Mario Rodriguez violated California Penal Code 243.4(e)(1) - Sexual Battery, for the following reasons: First, Mario Rodriguez touched Evelyn Lopez's buttocks and breast; Second, Mario Rodriguez touched Evelyn Lopez's intimate parts against her will; Third, Mario Rodriguez touched Evelyn Lopez with the specific intent of sexual arousal, which I think is proven by Rodriguez's recommendation, however misinformed, that Lopez should not be and needed a "real man." I also believe Mario Rodriguez violated California Penal Code 243.4(e)(1) - Resist an Executive Officer, for the following reasons: First, Mario Rodriguez used force to resist Officer Luciano Colantuono by refusing to submit to a lawful arrest; Second, Officer Colantuono was on duty, in full uniform and speaking with the victim of a sexual battery when he was required to arrest Mario Rodriguez for delaying an officer in the performance of his duty; Third, when Mario Rodriguez resisted Officer Colantuono, he knew Officer Colantuono based on his uniform, department patches, duty belt and firearm.
