HomeMy WebLinkAbout2B - PresentationSerena Park Development Agreement Amendment City Council Agenda Item #2B Case #DA -2024-0002 June 13, 2024 P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 1 Background: •Project involves 386 -unit attached and detached single-family homes over 126 -acre site •Entitlements involved General Plan Amendment, Planned Development District, Tentative Tract Map approved 09/07/16 •Project approvals conditioned upon the processing of a Development Agreement P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 2 Serena Park San Rafael SunriseVerona Whitewater Club Racquet Club Francis 2B - 3 Development Agreement: •7/19/17 – Development Agreement Approved •10/17/18 – Amended Development Agreement to revise payment requirements for DA Fee •10/14/21 – Amended Development Agreement to revise Performance Schedule, DA Fee due dates & memorialize phasing of utility undergrounding •9/21/22 – City notified owner of default P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 4 Request: •Revised Performance Schedule •Increased Development Agreement Fee •Memorialize maintenance & security obligations •City to cooperate in community facilities district financing of public infrastructure and development impact fees P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 5 Process: •Amendments to Development Agreements require same process as approving such applications •Planning Commission to make recommendation to City Council, after holding public hearing •Five findings required P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 6 Planning Commission Review: •On 5/22, the Commission held a public hearing and recommended approval to Council, subject to: 1.Modifying agreement to address to address the following: Maintenance and security requirements •An initial clean-up of site w/in one month •The hiring of an arborist to evaluate trees w/removal of certain trees w/in 4 mos. •Dust sealant may be applied more frequently than annually, if deemed necessary •Developer responsible for fixing broken cameras w/in 7 days (developer requests 10 days) Performance Schedule •Change milestones from "Ready to record...lots" to "Record...lots" (developer opposed) •Include milestone for improvement of Golden Sands Rd w/sidewalk to mobile homes during phase 1 •Include improvement of Park in Phase 1 2.Recommend 3rd access point for the project be provided P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 7 Recommendation: •Find that proposed agreement meets criteria: 1.Is consistent with General Plan 2.Is compatible with uses authorized 3.Is in conformity with public convenience, general welfare & good land use practice 4.Will not be detrimental to health, safety, and general welfare 5.Will not adversely affect the orderly development of property or the preservation of property values •Approve the proposed amendment by introducing ordinance amending Section 94.08.09 •Authorize City Manager to execute agreement P L A N N I N G S E R V I C E S DEPARTMEN T 2B - 8
