HomeMy WebLinkAbout2092ORDINANCE NO. 2092 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AMENDING THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN TO FACILITATE THE VACATION OF A PORTION OF MUSEUM WAY BETWEEN BELARDO ROAD AND MUSEUM DRIVE IN ORDER TO FACILITATE THE PERMANENT INSTALLATION OF THE "FOREVER MARILYN" STATUE AT THAT LOCATION, PURSUANT TO CALIFORNIA ELECTIONS CODE SECTION 9215(a). • WHEREAS, pursuant to authority provided by the California Elections Code, a petition has been filed with the City Council of the City of Palm Springs, seeking to enact an initiative measure which would amend the Downtown Palm Springs Specific Plan to facilitate the vacation of a portion of Museum Way between Belardo Road and Museum Drive in order to facilitate the permanent installation of the "Forever Marilyn" statue at that location, (the "Measure" or "Ordinance"); and WHEREAS, pursuant to Califo�nia Elec tions Code section 9215, an initiative . petition must be in filed with the City in valid form and signed by not less than ten percent (10%) of the registered voters of the City in order to qualify the Measure for the ballot; and ' WHEREAS, according to Riverside County voter records, the. minimum signature requirement in order to qualify the Measure for the ballot is 2,886 registered City voters; and WHEREAS, the City Clerk, through the Riverside County Registrar of Voters, has certified that the form of the petition complies with California law and, based upon an examination of voter registration records, has ascertained that the petition is signed by the req uisite number of voters to qualify the Measure for the ballot under the Elections Code;and WHEREAS, this Measure's/Ordinance's proponents have completed all other necessary prerequisite steps qualify and place it on the ballot; and WHEREAS, since this Ordinance has qualified for placement on the ballot, . pursuant to California Elections Code section 9215, the City Council is legally required to either (i) adopt this Ordinance without alteration, or (ii) submit it to the voters at its next regularly scheduled election occurring not less than 88 days after the date of the order of election or at a special election pursuant to Elections Code Section 1405; and WHEREAS, in lieu of placing the Measure/Ordinance on the ballot, the City Council has voted to adopt it without alteration. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: Ordinance No. 2092 Page2 SECTION 1. TITLE. This initiative measure shall be known and may be cited as Ithe "Forever Marilyn Permanent Installation Initiative" ("Initiative"). SECTION 2. FINDINGS AND PURPOSE. A.Findings. The City Council of the City of Palm Springs ("City") finds as follows: 1. 2. 3. 4. 5. 6. In March of 2021, the City issued a written determination to temporarily close Museum Way, between Belardo Road and Museum Drive, to allow for the temporary installation of the Forever Marilyn Statue. The City entered into a Temporary Encroachment and License Agreement with, a local non-profit corporation that promotes tourism in the City and is the current owner of the Forever Marilyn Statue, which only allows for the temporary installation of the Forever Marilyn Statue. Private citizens, residents, and businesses of the City have invested over one million dollars to procure, install, promot_e and maintain Forever Marilyn in Downtown Palm Springs, in order to support Palm Springs as one of the world's premier resort destinations. The City's General Plan has iden tified the goal of continuing to make Palm Springs a premier internationally recognized resort and visitor destination as one of the City's priorities. The location of the Forever Marilyn Statue on Museum Way, between Belardo Road and Museum Drive has afforded members of the public, easy access and opportunity to view and experience the statue and has drawn numerous people to the City's Art Museum, City destinations,. and businesses located nearby and has marketed the City throughout the world as people share their images of Forever Marilyn on social media. A photograph of the Forever Marilyn Statue in its aforementioned present location is attached hereto as Exhibit B. The subject portion of Museum Way that is sought to be permanently vacated is not included in the General Plan's Circulation Plan (GP Figure 4.1) and therefore a permanent vacation would be consistent with the General Plan's circulation element. The installation of the Forever Marilyn Statue provides opportunities for pedestrian and bicycle circulation and access to the mixed uses within the Downtown Palm Springs Specific Plan area, and the permanent installation of the Forever Marilyn Statue by the permanent vacation of Museum Way between Belardo Road and Museum Drive will strengthen conti_nuing pedestrian and bicycle circulation, along with continuing the presence of the vibrant and attractive gathering place that the statue has created as demonstrated by the thousands who have visited the statue's current location on Museum Way adding to the appeal of the City and enhancing the local economy since 2021. The pu rpose of this Initiative is to amend the Downtown Palm Springs Specific Plan to facilitate the permanent installation of the Forever Marilyn Statue in its current location on Museum Way between Belardo Road and Museum Drive by facilitating the City Council's permanent vacation of said portion of Museum Way. The intended street vacation would occur only after the conduct of proceedings as required by law and the exercise of discretion by the Planning Commission and the City Council. SECTION 3. AMENDMENTS TO THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN. The City Council hereby amends the City of Palm Springs' Downtown Palm Springs Specific Plan as set forth in Exhibit A attached hereto and incorporated herein by reference (new language to be inserted into the Downtown Palm Springs Specific Plan is shown as BOLD and underlined text, language to be deleted is shown in strikethrau§h telff, text in regular type reflects the existing text and is provided for informational/reference purposes). SECTION 4. SEVERABILITY. If any provision, section, paragraph, sentence, phrase, or word of this initiative is rendered or declared invalid, illegal, or unconstitutional by any final action in a court of competent jurisdiction or by reason of any preemptive legislation, such unconstitutionality illegality or invalidity shall only affect such provision, section, paragraph, sentence, phrase, or word and shall not affect or impair any remaining provisions, sections, paragraphs, sentences, phrases, or words, or the application of the initiative to any other person or circumstance, and to that end, the provisions her�of are severable. It is hereby declared to be the intention of the City Council that the initiative would have been adopted had such unconstitutional illegal or invalid prqvision, section,. paragraph, sentence, phrase, or word not been included herein. •• • SECTION 5. LI BERAL CONSTRUCTION. This Initiative shall be liberally construed to effectuate its purposes. SECTION 6. LEGAL DEFENSE. If challenged _in court of competent jurisdiction, the City shall defend the Initiative in such court of competent jurisdiction. The City Council hereby declares that the proponent(s) of the Initiative have a direct and personal stake in defending the Initiative from constitutional or statutory challenges to the initiative's validity or implementation . .In the event the City fails to defend the Initiative, or the City fails to appeal an adverse judgment against this Initiative, in whole or in part, in any court of competent jurisdiction, the Initiative's proponent(s) shall be entitled to assert their direct personal ·stake by defending the Initiative's validity and implementation in any court of competent jurisdiction and shall be empowered by the people through this Initiative to act as agents of the people of the City, and the City shall indemnify the proponent(s) for reasonable attorneys' fees. SECTION 7. AMENDMENT. The City Council is authorized to amend any aspect of this Initiative as long as the amendment furthers the purposes of the Initiative. Pursuant to California Elections Code section 9217, no other amendments may be made to this Initiative without another vote of the People of Palm Springs Ordinance No. 2092 Page 4 SECTION 8. EFFECTIVE DATE. Pursuant to California Elections Code Section I9215(a), the City Council hereby adopts this initiative Ordinance and it shall go into effect thirty (30) days after adoption. SECTION 9. CEQA. The City Council hereby finds and determines that adoption of this Ordinance is not a discretionary action of the City Council within the meaning of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines and is, therefore, not subject to CEQA review. See, Tuolumne Jobs and Small Business Alliance v. Superior Court, (2014) 59 Cal.4th 1029. SECTION 10. PUBLICATION. The City Clerk shall certify to the adoption of this Ordinance and cause publication to occur in a newspaper of general circulation which is published and circulated in the City in a manner permitted under State law.
