ORDINANCE NO. 2072
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, AMENDING SECTION
16.36.020 OF THE PALM SPRINGS MUNICIPAL CODE
RELATING TO THE CONDUCT AND APPEARANCE OF
AIRPORT COMMERCIAL VEHICLE OPERATORS
City Attorney's Summary
This ordinance amends Section 16.36.020 of the Municipal
Code related to the Palm Springs International Airport
Commercial Vehicle Operator Condu,ct and Appearance by
removing certain language related to the appearance of
commercial vehicle operators.
WHEREAS, Section 16.36.020 of the Palm Springs Municipal Code provides that
Commercial Vehicle Operators doing business within the Airport must comply with certain
dress requirements; and
WHEREAS, the City has r~ceived complaints regarding the feasibility of these
dress requirements during the summer months; and
WHEREAS, the City desires to provide Commercial Vehicle Operators flexibility in
their choice of dress during the summer months while still requiring Commercial Vehicle
Operators to maintain a professional appearance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS
DOES ORDAIN AS FOLLOWS:
SECTION 1. Recitals. The recitals reflected above are true and correct, and are
incorporated by this reference herein as the cause and foundation for the action taken by
the City Council and through this Ordinance. •
SECTION 2. Code Amendment. Section 16.36.020 of the Palm Springs Municipal
Code Vehicle Operator Conduct and Appearance is hereby amended to read as follows:
"16.36.020. Vehicle Operator conduct and appearance. (a) Commercial
Vehicle Operators shall remain in their Vehicles or in the immediate
vicinity (immediately adjacent to the Vehicle) at all times while at or on the
Airport except in those areas designated by the Director of Aviation.
(b) Commercial Vehicle Operators are prohibited from loitering or
standing inside the Airport Terminal Building while their Vehicle is in
position in the Commercial Lane. •

(c) Commercial Vehicle Operators shall not solicit, persuade or urge I
any person (by words, gestures, or other form of communication) to use or
hire any Commercial Vehicle Operator. •
(d) Commercial Vehicle Operators shall maintain a professional look
and appearance (i.e., oollared and olean shirt and pants, shoes, and
soaks) and shall display an identification badge which includes a
photograph and the name of the operator and the name of the operator's
~ompany at all times while conducting Commercial Activities at the Airport.
(e) Commercial Vehicle Operators shall conduct themselves in a
courteous and professional manner and treat members of the traveling
public with the utmost respect at all times.
(1) Commercial Vehicle Operators shall not intentionally obstruct the
movement of any person or Vehicle.
(2) Commercial Vehicle Operators shall not use offensive, abusive, or
obscene language, gestures, or other forms of communication while at or
on the Airport. •
(3) Commercial Vehicle Operators shall be fully familiar with the
provisions of the Passenger Bill of Rights and shall fully abide by the
terms and requirements of the Passenger Bill of Rights.
SECTION 3. Effective Date. This Ordinance shall become effective 30 days after
its adoption.
SECTION 4. Certification. The Mayor shall sign, and the City Clerk shall certify to
the passage and adoption of this Ordinance and shall cause the same, or the summary
• thereof, to be published and posted pursuant to the provi_sio_ns of applicable law; this
Ordinance shall take effect thirty (30) days after passage.
SECTION 5. Severability. If any section or provision of this Ordinance is for any
reason held to be invalid or unconstitutional .by any court of competent jurisdiction, or
contravened by reason of any preemptive legislation, the remaining sections and/or
provisions of this ordinance shall remain valid. The City Council hereby declares that it
would have adopted this Ordinanc!3, ·and each section or provision thereof, regardless of
the fact that any one or more section(s) or provision(s) may be declared invalid or
unconstitutional or contravened via legislation.
