The purpose of this hearing is to consider an application by Selene Palm Springs, LLC, to amend a previously approved Planned Development District (PD 333) and Tentative Tract Map 35236 for the construction of a 156-room hotel, 40 residential units on approximately 7.8 acres located at the northwest comer of Avenida Caballeros and Amado Road. The proposed amendment will replace the Farmhouse/Event Space at the southeast section of the site with 24 condominium units; reconfiguration of the previously approved 12 condo units at the northern end of the site; adjustment of residential tower from 28 to 29 units and reconfiguration of residential pools. At the hearing, the City Council will also consider an associated Settlement and Development Agreement that clarifies the schedule for the development of the project, other obligations and rights of the Parties, and settles all previous disputes between the Parties. The terms of the Settlement and Development Agreement are intended to facilitate the timely development of the project. . The Planning Commission reviewed the item, excluding the Settlement and Development Agreement, at their meeting of September 28, 2022 and voted 3-2-2 to recommend approval of the PDD 333 amendment to the City Council with added changes. ENVIRONMENTAL DETERMINATION: ENVIRONMENTAL DETERMINATION: A Mitigated Negative Declaration (MND) was previously adopted by City Council on July 18, 2007. An Addendum to the MND was prepared in 2017 which finds that the Amended Project will not result in any new significant environmental impacts or substantially increase the severity of previously identified significant impacts as compared to the previously approved project. Furthermore, the Addendum concludes that none of the conditions described in Section 15162 of the CEQA Guidelines calling for preparation of a subsequent MND or Environmental Impact Report (EIR) have occurred and therefore the Addendum to the MND is appropriate to satisfy CEQA requirements for the Amended Project.
