HomeMy WebLinkAbout25179RESOLUTION NO. 25179 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPOINTING A RETIRED ANNUITANT AS AN INTERIM TO THE VACANT POSITION OF SENIOR HUMAN RESOURCES SPECIALIST FOR THE CITY OF PALM SPRINGS UNDER GOVERNMENT CODE SECTION 21221(H) EFFECTIVE JANUARY 22, 2024 WHEREAS, Government Code section 21221(h) of the Public Employees' Retirement Law permits the governing body to appoint a CalPERS retiree to a vacant position requiring specialized skills during recruitment for a permanent appointment, and provides that such appointment will not subject the retired person to reinstatement from retirement or loss of benefits so long as it is a single appointment that does not exceed 960 hours in a fiscal year; and WHEREAS, the City Council desires to appoint Kim Peacher, a retired annuitant, as an interim appointment to the vacant position of Senior Human Resources Specialist under Government Code sections 21221(h) and 7522.56, effective January 22, 2024; and WHEREAS, an appointment under Gov. Code section 21221(h) requires the retiree is appointed into the interim appointment during recruitment for a permanent appointment; and WHEREAS, the recruitment for a permanent replacement for this position is active and publicly posted; and WHEREAS, Kim Peacher possesses the required specialized skills to perform the duties of Interim Senior Human Resources Specialist; and WHEREAS, the appointment shall end on June 30, 2024, or when a permanent Senior Human Resources Specialist is hired, whichever comes first; and WHEREAS, this section 21221(h) appointment shall only be made once; and WHEREAS, the appointment letter between Kim Peacher and the City has been reviewed by this body and is attached; and WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS, the compensation paid to a retired annuitant cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173,333 to equal the hourly rate; and Resolution No. 25179 Page 2 WHEREAS, the fiscal year 2023-2024 minimum monthly base salary for this position is $6,728 and the hourly equivalent is $38.82, and the maximum monthly base I salary for this position is $9,052 and the hourly equivalent is $52.22; and WHEREAS, the hourly rate paid to Kim Peacher will be $49.70; and WHEREAS, Kim Peacher has not and will not receive any other benefit, incentive, compensation in lieu of benefit or other form of compensation in addition to this hourly pay rate. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: RESOLVED, that the governing body of the City of Palm Springs hereby certifies the nature of the appointment of Kim Peacher as described herein and in the attached appointment letter, and that this appointment is necessary to fill the critically needed position of Senior Human Resources Specialist for the City of Palm Springs effective January 22, 2024 in order to provide benefit administration while the City is engaged in active recruitment to permanently fill the position.
