HomeMy WebLinkAboutARCH REV - RES NO 1041RESOLUTION NO. 1041 A RESOLUTION OF THE ARCHITECTURAL REVIEW COMMITTEE OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A SIGN PROGRAM AMENDMENT APPLICATION FOR THE THOMPSON HOTEL LOCATED AT 414 NORTH PALM CANYON DRIVE (APN: 513-081-049), ZONE CBD, SECTION 15 (CASE SNP-2023-0081). THE ARCHITECTURAL REVIEW COMMITTEE FINDS AND DETERMINES AS FOLLOWS: A. Brandon Dedmon of SMS Architects ("Applicant"), on behalf of Hall Palm Springs, LLC ("Owner"), filed a Sign Program Amendment application, Case SNP-2023-0081, with the City of Palm Springs, pursuant to Palm Springs Zoning Code (PSZC) Section 93.20.08(H) ("Sign Program for Multi -Tenant Buildings") for the Thompson Hotel located at 414 North Palm Canyon Drive ("the Project"). B. Pursuant to Palm Springs Zoning Code (PSZC) Section 93.20.08(H)(1), a Sign Program is required for any multi -tenant building or development project with more than one (1) tenant. Once implemented, the Sign Program is required to remain in force until a new program is submitted and approved. C. Pursuant to Palm Springs Zoning Code (PSZC) Section 93.20.08(H)(3), a Sign Program which fully conforms to the applicable Sign Ordinance regulations may be approved by the Director of Planning Services. D. Pursuant to Palm Springs Zoning Code (PSZC) Section 93.20.08(H)(4), a Sign Program which varies from the specific requirements of the Sign Ordinance regulations may be approved by the Architectural Review Committee (ARC), given that such a Sign Program meets the required findings stipulated in PSZC Section 93.20.08(H)(4). E. On November 15, 2023, the Department of Planning Services approved a Sign Program application, Case SNP-2023-0062, for the Thompson Hotel, with the exception of the signage which did not conform the requirements of the Sign Ordinance regulations (PSZC Section 93.20.06). F. On December 4, 2023, the City's Architectural Review Committee held a public meeting in accordance with applicable public law. At said meeting, the Architectural Review Committee carefully reviewed and considered all of the evidence presented in connection with the Project, including, but not limited to, the staff report, and all written and oral testimony presented. THE ARCHITECTURAL REVIEW COMMITTEE RESOLVES Section 1: Commercial sign installation is considered a project pursuant to the California Architectural Review Committee Resolution No. 1041 Case SNP-2023-0081 —Thompson Hotel Sign Program Amendment December 4, 2023 Page 2 of 2 Environmental Quality Act (CEQA). The Architectural Review Committee has evaluated the Project pursuant to CEQA and determined it to be Categorically Exempt from further analysis under CEQA Guidelines Section 15311(a) (Class 11, Accessory Structures). Section 2: As demonstrated in the staff memorandum, the Project meets the required findings stipulated in PSZC Section 93.20.08(H)(4) as conditioned. Section 3: Based upon the foregoing, the Architectural Review Committee hereby approves Case SNP-2023-0081 for a Sign Program Amendment for the Thompson Hotel located at 414 North Palm Canyon Drive, subject to the conditions of approval attached herein as Exhibit A. ATTEST: Christopher Hadwin Department of Planning Services Director CITY OF PALM SPRINGS, CALIFORNIA RESOLUTION NO. 1041 EXHIBIT A Case SNP-2023-0081 Thompson Hotel - Sign Program Amendment 414 North Palm Canyon Drive (APN: 513-081-049) December 4, 2023 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the City Engineer, Director of Planning Services, Building Official, the Chief of Police, the Fire Chief or their designee, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. ADMINISTRATIVE CONDITIONS ADM 1. Proiect Description. This approval is for the project described per Case SNP- 2023-0081 except as modified by the conditions below. ADM 2. Conform to all Codes and Regulations. The project shall conform to the conditions contained herein, all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, and any other City County, State and Federal Codes, ordinances, resolutions and laws that may apply. ADM 3. Indemnification. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case SNP-2023-0081. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of any such claim, action or proceeding or fails to cooperate fully in the defense, the applicant shall not, thereafter, be responsible to defend, Resolution No. 1041 December 4, 2023 Case SNP-2023-0081 —Thompson Hotel Sign Program Amendment indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. PLANNING DEPARTMENT CONDITIONS PLN 1. Sign Permit Required. Each business owner/tenant shall obtain a Sign Permit issued by the Department of Planning Services via a Sign Permit application prior to the installation of any permanent and/or temporary sign. PLN 2. Sign Encroachment into Public Right -of -Way. No signs shall be installed in the public right-of-way or project into the public right-of-way unless such a project is first and reviewed and approved by the Department of Planning Services and the Department of Engineering Services via an encroachment permit or encroachment license application. PLN 3. Department of Building and Safety Review and Permit Requirement. Each business owner/tenant shall obtain all necessary permits to install illuminated and/or non -illuminated signage as required by the Building Code prior to installation. PLN 4. Sign Program Amendment Required. All signage shall be installed in accordance with the Sign Program. A Sign Program Amendment shall be required for any proposed changes to the approved Sign Program, including changes that are necessitated by building alterations. PLN 5. Tenant N Signage (Section 8.10.0, Sign Program page 7). Omit the language "One blade/arcade sign many located at each customer entrance; each sign must be identical and the combination of such signs shall be deemed as one sign" from the Sign Program. PLN 6. Tenant N Signage — Wall Sign (Sign Program, page 5). Change the color of the wall sign indicated on the plan from yellow (main) to blue (secondary). PLN 7. Mon ument/Freestanding Sign — Site Plan Required. Applicant shall submit a dimensioned site plan which depicts the precise installation location relative to the property line to demonstrate that the sign does not encroach into the public right-of-way. Applicant may contact the Department of Engineering Services to confirm the location of the property line. END OF CONDITIONS 2
