Calle San Antonio, Palm Springs. Calle San Antonio, Palm Springs STAFF ANALYSIS: The owner for the property located at 3960 E. Calle San Antonio, Palm Springs did not hold a Vacation Rental Registration Certificate by the City of Palm Springs as of the date of administrative citation issuance on March 24, 2022. Staff has determined that the owner has, without a Registration Certificate, advertised and operated the property at 3960 E. Calle San Antonio as a Vacation Rental from elements as follows in violation of Palm Springs Municipal Code 5.25.040 (a): 1. Advertisement Airbnb.com/49079556 listed as “Stylish Affordable Palm Springs Oasis” ATTACHMENT 5 2. Advertisement Airbnb.com/49079556 shows 23 reviews between August 2021 and February 2022 ATTACHMENT 6 3. A Code Compliance Officer submitted an online booking inquiry to stay during the dates August 25 through August 29 (4 nights); ATTACHMENT 7 4. A response was received by the Code Compliance Officer confirming availability for the dates August 25 through August 29 (4 nights); ATTACHMENT 7 Staff finds that the Airbnb.com/49079556 and inquiry affirmation for the dates August 25 through August 29 (4 nights) for stay at property 3960 E. Calle San Antonio, is in violation of §5.25.040(a) and proceeded to issue Administrative Citation AB0374, in the amount of $5,000, to Ronald C Haus, the owner on title, for operating a Vacation Rental without a Vacation Rental Registration Certificate. The Administrative Citation was mailed by the Department of Special Program Compliance staff to the mailing address on title. The following Palm Springs Municipal Codes sections and Regulations are applicable to this matter. The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows: "Vacation Rental" means a single-family dwelling, or any portion thereof, utilized for occupancy for dwelling, lodging, or sleeping purposes without the Owner being present for a period of twenty-eight (28) consecutive days or less,…” Palm Springs Municipal Code §5.25.040(a) reads as follows: The operation of a Vacation Rental or a Homeshare Interest without a Vacation Rental Registration Certificate is prohibited. Calle San Antonio, Palm Springs (c) Any person who operates a Vacation Rental without a Vacation Registration Certificate, shall be liable to the City for the payment of transient occupancy tax pursuant to the provisions of the Palm Springs Municipal Code Chapter 3.24, including without limitation penalties and interest, payment of an administrative fine in the amount of Five Thousand Dollars ($5,000.00), and permanent ineligibility to operate a Vacation Rental in the City…” Administrative Regulation “Operation of a Vacation Rental” dated 07/2017 defining “Operation” of a Vacation Rental to include the following: 1. “Advertisement” of the property means on any web based advertising, hosting platform, print media, bulletin, signage, radio, and television or on any other medium for the purposes of promoting interest in, testing the market for, or soliciting the occupancy of a property for a period of twenty-eight (28) consecutive days or less. 2. An owner, agent or other representative of the owner has an interest in rental, exchange, trade, gift, or grant of a guest stay at a property of less than twenty-eight (28) consecutive days or less. 3. I am so, so sorry about this, and I am willing to do whatever I have to do to rectify this. I bought this dilapidated house about 8 years ago in Demuth Park. I am a teacher, a single-father who raised 5 kids, and I saved many years to renovate my Palm Springs house, making a weekend get-away for me and my kids, and to prepare for a retirement home. I had never anticipated renting it out. l am not a landlord or rental company. I am not a wealthy man, and obviously Demuth Park is one of Palm Spring's lower-property value neighborhoods, but I have had a home there for over l O years and was one of the home owners to begin gentrification. I finished the renovation last January during COVID. By the end of summer, friends had convinced me I should at least try renting it short-term and see if that worked for me since my job as a teacher and my weekend job as a minister at a church in San Diego wasn't allowing me to get out as much as I had anticipated. Several acquaintances referred a local Palm Spring house manager that could help me with obtaining permits, cleaning and managing the property. Over the next months, I paid him thousands of dollars. He provided a certificate, fitted my house with fire/CO detectors, first-aid kits, fire extinguishers, etc, and eventually told me I was ready to rent. I can provide proofs of monies paid, text chains, etc. It ended badly. Eventually I, and several other clients, realized he was a meth addict. He disappeared from town having stolen from several of us and leaving our homes a mess having lived there illegally when renters weren't there. I did not realize until I received my fine from the city that my permits were not valid. I have filled out all the necessary paperwork. I have talked with electricians, contractors, ready to do whatever I need to do to rectify this. Please know that I was not trying to do something illegal. I thought I had obtained proper permit with my house mgt service. I was not trying to hide anything. I was listed publicly on AirBnb thinking all was good.
