October 12, 2023 City of Palm Springs City Council Council Chamber/City Hall 3200 E. Tahquitz Canyon Way, Palm Springs, CA. 92262 Attn: Clerk of the Board Re: Written letter to be entered in the Public record and made available for public Inspection for the October 12, 2023 City Council meeting Agenda Item: 1-A (continuous implementation of AB361) Dear Palm Springs City Council, Please discontinue with the potential unlawful actions of having remotely performed meeting of City officials (City Council/boards/commissions/committees) throughout the Palm Springs City boundaries under California's AB361 law. It's been repeatedly demonstrated that the "Findings" of City officials to declare the use of Assembly Bill 361 has been false. The meeting of City Council on October 12, 2023 has NO remote meeting access codes or instruction for the general public listed on that meeting agenda. No telephone number was provide to contact City officials of any disruptions that would "delay" the meeting until corrections were made. Prior City Public meeting "required" participates (Public speakers) to pre-register thought City administrators (Not a third-party) to partispate in the Peoples business remotely (provide Public testimony). Most Importantly is AB361 has expired (No State of Emergency in regards to COVID-19). Plus the fact that the City has exceeded the "every 30 day" requirement to renew the original City resolution in regards to the legal use of AB361 in prior months. City officials haven't "promoted" any form of "physical" distancing in regards to COVID-19. Many City conducted remote access meetings have discontinued "Rollcall" Voting. In conclusion - the City of Palm Springs have missed AB361 to provide themselves a convenience method of avoiding Public meeting venues - which helps to destroy Public trust in Governance of the City of Palm Springs and the regional government agencies that they affect. Discontinue the use of AB361 Sincerely, 10/12/2023 Public Comment Item 1A Brad Anderson | 37043 Ferber Dr. Rancho Mirage, CA. 92270 Ba4612442@gmail.com Cc: 10/12/2023 Public Comment Item 1A
