I'm writing in to urge the City of Palm Springs to stay true to its commitment of supporting all small businesses,
including sidewalk vendors, by adopting the following changes:

Canyon for the months of October to April, Friday - Sunday, from 4:00 - 11:00 PM.

3. Finally please grant Free Business licenses for elders ages 55 and older.
Sidewalk vendors will be a great benefit for the City of Palm Springs. They attract new clientele to low foot traffic
areas. Also, they can form mutually beneficial relationships with local brick-and-mortar restaurants through shared
kitchen agreements and by attracting more clients that can visit surrounding businesses. They only need a chance to
thrive in the local economy.

Dear Palm Springs City Council,
Thank you for your continued efforts to create an equitable vending ordinance for micro-
entrepreneurs in Palm Springs. Although significant progress has been made, the ordinance still
contains a number of concerning provisions such as the following:
1.“Sections 5.89.050(B)(22) and 5.89.070(A)(11) were amended to limit the prohibition
of sidewalk vending in defined areas of Palm Canyon Drive and Arenas Road
from Friday through Sunday between the hours of 4:00pm to 11:00pm during the
months of October to April.”1
1.This provision is likely unlawful under state law. After meetings with the
Chamber of Commerce and hospitality and service industry organizations, and
directly at the behest of brick and mortar businesses in the Palm Springs
Downtown area, such as Blackbook – the City has decided to put forth a no
vending zone in Downtown Palm Springs. This was documented by a Palm
Springs Post article (where it was clear that City Council enacted regulations in
order to “protect brick-and-mortar downtown businesses”), by on the record
statements made during the June 5th hearing of the ordinance (and previous
hearings related to a street vending ordinance), and by a number of other sources
informing the ordinance and publicly available through the City Council file.
2.Using language such as "due to increased pedestrian and vehicular traffic" in
order to justify an outright ban on vendors in the Downtown area during the entire
weekend is not sufficient, without any relevant evidence or data, to demonstrate
that this restriction is directly related to objective health, safety, or welfare
concerns as required by SB 946. During the previous hearing, there was an
attempt by the City to link street vendors to police calls: "16,000 calls in the area
between Alejo and Baristo road and 2,500 call on Arenas Road." Yet, when
questioned, Police Chief Miller admitted that almost none of the calls, if any at
all, were related to street vending. The data as presented by the City in support of
a Downtown no vending zone is a misleading and harmful tactic. Furthermore,
tying crime and police calls to street vendors, a largely working-class, immigrant
community of color – without sufficient evidence or any causal relationship– is an
age-old racist and anti-immigrant practice. The City has not provided adequate
reasoning or data to justify the restrictions it intends to impose on vending.
3.Additionally, the outright ban is completely contrary to supporting a dynamic and
robust local economy that works for everyone. The hours of
Downtown exclusion trace the hours of kitchen operations and businesses in the

Downtown area, and clearly signal economic protectionism. There is no evidence
or data provided by the City to suggest otherwise. Ample public comment made
on-the-record by City officials and residents shows that the currently proposed
Downtown exclusion is at the behest of Downtown businesses, and is thus
economic protectionism that violates state law.
2. “A copy of general liability policy naming the City as additional insured in the
amount of $1,000,000 per occurrence and $2,000,000 combined.”
1. Requiring vendors to obtain insurance is an overly burdensome barrier due to
their limited income and the costs of insurance. As an alternative, the City can
include an indemnification clause in its ordinance and not require vendors to
obtain insurance up front, prior to obtaining a vending permit. Vendors should be
incentivized to go through the process of obtaining a permit, and then be
supported in obtaining insurance and following other business related best
practices. Other cities, such as the City of Long Beach, do not require liability
insurance because of a desire to engage with vendors, and eliminate barriers that
prevent vendors from obtaining necessary permits. Rather than requiring
insurance, Long Beach uses the following language:
“Each permit shall expressly provide that the permittee shall defend, indemnify
and hold the City, its officials, employees and agents harmless from and against
all claims, damage, demands, causes of action, loss, liability, proceedings, costs
and expenses (including reasonable attorney fees) of any kind (collectively in this
Subsection, "claim") arising from or attributable to or caused by the alleged acts
or omissions of permittee, its officers, agents or employees in connection with the
permittee's activities under the permit.”
2. Other cities in California have done away with the insurance requirement for
compact mobile food businesses as well. O r, they have reduced the coverage
amount to $300,000. Palm Springs should get rid of the insurance requirement, or
at the very least, reduce the coverage amount.
3. “The umbrella or tent structure shall not encroach into the accessible path of travel
or onto private property.”
1. This language unnecessarily creates obstacles for vendors given the size of tents
and the need for shade and protection from the sun. This language in the
ordinance can very easily be used to cite vendors and create further enforcement
issues against vendors.
4. “During operations, no food shall be stored, displayed, or served from any place
other than the approved food cart. The use of side units, coolers, benches, or tables
for food preparation, storage or display is prohibited.”
1. SB 972 allows for more variations of what integral equipment is allowed in a
vending operation, allowing for greater flexibility in the use of safely fashioned
detachable equipment to carry out vending operations. The City is creating further
barriers for street vendors to obtain permits by imposing the above restrictions.
Equipment and handling of food is already addressed by the health permit
process, and the City does not need to add these extra conditions on vendors who
sell food.

2. Furthermore, the state law specifically defines sidewalk vendor beyond the
limited understanding of what Palm Spring’s current municipal law proposes.
Under 51036: “Sidewalk vendor” means a person who sells food or merchandise
from a pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other
nonmotorized conveyance, or from one’s person, upon a public sidewalk or other
pedestrian path.” Thus, the expansive definition of sidewalk vendor under state
law allows for the use of many of the items prohibited by the City.
5. “The vendor shall not attach or use any water lines, electrical or telecommunication
lines, or gas lines during vending operations .”
1. Palm Springs should create access to infrastructure for vendors and small-scale
businesses that are generating economic vitality in Palm Springs. This language
signals an unwelcoming disposition by the City of Palm Springs towards vendors,
and is contrary to how many flourishing cities throughout the world operate in
support of street vendors.
6. “Sidewalk vendors shall comply with all applicable fire code requirements in the use
of an open flame or charcoal in the preparation of food products. Any smoke or
odors produced through the preparation of food products shall be subject to the
regulations contained in Palm Springs Municipal Code Section 6.08.020.”
1. SB 946 is the governing state law when it comes to sidewalk vending in
California. Section 51039 governs a local authority’s sidewalk vending program
and states that violations are punishable only by administrative fines and that the
person alleged to have violated the law “shall not be subject to arrest,” which
means cities cannot use nuisance laws or other municipal code provisions to
criminalize street vendors. In its present version of the ordinance, and in Section
6.15.160 of the Palm Springs Municipal Code, Palm Springs is attempting to
undermine state law and find ways to criminalize street vendors.
A. Section 6.08.020 Air Pollution.
It is a nuisance, and it is unlawful, to establish, conduct, maintain or
operate or cause or permit to be established, conducted or operated any
business, factory, yard, establishment or other place which will generate
into or pollute the atmosphere with any unwholesome, offensive, or
deleterious gas, fumes, dust, smoke, or odors, or to allow offensive odors
to be emitted from offal, garbage or any animal or vegetable matter. (Prior
code § 3702)
B. Section 6.15.160 Nuisance; Violation and Penalty.
Any Mobile Food Vending Vehicle operated contrary to the provisions of
this Chapter is declared to be unlawful and a public nuisance and the City
Attorney may, in addition to or in lieu of prosecuting a criminal action
hereunder, commence an action or actions, proceeding or proceedings, for
the abatement, removal or enjoinment thereof, in the manner provided by
law, and may take such other steps and may apply to such court or courts
as may have jurisdiction to grant such relief as will abate or remove such
establishment and restrain and enjoin any person from operating a Mobile
Food Vending Vehicle contrary to the provisions of this Chapter. Every
person, whether acting as an individual owner, employee of the owner,

operator, or employee of the operator, or whether acting as an agent or
independent contractor for the owner, employee, or operator, or acting as a
participant or worker in any way directly or indirectly sells or distributes
food or beverage from a Mobile Food Vending Vehicle as defined in this
Chapter without first obtaining a Mobile Food Vending Vehicle permit
from the City Manager, or that otherwise violates any provision of this
Chapter, shall be punishable as specified in
Sections 1.01.140 and 1.01.150 of this Code. (Ord. 1877 § 2, 2015)
Finally, I would like to remind the City of Palm Springs that street vending creates positive
contributions that are often unaccounted for: street vendors provide food for bar patrons and help
reduce the risks of intoxication; they often provide food for the unhoused and serve as the front
line for easing tension in public space; street vendors often create foot traffic that stimulates local
businesses and helps ease blighted corridors; street vendors provide culturally relevant foods and
healthier alternatives to chain fast foods in urban food deserts; street vendors often buy their
foods and supplies at local businesses, have a local customer base, and ultimately create cash
flow that benefits local communities; street vendors make cities more competitive as they create
a more vibrant urban street food culture that attracts and supports tourism; street vendors provide
food that is more affordable to workers in business districts and more affluent parts of cities; and
perhaps most importantly, a majority of street vending businesses in California are owned by
working-class, immigrant women of color – a population I hope the City of Palm Springs would
choose to promote and protect, rather than exclude.
I hope the City of Palm Springs amends the ordinance to comply with state law, and ultimately,
do what is right for immigrant, working-class businesses.

Dear Palm Springs Council Members:
We, the undersigned organizations, are submitting this letter to urge the City of Palm Springs to
adopt a modified sidewalk vendor ordinance, to be heard and discussed at its second reading
during the Palm Springs City Council meeting of September 14, 2023.
We commend this council and staff for adopting a number of the recommendations submitted by
the Inland Coalition for Immigrant Justice (ICIJ) and Public Counsel in previous city council
meetings. However, we ask the City of Palm Springs to strive for a better model sidewalk
vending ordinance by adopting the following recommendations:
● Remove the seasonal prohibition on street vending in the “Arenas District” and
Palm Canyon from October 1st to April 30th; Friday, Saturday, and Sunday from
4:00 PM - 11:00 PM:
○ The prohibition limits vendors earning potential and ability to make a living while
ensuring that the surrounding businesses will unfairly benefit from the prohibition.
○ The prohibition could set anti-competition barriers among businesses which are
potentially legally unsound.
○ The city does not have sufficient evidence to link pedestrian safety concerns with
vendors and could expand on their research to explore other solutions.
○ The city has no evidence to suggest that nuisance calls to the police from the
prohibited areas are in any way related to street vending.
○ The restricted hours fail to demonstrate how the city doesn’t center itself on
economic protectionism and classism within the building of small businesses.
Street vendors are small businesses in their most original stage. Record of public
comments from the city council meetings indicates preference over
brick-and-mortar small businesses which isn’t only illegal but also a conflict of
interest
● The 48’’ sidewalk restriction should be reduced, which will still respect the
Americans with Disability Act (ADA):
○ Most cities only require a 36’’ pathway to be unobstructed, which is the minimum
requirement to follow ADA regulations. Currently the low number of vendors in
the city doesn’t justify the 48” inch requirement, the city can reduce it to 36” which
will still remain in ADA compliance
○As a best practice to support vendors, it should not be more restrictive.
●Do not require extra permits that will cause undue burden
○Grant Free Business Licence to people ages 55 and older -The aging population
work as sidewalk vendors as a second job before retirement or once they retire,
this should be one less permit they need to pay considering they will have 10
starting up costs to formalize their small business
○ Do not require general liability insurance naming the City as additional insured in

I'd like to address some of my specific concerns regarding 3B SECOND READING AND
ADOPTION OF ORDINANCE NO. 2077 OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADDING
CHAPTER 5.89 TO THE PALM SPRINGS MUNICIPAL CODE RELATING TO SIDEWALK VENDING
AND AMENDING CHAPTER 5.48 RELATIVE TO COMMERCIAL SOLICITATION
1. We spent over 2 years researching the safety issues for free standing, 6 sq ft (A-frame)
signs in the downtown area. It was determined that 72 inches would be the minimum
required clearance for reasons of safety and ADA clearance. This new ordinance calls for
reducing the clearance to only 48 inches for food and retail street vendors. That does
not seem safe nor does it allow for proper ADA access on crowded sidewalks.
2. I truly think this proposal has not been thoroughly imagined in the curbside areas. There
needs to be some kind of accommodation for people to get out of their car parked
along Palm Canyon Drive, Indian Canyon Drive and other streets. Maybe consider
vendors would need to be at set up at least 18" from the curb line.
It is interesting to note that in that retail businesses downtown have asked for some sort of
allowance for outside display / carts for many years but we, the brick and mortar businesses of
Palm Springs, have always been turned down due to 'safety issues'.

CHAPTER 5.89 TO THE PALM SPRINGS MUNICIPAL CODE RELATING TO SIDEWALK VENDING
AND AMENDING CHAPTER 5.48 RELATIVE TO COMMERCIAL SOLICITATION
1. We spent over 2 years researching the safety issues for free standing, 6 sq ft (A-frame)
signs in the downtown area. It was determined that 72 inches would be the minimum
required clearance for reasons of safety and ADA clearance. This new ordinance calls for
reducing the clearance to only 48 inches for food and retail street vendors. That does
not seem safe nor does it allow for proper ADA access on crowded sidewalks.
2. I truly think this proposal has not been thoroughly imagined in the curbside areas. There
needs to be some kind of accommodation for people to get out of their car parked
along Palm Canyon Drive, Indian Canyon Drive and other streets. Maybe consider
vendors would need to be at set up at least 18" from the curb line.
It is interesting to note that in that retail businesses downtown have asked for some sort of
allowance for outside display / carts for many years but we, the brick and mortar businesses of
Palm Springs, have always been turned down due to 'safety issues'.

Dear Mayor, City Council, and City Staff Members:
The Board of the Palm Springs Hospitality Association strongly urges fairness and respect
regarding the City addressing street vendors and food trucks conducting businesses on the
streets and sidewalks of Palm Springs.
Durning the PSHA Board meeting on 9/14/2023, there was a Motion, a Second and discussion
to recommend the City of Palm Springs (in tonight’s City Council meeting), adopt the street
vending ordinance. It was unanimously approved to submit this formal letter today.
PSHA formally submitted a similar letter of support on June 2, 2023, and would like to reiterate
our continued support of adopting the ordinance at this evening’s City Council meeting.
For several years, PSHA has been requesting that the City Council address this important issue
and we are hopeful that tonight this current City Council will make a decision that supports local
businesses and the community.
