SOURCE:
On 9-2-2018 I was working uniformed patrol in marked PSPD unit 34. At approximately
0101 hours I was dispatched with Officer Gilbert to in the City of Palm
Springs, County of Riverside reference a disturbance at the location.
M.O. P.O.E.
Blake resists officers in the performance of their duties and knowingly resists by use of force
or violence causing visible injury to both officers. Blake is also found in possession of a
concealed dirk or dagger and assaults officers with a weapon other than a firearm.
VICTIM STATEMENT:

OFFICER STATEMENT:
While responding to the call, dispatch advised a friend of the reporting party (Marvin Blake)
was refusing to leave the location and acting aggressive towards him. Blake was described
as a black male adult and was last seen outside near the garage.
Officer Gilbert and I arrived on scene at 0110 hours and parked approximately 40-50 yards
from the residence which is located in a cul-de-sac. The residence () is a
single level home with a two car garage which was ajar.
Officer Gilbert and I approached on foot and could observe two older males standing in the
garage. One male, later identified as the original reporting party () appeared to
be on his phone with dispatch. As we got closer to the garage I could observe a black male
adult standing near the north side of the garage with his back against the interior wall. The
black male, later identified as Marvin Blake, was wearing a black shirt, beige shorts, and
had a backpack on. Blake's arms were crossed and I could not see his hands. Since Blake
matched the description of the subject in question and I could not see his hands I told him to

keep his hands visible and he complied. Blake was quiet and looking around. Since he was
in close proximity to and the other male in the garage, Officer Gilbert asked Blake to
step out of the garage so he could not hear the conversation between me and . Blake
walked out of the garage approximately 4-5 feet while I entered the garage and spoke with
briefly.
told me he knew Blake from past intimate encounters and invited him over to his
residence after learning he had gone through a recent break up. While at the residence
said Blake became angry for some reason and had removed a towel rod from one of
the bathrooms. said this behavior worried him and he asked Blake to leave but he
refused so he decided to call the police.
While speaking with , he said Blake had calmed down and he just wanted him to leave
the location and told me no crime had occurred. I walked to Blake and Officer Gilbert,
introduced myself and told Blake that had asked him to leave the residence and we
would escort him out of the area since it was a gated 55 and older community. I told Blake if
he refused to he would be in violation trespassing (602 PC). Blake told me "no" and began
to yell stating he did not have to listen to the police and to get away from him. Blake began
to walk away from officers while yelling at which time I decided to detain Blake in handcuffs
to prevent flight. At this time Blake had not been searched and based on his clothing
description and since he was wearing a backpack, he could have been in possession of a
weapon and/or contraband.
I placed my left hand on Blake's left wrist to put him in a department approved twist lock
while Officer Gilbert did the same on his right wrist. As soon as officers made contact with
Blake he immediately yelled "get off me" and began to swing his arms violently in an effort to
break our grip of his wrists which worked. Blake began to run north then east from the
garage to evade Officers which led to a small gravel side yard and closed gate. This area
was extremely dark and there was no lighting. I yelled for Blake to stop resisting and to get
on the ground numerous times during the altercation. While on the side yard I was struck in
the upper body but could not tell by what means. I grabbed Blake's backpack to pull him off
his feet and detain him but he was able to twist his body causing the backpack to fling
around his back erratically.

While the altercation continued on the side yard I saw Officer Gilbert fall to the ground and
Blake quickly approached him and began to swing his arms and attempted to strike Officer
Gilbert with his fists. It appeared Officer Gilbert was pushing Blake away with his feet which
allowed me to draw my X26 Taser (). I quickly told Officer Gilbert I was
going to deploy the Taser which I did immediately. Due to the darkness I did not see where
the darts struck Blake or if they did at all, but I did hear Blake make a moaning sound and
saw and heard the Taser arcing on Blake's right upper side torso area.
This caused Blake to focus his attention to me and he ran towards me and ducked as if he
was going to tackle me. Blake's shoulder area struck just above my waist line which placed
his left hand near my gun. I focused all my efforts on covering the hood on my holster to
prevent Blake from retrieving my firearm since my Taser was still in my other hand and I did
not want to drop it and risk Blake taking possession of it. Officer Gilbert was able to get
behind Blake and strike him twice in the face with his fist distracting him and allowed me to
strike Blake one time in the left rib cage area with my right fist. Blake then yelled and
grabbed the right side of my LBV (load bearing vest) and pulled. This uniform piece is
secured on each side by large hook and loop panels. When Blake pulled on the side of the
vest it caused that panel to rip open. I swung my right arm in a downward motion with a
closed fist striking Blake's arm causing him to release my uniform.
Blake continued to swing his arms frantically while yelling "hell no" and "get away from me"
as well as obscenities and other unintelligible grunts. Blake began to run from officers, still
non-compliant and refusing to follow lawful orders from officers still demanding to stop
resisting and to get on the ground. Since I believed my Taser darts were still attached to
Blake I depressed the trigger on my Taser an additional time. I heard the arcing but it had
no effect on Blake.
While near the open garage, one of Blake's wild arm swings struck my right shoulder and
Blake grabbed onto my LBV (load bearing vest). With his hand in this location, Blake
attempted to place his arm around my neck but I was able to deflect him but tripped and fell
to the ground inside the garage.

Since I still had possession of my Taser but it showed to have no effect on Blake to gain
lawful compliance I opted to discard it under a shelving unit in the garage. This allowed me
to use both of my hands and prevent Blake from trying to gain possession of it while
attempting to holster it.
While on the ground, Blake grabbed a closed folding chair that was within arm's reach on
the north side of the garage and began to raise it over his head. This particular chair is
constructed of heavy duty thick walled tubular steel that when folded in the closed position
measures approximately 8-10 inches wide and over 30 inches tall.
Fearing I was going to be struck with by the chair due to Blake's proximity (2-3 feet) and
having high ground on me, I quickly stood up to move away from Blake at which time Officer
Gilbert deployed his Taser, appearing to strike Blake in the upper torso. Blake again made
a moaning sound and dropped the chair which initially indicated a successful deployment.
Blake immediately ran towards Officer Gilbert which allowed me to get behind Blake, now
partially in the driveway which is slightly slanted downhill.
Once behind Blake I placed him in a department approved carotid control hold since he was
still violently and physically resisting. I have successfully completed department approved
training in the use and application of the carotid control hold.
I placed my left armpit on top of Blake's left shoulder and extended my left arm down and
around Blake's neck. My left bicep area made contact with the left side of Blake's neck and
my left forearm and hand was brought up and around his neck to make contact with the right
side of his neck. I did not feel any part of my left arm make contact or apply pressure to the
front of Blake's neck/throat area.
As I began to apply the carotid control hold, Blake pushed backwards causing my backside
to strike the vehicle in the driveway. At the same time, Blake began to swing his right arm
backwards in an effort to free himself. Blake's right elbow area struck the right side of my
jaw two times before I felt his body begin to relax after the carotid control hold was applied
for approximately 5-7 seconds.

As Blake's body continued to relax, I assisted his body to the ground so it would not fall
weightless causing additional injury. Once on the ground I released the carotid control hold
and cradled Blake's head/face to the ground with his body in the prone position. Officer
Gilbert was able to place Blake in handcuffs and Blake was immediately placed in the
recovery position on his side. As I began to check for breathing and search Blake's person
he began to kick his legs violently and screamed to get off him. Although the carotid control
hold had been released and never re-applied officers had to place their weight on Blake's
legs and upper torso area to prevent him from getting up as suspects can still flee and
cause injury while handcuffed.
Once other officers arrived on scene, they relieved Officer Gilbert and myself so we could
be assessed for injuries. Officer Christiansen located a concealed dirk/dagger in Blake's
right front pocket.
As soon as Blake was safely detained, medical staffed was called to the scene to treat him
for any injuries sustained and per policy due to the application of the carotid control hold.
Blake was transported to DRMC for a medical clearance to book before being taken to
Banning jail for the charges listed in this report.
Blake violated 148(a)(1) PC by failing to comply with repeated lawful order by peace
officers.
Blake violated 69PC by deterring or preventing an executive officer from performing any
duty imposed upon the officer by law, or who knowingly resists, by the use of force or
violence, the officer, in the performance of his or her duty.
Blake violated 21310 PC by carrying concealed upon his person a dirk or dagger.
Blake violated 245(c) PC by committing an assault with a deadly weapon or instrument,
other than a firearm (chair), or by any means likely to produce great bodily injury upon the
person of a peace officer or firefighter, and who knows or reasonably should know that the
victim is a peace officer or firefighter engaged in the performance of his or her duties, when

Blake violated 243(b) PC by committing battery against the person of a peace officer
engaged in the performance of his or her duties, whether on or off duty, including when the
peace officer is in a police uniform and is concurrently performing the duties required of him
or her as a peace officer while also employed in a private capacity as a part-time or casual
private security guard or patrolman, or a nonsworn employee of a probation department
engaged in the performance of his or her duties, whether on or off duty, or a physician or
nurse engaged in rendering emergency medical care outside a hospital, clinic, or other
health care facility, and the person committing the offense knows or reasonably should
know that the victim is a peace officer.

ADDITIONAL INFORMATION:
During the altercation I sustained a visible bleeding abrasion to my left arm (near the elbow)
as well as a visible abrasion to my right arm (elbow area) and left knee and swelling to the
right side of my jaw. After Blake was safely detained I discovered my wrist watch was
broken and in the driveway. Additionally my uniform was very dirty and a small light
attached to my vest was broken and unusable.
Officer Gilbert sustained visible scratches to his face as well as swelling to the left side of
his jaw.
Blake stood approximately 6'00" tall weighing over 200 pounds. I currently stand at 6'4"
weighing approximately 220 pounds and Officer Gilbert is 6'1" and weighs 170 pounds.

NARRATIVE
Supplemental Report:
On Sunday, 09/02/2018 at approximately 0120 hours, I was working downtown uniformed
patrol in the City of Palm Springs, County of Riverside with Officer Alcaraz. I responded to
to assist Officer Crampton and Officer Gilbert during a use of force
incident.
I arrived on scene and used my digital camera to take digital photographs of the scene. I
took several digital photographs of Officer Crampton and Officer Gilbert's appearance while
on scene. I responded to the PSPD station to take additional digital photographs of Officer
Crampton and Officer Gilbert.
I used a color scale to take additional digital photographs of Officer Crampton. I located
Officer Crampton had redness to the right side and center of his neck. Officer Crampton had
slight inflammation to the right side of his jaw. Officer Crampton's left elbow was bloody due
to an abrasion he sustained during the use of force incident.
I used a color scale to document Officer Gilbert's appearance with my digital camera. I
notice Officer Gilbert had redness and slight swelling to the left side of his face. Officer
Gilbert sustained a small abrasion to the left side of his face and jaw.
I uploaded all of the digital photographs into the PSPD digital evidence database.

NARRATIVE
On 09/02/18 I was on duty, in full uniform, in marked patrol unit number 78, in training with
Officer Christiansen in the City of Palm Springs, within the County of Riverside. At
approximately 0114 hours, I responded to request for additional units due an altercation
between Officers and a male subject located at .
Open arrival I observed a black male subject later identified as Marvin Blake. Blake was
laying on the driveway in handcuffs face down. Blake was wearing a black t shirt, beige
shorts and bare footed. I observed Officer Christensen search Blake incident to arrest. I was
advised by Officers on scene to locate witnesses and obtain statements.
I contacted inside his residence. had a thick accent and showed
signs of intoxication. had red watery eyes and I could smell the odor of an alcoholic
beverage coming from his person. provided the following statement in summary.
lives at with his husband .
went downtown for the evening with friends when he received a text message from
. texted requesting him to "come home now! Getting scary with this
guy". came home immediately and observed Blake's vehicle parked in the drive way
of his home. stated he does not know Blake and this was the first time he ever seen
Blake. stated he observed Blake in the driveway of his residence. asked
Blake to leave and offered to assist him in finding his vehicle keys. Blake became irate and
called the Police.
stated he observed Officer Gilbert and Officer Crampton approach Blake in the
driveway of his residence. The Officers asked Blake for identification and Blake refused. I
asked to elaborate on how Blake refused and stated "aggressively refused".
stated the Officers ordered Blake to put his hands behind his back and Blake "was
not cooperating". I asked to explain how Blake was not cooperating. stated
Blake was listening to the orders from the Officers and resisted arrest. I asked how
Blake was resisting arrest. stated Blake attempted to move away from Officers

when they tried to place him under arrest. I asked if he heard the Officers give
verbal commands to Blake. stated he heard the Officers give Blake lawful orders
but Blake did not listen. I asked what he heard the Officers say. stated the
Officers gave "lawful orders". Blake and Officers struggled outside the garage in the
driveway. observed Blake reach for folding chairs that were inside the garage on
the north wall. Blake and Officers stepped off to the north side of the residence out of sight.
stated the Officers requested him to step inside his residence. stated he
walked inside his residence but could hear muffled sounds from outside the residence.
I asked if he thought the Officers used the correct amount of force for the situation.
stated the Officers used the right amount of force because Blake was not
cooperating. stated Blake was very aggressive towards the Officers. I asked if
had any additional information to provided he stated he did not and this concluded
my interview with .
I photographed cell phone text message he received from . I completed a
consent to Search Computer Equipment/Electronic Data form and had sign it.

OFFICER STATEMENT
On 9/2/18, I was working uniformed patrol, driving a marked PSPD unit, in the City of Palm
Springs within the County of Riverside. At approximately 0101 hours, Officer Crampton and
I were dispatched to , reference a disturbance at the location.
Officers arrived on scene at approximately 0110 hours. Prior to officers arrival PSPD
dispatch advised a black male adult wearing a blue shirt, black shorts and sandals had
been acting aggressive towards the reporting part, . advised PSPD
dispatch the black male adult was Marvin Blake. Blake had been using a towel rack bar to
intimidate .
Upon arrival I noticed three males standing in the garage area of the residence. As officers
approached the residence I noticed a black male adult matching the description given to
officers by PSPD dispatch (Blake). I asked Blake to step outside of the garage area and
speak with me on the driveway of the residence while Officer Crampton spoke with
inside the garage area. Blake only moved approximately 3-4 feet outside of the garage and
was uncooperative in answering questions about the incident. After speaking with
Officer Crampton learned no crime had occurred and only desired Blake to leave the
property.

NARRATIVE
Officer Crampton gave Blake a lawful order to leave the property or he could be placed into
custody for 602 PC- Trespassing. Upon hearing Officer Crampton's lawful order Blake
stated, "No, I don't have to listen to the police." Blake changed his body positioning from
having his arms crossed over his chest to placing them down at his sides and forming fists
with his hands. Upon seeing this Officer Crampton, to prevent flight or other possible
aggressive behavior, placed his left hand on Blake's left wrist in an attempt to place Blake in
a department approved twist lock. I placed my right hand on Blake's right hand in an attempt
to place him in a department approved rear wrist lock. As soon as officers made contact
with Blake's person he immediately yelled, "Get off me," and began to swing his fists at both
myself and Officer Crampton.
Blake attempted to flee north east which lead to a small gravel side yard. While attempting
to regain control of Blake's right arm he began throwing punches towards my face, striking
me once in my left jaw area. Officer Crampton and I continuously told Blake, "Stop
resisting," but Blake refused to do so. Blake attempted to tackle Officer Crampton, at which
point I delivered two closed fist distraction strikes to the right side of Blake's face. During
the violent altercation I tripped over an exposed sprinkler line protruding from the ground. At
which point Blake attempted to mount me and strike me with both of his fists. I was able to
keep Blake from doing so by kicking him in his torso with both of my feet.
While Blake was focused on me this gave Officer Crampton an opportunity to draw his X26
Taser (). I heard Officer Crampton give Blake a warning he would be tased. I
heard Officer Crampton's Taser be deployed but I was unable to see if the probes made
contact with Blake.
After Officer Crampton's Taser had been deployed Blake still continued to resist officers
violently. After possibly being struck by probes from Officer Crampton's X26 Taser, Blake
turned his aggression towards Officer Crampton. This allowed me to regain my footing and
continue trying to gain Blake's compliance. The violent altercation moved back into the

Once back into the garage area, I noticed Blake attempted to place both of his arms around
Officer Crampton's neck. Fearing for Officer Crampton's life and safety I pulled my duty
firearm and pointed it in close proximity to Blake. I ordered Blake to, "Let go of my partner or
you will be shot." At which point Officer Crampton was able to free himself from Blake's
arms causing him to fall backwards. Blake now turned his attention towards a folding chair
hanging from the rafter area of the garage. Blake took a hold of the lawn chair and held it
over his head in what appeared to be an attempt to strike Officer Crampton.
I holstered my duty firearm and drew my X26 Taser (). I ordered Blake to drop
the folding lawn chair or he would be tased. When Blake did not drop the folding chair I
deployed my X26 Taser in order to gain Blake's compliance. I noticed one probe make
contact with Blake in his right abdominal region. I was unable to see the second probes
location. The taser appeared to have no effect on Blake. Upon deploying my X26 Taser,
Blake began moving out of the garage area directly towards me. Fearing Blake would be
able to gain access to my X26 Taser and use it as a weapon against myself or Officer
Cramton, I threw my taser underneath a nearby vehicle. Blake struck me in the right side of
my jaw with an unknown fist. Officer Crampton regained his footing and immediately took
position behind Blake. Blake began to violently swing his elbows striking Officer Crampton
on the left and right side of his head. Seeing this I delivered 3-5 additional closed fist
distraction strikes to the left side of Blake's face and abdominal area.
Officer Crampton was able to place Blake into the department approved carotid control
hold. Officer Crampton held the department approved carotid control hold for approximately
5-7 seconds before I saw Blake appear to become relaxed. Officer Crampton assisted
Blake to the ground and released the carotid control hold. While on the ground in the
recovery position I was able to gain control of Blake's right hand and left hand and apply
handcuffs. Within 3-4 seconds Blake again began to scream at officers and violently kick his
feet in an attempt to strike Officer Crampton and I. Officer Crampton and I placed our weight

NARRATIVE
on Blake's legs and upper torso area to prevent him from getting up. Additional officers
arrived on scene and relieved Officer Crampton and I in restraining Blake so we could be
assessed for injuries.
Based on the fact Blake failed to comply with a lawful order by a peace officer, and his
continued resistance with lawful commands I believe Blake was in violation of 148(a)
(1)PC-Resist/Delay Peace Officer and the due to the fact, Blake, by means of violence,
attempted to deter or prevent officers from performing their duties and knowingly resisted,
by the use of force or violence, the officers, in the performance of their duty I believe Blake
is in violation of 69 PC- Resisting Executive Officer.
Blake was immediately treated on scene by PSFD paramedics for any injuries sustained
during the violent altercation per department policy due to the Taser deployment and
application of the carotid control hold. Blake was transported by AMR to Desert Regional
Medical Center for medical clearance to book. Blake cleared for booking by DRMC staff and
later transported to Smith Correctional Facility by Officer Nanez for booking.
During the violent altercation Officer Crampton sustained visible, bleeding abrasion to his
left and right arms as well as visible abrasions to his left knee and swelling to the right side
of his jaw.
I sustained visible lacerations to the left side of my face and jaw as well as swelling to the
left side of my jaw.
At the time of the incident Blake's California Driver License indicated he was 5'11" weighing
203 pounds.
At the time of the incident I am 6'1" and weigh 170 pounds, Officer Crampton is
approximately 6'4" weighing 220.

NARRATIVE
SUPPLEMENTAL:
On 9/2/18 I was on duty, in full uniform, in marked patrol unit #10, in the City of Palm
Springs, in the County of Riverside. At approximately 0110 hours, I responded to
in the City of Palm Springs within the County of Riverside, in reference to
a subject fighting with Officers on scene.
I arrived on scene at approximately 0119 hours, and met with Officers at the scene. While at
the scene, I was tasked with taking photographs and collecting evidence.
While on the scene I was directed to the north side, the garage area and the driveway area
of the residence. Officers on scene told me that a physical altercation took place involving
Officers and a subject (later identified and confirmed) named Marvin Blake in these areas in
front of the residence. I took photographs of these areas along with all the physical
evidence left behind during the altercation.
While on the scene I photographed a Taser located underneath a silver Toyota vehicle in
the driveway. I also photographed and collected a Taser cartridge located near the driver's
side front tire area. The cartridge had 2 Taser darts located in close proximity. It was later
learned that the Taser in question belonged to Officer Gilbert.
I photographed a Taser located on the northeast corner area of the garage. I then located a
Taser cartridge which, had 1 Taser dart located in close proximity in the grass area near the
garage. It was later learned that this Taser in question belonged to Officer Crampton. Only 1
AFID (pink in color) was located on scene. I photographed the AFID near the Taser dart
located in the grass but it flew away when officers attempted to collect it for evidence due to
high winds.
I photographed and collected a metal towel rod (approximately 2 feet in length), said to be
in the subjects possession at one point in time during the incident. I also photographed the
bathroom area where the rod was taken from.

NARRATIVE
I photographed and collected 2 folding chairs located on a table along the north wall of the
garage. Officers told me the subject had one of the chairs in his possession during the
incident.
I photographed a knife located on the garage floor. Officer Christiansen later collected and
securely placed the knife into evidence at the Palm Springs Police Station (PSPD). Please
refer to Officer Christiansen's supplemental report for further information.
I photographed and collected the suspects black Jansport backpack along with some of his
personal hygiene items along with 2 cellular phones that were located at the scene. While
later checking the suspects backpack for weapons a small plastic container with suspected
marijuana was located. I later tested and weighed the suspected marijuana (approx. 2.2
grams with packaging) with Nik test kit E It tested presumptively positive by turning purple
on the Identidrug Chart located in the Nik E Test kit.
All photographs and evidence collected were securely placed in to evidence at the Palm
Springs Police Department. Please refer to Officer Gilbert and Officer Crampton's arrest
reports for further details.

NARRATIVE
On Sunday, September 02, 2018, I was working uniformed patrol in a marked black and
white police vehicle in the City of Palm Springs. At approximately 0115 hours, I responded
to reference officers physical with a subject.
I arrived at the residence at approximately 0117 hours. Upon arrival, I saw a black male
adult was in custody, he was later identified as Marvin Blake. I then spoke to the reporting
party who identified himself through a valid California drivers license.
was in the kitchen of his residence when I spoke with him. I audio recorded my
interview with with my department issued audio recorded. The following is a summary
of what he told me: told me he is friends with Blake and has known him for
approximately eight months. advised me Blake asked to come over and arrived at his
residence at approximately 2100 hours. Blake arrived in his grey Toyota Camry, bearing
California plate , which he parked in the drive way of the residence. met
Blake outside and said it took Blake approximately five minutes to come inside the
residence. Blake kept looking around. Upon entering the residence, heard Blake say
something about the lights and people following him. did not think much of the
statement.
Once inside, Blake sat in the living room and smoked some marijuana that he brought with
him. learned Blake had recently broken up with a boyfriend and was upset. Blake
began to talk about people being after him. thought Blake was too "high" to drive and
told him he could stay the night in the spare bedroom. Blake went into the bathroom near
the garage and took a shower. At this time heard a car alarm go off outside.
went outside and saw Blake's Camry alarm was going off but no one was around it, and it
was secured. The alarm eventually turned off. Blake exited the bathroom and walked out
with a light yellow towel over his right shoulder. could see there was something
wrapped in the towel. did not know it a the time, but Blake had removed the towel
rack from the bathroom and wrapped it in the towel.
Blake then began to gesture at and whisper. said Blake's eyes were very big

and he kept signaling at someone who was not there. told Blake he needed to leave,
and was now afraid because Blake was acting paranoid. told Blake he needed to
leave, but kept making excuses such as he lost his car keys and he wanted someone
else to start his car for him. After being unsuccessful in having Blake leave, called
police and his friend (see Officer Enriquez supplemental of interview with
) to come over. stated Blake was becoming more agitated. arrived
and tried to convince Blake to leave with no success. All three were in the garage and
driveway.
said two police officers arrived and walked towards the garage. remembers
seeing two flashlights coming towards him. The officers approached and began talking to
Blake who was agitated and began to walk away initially. said Blake became
uncooperative with Officers, who told him not to do that. could not see what Blake
did, but gestured to me as if he was grabbing his pant pocket by bringing his right hand
forward towards his front pocket/waist area. The officers tried to grab Blake who resisted
them. heard both officers say, "Don't resist" approximately three of four times. Blake
responded by saying, "Get off , your hurting me" said he saw something change in
Blake and he became very strong, he said the two officers fought with Blake for what
seemed like fifteen minutes. saw both Officers use there tasers to try and stop Blake,
but it seemed to make Blake stronger. was unsure if the tasers even worked.
then saw the tasers go flying in opposite directions. The fight continued and moved to the
side of the house. saw the officers strike Blake, but could not specify any more
details. The strikes did not work to stop Blake. Eventually, Officers were able to take Blake
to the ground and place him into handcuffs.
walked me through the residence and showed me the bathroom were the towel rack
was missing from. The actual towed rod was in the garage in a green recycling box. The
yellow towel used to wrap the towel rod was on the living room floor near a sitting chair.
said he was not hurt, nor did Blake ever make any direct threats to cause him harm.
suggested Blake may have smoked marijuana that was laced with something,

NARRATIVE
On 9/2/18 I was on duty, in full uniform, in marked patrol unit 78, with Officer Enriquez, in
the City of Palm Springs, within the County of Riverside. At approximately 0114 hours I
responded to a residence at to assist Officers Crampton and Gilbert
who were in a physical fight with a subject, later identified as Marvin Blake. Officer Enriquez
and I responded from the Courtyard at 777 E. Tahquitz Canyon Way.
I arrived on scene at approximately 0120 hours.
I observed that Officer Escallada was kneeling with Blake who was lying prone on the
driveway of the residence. Blake was in handcuffs and was shouting to call the Police.
Officer Crampton and Officer Gilbert were on the northern side of the property and
appeared out of breath and disheveled. I observed that there was wire on the ground near
Blake that was consistent with that from a Taser electric control device.
Officer Escallada advised that Blake had not been searched yet. I put on gloves and
searched Blake incident to arrest. I located a fixed blade knife in Blake's right front shorts
pocket, a violation of PC 21310 Carry Concealed Dirk or Dagger. The knife had an
approximately 3 inch silver blade and a black handle.

NARRATIVE
I located a glass pipe with a partially burnt green leafy substance in Blake's left front shorts
pocket. Based on my training and experience, including but not limited to drug recognition
expert (DRE) school, I recognized this as a pipe used to smoke marijuana with marijuana in
the bowl portion.
I assisted Officer Wilson in documenting the knife as Officer Wilson documented the scene
with digital photographs. I observed as Officer Calleros collected the knife and placed it into
a bag which she then handed to me.
I advised Officer Crampton of the knife I located.
I assisted Officer Enriquez as she obtained statements from a witness.
I later booked the knife into evidence.

NARRATIVE
On Sunday, 09/02/2018 at approximately 0120 hours, I was working uniformed patrol with
Officer Nanez, in the City of Palm Springs, County of Riverside. I responded to
to assist Officer Crampton and Officer Gilbert during a physical fight with
a subject.
I arrived and contacted officers at the scene to assist. I observed a black male adult was in
custody, consistent with the information provided in the call for service regarding a subject
that was acting aggressive and refusing to leave the location reported to be named Marvin
Blake ("Blake"). Officer Escallada was asking the suspect who he was, and the suspect was
not answering his questions. I attempted to obtain the name of the suspect and he said his
name was . As Palm Springs Fire Department ("PSFD") personnel arrived on
scene and began to render aid to Blake, Blake appeared that he was going to fall over and I
supported him to prevent him from falling and injuring his head.
Captain Lyle (#15121), Engineer Arden (#15851) and Firefighter Shank (#16163) contacted
Blake and secured him to the stretcher provided by AMR Paramedic Riely Farrel and EMT
Rick Johnson. Paramedic Farrel requested I take the handcuffs off of Blake to position him
on the stretcher. I spoke with Sergeant Fieux and discussed alternative options, given the
circumstances and ultimately decided to secure the handcuff to the right side of the
stretcher, and use a soft restraint to secure the hand on the left side of the stretcher.
After Medical personnel secured Blake in the ambulance, male arrived and contacted me
who I identified by his California identification card as ( ). told me
he was responding to his friend's text for help at the location. I asked him to clarify what he
meant by text for help, and he showed me a text message sent to him from Blake stating "If
this messages reaches you… That means I'm in serious trouble tonight and I need your
help by calling 911 ans reporting a violent crime just took place 1". Blake included a map
location in the text message and sent the message to a group of 11 people. Officer Nanez
was observing, and asked how Blake got to this location, and said there's his
car right there, and pointed to it. Officer Nanez requested dispatch perform a records check

NARRATIVE
of the vehicle that was identified by and it returned Clear and registered
told me he and Blake had been together earlier in the day and had smoked
Marijuana, but nothing else. also told me Blake had stayed the previous night at
residence, located at . was just concerned about
the text and wanted to check up on Blake. I obtained contact information and
responded to Desert Regional Medical Center to photograph Blake and attempt to get a
medical release signed. I took 20 photos of Blake, including the injuries I was able to see,
including an abrasions to both his left and right elbows, an abrasion above his left eye, an
abrasion on his left wrist, what appears to be a puncture wound on his stomach. Blake had
dry skin all around his feet and knees, I was unable to to determine if the dry skin was from
the physical fight or a pre-existing condition. I attempted to get Blake's authorization for
medical release, but he refused to consent.
Blake was given an OK to book at the hospital and I transported him to PSPD without
incident to complete the booking paperwork.
Officer Nanez later transported Blake to Banning for booking without issue.

NARRATIVE
SUPPLEMENTAL:
On 09/02/18 I was on duty, in full uniform, in the City of Palm Springs, the County of
Riverside. At approximately 0415 hours, I was at the PSPD station assisting Officer Wilson
book evidence. This was following a physical altercation that Officers Gilbert and Crampton
were involved in at in the City of Palm Springs, County of Riverside.
While assisting Officer Wilson I picked up a large blue folding chair which I was advised by
Officers on scene to have been involved in a physical altercation with Officers Crampton
and Gilbert. As I carried the chair I observed a Taser Dart lodged in the fabric of the chair
which I was informed to have been deployed by Officers during the physical altercation.
I removed the Taser Dart from the chair and packaged it in an evidentiary box.
I later booked the Taser Dart into evidence at the downstairs locker number 05.
All evidence collected were securely placed in to evidence at the Palm Springs Police
Department. Please refer to Officer Wilson's reports for further details regarding evidence.

NARRATIVE
SOURCE:
On Tuesday, September 4th, 2018 I was a Detective assigned to the Crimes Against
Persons Unit of the Palm Springs Police Department. The Palm Springs Police Department
is located in the City of Palm Springs, County of Riverside. At approximately 0840 hours, I
was assigned to conduct follow-up investigation into this case.
INVESTIGATION:
I reviewed the police reports authored in this case. I noted that the following PSPD
personnel had authored reports in this case: Officer Crampton, Officer Gilbert, Officer
Calleros, Officer Enriquez, Officer Wilson, Officer Sandoval, Officer Christiansen, Officer
Merenda and Officer Delgado. The following is a summary of the information that I garnered
from those reports.
On the night of September 2nd, 2018 Officers Crampton and Gilbert responded to the
residence at Palm Springs, in reference to a subject who was
trespassing. Officers Crampton and Gilbert responded to the location and contacted the
reporting party, who was identified as told officers that he was
the owner of the residence and that he had a guest who was refusing to leave the location.
Officers also contacted the guest in question, who was identified as Marvin Blake (BLAKE).
asked Officers Crampton and Gilbert to remove BLAKE from the residence.
Officer Crampton spoke to BLAKE and told BLAKE that he needed to leave the location.
BLAKE refused to leave. Officers Crampton and Gilbert then attempted to physically
restrain and detain BLAKE. BLAKE physically resisted the officers' efforts to detain him and
a struggle ensued. During the struggle, both officers told BLAKE several times to stop
resisting and to submit to their commands. BLAKE ignored the officers' commands and
continued to fight with them. During the struggle, BLAKE struck both Officer Crampton and
Officer Gilbert several times with his arms and fists. Officer Crampton deployed a Taser
device on BLAKE and the deployment was ineffectual. BLAKE then retrieved a metal folding
chair and attempted to strike Officer Crampton with it. Officer Gilbert then deployed a

second Taser device on BLAKE. The second Taser deployment was also ineffectual. After
additional assaults by BLAKE on Officer Gilbert, Officer Crampton was able to successfully
deploy a Carotid Control Hold on BLAKE, rendering BLAKE unconscious. Officers then
placed BLAKE into handcuffs and under arrest.
During the course of the fight with BLAKE, Officer Crampon sustained a visible bleeding
abrasion to his left arm (near the elbow) as well as a visible abrasion to his right arm (elbow
area) and left knee and swelling to the right side of his jaw. Officer Gilbert sustained visible
scratches to his face as well as swelling to the left side of his jaw. A search of BLAKE's
person, incident to his arrest, revealed that he had a fixed-blade knife in his shorts pocket.
Officer Crampton determined that BLAKE had been in violation of the following sections of
the California Penal Code: 69, 148(a)(1), 245(c), 243(b) and 21310. BLAKE was
transported to Desert Regional Medical Center for medical assessment and then to the
Banning Jail for booking (See case file reports for additional information).
I used law enforcement computer databases to research whether or not BLAKE had any
criminal history. I was unable to locate any criminal history for BLAKE, prior to this incident.
Based upon the above information, I concur with Officer Crampton's determinations. I
request that the Riverside County District Attorney's Office review this case and consider
filing the above listed charges against BLAKE.

NARRATIVE
On 01/26/22, while working as the Palm Springs Police Department's Property Evidence
Specialist, I conducted an audit of the aforementioned property. This audit consisted of me;
-Putting on a new pair of rubber gloves
-While using a sterilized paper cutter and/or envelope razor I opened the aforementioned
item(s). Each item was processed individually with a sterilizing of equipment occurring
between items.
-I removed the item from its property envelope(s).
-Once down to its singular packaging, I weighed the item on a Ohaus Trooper Count
digital scale last serviced for accuracy on 09/29/2021 by Left Coast Scale
-The weight was verified and recorded onto the audit report
-I placed the item back into its previous packaging and sealed the envelope
-I then initialed and dated the seal and placed the item back into evidence
Assisting with sterilizing the equipment was Property Evidence Technician Rachelle
Campbell. Recording the data onto the audit report was Sgt Kelly Fieux.
Photos of the scale, setup, and equipment are recorded with the audit report.
