Item 5 - 2Administrative Appeals Board Staff Report July 27, 2022 Vacation Rental Appeal -1650 Ridgemore Dr., Palm Springs BACKGROUND On March 2, 2022 staff from the Department of Special Program Compliance returned an application for a Vacation Rental Registration Certificate for the property located at 1650 Ridgemore Dr., Palm Springs. The application was not accepted due to missing necessary documents and payment. ATTACHMENT 5 On March 9, 2022, staff returned payments for a Vacation Rental Certificate for the property located at 1650 Ridgemore Dr., Palm Springs. ATTACHMENT 6 On May 28, 2022 the cities vacation rental hotline received two complaints. The first complaint was received at 12:58pm and stated that" I want to report really loud music coming from the rental". The second complaint was a received at 1 :34pm and stated "loud music playing and thinks its not registered". ATTACHMENT 7 STAFF ANALYSIS: The owner for the property located at 1650 Ridgemore Dr., Palm Springs did not hold a Vacation Rental Registration Certificate by the City of Palm Springs as of the date of administrative citation issuance on May 31, 2022. Staff has determined that the owner has, without a Registration Certificate, advertised and operated the property at 1650 Ridgemore Dr., as a Vacation Rental from elements as follows in violation of Palm Springs Municipal Code 5.25.040 (a): 1. Check-in instructions and booking code 2ED3VB3P from a guest for short-term stay between May 27, 2022 to May 31, 2022 ATTACHMENT 8 2. Advertisement avantstay.com/502136 title" El Reino" ATTACHMENT 9 3. Advertisement airbnb.com/rooms/595572374241093085 titles " Available for Stagecoach! Spectacular Estate w/Pool & Tennis Court! Advertisement airbnb.com/rooms/595572374241093085 guest review from May 2022 states "We had a blast all weekend by the perfectly maintained pool and slept amazingly in comfy beds". ATTACHMENT 9 Staff finds that the booking information provided by a guest and the advertisements avantstay.com/502136 and airbnb.com/rooms/595572374241093085 for the property 1650 Ridgemore Dr., is in violation of §5.25.040(a) and proceeded to issue Administrative Citation AB0386, in the amount of $5,000, to Chip Martin LLC, the owner on title, for operating a Vacation Rental without a Vacation Rental Registration Certificate. The Administrative Citation was mailed by the Department of Special Program Compliance staff to the mailing address on title.
Item 5 - 3Administrative Appeals Board Staff Report July 27, 2022 Vacation Rental Appeal -1650 Ridgemore Dr., Palm Springs The following Palm Springs Municipal Codes sections and Regulations are applicable to this matter. The Palm Springs Municipal Code §5.25.030 Definitions, reads as follows: "Vacation Rental" means a single-family dwelling, or any portion thereof, utilized for occupancy for dwelling, lodging, or sleeping purposes without the Owner being present for a period of twenty-eight (28) consecutive days or less, ... " Palm Springs Municipal Code §5.25.040(a) reads as follows: The operation of a Vacation Rental or a Homeshare Interest without a Vacation Rental Registration Certificate is prohibited. Palm Springs Municipal Code §5.25.090(c) reads as follows in regards to the administrative fines: (c) Any person who operates a Vacation Rental without a Vacation Registration Certificate, shall be liable to the City for the payment of transient occupancy tax pursuant to the provisions of the Palm Springs Municipal Code Chapter 3. 24, including without limitation penalties and interest, payment of an administrative fine in the amount of Five Thousand Dollars ($5,000.00), and permanent ineligibility to operate a Vacation Rental in the C·t ,, I y ... Administrative Regulation "Operation of a Vacation Rental" dated 07/2017 defining "Operation" of a Vacation Rental to include the following: 1. "Advertisement" of the property means on any web based advertising, hosting platform, print media, bulletin, signage, radio, and television or on any other medium for the purposes of promoting interest in, testing the market for, or soliciting the occupancy of a property for a period of twenty-eight (28) consecutive days or less. 2. An owner, agent or other representative of the owner has an interest in rental, exchange, trade, gift, or grant of a guest stay at a property of less than twenty-eight (28) consecutive days or less. 3. An owner, agent or any other representative of the owner interacts with another party whether directly or indirectly through personal or digital/electronic contact with the intent to provide availability of the property for occupancy of 28 days or less, or to complete a rental and/or reservation of the property for future occupancy of 28 days or less."

Item 5 - 14To The City of Palm Springs Administrative Citation Program, We received our citation for the incident on May 31st, 2022. While it is our property and are responsible for what goes on, we were told disingenuous information. We purchased the property as a second home and intended to retire there, this was not purchased just to be an income generator. Our hope was to make enough to pay the mortgage, care of the property, and hopefully have enough left over to pay down the mortgage as quick as possible. This house was our dream retirement home. After painting the entire property, lighting, new floors, we were finally ready to rent the home in January of 2022. We signed with a STR property management company and they assured me they would take care of all the permit paperwork. I offered to drive from Los Angeles and hand deliver it myself to get it going as quick as possible. We needed to start covering the mortgage. I also asked them if they needed the pool inspection receipt and a copy of our LLC. They told me they did not. I assumed since this was their business, I was under the wrong impression or something had changed with the city. I repeatedly checked in because I thought it was odd we hadn't had our inspection with the city. They kept telling me we were right on track. In April, on the day we were set to list, I received an email from the agency saying they found out they needed a pool inspection receipt and copy of our LLC. The two documents I specifically asked about. When it was taking forever to hear back what was going on, I called the city myself. To which I found out that the city had sent the paperwork back to them for not having the complete paperwork AND payment. They had sent it back over a month before and no one did anything. It was as if we hadn't even applied and we were supposed to be listing that day. We were starting all over and now the permit process was taking 90 days. This was a massive loss for us as we were missing the big Coachella/Stagecoach window. I sent an email to the agency extremely upset about this financial loss that would help pay for the house and honestly, didn't hear back from them. We went on our honeymoon and tried to let the loss go. On April 22nd the company followed up and asked if we would want to rent without a permit. I thought this wasn't a great idea, but they assured me that they hadn't had a problem before. I received an email (please see the screenshot included) "per the ordinance, she can technically be fined ~$5000 and it could impact her permit application. That is what the letter of the law states. That being said, we have seen very little enforcement from the city of palm springs. And moreover, many cities grant some leeway if you are in the application process for a permit." From the statement of seeing very little enforcement and especially the leeway if you are in process of the permit, I thought the worst that could happen was a fine. I figured the company that has been doing this would know. We risked the fine because we needed to pay the mortgage and losing April was huge for us. The company started booking for May. On May 10th I sent the company an email stating that I was no longer comfortable with renting out our home after finding out from my realtor in Los Angeles that his colleagues in Palm Springs informed him that. "No. The city of Palm Springs is extremely strict." I told the company that they could keep the current booking. I didn't want to cancel on the poor renters that had made their plans. The company was renting the house so low, if their stay was fined it would end up costing us thousands, but I still kept it because I felt bad for them. On May 11th they agreed to book out the rest of May and fingers crossed we'll be set for the permit for June.
Item 5 - 15On June 1st I emailed the company again about not renting. While booking out our stay at the home I saw there was a new short rental for the first weekend in June. I emailed them saying that I had asked that they not be booking and how is it even happening when all the sites were set up for 30 day stays? They assured me it wouldn't happen again. Then last week I received the letter from Palm Springs saying we were being fined and are losing our privileges to rent. Essentially the final nail in the coffin of having our dream retirement home. Even if we were to get it back, I'm not sure after the months lost from the permit process that we can keep it and be comfortable with the financials of it all. So we have listed the property with a local realtor. The contracts are signed and it will be on the market July5th. I understand that we rented outside of having a permit, but as you can see from above, I thought the city was okay with it while in process. Once I found out they weren't, I said to stop. However, I didn't want to ruin someone's vacation, so I let them stay. While I know we were complicit in renting the house out, it was under the impression that it wouldn't be a problem this extreme. And when I found out that it is a problem, I immediately tried to rectify it, except for not wanting to ruin someone's vacation. From what I have explained above, I'm asking that you consider refunding the fine so that we don't have another loss from this process. And while we have listed the home to sell, I ask for your consideration in letting us go through with the permit process so that in the worst case scenario we haven't been able to sell the house, we have a backup to not go deep underwater. We need to have money coming in if it's been sitting for months. Hopefully this won't be the case.
Item 5 - 16The app is still showing the other stays and that ours fOJ PS i5 canceled. Lighthouse still has it listed, though. That's fine about the cleaning fee, understand. I am a bit confused about why there are short stays still being booked for June. Did we secure the permit? I had asked that we stoP renting for-shorter than 31 days until we do have it because we risk not getting our permit at all. I don't even know how they're getting booked when the sites all say 31 days when trying to book a reservation. We can keep the current bookings f0f June, but after those I realty don't want to risk not being able to get our permit at all. After what happ~ary, my trust isn't really wit~·s pennit department.
