Ordinance Revisions•Sidewalk width: 48” unobstructedaccessible route•Distance from farmers markets, special events: Changedfrom 500’ to 200’•Palm Canyon/Arenas Road: Weekend restrictions fromOctober to April between 4pm and 11pm•Fines decreased by 50% for administrative violations andfor first violation of operating without a permit•Other minor corrections/clarificationsDEVELOPMENTSERVICESItem 3B - Page 3
Environmental Health•Environmental Health permit process for sidewalk vendors is now in place•Food vendors will be required to have Environmental Health permits before obtaining a business license•City ordinance duplicates certain Environmental Health regulations for consistency of administration•However, City does not have the ability to enforce food safety regulationsDEVELOPMENTSERVICESItem 3B - Page 4
Education/Licensing AssistanceImplementation:•Upon adoption of the ordinance, letters will be provided to operators with information on licensing and regulations•Staff will provide brochures with step-by-step licensing procedures and operational standards (English & Spanish)•Staff will hold workshops to assist applicants with the licensing process and understanding operational requirementsDEVELOPMENTSERVICESItem 3B - Page 5
Enforcement•Code Compliance officers are available until 1am on weekends (760-778-8434)•Police Department is available after 1am (760-327-1441)•Environmental Health will periodically conduct enforcement with City staff•Education efforts with licensed vendors will assist in reducing demand for enforcement effortsDEVELOPMENTSERVICESItem 3B - Page 6
Vending on Private PropertyLand Use Permit Process for Vendors:•Vending use on private property allows for greaterflexibility in vending operations•Vending on private property is currently allowed by theZoning Code – no code amendment needed•By policy, vendors will be charged $438 (Minor LUP)rather than current rate of $1,642 (Major LUP)DEVELOPMENTSERVICESItem 3B - Page 7
