On behalf of the Latino Restaurant Association, I write to express our opposition to the
creation of a permanent price control on delivery commissions in Palm Springs. The Latino
Restaurant Association represents hundreds of Latino-owned restaurants in California. We
promote, support and educate restaurateurs and small business owners to ensure the equitable
economic growth of the Latino restaurant sector. Based on our experiences working directly
with and on behalf of minority-owned restaurants and California’s Latino community, we
believe a permanent price control would restrict restaurant choice.
The fees restaurants choose to pay for delivery services are voluntary and allow for flexibility
for restaurants in selecting the services that best suit their business needs. This customization
sets up Latino businesses for success in an increasingly competitive industry while paying for
the services they actually need.
Delivery services already offer a 15% pricing option - the same percentage provided by this
ordinance - which gives restaurants access to low-commission delivery options. Since this
option is already available, a permanent price control would simply restrict restaurant choice
and cut off access to additional desirable services that could help potentially grow their
business.
Further, price controls inevitably result in higher consumer prices. Price increases cause fewer
orders, which will harm restaurant revenue. We are deeply concerned about the effect
consumer price increases will have on small Black- and brown-restaurants who cannot afford
their own expensive marketing campaigns and delivery services the way large chains are able
to.
Finally, as prices increase and orders fall, folks who rely on app-based food delivery platforms

To the Palm Springs City Council:
On behalf of the greater Los Angeles Business Federation, also known as BizFed, we are
writing today to urge the Palm Springs City Council to not move forward with a permanent
price control on food delivery.
BizFed is a massive, diverse grassroots alliance that unites and amplifies the voice of
businesses large and small. We represent over 420,000 employers and 5 million employers
in the greater LA region, many of whom are restaurant owners.
Price ceilings sound attractive because they appear to be no-cost assistance to struggling
restaurants, but it is precisely the small restaurants and their workers that will be hurt the
most. By implementing a price cap, fees will be transferred to consumers. Consumers, more
sensitive to price changes, then place fewer delivery orders on restaurants. This reduced
demand will in turn cause more cutbacks and layoffs. In the end, everyone loses.
Price controls like this also set a dangerous precedent for the entire business community
which is a concern to us and our members. With the pricing models available to restaurants,
a price control is not needed and will have the unintended consequence of limiting options
for restaurants to opt in for more services and marketing from delivery companies. Food
delivery platforms are empowering restaurants to stay in business, keeping their workers
employed, and providing supplemental income to delivery drivers.
We ask you to oppose permanent price controls in Palm Springs.

Re: Opposition to Food Delivery Price Controls
To Whom It May Concern:
We write to respectfully register our opposition to price controls on commissions for food delivery
platforms. While well intended, we believe this is the wrong approach to assist struggling restaurants.
We are deeply concerned that price controls in this highly competitive market will hamstring its ability
to continue helping keep restaurants open, their workers employed, communities safe, and offering
accessible part-time work throughout the state.
We have seen the effect that flexible work opportunities such as those offered by food delivery services
have had -- uplifting good, hardworking people. For low-income communities of color, low barrier-to-
entry earning opportunities are vehicles to help earn an education, support their families, save for a
rainy day, and achieve a better quality of life.
In addition to providing flexible, good paying work that fits around their schedules, food delivery
services are helping to keep businesses afloat during a time of extraordinary pressure on the restaurant
industry. Stifling food delivery platforms during unprecedented demand for such services hurts our
communities.
The negative impact of price control policies on businesses and consumers are made clear throughout
history and in cities in California and across the country today – higher prices on consumers, reduced
demand for delivery, fewer orders at restaurants, and more livelihoods unnecessarily lost. As was
confirmed by the Progressive Policy Institute’s study, price controls result in higher prices, longer wait
times and poorer services for customers, fewer orders, and less revenue for restaurants.
Interfering with prices in competitive markets may appear like a no-cost solution to the very real
struggles the restaurant industry is experiencing. In practice, it takes little time to begin weakening the
market on all sides, including an already reeling population of consumers, workers and restaurant
owners. As costs of operation shift to consumers, especially low-income consumers where even a dollar
or two increase can be cost prohibitive, demand inevitably falls.

This is not only a detriment to the food delivery platforms; it hurts workers, restaurants and consumers
that rely on these services.
Arbitrary caps on the commission food delivery platforms may charge are misguided and shortsighted,
poised to unintentionally add unnecessary strain on the entire restaurant industry and their workers,
food delivery platforms and their workers, and Californians trying to make every dollar stretch. We must
refocus our efforts and double down on ways to directly aid struggling restaurants and workers, not
manipulating markets in a way that will actually hurt them.

We respectfully express our opposition to imposing price controls on food delivery platforms'
commissions. Although the intention is good, we believe this is not the right approach to help
struggling restaurants. We are deeply concerned that in this highly competitive market, price
controls may hinder food delivery platforms' ability to keep restaurants open, retain their
employees, ensure community safety, and provide accessible part-time work opportunities
throughout the state.
We have witnessed the positive impact that flexible work opportunities such as food delivery
services have on hardworking individuals. For low-income communities of color, earning
opportunities with low barriers to entry can help them obtain an education, support their
families, save for a rainy day, and achieve a better quality of life.
Intervening in competitive markets' prices may seem like a cost-free solution to the challenges
faced by the restaurant industry. However, in reality, it does not take long to weaken the
market on all fronts, including consumers, workers, and restaurant owners. As operating costs
shift to consumers, particularly low-income ones, where even a small increase can be financially
burdensome, demand decreases.
Imposing arbitrary caps on food delivery platform commissions is a misguided and short-sighted
approach that may unintentionally add unnecessary strain on the entire restaurant industry, its
workers, and Californians trying to make ends meet. Instead, we must focus on ways to directly
aid struggling restaurants and workers and refrain from manipulating markets in a way that
would harm them.

I'm a DoorDash driver: permanent price controls
will affect my job

My days are not what most would consider typical. There was a time when I had a more normal
schedule and I worked a 9-to-5 job in an office setting. But everything changed when my
husband developed a disability that resulted in him needing full-time care, and I had to make big
life adjustments.
Based on our doctor’s advice, we moved to Palm Springs from Colorado because of the lower
elevation and drier climate. We used our savings to move and, once we got here, I had to find a
way to make an income and still be my husband’s primary caregiver. That’s when I started to
drive a few hours each week with the delivery app DoorDash. This kind of flexible work has
helped me earn what we need to cover our bills, while still giving me the time and freedom to
take care of my husband. As a woman, I feel a level of safety in dashing compared to other
non-office jobs. Unfortunately, a new policy in Palm Springs could change all of that.
The Palm Springs City Council plans to vote on a shortsighted proposal to place a permanent
price control on the fees that delivery apps like DoorDash can charge restaurants that use their
services. While well intended, they are failing to think about all of us who do app-based delivery
to keep our lights on at home and food on our table.
This policy can actually harm the restaurants it claims to help. While the intention behind
establishing caps may have been a well-meaning response during the worst days of the
pandemic, limiting the amount of money that restaurants can choose to pay for services, like
marketing and delivery, can significantly impact their ability to operate and turn the corner
toward sustainability. This proposed policy fails to acknowledge that every major delivery
platform already offers a 15% delivery option – a rate that’s equal to the price controls being
proposed. As we move forward from the pandemic, it does not make sense to permanently
codify policies that were designed to bring pandemic relief.
In addition to making it harder for restaurants to market their services, this bill could make the
cost of delivery too expensive for consumers. In other cities where permanent caps have been
implemented, delivery platforms were forced to make up the lost revenue by adding on new
delivery fees. These fees, which help pay Dashers like me, can make it too expensive for
customers to use delivery, meaning fewer orders and fewer earnings for both Dashers and
restaurants.

My story is no different from others who utilize third-party delivery to make ends meet. I’ve met
single moms who need a flexible schedule in order to take care of their families and earn an
income, and students who manage a full-time class load and drive to earn what’s needed for
books and tuition. The list of reasons goes on and on.
As I pick up orders on Palm Canyon Drive and meet other delivery drivers, I take pride in the
fact that we are providing a service and if the City Council moves forward, I fear there will be
less need for us to provide a service that supports our lives. A permanent price control could
hurt customers, restaurants, and Dashers in Palm Springs. History shows that price controls like
this one don’t work and are more likely to damage competition in the long run.
I urge policymakers to consider the negative impact that permanent price controls would have
on our local restaurants and delivery drivers and encourage them to work with the restaurant
industry to find solutions that will drive recovery, not drive business away.
