Dear City Clerk, This was sent in regards to an item on the agenda for
Thursday, June 14th's city council meeting. It is URGENT business. Please
see that the parties listed here receive this email.
Jeffrey, Christy and Lisa, Hope you are all well and ready for whatever
surprises the sweaty heat of summer may bring our way this year.
Larry and I are good and busy as can be.
I am writing to you all now in regards to an issue that has both Larry and I
perplexed and very concerned and we have some questions
we hope you can address.
Why is the city proposing a bridge and water control project in our area? As
you likely know, we live off Bogert Trail and South Palm Canyon in the most
peaceful and wonderfully environmentally safe area of South Palm Springs.
We have fought hard to keep it that way. We battled with developers for five
years and raised over 7 million dollars to protect the Oswit Canyon area
here from any kind of future development, not just for the 27 varieties of
endangered mammals and bird species that make the area their habitat in
our awesome 10,000 year old alluvial fan, but, for our sanity, as well.
Several years ago we got the Oswit Canyon area declared
"environmentally protected" and won the right to keep it safe from
development - forever. How is this proposed project even on your agenda?
What could possibly be the justification for building such a thing? Why do

we need it? Originally, something of this nature was proposed to deal with
all the plumbing and water that would be going into and out of the 260
homes that were (shamefully) going to be built in that canyon area, but
that's not happening anymore, and we have not had ANY major flooding
issues over there in.... well, never. We have a huge wash area set-up to
handle any flooding and even that hasn't been full since we moved here
almost a dozen years ago. Even during two small flood events that occured
(I am told) in 2005, emergency vehicles were still able to get through quite
easily and none of the water in question at that time was flowing from Oswit
Canyon. There was just a lot of rain in our streets. Why does this behemoth
project, which they predict will last for over 24 months, need to be?
Also, it's disconcerting that something like this got this far without more
discussion from the neighbors it would affect, and why such an important
neighborhood decision, (which would affect traffic, noise and dust levels and
property values for two to three years, while destroying over three acres of
wildlife habitat) was scheduled for discussion and possible a vote by the city
council at a time of the year when so many residents take off to escape the
summer heat and therefore cannot weigh in with their opinions or
objections. That looks a bit suspect, don't ya think?
It is our belief that there is absolutely no good reason to dole out 8.5
million of our city's always starving budget to build this contraption and we
want to know why it's even being proposed?
Can any of you help shed some light on this issue for us?

Dear Members of the Palm Springs City Council,
My name is Olivia Johnson and I am a born and raised member of the Coachella
Valley. It has been brought to my attention that the city is proposing a large
infrastructure project in Oswit Canyon in order to “control flooding”. I think this
decision, if passed, will have negative consequences that will have to be undone in
the not so distant future.
This project will destroy 3 acres of fragile habitat that many animals and wildlife call
home, animals whose habitat has been completely changed by human development
and infrastructure. This project will cut off accessibility and freedom of movement for
many animals that don’t have many options to get around town, without the threat of
moving cars. They need open space that is connected to each other to hunt, mate,
and enjoy life safely. This conversion of habitat to concrete will disrupt thousands of
lives. Human lives as well, as many in the adjacent neighborhoods will suffer from
noise and air pollution as a result of this construction, not to mention the emotional
loss of a beautiful, ancient landscape.
We are seeing, all across the country, billions of tax dollars being put toward undoing
infrastructure (dams, culverts, roads, bridges, etc.) that have impacted wildlife
populations in ways we couldn’t dream of at the time they were originally built. The
only thing we can do to prevent having to undo this project, is to not build it in the first
place. As a tax paying member of this community, please don’t use our
municipal/county/state/federal tax dollars to harm the home and habitat of our more-
than-human family.

Dear Jeffrey, Thank you very much for your response and the
documentation for me to peruse. After reading and re-reading all the
info and looking at some of the facts that have come to our attention via
people who are familiar with this, plus info obtained from a source we
trust implicitly, The Oswit Land Trust Organization, we still have the
following questions.
1. Why doesn't the subject of the city staff report on this say
exactly where it will be built? It just says, “South Palm Canyon
Drive at Arenas Canyon”. I don't even know where that is and I
live over there! It sounds like it is up near Lulu's!
2. Under the background information, it says that “South Palm
Canyon Drive is subject to flooding from Oswit Canyon and has
been subject to closure at times during the past heavy storms”.
Not true. It is actually documented by the city that water has
never flowed from the Canyon into the street and, apparently, the
street has only been closed twice in 20 years. This is not a
situation like Gene Autry or other parts of town. Apparently, the
city keeps records of all street closures through its nixle system
so you should confirm this. Also, Oswit Canyon Land Trust tells us
that they "have been out to the site after every rain, including
Hurricane Hilary, and that the street remained open even when
other parts of the city were closed for days and weeks". So, where

are your city guys getting their information from?
3. It looks like the city applied for the funding in 2005 to build this
"elevated roadway", because, at the time, entitlements were in
place to develop the entire Oswit Canyon with over 260 homes,
which (thank God) didn't happen.
And in 2006, Caltrans was under the impression that the canyon
was going to be developed, which is why the city received an
authorization from Caltrans to build this. Has Caltrans been
notified that the proposed Oswit Canyon (aka Eagle Canyon)
development did not and will not take place? They should be!!!
Right now, the state has a pretty tight budget problem and, under
the current circumstances, they might very well have prefered to
rescind that approval/funding and use it where it is actually
needed.
4. We found out that, under your staff analysis, in the staff notes,
they received four other options from Oswit Land Trust's
hydrologist as to how to approach this potential problem, yet, the
city determined that all of the options the OLT hydrologists
recommended would not work just based on the numbers
provided and apparently, never went forward with any in-depth
hydrology studies of their own at the site to determine if those
options were feasible. Is this accurate? If so, why not? We were
told that all of OLT's options would cost considerably less money,
take less time, bring less aggravation and not destroy three acres
of land. Has the current city council looked at those other options?
5. The report says that they "reduced the footprint as much as
possible”. Not true. It is still the exact same size. Three acres.
6. They also mention how it might look "after natural vegetation
takes hold" yet, they told Oswit Land Trust in the meetings that
any natural vegetation which might pop up will be "cut down
immediately, like they do in the channel on Riverside drive" (and
like we wish SOMEONE would do to the dangerously high amount
of vegetation taking over the wash east of South Palm Canyon
which flows under Bogert Trail that is a fire waiting to happen!)

7. Under the environmental assessment section, they mention the
project is "excluded from an environmental assessment", but that
was back in 2012, before the entire Canyon was protected and is
now conservation land! They should not be able to do this at this
time. The noise of construction, traffic, dust, etc. is going to be
incredibly disruptive and stressful for all of the residents who live
around there and must commute through that area, each day, as
well as our beautiful endangered bighorn sheep, who now
frequent the lower part of the property, and which thousands of
tourists travel hundreds of miles to hike through that canyon to see
every year.
8. In the strategic planning section, under "the alignment", it states
that this is for “high priority facilities”. A road that hasn't been
closed except twice in 20 years is a "high priority facility"? That
doesn't compute in our minds.
Bottom Line-
A) Why the rush to move to approve a project of this nature, with
all these discrepancies, considering how infrequently that road
actually floods?
B) Why is this being pushed through in mid June, at the very time
when residents who live in the neighborhoods of this area (many
of whom contributed to the millions of dollars raised to preserve
the open space and not look at concrete and rock), can't be part
of this decision process?
C) Larry and I are 100% eager to do everything necessary to
combat climate change - a huge issue and a problem that is
slipping through our fingers as we speak. But, there must be
better things the city can do to help with climate resiliency here
than hardening more surfaces with concrete and rock? Many
communities are adding more vegetation and more trees to
counter the devastating effects of global warming. They are not
removing vegetation and replacing it with harder surfaces.
Plus, that $8.3 million could finance a whole bunch of emergency
vehicles that could help in any part of our city when there is actual

flooding. AND, in the meantime, use some of that money to plant
more trees to help with carbon and sequestration or the purchase
of more land for open space.
With all of the other information we have found about this issue,
we are beginning to feel that this STAFF ANALYSIS report is
misleading and that is worrisome. Why would it be? Why is it
trying to fudge the actual facts?
Larry and I want to add our voices to the increasing number of
concerned folks here who do not see the need for this particular
project and want answers to understand the city's justification.
We hope you will share these questions and views with the rest of
your colleagues on the council.

18) be removed from next week's agenda and rescheduled for November.
Residents who live in the neighborhoods surrounding that area need to be properly notified
and have input regarding this proposed project.
The city project is referred to as “Arenas Canyon South” on the council agenda, a location
that most residents would never know or recognize. The proposed project destroys 3 acres
in Oswit Canyon and causes construction for nearly 2 years at the corner of South Palm
Canyon Drive and Bogart Trail. The location should have been more clear on the agenda
and residents should have received written notice.
In addition, a project of this magnitude, that would create an enormous amount of noise,
construction, traffic, dirt and will permanently change views, should be approved when most
people are in town, not mid June.
The following is the history of this project for council members and staff who were not at the
city when this started:

The city developed the flood construction project in 2005 and approved it in 2012.
The plan was designed with the notion that Oswit Canyon would become a
neighborhood with several hundred houses and those houses would have to be
protected. The Canyon South specific plan was already in place and there were
entitlements in place to build homes in the canyon.
In 2019, after a 3 year campaign to save Oswit Canyon , Oswit Land Trust (OLT)
negotiated with the developer and agreed to purchase Oswit Canyon. The city agreed
to help with a donation and offered to get the appraisal that was required for the grant
to purchase the property.
A previous employee of the City removed 3 acres from the appraisal without telling
Oswit Land Trust. Oswit Land Trust didn't know these acres were not in the appraisal
until November 2019.
OLT had no time to get a new appraisal in order to meet the developers Dec 31
deadline; starting a new appraisal would have made OLT lose Oswit Canyon. This
former city employee put Oswit Land Trust in a corner and tied our hands which was
completely unethical.
Oswit Land Trust hired Richard Haimann, a renowned hydrologist/engineer to come
look at the site and also had Dr Hoori Ajami, a hydrologist and professor from UCR,
come look at the site. Both thought the city's proposed flood project was overkill,
outdated and could be done without so much impact on the land.
We met Grace Garner and Lisa Middleton at the site separately and each assured us
that the city would not go forward with a plan from 2005 and the city would work to
reduce the proposed footprint.
We met with city staff several times and brought many suggestions from our
hydrologists but none were incorporated into this proposed project design and the
footprint is the same size it originally was when the canyon was going to be
developed.
Additional important information
South Palm Canyon Drive has only been closed to vehicles twice since 2005 and
only for a few hours each time. Emergency vehicles such as fire trucks still would

We have visited this site during every rainfall in the last several years and have video

The canyon has a large berm that prevents any future flooding on the street. This
was not taken into consideration.
Perhaps the city could have an open meeting with the residents from the surrounding
neighborhoods to receive their input into this project. Since this project has been around
since 2005 there certainly is no harm in waiting a few months to meet with the residents
who are most impacted by this project.

Dear City Council:
I’m writing to request that this project, which has a project title that’s unrecognizable to
anyone living on the south side of Palm Spring, be withdrawn from the upcoming agenda on
June 13, 2024 and delayed until later. I live in Andreas Hills and witnessed the last flooding
event, even taking photos of it. I lived in the city for the one before that but lived in a different
neighborhood at the time.
The proposed bridge is not necessary; and no one on the south side would even know this
project is coming up for a vote due to three reasons. There is nothing called ‘Arenas Canyon’
anywhere near this neighborhood or any other neighborhood on this side of town; and a very
large portion of the residents who own property here are not in town for the season and have
no idea this is being proposed. The most important reason tho is that the proposed bridge was
a response to possible land development in Oswit Canyon - which never happened. A bridge is
not a needed solution to a non-issue..
There are far better ways to approach these rare street flooding events that doesn’t involve a
bridge; and I'm sure a good solution won’t cost $9M. The residents here need to be engaged as
well, to give their insights and comments. Please delay this agenda item so that we can all be
properly informed and discuss it as a community before it comes up again.

Canyon South" on South Palm Canyon Drive at Bogart Trail, Item 3-B on the June 13
agenda.
As a 20-year homeowner in a condominium nearby, I have appreciated that Oswit
Canyon remains free of further development. This project is not necessary, as it was
initiated in 2005 when there were plans for building in the canyon. Oswit Land Trust
changed all that, and our community has watched the canyon vegetation and valued
wildlife flourish.
This project is solely in the interest of potential developers, and not for the
community. We don't need it. There has not been any appreciable flooding affecting
traffic or homes in the wash path to justify this type of construction.

I live in Estancias of South Palm Canyon and experienced the February 2019 flooding. This is
my recollection of what happened for us the day of the flooding:
1.Was able to drive to a 10:00 am appointment in Smoketree Center.
2.Roads were flooded, but was more of an inconvenience.
3.Road blocks were set up and I was not allowed to return to my home in the late morning.
4.Majority of the water was flowing into the Indian Canyons South Golf Course
5.Early afternoon, no officials were monitoring the roadblock. Was able to drive back on
South Palm Canyon to Estancias. I saw only only two small vehicles in the flooded water.
For myself and my husband, the flooding was more of an inconvenience rather than "life
threatening".
The major problem was lack of electricity for more than 12 hours.
We have lived in Estancias for nine years.
Our NO ON ITEM 3_B based on the following:
1.I drive on South Palm Canyon everyday, and enjoy the unspoil beauty of Oswit Canyon.
2.After saving Oswit Canyon, I've seen more families of Bighorn sheep come down the
mountain.
Construction of the bridge will drive the Bighorn sheep higher up the mountain.
3.Cost of the bridge has doubled from initial estimate of $4.1 to $8.2 billion with City of
Palm. Springs responsible for 11.5%. Though, the staff report indicates the budget is
already $2.6 million over budget. This is unacceptable.
4.The buildout of berms and/or sediment basins will scar the beauty of Oswit Canyom.
5.The impact of the February 2019 flooding was an inconvenience and does not warrant
spending the money.

Project would ensure a critical connection to emergency services and serve
the health safety and welfare of residents.
Project has satisfied CEQA requirements and was given a Mitigated
Negative Declaration.
OLT hired a consultant that produced 4 alternative options. The City spent
$112,500 on a consultant to review all options which were deemed
infeasible.
OLT’s options would have disturbed far more land and habitat than the
Project.
The Oswit Canyon Parcel is located within a designated FEMA Flood Zone
(noted in profile of Jane Garrison in Palm Springs Life, 1/2/2021)
OLT agreed to cede all control of the project to the City Council.
While I wholeheartedly applaud OLT’s purchase and preservation of the Oswit
Canyon parcel, I entirely disagree with their recent disingenuous, false PR
campaign to stop the Project.
OLT opposes the Project - yet sold the required 3.5 acres to the City.
OLT has falsely stated the Project is designed for the defunct Eagle Canyon
Housing Development.
OLT states the Project is new & not justified - it’s been approved by
Caltrans and vetted by numerous agencies over the past 18 years.
OLT states that South Palm Canyon has been only closed 2 times since
2005 - which has zero bearing on the probability of a 100 year storm event.
OLT participated in developing options for a project that they profess isn’t
required - implying that Caltrans, FEMA, CEQA, Dokken Engineering
AND the City have all colluded on an unnecessary project using public
funds for the past 18 years.
OLT opposes the Project, knowing the site is located in a FEMA Flood
Zone.
I believe OLT is compelled to oppose the Project. They saved the Oswit parcel
with the mantra “Not One Shovel”, which garnered national attention and
extensive press.
But OLT cannot publicly do a 180 and support the Project that they provided the
land for, provided options for, and would require a shovel.
OLT supporting the Project would be entirely incongruous with their public
image and corporate profile. Their baseless, misrepresented, emotional pleas
opposing the Project do not represent reality. Their opposition at tonight’s
meeting is simply a face saving PR campaign.
I believe this is the absolutely right project - it’s in a FEMA Flood Zone, it’s been
vetted and funded, completes a key section of a larger flood control plan, and it’s
a public safety project. Please vote for this Project that is based on logic and
science - not emotional pleas.

To Palm Springs City Council,
This is an ongoing life and safety issue. It is morally wrong not to repair a dangerous flooding problem in the
Andreas Hills and Bella Monte neighborhoods. We frequently hear fire engines and ambulances in these mostly
senior residential neighborhoods. No one will get fast emergency help during a high water situation and the only
way in and out of S Palm Canyon is blocked.
As you all know it’s minutes that saves lives not hours when trying to rescue someone in distress at their home
during a flooding event at S Palm Canyon and Bogert Trail. I am 82 and my husband is 87.
We and all who live here deserve a safe neighborhood especially if the city and federal aid has identified that there
is a dangerous issue that can be resolved and is prepared to fund the project and permanently solve the flooding
issue.
We have lived in Andreas Palms Estates off Bogert Trail since 1999. We have experienced high water many times
over the last 25 years at S Palm Canyon and Bogert Trail. It has gotten worse since the Canyons South Golf Course
was remodeled and the natural flow may have been altered.
Road closures are a serious safety issue for all the residents in the area. As a reminder there is only one way in and
one way out. The city owes to the residents a safe community where they don’t have to live in fear of a storm
causing dangerous road closures.
When we moved here in 1999 we were told a road was to be constructed on the other side of the wash to Highway
111 in Andreas Hills. After the golf course remodel we were told that was no longer a plan. All the more reason S
Palm Canyon at Bogert Trail needs to be passable 365 days a year.
The inconvenience of road work for a period of time is nothing to the peace of mind that S Palm Canyon and Bogert
Trail will not be closed due to flooding.
The February 14, 2019 storm and flooding was incredibly dangerous for all the residents in the area. I left early
around 8:00 AM for an appt. My husband was home and ill. I COULD NOT return home as the S Palm Canyon
and Bogert Trail roads were closed due to raging high water. The Fire Dept was at Murray Canyon to stop traffic
with barriers. It was a terrifying experience. It was late afternoon before I was able to get home slowly driving
through deep fast moving water. Someone had taken down the barricades and we drivers thought the fire dept had
deemed it passable and that it was safe to drive through. There were no fire trucks or officials around as they were
in the morning.
When I got through the raging water to high ground on Bogert Trail there was a fire truck. I was admonished for
driving through such dangerous raging water. They were shocked when I told them the barriers were removed and
no officials were there. The water was so high it came into my SUV.
This need not be our future. Palm Springs has the tools to fix this ongoing safety issue and protect the thousands of
people who live in Andreas Hills and Bella Monte neighborhoods.

Several of our neighbors who are seniors walked through the golf course and had to climb over barriers to get home
with their groceries.
Please vote yes for a solution. Listen to the neighbors who live here and we all have experienced the flooding issues.
Start ASAP to build a sensible solution to a problem that with climate change will continue to cause havoc for a
large residential area of Palm Springs. Time is of the essence for us who live here.

As a homeowner in Andrea’s Canyon I am opposed to a potential bridge and flood control project in Oswit Canyon.
There is really no need for this now that there will not be any development In Oswit canyon.
You should be concentrating and SPENDING money on a second bridge over the wash South of E. Bogert Trail.
With all the development up off Bogert Trail the fact that there is only one exit/ escape route East of the wash for all
those residents is a recipe for disaster in an emergency. The traffic congestion is awful on Bogert Tr. as it is!!!
I would be interested in why this proposal is not being considered.

My name is Olivia Alaniz, and I’m addressing you on behalf of myself, my
daughter, Shilo Alaniz and her swim team, Elite Otters.
I’ve recently been made aware of certain difficulties the team has encountered
over the usage of the pool.
My daughter has been a member of this team for over two years now. In this time,
she grew a lot as a swimmer, mainly because of the wonderful coaches this team
has. She’s already considering doing swimming in her high school years. Elite
Otters became a constant part of our life and they are like family to us.
We need this organization to keep existing in Palm Springs. And for that they
need to be able to use the pool. There is no other program similar in the area.
They bring hundreds of people in town by organizing the swim meets every year.
The team needs to grow and develop and that can only happen with help of the
city.

I am writing to my Palm Springs City Council regarding an important topic that was on your
plan to vote on today.
The people who live in my Andreas Hills neighborhood were not given notice or made aware
of what was being planned.
We would be the most affected by this unneeded bridge and flood control!
I have owned my home and lived on Bogert Trail, close to So. Palm Canyon, for 23 years.
Except for 1 year, we have not had a flooding problem!
If the city wants to use a huge amount of money, including our tax money, to make
improvements, there are other more important ways to do that!
If the city wants to know about how the people who live in that area feel, then you need to
wait until the majority of residents are here
