(NK) FROM: Department of Planning Services SUMMARY: This is a request for the approval of a one (1)-year Extension of Time application for an approved Major Development Permit application and a Major Architectural Review application (Case 3.2802 MAJ) for the construction of a 61,704-square-foot self-storage facility which includes a 912-square-foot leasing office on a 3.55-acre undeveloped parcel. The Major Development Permit application was approved by the Planning Commission on March 9, 2022, and the Major Architectural Reivew application was later approved by the Architectural Review Committee (ARC) on July 5, 2022 subject to conditions of approval. One of the conditions required an additional review by an ARC subcommittee, which was completed on November 3, 2022. In accordance with Palm Springs Zoning Code (PSZC) Section 94.04.00(E), the effective date of the application approval is July 20, 2022, and the entitlements are due to expire on July 20, 2024. An extension of time may be granted pursuant to the requirements of PSZC Section 94.12.00 (Extension of Time) per PSZC Sections 94.04.00(H)(2) and 94.04.01(G)(2). RECOMMENDATION: Approve the one (1)-year Extension of Time through July 20, 2025. Planning Commission Staff Report June 26, 2024 – Page 2 of 8 Case No. EOT-2024-0004 BUSINESS PRINCIPAL DISCLOSURE: The subject property is owned by NWB Palm Springs, LLC. A copy of the Public Integrity Disclosure Form is attached to this staff report (Attachment 5). PROJECT DESCRIPTION: The project is approved for the development of a 61,704-square-foot self-storage facility on a 3.55-acre undeveloped parcel located at the northeast corner of North Gene Autry Trail and Tamarisk Road, immediately north of the former Desert Sun building. The site abuts the Escena community on its north and east sides. The approved self-storage facility is 20 feet in height, and it includes a 912-square-foot leasing office. The site is designed with covered loading and parking areas on the north elevation, an RV and boat parking area, gates, and perimeter landscaping. The primary access to the site is provided on the Tamarisk Road frontage, which allows two-way and emergency vehicle access. Additionally, the site is designed with a one-way exit on the North Gene Autry Trail frontage. An aerial view of the site and its vicinity is attached to this staff report (Attachment 2). A Major Development Permit application was approved by the Planning Commission on March 9, 2022 (Attachments 6 & 9). The Architectural Review Committee (ARC) approved a Major Architectural Review application on July 5, 2022, and an ARC subcommittee review was completed on November 3, 2022. The final approved plan set is attached to this staff report (Attachment 10). In accordance with Palm Springs Zoning Code (PSZC) Section 94.04.00(E), the effective date of the application approval is July 20, 2022, and the entitlements are due to expire on July 20, 2024. The applicant is seeking one (1)-year Extension of Time to commence construction. According to the justification letter, the project was delayed due to industry-wide team member retention issue, in addition to a prolonged engineering value analysis process which involved applicant’s team to explore possible design alternatives and engineering approaches. The applicant is not proposing any changes to the approved plans. The justification letter is attached to this staff report (Attachment 4), and the applicant’s request for the Extension of Time is further analyzed in the analysis section of this staff report (page 4). In order to clear the plan check, the building pad has to be installed and certified. At the time of writing this staff report, the applicant is about to obtain a grading permit to commence building pad installation. Following the building pad certification and the issuance of a building permit, the project will proceed to building and site construction. The building pad installation and certification process is anticipated to be completed in July of 2024. In the justification letter (Attachment 4), the applicant states that project team retention issues and a prolonged engineering value analysis process delayed the project. The applicant notes in the justification letter that “With recent workforce conditions in the architecture and engineering fields, it has proven challenging to maintain a consistent design team.” According to the applicant, this condition was further exacerbated by conducting an engineering value analysis to possibly reduce the construction cost, which involved the exploration of possible design alternatives and engineering approaches. While the applicant’s team ultimately decided not to make any changes to the approved plans, the exploratory process was time-consuming and contributed to the delay of the project as well. Palm Springs Zoning Code Section 94.12.00(D)(7) states extenuating circumstances that are out of the applicants’ control, excluding “financial inability and market conditions”, must be present to justify granting an extension of time. Staff believes that the challenge and delay caused by the industry-wide project team retention issue was an unforeseen circumstance that was out of the applicant’s control. No changes have been proposed to the approved plans following the completion of the engineering value analysis, and the applicant has demonstrated its financial commitment to the project as exemplified by the submission of a $125,000 water connection fee to the Desert Water Agency (DWA). Considering above, the project meets the required findings as explained below. FINDINGS – EXTENSION OF TIME: Section 94.12.00(D) of the Palm Springs Zoning Code (PSZC) requires that the following conditions be met in order to justify an Extension of Time application. Staff has analyzed the findings as follows: 1. The requested extension of time is consistent with the General Plan and any applicable specific plan, and the proposed project remains consistent with those plans as they exist at the time the extension request is being considered. Planning Commission Staff Report June 26, 2024 – Page 5 of 8 Case No. EOT-2024-0004 The site’s General Plan land use designation is Industrial (IND), which is intended for various industrial service uses including storage and ancillary offices (Palm Springs 2007 General Plan, page 2-8). The approval of this Extension of Time application would allow the construction of a self-storage facility at the site, which is consistent with the intent of the Industrial (IND) General Plan land use designation area. The site is not located within a Specific Plan, and no changes are proposed to the previously approved plans. Therefore, the approval of this application meets this finding. 2. The findings made in support of the original approval remain valid and are still appropriate. The applicant is not proposing any modifications to the approved plans or the land uses intended for the site. Additionally, there have not been any changes to the physical environment of the site or its surroundings which would require the reassessment of the previously-made findings. Therefore, the findings made for the approval of the original entitlement are still valid and appropriate, and the approval of the Extension of Time application would meet this requirement. 3. There have been no significant changes to the proposed project, or to areas within the geographic proximity of the proposed project that negates the appropriateness of the project, or new information concerning new or substantially more severe environmental effects which would require a reevaluation of the project under the California Environmental Quality Act (CEQA). The applicant is not proposing any changes to the approved plans. The proposed self-storage facility and ancillary office uses are permitted by right in the M-1-P Zone per Palm Springs Zoning Code Sections 92.16.01(A)(8) and (3)(j). The site design conforms to the M-1-P Zone development standards, and the project did not require any relief or deviations from the applicable zoning regulations (e.g. Administrative Minor Modification, Variance). The project was deemed categorically exempt from the CEQA review pursuant to Section 15332 of Tile 14, Chapter 3 of the California Code of Regulations (Class 32, In-Fill Development). Finally, staff has not observed any changes to the environment of the project site or its vicinity, which would necessitate the reevaluation of the CEQA determination or question the appropriateness of the project. Hence, this required finding is met. 4. The subject site has been properly maintained in accordance with the Property Maintenance Standards of this Title: At the most recent site visit (June 10, 2024), staff confirmed that the project site was properly maintained and was in conformance with the Property Maintenance Standards (Palm Springs Zoning Code Section 93.19.00). Therefore, the project meets this finding. 5. The applicant has demonstrated convincingly and clearly that the project will be Planning Commission Staff Report June 26, 2024 – Page 6 of 8 Case No. EOT-2024-0004 substantially underway within the extended period. While the project faced the industry-wide challenge of team member retention, the applicant currently has a stable and reliable team to implement the next phase of the project as demonstrated by the most recent steady progress of the project. The project is in plan check for a building permit, and the applicant is ready to obtain a grading permit to commence building pad installation. Following the building pad certification and building permit issuance, the applicant will be permitted to proceed to building construction. The building pad installation and certification process is anticipated to be completed in July of 2024, and the approval of a one-year extension of time is adequate for the applicant to demonstrate substantial progress. 6. The applicant has made reasonable, substantial and timely efforts to exercise the entitlement and advance the project, such as, but not limited to, the pre-payment of impact fees or submittal of permit applications. As noted earlier in this staff report, the applicant applied for a building permit on October 17, 2022 and is making progress to complete that process and commence construction. The applicant has obtained a Caltrans encroachment permit to commence work along North Gene Autry Trail and has submitted a $125,000 water connection fee to the Desert Water Agency. Per a Department of Building & Safety policy, however, the applicant is unable to submit the development impact fees until the building permit is ready for issuance. This demonstrates that the applicant has made reasonable and substantial efforts to exercise the entitlement in spite of the logistical challenges. 7. Extenuating circumstances, not within the applicant’s control, (financial inability and market conditions excepted), have prevented the applicant from exercising the entitlement within the initial time period granted, but that such circumstances are more likely than not to be removed in time for the applicant to substantially begin the project within the extended period. Changes have been made to the project architects and engineers since the approval of the original entitlement. The industry-wide project team retention issue and the time required for searching for new team members and bringing the new members up to speed caused the project delay. This condition was further exacerbated by the time-consuming engineering value process. The applicant has demonstrated its financial commitment to the project as exemplified by the submission of a $125,000 water connection fee to the Desert Water Agency (DWA). Considering above, the project was neither delayed by financial inability nor market conditions. The building pad installation and certification process is anticipated to be completed in July of 2024, at which point the project is ready to proceed to the construction phase. Hence, the approval of the one-year extension of time is adequate for the applicant to commence and substantially advance in construction. Planning Commission Staff Report June 26, 2024 – Page 7 of 8 Case No. EOT-2024-0004 ENVIRONMENTAL ANALYSIS: The construction of the proposed self-storage facility is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15332 of Title 14, Chapter 3 of the California Code of Regulations (Class 32, In-Fill Development Projects). The project is consistent with the intent of the IND (Industrial) General Plan land use designation area and policies, as well as the intent and zoning regulations of the M-1-P (Planned Research and Development Park) Zone. The project site is less than five (5) acres in area, and it is fully located within the city limit and surrounded by urban uses. The project site is adjacent to the Palm Springs International Airport, and there is no value as habitat for endangered, rare, or threatened species. The implementation of the project will not result in any significant effects relating to noise, air quality, water quality, or traffic, as supported by the traffic impact assessment report the applicant previously submitted, which found that the traffic impact of the project would be less than significant. Finally, the site can be adequately served by all required utilities and public services. CONCLUSION: The applicant is seeking a one (1)-year Extension of Time for the construction of a previously approved 61,704-square-foot self-storage facility, which was delayed due to industry-wide project team retention issue and time-consuming engineering value analysis process. The applicant faced unforeseen circumstances that were out of its control and has demonstrated its commitment to the project by gradually moving forward with the project. This is exemplified by the obtainment of a Caltrans encroachment permit and the submission of a $125,000 water connection fee to the DWA. As stated in the staff report earlier, the applicant is ready to obtain a grading permit for building pad installation. The building pad installation and certification process is anticipated to be completed in July of 2024, at which point the applicant will be permitted to commence building and site construction. The applicant is not proposing any changes to the approved plans, and the extended time of one year is adequate for the applicant to substantially commence and advance in the next construction phase. Therefore, staff recommends that the Planning Commission approve the one (1)-year Extension of Time application, Case EOT-2024-0004, subject to the conditions of approval included in Exhibit A of the attached draft resolution (Attachment 3). EOT- 2024-0004). THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS: A. Jackson Main Architecture, on behalf of West Coast Self-Storage (“Applicant”), has filed an Extension of Time application, Case No. EOT -2024-0004, with the City of Palm Springs pursuant to Sections 94.04.00(H)(2), 94.04.01(G)(2) and 94.12.00 of the Palm Springs Zoning Code to extend the approval of Case 3.2802 MAJ, a Major Development Permit application and a Major Architectural Review application, for the construction of a new 61,704-square-foot self-storage facility (West Coast Self-Storage) on a 3.55-acre undeveloped parcel located at 890 North Gene Autry Trail (APN: 677 -260- 055). B. On March 9, 2022, the Planning Commission held a public meeting on the Major Development Permit application, Case 3.2802 MAJ, in accordance with applicable law. Subsequently, the Planning Commission voted 6-0-1 (Absent: Weremiuk) to approve the project subject to conditions of approval and adopted Resolution No. 6910. C. On April 4, 2022, the Architectural Review Committee (ARC) held a public meeting on the Major Architectural Review application, Case 3.2802 MAJ, in accordance with applicable law. Subsequently, the ARC voted unanimously for further study due to design concerns. D. On July 5, 2022, the Architectural Review Committee (ARC) reviewed the Major Architectural Review application, Case 3.3802 MAJ, in accordance with applicable law. Subsequently, the ARC voted unanimously to approve the application subject to conditions of approval and adopted Resolution No. 1012. One of the conditions of approval, PLN 18, required that an ARC subcommittee review and approve conditions of approval PLN 10 through PLN 17. E. On November 3, 2022, the ARC subcommittee confirmed that the project conforms with conditions of approval PLN 10 through PLN 17. F. On June 26, 2024, the Planning Commission held a public hearing in accordance Planning Commission Resolution No. June 26, 2024 Case No. EOT-2024-0004 – 890 North Gene Autry Trail Page 2 of 5 with applicable law to consider the Extension of Time application, Case No. EOT-2024- 0004. At said meeting, the Planning Commission carefully reviewed and considered all the evidence presented in connection with the Project, including, but not limited to, the staff report, and all written and oral testimony presented . G. Pursuant to Palm Springs Zoning Code (PSZC) Sections 94.04.01(G)(2), 94.04.00(H)(2), and 94.12.00(A), The Planning Commission may grant an Extension of Time request for a Major Development Permit application and a Major Architectural Review application pursuant to the requirements of PSZC Section 94.12.00. In determining that good cause exists for an extension of time, the Planning Commission is required to make the seven (7) findings stated in PSZC Section 94.12.00(D). Subsequently, the Planning Commission finds as follows: 1. The requested extension of time is consistent with the General Plan and any applicable specific plan, and the proposed project remains consistent with those plans as they exist at the time the extension request is being considered. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. SECTION 2. That the review of this Extension of Time application is considered a project under the definitions of the California Environmental Quality Act (CEQA). The construction of the proposed self-storage facility is categorically exempt from the CEQA pursuant to Section 15332 of Title 14, Chapter 3 of the California Code of Regulations (Class 32, In-Fill Development Projects). The project is consistent with the intent of the IND (Industrial) General Plan land use designation area and policies, as we ll as the intent and zoning regulations of the M-1-P (Planned Research and Development Park) Zone. That the Planning Commission hereby approves Case No. EOT- 2024-0004, Extension of Time, to extend the approval of Case No. 3.2802 MAJ by one (1) year for the construction of a new 61,704-square-foot self-storage facility (West Coast Self-Storage) on a 3.55-acre undeveloped parcel located at 890 North Gene Autry Trail (APN: 677-260-055), subject to the conditions of approval stated in Exhibit A of this resolution. ADOPTED this 26th day of June, 2024. EXHIBIT A West Coast Self-Storage 890 North Gene Autry Trail Case EOT-2024-0004 June 26, 2024 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer, Development Services Director, Building Official, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. ADMINISTRATIVE CONDITIONS ADM 1. Project Description. This approval is for the project described per Case 3.2802 MAJ; except as modified with the conditions below; ADM 2. Reference Documents. The site shall be developed and maintained in accordance with the approved plans including site plans, architectural elevations, exterior materials and colors, landscaping, and grading on file in the Planning Division except as modified by the approved Mitigation Measures and conditions below. ADM 3. Conform to all Codes and Regulations. The project shall conform to the conditions contained herein, all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, and any other City County, State and Federal Codes, ordinances, resolutions and laws that may apply. ADM 4. Minor Deviations. The Director of Planning or designee may approve minor deviations to the project description and approved plans in accordance with the provisions of the Palm Springs Zoning Code. ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 3.2802 MAJ. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 2 of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. ADM 6. Maintenance and Repair. The property owner(s) and successors and assignees in interest shall maintain and repair the improvements including and without limitation all structures, sidewalks, bikeways, parking areas, landscape, irrigation, lighting, signs, walls, and fences between the curb and property line, including sidewalk or bikeway easement areas that extend onto private property, in a first class condition, free from waste and debris, and in accordance with all applicable law, rules, ordinances and regulations of all federal, state, and local bodies and agencies having jurisdiction at the property owner’s sole expense. This condition shall be included in the recorded covenant agreement for the property if required by the City. ADM 7. Time Limit on Approval. Approval of the Major Architectural Application (MAJ) shall be valid for a period of two (2) years from the effective date of the approval. Extensions of time may be granted by the Planning Commission upon demonstration of good cause. ADM 8. Right to Appeal. Decisions of an administrative officer or agency of the City of Palm Springs may be appealed in accordance with Municipal Code Chapter 2.05. Permits will not be issued until the appeal period has concluded. ADM 9. Public Art Fees. This project shall be subject to Chapters 2.24 and 3.37 of the Municipal Code regarding public art. The project shall either provide public art or payment of an in-lieu fee. In the case of the in-lieu fee, the fee shall be based upon the total building permit valuation as calculated pursuant to the valuation table in the Uniform Building Code, the fee being 1/2% for commercial projects or 1/4% for residential projects with first $100,000 of total building permit valuation for individual single-family units exempt. Should the public art be located on the project site, said location shall be reviewed and approved by the Director of Planning and Zoning and the Public Arts Commission, and the property owner shall enter into a recorded agreement to maintain the art work and protect the public rights of access and viewing. ADM 10. Comply with City Noise Ordinance. This use shall comply with the provisions of Section 11.74 Noise Ordinance of the Palm Springs Municipal Code. Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 3 ENVIRONMENTAL ASSESSMENT CONDITIONS ENV 1. Coachella Valley Multiple-Species Habitat Conservation Plan (CVMSHCP) Local Development Mitigation Fee (LDMF) required. All projects within the City of Palm Springs, not within the Agua Caliente Band of Cahuilla Indians reservation are subject to payment of the CVMSHCP LDMF prior to the issuance of certificate of occupancy. ENV 2. California Fish & Game Fees Required. The project is required to file a Notice of Determination (NOD). Required filing fee shall be submitted by the City to the County Clerk with the Notice of Determination. Action on this application shall not be final until such a filing and fee is paid. ENV 3. Cultural Resource Survey Required. Prior to any ground disturbing activity, including clearing and grubbing, installation of utilities, and/or any construction related excavation, an Archaeologist qualified according to the Secretary of the Interior’s Standards and Guidelines, shall be employed to survey the area for the presence of cultural resources identifiable on the ground surface. ENV 4. Cultural Resource Site Monitoring. There is a possibility of buried cultural or Native American tribal resources on the site. A Native American Monitor shall be present during all ground-disturbing activities. (check for duplication in engineering conditions) a. The presence of an approved Agua Caliente Native American Cultural Resource Monitor(s) during any ground disturbing activities (including archaeological testing and surveys). Should buried cultural deposits be encountered, the Monitor may request that destructive construction halt and the Monitor shall notify a Qualified Archaeologist (Secretary of the Interior’s Standards and Guidelines) to investigate and, if necessary, prepare a mitigation plan for submission to the State Historic Preservation Officer and the Agua Caliente Tribal Historic Preservation Office. b. Two copies of any cultural resource documentation generated in connection with this project, including reports of investigations, record search results and site records/updates shall be forwarded to the Tribal Planning, Building, and Engineering Department and one copy to the City Planning Department prior to final inspection. PLANNING DEPARTMENT CONDITIONS PLN 1. Outdoor Lighting Conformance. Outdoor lighting shall fully conform to the requirements of Palm Springs Zoning Code and shall not produce disability Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 4 glare, discomfort glare, light trespass, and/or light pollution as defined in Palm Springs Zoning Cod Sections 93.21.00(A)(7), (8), (9), and (10). Additionally, the outdoor lighting shall conform to the requirement by the Riverside County Airport Land Use Commission (ALUC). Also see Condition ALUC 1. PLN 2. Water Efficient Landscaping Conformance. The project is subject to the Water Efficient Landscape Ordinance (Chapter 8.60.00) of the Palm Springs Municipal Code and all other water efficient landscape ordinances. The applicant shall submit a landscape and irrigation plan to the Director of Planning for review and approval prior to the issuance of a building permit. Landscape plans shall be wet stamped and approved by the Riverside County Agricultural Commissioner's Office prior to submittal. Prior to submittal to the City, landscape plans shall also be certified by the local water agency that they are in conformance with the water agency’s and the State’s Water Efficient Landscape Ordinances. PLN 3. Sign Applications Required. No signs are approved by this action. Separate approval and permits shall be required for all signs in accordance with Zoning Ordinance Section 93.20.00. PLN 4. Screen Roof-mounted Equipment. All roof mounted mechanical equipment shall be screened per the requirements of Section 93.03.00 of the Zoning Ordinance. PLN 5. Surface Mounted Downspouts Prohibited. No exterior downspouts shall be permitted on any facade on the proposed building(s) that are visible from adjacent streets or residential and commercial areas. PLN 6. Exterior Alarms & Audio Systems. No sirens, outside paging or any type of signalization will be permitted, except approved alarm systems. PLN 7. Outside Storage Prohibited. No outside storage of any kind shall be permitted except as approved as a part of the proposed plan. PLN 8. Final Landscape Plan. The plant materials and installation shall be satisfactory to the Riverside County Airport Land Use Commission and Palm Springs International Airport requirements. PLN 9. Riverside County Airport Land Use Commission (ALUC) Review. Applicant shall contact the ALUC to ensure that the proposed use is permitted and the project meets all the requirements imposed by the ALUC. PLN 10. Additional Planters Required. Install two (2) planters in the RV parking area on the north and east sides. PLN 11. Green Screen Plant Requirement. Install Caliandra for the green screens proposed on the primary (west) elevation. Replace Queen Palm with California Fan Palm with a variety of heights (at the time of installation). PLN 13. Lighting Fixture Operability. Limit or turn off lighting (east and north sides) during closing hours (time control – e.g. motion control). PLN 14. Lighting Fixture F05. Install glare shields on the light fixtures adjacent to the abutting residential development. PLN 15. Glazing Treatment Requirement. Apply tint or color to the glazing so that it is more compatible with the design of the building. PLN 16. Additional Plant Materials Required. Install additional plant materials (low- height trees, multi-trunk) on the west side of the sidewalk to enhance the parkway. PLN 17. General Requirement. Increase the plant size. Diversify the size and height of the proposed plant materials. PLN 18. Subcommittee Review Required. Conditions of Approval PLN 10 through PLN 17 shall be subject to review and approval by the ARC subcommittee, which consists of Member Lockyer and Member Doczi. RIVERSIDE COUNTY AIRPORT LAND USE COMMISSION (ALUC) CONDITIONS ALUC 1. Any new outdoor lighting that is installed shall be hooded or shielded so as to prevent either the spillage of lumens or reflection into the sky. Outdoor lighting shall be downward facing. ALUC 2. The following uses shall be prohibited: (a) Any use which would direct a steady light or flashing light of red, white, green, or amber colors associated with airport operations toward an aircraft engaged in an initial straight climb following takeoff or toward an aircraft engaged in a straight final approach toward a landing at an airport, other than an FAA-approved navigational signal light or visual approach slope indicator. (b) Any use which would cause sunlight to be reflected towards an aircraft engaged in an initial straight climb following takeoff or towards an aircraft engaged in a straight final approach towards a landing at an airport. Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 6 (c) Any use which would generate smoke or water vapor or which would attract large concentrations of birds, or which may otherwise affect safe air navigation within the area. Such uses include landscaping utilizing water features, aquaculture, outdoor production of cereal grains, sunflower, and row crops, composting operations, wastewater management facilities, artificial marshes, trash transfer stations that are open on one or more sides, recycling centers containing putrescible wastes, construction and demolition debris facilities, fly ash disposal, and incinerators. (d) Any use which would generate electrical interference that may be detrimental to the operation of aircraft and/or aircraft instrumentation. (e) Highly noise-sensitive outdoor nonresidential uses and hazards to flight. ALUC 3. The attached “Notice of Airport in Vicinity” shall be provided to all prospective purchasers and occupants of the property and be recorded as a deed notice. ALUC 4. Any proposed stormwater basins or facilities shall be designed and maintained to provide for a maximum 48-hour detention period following the design storm, and remain totally dry between rainfalls. Vegetation in and around the basins that would provide food or cover for birds would be incompatible with airport operations and shall not be utilized in project landscaping. Trees shall be spaced so as to prevent large expanses of contiguous canopy, when mature. Landscaping in and around the basin(s) shall not include trees or shrubs that produce seeds, fruits, or berries. Landscaping in the stormwater basin, if not rip-rap, should be in accordance with the guidance provided in ALUC “LANDSCAPING NEAR AIRPORTS” brochure, and the “AIRPORTS, WILDLIFE AND STORMWATER MANAGEMENT” brochure available at RCALUC.ORG which list acceptable plants from Riverside County Landscaping Guide 3 or other alternative landscaping as may be recommended by a qualified wildlife hazard biologist. A notice sign, in a form similar to that attached hereto, shall be permanently affixed to the stormwater basin with the following language: “There is an airport nearby. This stormwater basin is designed to hold stormwater for only 48 hours and not attract birds. Proper maintenance is necessary to avoid bird strikes”. The sign will also include the name, telephone number or other contact information of the person or entity responsible to monitor the stormwater basin. ALUC 5. This project has been evaluated as consisting of 60,204 square feet of storage area and 1,500 square feet of office area. Any increase in building area, change in use to any higher intensity use, change in building location, or modification of the tentative parcel map lot lines and areas will Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 7 require an amended review to evaluate consistency with the ALUCP criteria, at the discretion of the ALUC Director. ALUC 6. Buildings shall be limited to a maximum height of 20 feet and a maximum top point elevation of 485 feet above mean sea level unless a “Determination of No Hazard to Air Navigation” letter authorizing a higher top point elevation has been issued by the Federal Aviation Administration Obstruction Evaluation Service. BUILDING DIVISION CONDITIONS The Following Standard Building & Safety Conditions of Approval Are Applicable to This Project: BLDG 1. Separate permits are required for Site Walls, Trash Enclosures, Signs, PV (Photovoltaic), Construction Trailers. BLDG 2. Grading & ROW permits are to be issued by our Engineering Division. BLDG 3. Utilities on the utility side of any meter are to be arranged with the respective Utility Company. Any utilities after a meter will be included in the Building Departments scope of work for inspections. The Following Standard Building & Safety Conditions of Approval Are Applicable to This Project: General Conditions 1. Shall comply with the latest adopted edition of the following codes as applicable: A. 2019 California Building Code B. 2019 California Electrical Code C. 2019 California Mechanical Code D. 2019 California Plumbing Code E. 2019 California Energy Code F. 2019 California Fire Code G. 2019 California Green Building Standards Code 2. Any temporary building, trailer, commercial coach, etc. installed and/or used in connection with a construction project shall comply with City Code. 3. In addition to approval from Building & Safety, approval is required from the County of Riverside, Department of Public Health for occupancies involving fueling stations and foods and beverages. All exterior lighting shall be oriented, directed, and/or shielded as much as possible so that direct illumination does not infringe onto adjoining properties. 5. All development impact fees including but not limited to TUMF, CVMSHCP, Sewer Connection and Public Arts shall be paid at time of permit issuance. ENGINEERING DIVISION CONDITIONS: Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer. All Grading Plans, Improvement Plans, Required Studies and Documents listed below, must be submitted to Engineering Services Department for review and approval. STREETS ENG 1. Applicant shall obtain State permits and approval of plans for any work done on State Highway 111. A copy of an approved Caltrans encroachment permit shall be provided to the City Engineer prior to the issuance of any grading or building permits if there is any work being done in the public right-of-way on State Highway 111. GENE AUTRY TRAIL (HIGHWAY 111) ENG 2. Construct a 26 feet wide driveway approach in accordance with City of Palm Springs Standard Drawing No. 205 or Equivalent Caltrans Standards. Subject to Caltrans encroachment permit. ENG 3. Construct a meandering 12 feet wide combination sidewalk and bicycle path along the entire frontage per City of Palm Springs Standard Drawing No. 210 or Equivalent Caltrans Standards. The construction shall be with colored Portland cement concrete, with an admixture of Palm Springs Tan, Desert Sand, or approved equal color by the Engineering Services Department. Easements for pedestrian and bike path purposes shall be dedicated for those portions of the meandering sidewalk and bicycle path that extend onto private property. Subject to Caltrans encroachment permit. ENG 4. Remove and replace existing asphalt concrete pavement where required, in accordance with Caltrans standards. ENG 5. All broken or off grade street improvements along the project frontage shall be repaired or replaced. ON-SITE Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 9 ENG 6. The minimum pavement section for all on-site pavement (drive aisles, parking spaces) shall be 2-1/2 inches asphalt concrete pavement over 4 inches crushed miscellaneous base with a minimum subgrade of 24 inches at 95% relative compaction, or equal. If an alternative pavement section is proposed, the proposed pavement section shall be designed by a California registered Geotechnical Engineer using "R" values from the project site and submitted to the City Engineer for approval. ENG 7. The applicant shall demonstrate access rights across the adjacent property identified by Assessor’s Parcel Number (APN) 677-260-056. Proof of access rights shall be submitted to the City Engineer prior to approval of a grading plan. ENG 8. On-site drive aisles and parking lot shall be constructed with curbs, gutters, and cross-gutters, as necessary to accept and convey street surface drainage of the on-site streets to the on-site drainage system, in accordance with applicable City standards. SANITARY SEWER ENG 9. All sanitary facilities shall be connected to the public sewer system New laterals shall not be connected at manholes. Subject to Caltrans encroachment permit. GRADING ENG 10. Submit a Precise Grading Plan prepared by a California registered Civil engineer to the Engineering Services Department for review and approval. The Precise Grading Plan shall be approved by the City Engineer prior to issuance of grading permit. a. A Fugitive Dust Control Plan shall be prepared by the applicant and/or its grading contractor and submitted to the Engineering Services Department for review and approval. The applicant and/or its grading contractor shall be required to comply with Chapter 8.50 of the City of Palm Springs Municipal Code, and shall be required to utilize one or more “Coachella Valley Best Available Control Measures” as identified in the Coachella Valley Fugitive Dust Control Handbook for each fugitive dust source such that the applicable performance standards are met. The applicant’s or its contractor’s Fugitive Dust Control Plan shall be prepared by staff that has completed the South Coast Air Quality Management District (AQMD) Coachella Valley Fugitive Dust Control Class. The applicant and/or its grading contractor shall provide the Engineering Services Department with current and valid Certificate(s) of Completion from AQMD for staff that have completed the required training. For information on attending a Fugitive Dust Control Class and information on Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 10 the Coachella Valley Fugitive Dust Control Handbook and related “PM10” Dust Control issues, please contact AQMD at (909) 396-3752, or at http://www.AQMD.gov. A Fugitive Dust Control Plan, in conformance with the Coachella Valley Fugitive Dust Control Handbook, shall be submitted to and approved by the Engineering Services Department prior to approval of the Grading plan. b. The first submittal of the Grading Plan shall include the following information: a copy of final approved conformed copy of Conditions of Approval; a copy of a final approved conformed copy of the Site Plan; a copy of current Title Report; a copy of Soils Report; and a copy of the associated Hydrology Study/Report; a copy of the project-specific Final Water Quality Management Plan. ENG 11. Prior to approval of a Grading Plan (or issuance of a Grading Permit), the applicant shall obtain written approval to proceed with construction from the Agua Caliente Band of Cahuilla Indians, Tribal Historic Preservation Officer or Tribal Archaeologist ( a copy of the written approval must be provided to the City) . The applicant shall contact the Tribal Historic Preservation Officer or the Tribal Archaeologist at ACBCI- THPO@aguacaliente.net to determine their requirements, if any, associated with grading or other construction. The applicant is advised to contact the Tribal Historic Preservation Officer or Tribal Archaeologist as early as possible. If required, it is the responsibility of the applicant to coordinate scheduling of Tribal monitors during grading or other construction, and to arrange payment of any required fees associated with Tribal monitoring. ENG 12. In accordance with an approved PM-10 Dust Control Plan, temporary dust control perimeter fencing shall be installed. Fencing shall have screening that is tan in color; green screening will not be allowed. Temporary dust control perimeter fencing shall be installed after issuance of Grading Permit, and immediately prior to commencement of grading operations. ENG 13. Temporary dust control perimeter fence screening shall be appropriately maintained, as required by the City Engineer. Cuts (vents) made into the perimeter fence screening shall not be allowed. Perimeter fencing shall be adequately anchored into the ground to resist wind loading. ENG 14. Within 10 days of ceasing all construction activity and when construction activities are not scheduled to occur for at least 30 days, the disturbed areas on-site shall be permanently stabilized, in accordance with Palm Springs Municipal Code Section 8.50.022. Following stabilization of all disturbed areas, perimeter fencing shall be removed, as required by the City Engineer. Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 11 ENG 15. A Notice of Intent (NOI) to comply with the California General Construction Stormwater Permit (Water Quality Order 2009-0009-DWQ as modified September 2, 2009) is required for the proposed development via the California Regional Water Quality Control Board online SMARTS system. A copy of the executed letter issuing a Waste Discharge Identification (WDID) number shall be provided to the City Engineer prior to issuance of a grading or building permit. ENG 16. In accordance with City of Palm Springs Municipal Code, Section 8.50.022 (h), the applicant shall post with the City a cash bond of two thousand dollars ($2,000.00) per disturbed acre (if there is disturbance of 5,000 square feet or more) at the time of issuance of grading permit for mitigation measures for erosion/blowsand relating to this property and development. ENG 17. A Geotechnical/Soils Report prepared by a California registered Geotechnical Engineer shall be required for and incorporated as an integral part of the grading plan for the proposed development. A copy of the Geotechnical/Soils Report shall be submitted to the Engineering Services Department with the first submittal of a grading plan. ENG 18. The applicant shall provide Grading Certification for all building (or structure) pads in conformance with the approved grading plan to the Engineering Services Department for review and approval. ENG 19. In cooperation with the California Agricultural Commissioner and the California Department of Food and Agriculture Red Imported Fire Ant Project, applicants for grading permits involving a grading plan and involving the export of soil will be required to present a clearance document from a Department of Food and Agriculture representative in the form of an approved “Notification of Intent To Move Soil From or Within Quarantined Areas of Orange, Riverside, and Los Angeles Counties” (Revised - RIFA Form CA-1) prior to approval of the Grading Plan (if required). WATER QUALITY MANAGEMENT PLAN ENG 20. This project shall be required to install measures in accordance with applicable National Pollution Discharge Elimination System (NPDES) Best Management Practices (BMP’s) included as part of the NPDES Permit issued for the Whitewater River Region from the Colorado River Basin Regional Water Quality Control Board (RWQCB). The applicant is advised that installation of BMP’s, including mechanical or other means for pre-treating contaminated stormwater and non-stormwater runoff, shall be Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 12 required by regulations imposed by the RWQCB. It shall be the applicant’s responsibility to design and install appropriate BMP’s, in accordance with the NPDES Permit, that effectively intercept and pre-treat contaminated stormwater and non-stormwater runoff from the project site, prior to release to the City’s municipal separate storm sewer system (“MS4”), to the satisfaction of the City Engineer and the RWQCB. Such measures shall be designed and installed on-site; and provisions for perpetual maintenance of the measures shall be provided to the satisfaction of the City Engineer, including provisions in Covenants, Conditions, and Restrictions (CC&R’s) required for the development (if any). ENG 21. A Final Project-Specific Water Quality Management Plan (WQMP) shall be submitted to and approved by the City Engineer prior to issuance of a grading or building permit. The WQMP shall address the implementation of operational Best Management Practices (BMP’s) necessary to accommodate nuisance water and storm water runoff from within the underground parking garage and the on-site private drive aisles. Direct release of nuisance water to adjacent public streets is prohibited. Construction of operational BMP’s shall be incorporated into the Precise Grading and Paving Plan. ENG 22. Prior to issuance of any grading or building permits, the property owner shall record a “Covenant and Agreement” with the County-Clerk Recorder or other instrument on a standardized form to inform future property owners of the requirement to implement the approved Final Project- Specific Water Quality Management Plan (WQMP). Other alternative instruments for requiring implementation of the approved Final Project- Specific WQMP include: requiring the implementation of the Final Project- Specific WQMP in Home Owners Association or Property Owner Association Covenants, Conditions, and Restrictions (CC&Rs); formation of Landscape, Lighting and Maintenance Districts, Assessment Districts or Community Service Areas responsible for implementing the Final Project- Specific WQMP; or equivalent. Alternative instruments must be approved by the City Engineer prior to issuance of any grading or building permits. DRAINAGE ENG 23. All stormwater runoff passing through the site shall be accepted and conveyed across the property in a manner acceptable to the City Engineer. For all stormwater runoff falling on the site, on-site retention or other facilities approved by the City Engineer shall be required to contain the increased stormwater runoff generated by the development of the property. Provide a hydrology study to determine the volume of increased stormwater runoff due to development of the site, and to determine required stormwater runoff mitigation measures for the proposed Resolution No. June 26, 2024 Case EOT-2024-0004 – 890 North Gene Autry Trail 13 development. Final retention basin sizing and other stormwater runoff mitigation measures shall be determined upon review and approval of the hydrology study by the City Engineer and may require redesign or changes to site configuration or layout consistent with the findings of the final hydrology study. No more than 40-50% of the street frontage parkway/setback areas should be designed as retention basins. On-site open space, in conjunction with dry wells and other subsurface solutions should be considered as alternatives to using landscaped parkways for on-site retention. ENG 24. The project is subject to flood control and drainage implementation fees. The acreage drainage fee at the present time is $ 4608.16 per acre in accordance with Resolution No. 15189. Fees shall be paid prior to issuance of a building permit. GENERAL ENG 25. Any utility trenches or other excavations within existing asphalt concrete pavement of off-site streets required by the proposed development shall be backfilled and repaired in accordance with City of Palm Springs Standard Drawing No. 115. The developer shall be responsible for removing, grinding, paving and/or overlaying existing asphalt concrete pavement of off-site streets as required by and at the discretion of the City Engineer, including additional pavement repairs to pavement repairs made by utility companies for utilities installed for the benefit of the proposed development (i.e. Desert Water Agency, Southern California Edison, Southern California Gas Company, Time Warner, Verizon, Mission Springs Water District, etc.). Multiple excavations, trenches, and other street cuts within existing asphalt concrete pavement of off-site streets required by the proposed development may require complete grinding and asphalt concrete overlay of the affected off-site streets, at the discretion of the City Engineer. The pavement condition of the existing off-site streets shall be returned to a condition equal to or better than existed prior to construction of the proposed development. ENG 26. All proposed utility lines shall be installed underground. ENG 27. All existing utilities shall be shown on the improvement plans if required for the project. The existing and proposed service laterals shall be shown from the main line to the property line. ENG 28. Grading and site improvement permits only need one minor administrative form that is part of the PM-10 dust control permit and are otherwise ready for issuance. The only remaining component required to make the building permit ready for issuance is certification of the building pad. This pad preparation and certification process, per Public Works Department procedures, may exceed the entitlement period and is the reason for this request. Once the contractor selection is finalized and the PM-10 form is submitted, the grading and site permits will be pulled immediately in order for pad preparation to begin. Applicants are in the process of bidding for the work and construction will commence immediately after contractor selection. Construction is scheduled to begin July 2024. The developer typically waits until all substantial building permit review comments have been received and resolved before going out to bid to minimize construction contract change orders. The extended permit review cycles were among factors contributing to extended timeline for bidding and contractor selection. Once the permits were essentially ready for issuance, the project went out to bid on 05-01-2024. A typical bid duration is 4 weeks. GC contract will be awarded in mid-June with a start in early July 2024. 6. The applicant has made reasonable, substantial and timely efforts to exercise the entitlement and advance the project, such as, but not limited to, the pre-payment of impact fees or submittal of permit applications. Response: As noted in paragraph 5. All permits necessary to commence work are ready to be issued. The applicant has paid the $125,000 water connection fee to make connection in Gene Autry Trail and is prepared to pay remaining fees as they become payable. 7. Extenuating circumstances, not within the applicant's control, (financial inability and market conditions excepted), have prevented the applicant from exercising the entitlement within the initial time period granted, but that such circumstances are more likely than not to be removed in time for the applicant to substantially begin the project within the extended period. Building permits are ready to be obtained, however Public Works will not release the building permit until the building pad has been completed and certified per the City of Palm Springs Municipal Code. With recent workforce conditions in the architecture and engineering fields it has proven challenging to maintain a consistent design team. Since this project was entitled, we have had three different project architects and two different project civil engineers. Project handoffs and bringing new team members up to speed have proven time- consuming. This issue has been corrected and we expect to have consistency for the remainder of the project. Once the project was put out to bid, the bidders provided considerable potential value- engineering feedback. In turn, the developer prudently reconsidered the overall design and investigated potential alternative value engineering approaches and how these might impact previous entitlements, ARC design approvals and facility operations. Upon consideration of all factors the developer ultimately decided to continue with the project in its original configuration, however this VE analysis process did take some time.
