Palm Springs STAFF ANALYSIS: The owner for the property located at 1109 Via Ten is., Palm Springs did not hold a Vacation Rental Registration Certificate by the City of Palm Springs as of the date of administrative citation issuance on July 29, 2021. Staff has determined that the owner has, without a Registration Certificate, advertised and operated the property at 1109 Via Ten is. as a Vacation Rental from elements as follows in violation of Palm Springs Municipal Code 5.25.040 (a): 1. Advertisement airbnb.com/rooms/45163726 listed as "Stunning Private Resort Condo & Complex" ATTACHMENT 5 2. A Code Compliance Officer submitted an online booking inquiry to stay during the dates September 3, 2021 to September 19, 2021 (16 nights); ATTACHMENT 6 3. A response was received by the Code Compliance Officer on availability for the dates September 3, 2021 to September 19, 2021 (16 nights); ATTACHMENT 6 The initial booking inquiry by the Code Compliance Officer for the dates September 3, 2021 to September 19, 2021 (16 nights) was not available as communicated by the host and that the property would be available September 6, 2021. ATTACHMENT 6. Communication between the Code Compliance Officer continued and new dates between September 11, 2021 to September 26, 2021 (15 nights) were offered. Staff finds that the advertisement airbnb.com/rooms/45163726 and inquiry affirmation for the dates September 11, 2021 to September 26, 2021 (15 nights) for stay at property 1109 Via Ten is is in violation of §5.25.040(a) and proceeded to issue Administrative Citation AB0345, in the amount of $5,000, to Susan Baraz, the owner on title, for operating a Vacation Rental without a Vacation Rental Registration Certificate. The Administrative Citation was mailed by the Department of Special Program Compliance staff to the mailing address on title. The following Palm Springs Municipal Codes sections and Regulations are applicable to this matter. The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows: "Vacation Rental" means a single-family dwelling, or any portion thereof, utilized for occupancy for dwelling, lodging, or sleeping purposes without the Owner being present for a period of twenty-eight (28) consecutive days or less, ... " Palm Springs Municipal Code §5.25.040(a) reads as follows: The operation of a Vacation Rental or a Homeshare Interest without a Vacation Item 4 - 3 Administrative Appeals Board Staff Report January 26, 2022 Vacation Rental Appeal -1109 Via Ten is. Palm Springs Rental Registration Certificate is prohibited. Palm Springs Municipal Code §5.25.090(c) reads as follows in regards to the administrative fines: (c) Any person who operates a Vacation Rental without a Vacation Registration Certificate, shall be liable to the City for the payment of transient occupancy tax pursuant to the provisions of the Palm Springs Municipal Code Chapter 3. 24, including without limitation penalties and interest, payment of an administrative fine in the amount of Five Thousand Dollars ($5,000.00), and permanent ineligibility to operate a Vacation Rental in the City ... " Administrative Regulation "Operation of a Vacation Rental" dated 07/2017 defining "Operation" of a Vacation Rental to include the following: 1. "Advertisement" of the property means on any web based advertising, hosting platform, print media, bulletin, signage, radio, and television or on any other medium for the purposes of promoting interest in, testing the market for, or soliciting the occupancy of a property for a period of twenty-eight (28) consecutive days or less. 2. An owner, agent or other representative of the owner has an interest in rental, exchange, trade, gift, or grant of a guest stay at a property of less than twenty-eight (28) consecutive days or less. 3. An owner, agent or any other representative of the owner interacts with another party whether directly or indirectly through personal or digital/electronic contact with the intent to provide availability of the property for occupancy of 28 days or less, or to complete a rental and/or reservation of the property for future occupancy of 28 days or less." Administrative Regulation "Authority for the Issuance of Administrative Citations" dated 08/2014 reads as follows: "Vacation Rental Enforcement Officials are hereby authorized to issue, an Administrative Citation for the violation of the provision of Chapter 5. 25 of the Palm Springs Municipal Code without first complying with the pre-citation or courtesy notice requirements contained in PSMC Section 1. 06. 030." Please see attached correspondence. 41 Page Item 4 - 15 August 16, 2021 To Members of the Administrative Appeals Board: Re: Citation #AB0345 My name is Susan Baraz and I've just received a certified letter regarding not having a Rental Realstration Certificate for my condo in PS and to pay a fine of $5000. I am absolutely clueless and beside myself, in terms of what this is all about, as I've never in my whole life done anything untoward or illeaal, and at 78 yrs old, I don't think I have reason to start now. I've just retired and was planning on having my condo to rent, from time to time as a means to have a little additional Income to make my big step to retire, a bit easier for me. I've worked my entire life supporting myself and my, now grown, daughter. I'm asking for an appeal to try to rectify this situation and hopefully make it possible to just be able to rent my place whenever my family and I are not using it. I will do anything that's lega lly required for that to happen. To that end, now that I have been notified of the registration requirements, I am undertaking to register my property with the City. I had absolutely no idea about this ID number. I still don't. I never received any news of it-and even the certified letter just arrived to my address though was mailed on July 29th. The last time I actually had a renter was almost a year ago through the Alrbnb site, which I decided to go onto in 2019, to coincide with my winding down at work to finally retire. I have tried to contact the person listed on the certified letter several times and also sent an email to no avail. Thank you for looking at this appeal-I am beyond upset and quite frantic to have received this citation and want to get everything sorted out so that things come right again. This has caused such a heavy burden added onto almost two years of Covld Isolation that I'm just overwhelmed-at a time of my life when I only want to find some tranquility. Please see the attached appeals form and her letter addressed to the AAB in connection with the appeal. I have attached my check in the amount of $802.00 as the appeal fee. Please also consider my statement in support of the appeal: I have known Susan Baraz for many years. She is an entirely ethical person, a responsible citizen, and never known to have violated any law. She loves Palm Springs and the people in it, a veritable ambassador for the community. She was genuinely shocked at the citation and was completely unaware of the City's requirement to register her condo. She will be registering now. Ms Baraz occasionally leases her condo to visitors as a means to supplement her retirement. She is a single woman, with family living far away. Prohibiting her from renting the property in the future will seriously affect her already diminished income as a retiree.
