HomeMy WebLinkAboutItem 4 - CorrespondenceAdministrative Appeals Board City of Palm Springs May 24, 2022 I am writing to provide information re: the Hearing outlined below: APPEAL OF THE ADMINISTRATIVE DECISION THAT KIMBERLY KEYS AND KENNETH ROSENFELD ARE PERMANENTLY INELIGIBLE TO OPERATE A VACATION RENTAL IN THE CITY OF PALM SPRINGS AND THE ADMINISTRATIVE FINE OF $5,000 FOR OPERATING AN UNREGISTERED VACATION RENTAL PROPERTY LOCATED AT 2965 E. AVERY DR., UNIT F, PALM SPRINGS, CALIFORNIA RECOMMENDATION: 1) Open the Appeal Hearing and accept public testimony. 2) Adopt a Resolution entitled, !A RESOLUTION OF THE ADMINISTRATIVE APPEALS BOARD OF THE CITY OF PALM SPRINGS, CALIFORNIA, ON THE APPEAL OF KIMBERLY KEYS AND KENNETH ROSENFELD FOR THE PROPERTY LOCATED AT 2965 E. AVERY DR., UNIT F, PALM SPRINGS, CALIFORNIA REGARDING ADMINISTRATIVE CITATION AB0366 ISSUED IN THE AMOUNT OF $5,000 AND THE PERMANENT INELIGIBILITY TO OPERATE A VACATION RENTAL IN THE CITY OF PALM SPRINGS.” 
 I live adjacent to 2965 F E. Avery Drive. I had been noticing people going into the unit, staying for a few days and then leaving. I would observe, and occasionally speak the the woman who cleans the unit in-between visitors. She agreed that she was there “ a lot.” I noticed her cleaning sheets in the washer and dryer which are located in the garage (she had the garage door open). This had been going on for a long time and so since I have a “RING” doorbell, started to document specific dates of this situation. Other homeowners have complained about the numerous people in and out of that unit. Here is what I documented (which was to the best of my ability): 1.Monday, 3/21/22 the cleaning lady was there. 2.Thurs. 3/24/2022 the cleaning lady was there and 3.Thursday, 3/24/22- new people arrived. 4.Monday, 3/28/22 - the cleaning lady was there prior to new people arriving (although I hadn’t noticed) the new people. 5.Wednesday, 3/30/22 the cleaning lady was there. 6. Saturday, 4/2/22 new people arrived. 7.Monday, 4/4/22 the cleaning lady was there. 8.Wednesday, 4/6/22 new people arrived. 9.Sunday 4/10/22 cleaning lady was there and 10.Sunday, 4/10 2022 new people arrived later in the day. 11.Monday, 4/18/2022 the cleaning lady was there. (I was out of town for a few weeks after that so began documenting again after returning). 12. Thursday, 5/12 new people arrived 13. Saturday 5/14/2022 new people left and new people arrived in the evening. Apparently, there are people there now as notice that the lights are on and off. The additional thing I would like to mention is that in conjunction with the City’s rules regarding short-term rentals, this practice is also a violation in our HOA’s governing documents (CC&R’s).
