FARRELL DRIVE., PALM SPRINGS, CALIFORNIA. BY: Department of Special Program Compliance SUMMARY Krista Reddaway has requested an appeal of administrative citation A6863 issued in the amount of $500 and two (2) year suspension of the Vacation Rental Registration Certificate #4679 for the property located at 1350 S. Farrell Drive, Palm Springs, California. RECOMMENDATION: 1)Open the Appeal Hearing and accept public testimony. 2)Adopt Resolution No. __ __. A RESOLUTION OF THE ADMINISTRATIVE APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE APPEAL OF KRISTA REDDAWAY FOR THE PROPERTY LOCATED AT 1350 S. FARRELL DRIVE, PALM SPRINGS, CALIFORNIA REGARDING ADMINISTRATIVE CITATION A6863 ISSUED IN THE AMOUNT OF $2,500 AND THE TWO-YEAR SUSPENSION OF VACATION RENTAL REGISTRATION CERTIFCATE #4679. STAFF ANALYSIS On October 9, 2021 the City of Palm Springs Vacation Rental Hotline received a call for the property located at 1350 S. Farrell Drive, Palm Springs regarding a complaint for cars exceeding parking limit. Code Officer Wade arrived and observed a violation of Palm Springs Municipal Code "PSMC" 5.25.070(c) cars exceeding parking limit at Vacation Rental located at 1350 S. Farrell Drive. Code Officers Wade contacted the occupants, discussed the findings and violation, and attempted to issue a citation to the responsible renter; however, the guests represented the responsible renter was not there. Code Officer Wade contacted the local contact for the responsible renter's ID; however, to no Item 3 - 1 65Item 3 - 2 Administrative Appeals Board Staff Report March 23, 2022 -Page 3 Vacation Rental Appeal -1350 S. Farrell Drive, palm Springs, California First Citation Administrative Citation A6591 was issued on June 30, 2021. The citation was issued to a guest for violation of 5.25.070(9) that occurred on June 30, 2021; Music audible at property line. The Code Enforcement Officer report is attached as ATTACHMENT 4. The following Palm Springs Municipal Code sections and Regulations are applicable to this matter. The Palm Springs Municipal Code, Vacation Rentals §5.25.070 -Operational Requirements and Standard Conditions: (g)"Notwithstanding the provisions of Section 11. 7 4. 043, any radio receiver, musical instrument, phonograph, loudspeaker, sound amplifier, or any machine or device for the producing or reproducing of any sound shall be conducted within a fully enclosed Vacation Rental unit and shall not be audible at the property line of the Vacation Rental." (h)(1) "Prior to occupancy pursuant to each separate occasion of rental of a Vacation Rental, the Owner or the Owner's agent or representative shall enter into a written Contract with a Responsible Person where (1)the Responsible Person will provide the Responsible Person's name, age, address, and a copy of a government issued identification" Palm Springs Municipal Code §5.25.090 (b)-Violations (b )"Upon the third violation in any twelve month period, the City Manager shall suspend the Vacation Registration Certificate for two (2) years". ADMINISTRATIVE REGULATION "Violation Count for Purposes of Suspending a Vacation Rental Certificate"-Effective 8/2017 Procedure: A.Section 5.25.090(b) specifies, "Upon the third violation in any twelve (12) month period, the City Manager shall suspend the Vacation Rental Certificate for two (2) years." Following is a clarification how violations are counted. 1.Administrative citations for violations of Chapter 5. 25 issued to the Vacation Rental guest, Owner, or Owner's agent prior to April 16, 2017 will count towards the calculation of the three (3) violations in any twelve (12) month period for suspending the Vacation Rental Certificate for such property in accordance with Section 5.25.090(b). 2.There will be no suspension unless at least one (1) violation occurs under new Ordinance No. 1918. WHEREAS, the City investigated in detail and found the property 1350 S. Farrell Drive, Palm Springs, California to be in violation pursuant to Section 5.25.070 (h)(1) on October 9, 2021 and issued administrative citation A6863; and WHEREAS, the City investigated in detail and found the property 1350 S. Farrell Drive, Palm Springs, California to be in violation pursuant to Section 5.25.070 (g) on July 31, 2021 and issued administrative citation A6701; and WHEREAS, the City investigated in detail and found the property 1350 S. Farrell Drive, Palm Springs, California to be in violation pursuant to Section 5.25.070 (g) on June 30, 2021 and issued administrative citation A6591 on June 30, 2021 O; and WHEREAS, upon the third violation in any twelve-month period, the City Manager shall suspend the Vacation Registration Certificate for two (2) years; and WHEREAS Krista Reddaway was issued a suspension of the Vacation Rental Registration Certificate for the property located at 1350 S. Farrell Drive, Palm Springs, California on November 24, 2021 with an effective suspension date of December 20, 2021,and WHEREAS, Krista Reddaway for the property located at 1350 S. As owners of 1350 South Farrell Dr., we have con sistently observed all rules set forth by the city ofPalm Springs in the short term rental permit. We recently changed property management companies to a much more professional and stringent management approach and upon receipt of this violation, we found that the former property manager was not collecting copies of the renter's identification as they were new to the property management process. We have since remedied this and the new management company (LuxBox agency) will be collecting all necessary information and identification upfront from renters so we never have this problem ever again. We have also instituted much more stringent controls and installed noise decibel alarms around potential guest noise to ensure a quality stay for the auest and also for the surroundina residents of the neiahborhood. 3.Specify the relief you are seeking/ Especiflque el alivio que busca.Asking to please remove this 3rd citation and reinstate our short term rental permit. The song observed, identi 1ed via m de artment issued mobile device, was titled I contacted the occupants at the front door and rie y is cussed the complaint received and the violation observed with the responsible renter Jarrett. Jarrett stated that they were told the rules, and that they thought the rule was to keep the music low. I issued Jarrett a good neighbor brochure and briefly discussed the rules related to music. Jarrett handed it back to me and said he didn't need it. He then stated that the music was being played from inside the house and that there was no way I would've been able to hear it from the street. I tried to inform Jarrett of how I conducted my observation, but he was dismissive and appeared frustrated with the situation. Citation issued. Attempted to contact the listed local contact, David Rios, but the call went unanswered and his voicemail inbox was full. The recorded message asked to send a text message if it was an emergency, so I sent a text to the number as instructed at 21 :33. As of this writing I have not gotten a response. Yes Additional Notes: I arrived at the property at 1502 and observed the property from the street in f rant of the location. A violation for the amount of cars parked in the driveway was observed. There were 5 cars parked in the property's driveway and the home is registered as a 4 bedroom. I contacted the occupants and asked to speak with the responsible renter. After a few moments the responsible renter came to the door and I explained the complaint and our observations. I attempted to issue a citation to the responsible renter and was advised they were not there. Pictures of the front of the home with address are a must along with a picture of the violation if applicable he stated that he would send the .identification of the responsible renter to me. After a few hours I texted the LC because I hadn't received the ID and never heard back. Issuing the citation to the owner since I don't have a responsible renter at this time. I also was unable to locate any contract summaries for the location and issued a citation to the owner tor that as well. I contacted RP to advise of the result. Farrell Dr., Palm Springs, CA 92264 Upon review of the recent activity at your short-term rental property at 1350 S. Farrell Dr., Palm Springs, the City of Palm Springs is suspending your Vacation Rental Registration Certificate for a period of two (2) years. In order to minimize the negative impact to the near-term guests visiting our City who may be currently booked at your property, the suspension period will begin on December 20, 2021 and will end on December 20. 2023. All advertising of your property for short term renting must cease immediately. During the suspension period, your property may not be rented for short term stays (28 days or less) but you may rent your property as a long term rental. This suspension is being made in accordance with the City of Palm Springs Municipal Code Section 5.25.090(b) as follows: "Upon the third violation in any twelve-month period, the City Manager shall suspend the Vacation Registration Certificate for two (2) years."
