DATE, TIME AND DAY OF OCCURENCE DATE AND TIME REPORTED 11/13/18 21:36 Tuesday 11/13/18 21:36 LOCATION OF OCCURENCE LOCATION NAME TYPE OF LOCATION BEAT SECTOR Restaurant -Fast Food CASE SUMMARY Supplemental report to CR-1 NARRATIVE SOURCE: On 11-13-18 at approximately 2156 hours, I was working patrol in the City of Palm Springs within the County of Riverside. I was in full uniform and in a marked PSPD vehicle at the PSPD station when I heard Officer's Colantuono broadcast over the radio that he was involved in a physical altercation. I checked my MDC and learned that Officer's Colantuono and Jimenez were at the Panda Express located at 425 S. Sunrise Way in reference to a trespass call for service. I responded to this location CODE3 from the station. On my arrival to the scene I saw Officer Jimenez, Colantuono suspect Adan Pimentel Quevedo and numerous other officers on the west sidewalk of S. Sunrise Way east of the Panda Express restaurant. Quevedo was detained in handcuffs at this time. I also saw a SUNBUS #623 stopped on the #2 southbound lane of S. Sunrise Way just north of the officer's location. I contacted Officer Jimenez and I asked him if he needed assistance with anything. Officer Jimenez requested that I make contact with the SUNBUS driver and occupants in an attempt to obtain witness statements. I made contact with the passengers of the SUNBUS and the bus driver. The following passengers advised me that they did not witness anything: I then spoke to`M, the following is a summary of his statement. Msaid when the bus driver stopped the bus he saw two officer's fighting with a subject (Quevedo) on the sidewalk. stated one of the officers was "Choking" the subject. I also spoke toMMM the following is a summary of her statement. Mstated when the bus driver stopped the bus she saw 4 officers on top of a subject (Quevedo). She said the officers and the subject were on the east sidewalk of S. Sunrise Way. She said a couple of the officers had the subject by the neck._ said several other officers were pulling the subjects arms behind his back as if they were attempting to handcuff him. said another officer was pinning the subjects head against the ground. She also saw another officer pinning the subject down as if he was attempting to hurt the subject. said there was a total of about 10 officers involved. At the scene I also spoke to the SUNBUS driver, _�. The following is a summary of her statement. - said she was driving SUNBUS#623 southbound on S. Sunrise Way south of Baristo Rd. - said she was driving in the #2 traffic lane when she saw what appeared to be a subject ahead of her in the roadway. As she approached the area of the Panda Express she realized that two officers were actively fighting with a subject (Quevedo). She said it appeared that the officers were attempting to hold on to the subject and pin him down. �said the subject was on his stomach and attempting to turn around on the officers. During the fight she said one of the officers placed his arms around the subject's neck. She said the other officer was attempting to place the subjects hand behind his back. � stated the subject was "Moving like a snake violently and not cooperating." She said as the fight continued the officers and subject ended up on the sidewalk. She said moments later more officers arrived and managed to restrain the subject. � said she kept being distracted by the passengers who kept asking her questions. said she kept the doors to the bus locked until she saw the subject detained. a��i�►ir�ariani 'FOLLOW-UP COPESTO. At this time I concluded my interviews with the passengers of the bus. At approximately 2232 hours I telephoned the SUNBUS customer service -safety department in an attempt to obtain a copy of the SUNBUS surveillance video. I learned via the recording that they were closed at this time but their hours of operation are from 0800-1700 hours. For further details refer to initial report by Officer Jimenez with same DR#. Officer Colantuono and I were dispatched to Panda Express (425 S Sunrise Way H1) reference a subject locked inside the bathroom. MO/POE: Quevedo provided a false name to me. He violently resisted arrest and had a felony warrant for his arrest. During the alteration with Quevedo, Officer Coantuono sustained an injury to his knee. A parole hold was also obtained for the new charges for Quevedo. VICTIM STATEMENT: Please refer to Officer Colantuono's supplemental report for his statement. WITNESS STATEMENT: Officer Perez and Officer Lopez contacted two Panda Express employees who witnessed the incident. Please refer to Officer Lopez and Officer Perez' supplemental reports for witness statements. Officer Nanez contacted a Sun Bus driver at the scene and Sun Bus occupants. OFFICER STATEMENT: Upon arrival to the scene, Officer Colantuono and I contacted a Panda Express employee who stated that a male subject had been locked inside the men's bathroom for approximately one hour and he was refusing to leave the location. Officer Colantuono knocked on the bathroom door and said, "Police, open the door." The door opened and a Hispanic male adult appeared (later identified as Alan Pimentel Quevedo). I asked Quevedo what he was doing and he stated that he was sleeping and he was trying to stay away from the cold. I told Quevedo that the Panda Express employees did not want him there and he could not be sleeping inside the bathroom. Quevedo stated that he understood and picked up some belonging from the bathroom floor. I asked Quevedo to sit on one of the restaurant chairs and he did. He was wearing grey zip up sweater and tan pants. I asked Quevedo for his name and date of birth and he stated that his name was Martin Martinez Zepeda with a date of birth of 5/20/98. 1 provided the name to dispatch for a records check. I spoke to Quevedo while I waited for a return from dispatch. Quevedo stated that he was homeless in Palm Springs. He stated that he lived in Indio with his parents, but he had been "Kicked out" and he had been in Palm Springs for approximately two weeks. Quevedo spoke in a slow soft voice and answered all my questions for the most part. PSPD dispatch advised they were unable to locate anyone by the name Quevedo had provided. While Quevedo spoke to me, he began reaching inside his purse. Based on the fact that I did not know what was inside the purse, I told Quevedo not to reach inside the purse and to keep his hands where I could see them. I asked Quevedo if he had any weapons or anything illegal inside the purse or on his person and Quevedo stated that he did not. I asked Quevedo if I could search his purse and Quevedo took off his purse from around his neck and gave it to me as he consented to a search. I searched the purse and did not locate any weapons or anything illegal inside. Based on the fact that dispatch could not find a match on the name Quevedo initially provided for me, I asked him if he had identification. I specifically instructed Quevedo not to reach inside his pockets to retrieve anything unless I told him to. Quevedo began reaching inside both of his pant pockets and I told him again not to reach inside his pockets. Based on the fact that Quevedo had not been properly identified and he wanted to reach inside his pockets even after I repeatedly asked him not to, I decided to conduct a pat down of Quevedo for weapons. As I instructed Quevedo to stand up, I reached for his left arm and grabbed it to prevent him from reaching inside his pocket and potentially retrieving a weapon. I began my pat down of Quevedo's right side. As I conducted my pat down, I kept telling Quevedo to keep his fingers interlocked as he was attempting to slowly release and separate his hands from my grip. Quevedo also moved from side to side and wanted to bend at his waist. Based on my training and experience, I know these are all signs of someone who might be getting ready to break free, flee or fight. After completing a pat down of Quevedo's right side, I transitioned to his left side. Quevedo took one step to his right and one step back. This movement of Quevedo's body was a good indicator that he was attempting to break free from my grip and he was trying to get away. I placed my left hand around his left shoulder .. At this time, I knew that there was a good possibility if Quevedo broke loose from my grip, he would have a better chance of escaping so I used my left leg to sweep Quevedo's left leg from under him. Quevedo fell backwards and landed on his side and then onto his stomach. I immediately tried to gain control of Quevedo's upper body while Officer Colantuono gained control of Quevedo's legs. As we struggled to maintain control of Quevedo on the ground, Quevedo used his brute force and began lifting his body off the ground. Quevedo was able to get back on his feet and he attempted to pull his arms away from us and flee on foot. I advised dispatch that Officer Colantuono and I were in a physical altercation with Quevedo at that time. Quevedo was able to break free from Officer Colantuono and I and began running towards the door on the south portion of the restaurant. Officer Colantuono was able to reach Quevedo before he got to the doors and they both fell down to the ground. As I approached Officer Colantuono and Quevedo, I saw Officer Colantuono holding on to Quevedo. Quevedo was actively resisting and attempting to free himself. I began to walk closer and closer to Quevedo and I drew my straight stick baton. I told Quevedo to get on the ground and stop resisting. Quevedo continued to swing his elbows from side to side and did not comply with my commands. I positioned my baton in the upper cradle and I closed the distance between us. At this point, Quevedo was facing me and he was on top of Officer Colantuono. I struck Quevedo's left leg once with my baton in the knee/shin area. The baton strike did not have an effect on Quevedo, which caused me to believe that he was unable to feel any pain. I holstered my baton and before I could get to Quevedo, Quevedo got up onto his feet and began running towards the north east door. Officer Colantuono and I gave chase. Quevedo exited the east door and began running east toward S. Sunrise Way. Officer Colantuono was able to catch up to Quevedo and he grabbed Quevedo's legs. This caused both Quevedo and Officer Colantuono to fall to the ground in the #2 lane of S. Sunrise Way. While Officer Colantuono controlled Quevedo's lower body and legs, I again drew my baton and struck Quevedo in the left arm one time. I did not get any reaction from Quevedo and I continued to instruct him to stop resisting. I put my baton away and attempted to gain control of Quevedo's arms and upper body. I attempted to gain control of Quevedo's arms, but Quevedo moved his body from side to side in an attempt to escape. With my left arm wrapped around Quevedo's neck, I used my right closed fist to punch Quevedo's face. I punched Quevedo three separate times on the right side of his face in an effort to gain his compliance and I continued to yell at him to stop resisting. I was able to gain control of Quevedo's left arm and pinned it to the ground. Based on the fact that Quevedo was actively resisting and attempting to get away, the fact that he was not listening to any of our commands to stop resisting and the fact that the baton strikes and punches to his face were not effective and pain compliance was not present, I attempted to place Quevedo in a carotid restraint hold. The carotid restraint hold was successful and Quevedo was rendered unconscious at approximately 2154 hours. Additional units arrived on scene and assisted with handcuffing Quevedo. Sgt. Hackbarth was on scene at the time Quevedo was rendered unconscious. The paramedics were called immediately for treatment of Quevedo. While waiting for the paramedics, Officer Arden and Officer Delgado stood by with Quevedo. Quevedo was breathing and had a pulse, but he was not responding to any of us on scene. The paramedics arrived on scene at approximately 2200 hours and transported Quevedo to Desert Regional Medical Center for further treatment. Officer Mosley arrived on scene and contacted an employee at Panda Express. Officer Mosley took photographs of the crime scene and collected video footage of the incident inside the restaurant. For additional information, please refer to Officer Mosley's supplemental report. Officer Perez, Officer Lopez and Officer Nanez assisted with witness statements at the scene. Officer Arden was able to identify Quevedo through tattoos and a DMV photo. A records check of Quevedo revealed he had a no bail warrant for a parole hold (Warrant# BPR1801370). Quevedo was also found to be on active Parole for PC 69. For additional information, please refer to Officer Arden's supplemental report. Officer Arden also stood by with Quevedo at the hospital and documented Quevedo's injuries sustained during the incident. Officer Colantuono was treated at Desert Regional Medical Center for his injuries and he was later released without further incident. Based on the fact that Quevedo provided me with a false name, resisted arrest, and had a felony warrant, I placed him in custody per PC 69 - Resisting an Executive Officer, PC 148.9 - Providing false information to a peace officer and the felony warrant. Quevedo was also placed in custody for PC 3056 - Parole hold. EVIDENCE: I placed two small plastic containers belonging to Quevedo into safekeeping at PSPD. The containers contained a small amount of marijuana in them. ADDITIONAL INFORMATION: At approximately 0541 hours, Officer Arden transported Quevedo from Desert Regional Medical Center to PSPD for booking. Quevedo has an extensive criminal record that includes contacts for assault with a deadly weapon, obstruct a public officer, thefts and stolen vehicles, and obstruct and resist and executive officer among other violent contacts. The male was later identified as Adan Pimentel Quevedo by Cal ID and his tattoos. When I arrived at the location, officers already had Quevedo detained in handcuffs and AMR had been notified to respond to the location. I was tasked with attaining statements from the employees inside the business. I went inside the business and made contact with��who identified himself to me verbally. The following is a brief summary of his statement: told me that he was in the back preparing the business for closing when he was advised by other employees at the location that a subject, later identified as Adan Pimentel Quevedo, had locked himself in the bathroom and refused to come out. -told me he went to the bathroom door and tried the doorknob but it was locked. � told me he got down on the floor and looked through the small space between the bottom of the door and the floor. � told me all he could see was a pair of shoes pacing back and forth in the restroom.�told me he asked Pimentel to open the restroom door and come out because they needed to close the business for the night. told me Quevedo did not respond so he went and told the business manager that Quevedo refused to come out of the restroom. �could not provide me any additional information about the incident. NARRATIVE SOURCE: On November 13, 2018, 1 was working uniformed patrol, in marked unit #39, in the City of Palm Springs, in the County of Riverside. At approximately 2151 hours, I responded to 425 S. Sunrise Way, in reference to Palm Springs Police Officers being involved in a physical altercation at the location. OFFICER STATEMENT: Once I heard an officer communicate over the radio that they were in a physical altercation, I responded with my audible siren and full overhead red and blue lights activated from the area of N. Civic Dr. and E. Alejo Rd. Once I arrived at the location, I observed Sergeant Hackbarth, Officer Jimenez, and Officer Colantuono attempting to physically restrain the subject, who was later identified as Adan Pimentel Quevedo by tattoos, and a CA DMV photograph that was sent to my PSPD department issued email from dispatch. I made contact with the two officers and the Sergeant. I began to assist in controlling Quevedo's right hand. Officer Jimenez appeared to be attempting a Carotid control hold on Quevedo. At this point, Quevedo was actively resisting. His right arm was under his chest with his right hand on the left side of his body as he was laying on his stomach. At one point, Quevedo was even attempting to squeeze my left hand with his right hand. A short time later, I heard Officer Jimenez say "He's out." Based on my training and experience, I believed that Officer Jimenez was able to successfully apply the carotid control hold and render Quevedo unconscious. Shortly thereafter, Officer Jimenez, Officer Colantuono and Sergeant Hackbarth were able to apply handcuffs to the subject. Officer Delgado was on scene at this time. He assisted me with rolling Quevedo onto his left side. I immediately checked his brachial artery and located a pulse. I also watched his chest rise and fall as an indicator that he was breathing. I continuously monitored his pulse and breathing until AMR and PSFD arrived on scene. Once they were on scene, AMR employee (identified verbally) was notified that Quevedo had the carotid control hold applied. NARRATIVE handcuffs were removed and his arms and legs were placed into soft restraints on the gurney by AMR staff. At this point, Quevedo was still seemingly unconscious. A short time later, Officer Colantuono and I followed the AMR unit containing Quevedo to Desert Regional Medical Center (DRMC). Once at DRMC, medical staff, including Nurse and Doctor were notified that Quevedo had the carotid control hold applied to him. As Quevedo received medical treatment, I used gloved hands and my Palm Springs Police Department issued digital camera to take photographs of Officer Jimenez's uniform, and Officer Colantuono's uniform and injuries. Officer Colantuono complained of pain to his left knee. It was slightly red and appeared to be swollen. He also had a small amount of blood on the left side of his nose, and appeared to have a slight abrasion to the inside of his lower lip. His uniform was dirty, had blood on the left arm sleeve of his uniform and his "SWAT" pin had been partially removed from his uniform over his right breast uniform pocket. (Refer to digital photographs, and Officer Colantuono's supplemental report for additional information). Officer Jimenez's uniform was dirty, but he did not appear to have any visible injuries other than what he told me was a "Splinter hemorrhage" on his left middle finger nail (Refer to digital photographs for details). I then took photographs of the visible injuries sustained on Quevedo. Quevedo had minor abrasions to the top of his left hand, the lower part of his chin, and redness to his nose. He had redness on the top of his right upper eye lid, and swelling above his right eye. He had what appeared to be blood inside of his nostrils, and around his lips. It was unknown if he had any injuries inside of his mouth at the time. Quevedo also suffered an approximate 1 inch in diameter abrasion under his left knee, and an approximate 3 inch scratch below his left knee. Quevedo also appeared to have several small abrasions on his right knee, right hand, right wrist, and right elbow. NARRATIVE older injuries on the left side of his stomach (very small scabbed over scratches), several scars on his left shoulder, and the top of his right hand. Refer to digital photographs for additional information regarding Pimentel's injuries. We were unable to identify Quevedo as he did not have any identification on him. However, I was able to provide Dispatch the description of several tattoos he had on his body, one of which was "PIMENTEL" on his left forearm (refer to digital photographs for details). Dispatch used this information to provide me a CA DMV photo of Quevedo, which enabled us to identify him. Quevedo remained unresponsive while at the hospital while he was receiving medical treatment. While at the hospital, Quevedo's arms and legs were placed in soft restraints by hospital staff in case he decided to be uncooperative again as he had already fought and/injured two officers. At approximately 0215 hours, Transport Officer Ortiz arrived to DRMC, and shortly thereafter, DRMC staff had completed an "Ok to book" for Quevedo. Quevedo was responding to different stimuli DRMC staff was administering from him. Transport Officer Ortiz and I applied handcuffs and leg restraints to Quevedo as well as a hospital gown, in hopes he would begin to respond to us and we could attempt to transport him to jail for booking. However, Quevedo would still not respond to us and would only make groaning noises. He opened his eyes several times and appeared to be awake, but he continued to not cooperate. It is my opinion that Quevedo was pretending to be sleeping as he did not want to cooperate with us since he knew he was going to be transported to jail. Transport Officer Ortiz remained at DRMC with Quevedo. Officer Jimenez brought the necessary booking paper work to DRMC. Eventually, DRMC staff were able to use a cold and wet wash cloth on Quevedo's body to wake him up. NARRATIVE November 14, 2018, at approximately 0541 hours, Quevedo became cooperative enough that I was able to transport him to the Police Department. Once at the Police Department, Quevedo was able to put enough weight on his legs to hop into the jail holding area. Shortly thereafter, Transport Officer Ingram arrived to the police department. I notified him that the carotid control hold was applied. Transport Officer Ingram later transported Quevedo to the Banning Jail after receiving an additional "Ok to book" for him regarding the complaint of pain to his knees. Once Transport Officer Ingram booked him at the Banning Jail, Transport Officer Ingram notified the on duty nurse as well as Riverside County Correctional Deputy Gilbert (ID# N5718) that the carotid control hold had been applied to Quevedo. Quevedo was booked without further incident. I later booked the digital photographs I took into the evidence folder on the computers in the report writhing room. At about 2137 hours Officer Jimenez and I were dispatched to 425 South Sunrise Way H1 (Panda Express) reference a male subject who locked himself in the restroom. OFFICER'S STATEMENT: Officer Jimenez and I arrived on -scene at about 2140 hours and contacted Panda Express Employee who stated a possible homeless male locked himself in the bathroom for the past hour. The employee further stated the business was closing and they needed him out of the bathroom and advised not to return. After receiving a brief statement from the employee Officer Jimenez and I knocked on the bathroom door identifying ourselves as Police Officers. After a few seconds a Hispanic male adult, wearing a baggie grey zip -up jacket, and tan pants opened the door and willingly exited out of the bathroom. Officer Jimenez spoke with the subject who verbally identified himself as Martin Martinez Zepeda (05/20/1998). Officer Jimenez provided the information in which Zepeda provided to him to dispatch. Subsequent records revealed no match or contacts with the name provided. While Officer Jimenez continued his investigation, I noticed that Zepeda spoke in a slow, soft tone of voice and had trouble following directions; such as not placing his hands inside his pockets or his purse which he had slung across his chest allowing free unobstructed immediate access. This behavior in which Zepeda displayed immediately caused my officer safety awareness to become heightened since dispatch was unable to locate a match on Zepeda, which based on my training and experience has shown me that the subject is lying about his name and the fact that Zepeda continued reaching around his person after being told multiple times not to. While still sitting on the chair to the business, Officer Jimenez began searching Zepeda's purse. Once he completed that search Officer Jimenez requested Zepeda to stand up and placed him in the department approved and taught standing modified search. As Officer Jimenez was conducting his search, I noticed Zepeda continued to move side to side, bending at the waist, and arching his back. I heard Officer Jimenez tell Zepeda to, "Stop moving, and interlock his fingers together." Once Officer Jimenez completed a systematic search of Zepeda's right side, he transitioned over to Zepeda's left side and began his systematic search. While searching his upper torso, I noticed that Zepeda took one step to his right and one step back, as to escape from Officer Jimenez's control. Fearing that Zepeda was going to engage in a physical altercation with Officer Jimenez I assisted by grabbing a hold of Zepeda's right arm and upper torso. While maintaining control, Zepeda continued to struggle, by attempting to free himself from our grasp and pushing his body forward as though he was attempting knock us down. Officer Jimenez and I were able to overcome such resistance and push Zepeda backwards causing him to lose his balance and fall face down towards the tile floor. Once all of us were on the floor, Officer Jimenez maintained control on his upper back and I took control of his legs. While holding Zepeda down and requesting assistance of additional units, Zepeda used his brute force, and in a push up style, lifted both Officer Jimenez and I off his person, allowing Zepeda to get back to his feet. While on his feet I grabbed a hold of Zepeda's left arm and Officer Jimenez grabbed a hold his right arm. Zepeda continued to fight with both Officer Jimenez and I as he attempted to pull his arms away and flee on foot. Noticing this behavior I attempted to complete a department approved/taught arm -bar take down which yielded negative results. With the unsuccessful attempt of getting him back to the ground Zepeda broke free and ran across the restaurant floor towards the south entry/exit single swing glass door. Zepeda began to swing his elbows side to side multiple times causing me to get struck once in the lower lip. I attempted to maintain control of Zepeda's movement as Officer Jimenez attempted to gain compliance. Zepeda continued to struggle which caused me to lose my grasp once more. Upon being free from my grasp, Zepeda sprang to his feet, and began running back towards the east door entry/exit single swing glass door. I again gave chase as Zepeda exited out the door and made his way towards South Sunrise Way. I caught up to Zepeda as his was approximately 10 feet away from the door. Once I was within arm's reach, I dove towards him, grabbing a hold of both Zepeda's legs. This caused both Zepeda and I to fall swiftly and violently towards the asphalt ground and into the #2 lane of South Sunrise Way. Once on the ground I maintained a hold of Zepeda's legs and Officer Jimenez grabbed a hold of his upper back. Zepeda again attempted to free himself from our grasp by moving side to side and pushing his body up. As Zepeda was doing so I could hear Officer Jimenez yell, multiple times, "Stop Resisting Stop Resisting!" Zepeda refused to comply and continued to fight with both Officer Jimenez and I in the middle of the roadway. Additional Officers arrived on -scene at which time Zepeda was detained in handcuffs. Due to the violent struggle and the force options which were used Zepeda was transported to Desert Regional Medical Center to obtain an "Okay to Book." While at Desert Regional Medical Center, I was medically examined and cleared by Doctor _due to complaint of swelling, redness, and pain to my left knee during the violent struggle with Zepeda. Officer Jimenez and Officer Colantuono were at Panda Express (425 S. Sunrise Way 111) reference a male subject who locked himself in the restroom. I heard Officer Jimenez call out a that they were in a physical altercation with the subject in question. OFFICER STATEMENT: Upon my arrival, I went inside Panda Express to check for evidence and witnesses. I spoke with employee/witness, -- by the cash register. I asked - if she could tell me what had occurred and the following is a summary of what she told me. � told me she was working in uniform at Panda Express. said a black male adult had locked himself in the bathroom. _stated she knocked on the bathroom door several times and asked the male to leave the bathroom which he refused. I called the listed number for Sunbus Transit (760�, but got sent to voicemail. I left a voicemail identifying myself as Palm Springs Police Detective, and requested a call back reference video surveillance from SUNBUS#623. At the time of this writing, I have not received a call back from Sunbus Transit. I will complete a Supplemental Report when Sunbus Transit returns my call reference surveillance footage. I completed the necessary paperwork and forwarded this case to the Riverside County District Attorney's Office for review.
