HomeMy WebLinkAbout1P OCR CITY COUNCIL STAFF REPORT DATE: JUNE 5, 2023 CONSENT CALENDAR SUBJECT: APPROVAL OF A REQUEST FOR NIGHT CONSTRUCTION START TIMES BETWEEN JULY 5, 2023 AND AUGUST 25, 2023, FOR WASTEWATER TREATMENT PLANT DIGESTER NO. 2 GAS FLARE AND FILTRATE PUMP STATION, CITY PROJECTS NO. 20-25 AND 21- 07 FROM: Scott C. Stiles, City Manager BY: Engineering Services Department SUMMARY: The City has received a request from Steve P. Rados, Inc.(“Contractor”), responsible for the Wastewater Treatment Plant (WWTP) Digester No. 2 Waste Gas Flare and Filtrate Pump Station (City Projects No. 20-25 and 21-07) for night construction start time for the dates between July 5, 2023 and August 25, 2023, for welding of the stainless-steel dome for the Digester No. 2 at the WWTP. The construction work is proposed to begin at 9:00 p.m. and end at 5:00 a.m. during the proposed dates. Chapter 8.04.220 of the Palm Springs Municipal Code limits the hours of construction from 7:00 a.m. to 7:00 p.m. Monday through Friday, unless the construction work complies with the terms of a written early work permit issued by the Building Official upon showing of sufficient need due to circumstances of an unusual or compelling nature. In this case, the Building Official will be approving the night construction request. The location of Digester No. 2 is under a flight path to Palm Springs Airport. During daytime construction, the stainless-steel dome would produce a reflective glare that would blind the incoming arrival planes into Palm Springs Airport. The night construction work would not produce a glare to the incoming planes. The night construction authorization will be subject to continuous monitoring of noise complaints and impacts to adjacent properties and businesses. RECOMMENDATION: Approve the requested night construction time of 9:00 p.m. for the dates between July 5, 2023 and August 25, 2023, for the WWTP Digester No. 2 Waste Gas Flare and Filtrate Pump Station Project, subject to continuous monitoring of noise complaints and impacts to adjacent properties and businesses. Item 1P - Page 1 City Council Staff Report June 5, 2023 -- Page 2 Approval of Night Construction Start Time BACKGROUND: On May 17, 2023, the City received a request from the Contractor to do a portion of the project at night due to issues in carrying out the construction work during the day. A map of the location of the work is provided in their request, included as Attachment A. STAFF ANALYSIS: The WWTP Digester No. Gas Flare and Filtrate Pump Station, City Projects 20-25 and 21-07, is located at the Wastewater Treatment Plant. The portion of the project requested for night work will take place inside the Wastewater Treatment Plant site. The Contractor would like to begin work at 9:00 p.m. and anticipates the completion of welding before 5:00 a.m. The primary reason to request the night start time is to complete welding work on the dome of the digester. Performing this work at night has a safety benefit, in that work on the stainless-steel surface produces a reflective glare during daylight hours. Night work would eliminate the glare to incoming planes to Palm Springs Airport. Permitted construction hours per the Palm Springs Municipal Code 8.04.220 are listed in the table below: Permitted Hours of Construction *Thanksgiving Day, Christmas Day, New Years Day, July 4th, Labor Day and Memorial Day Certain exceptions to these construction hours are allowed in the Municipal Code, including exception (2): (2) Construction work complying with the terms of a written early work permit which may be issued by the building official upon a showing of sufficient need due to circumstances of an unusual or compelling nature. To mitigate the noise associated with the welding, Steve P. Rados, Inc. has agreed to implement welding shields/screens to prevent light pollution and eliminate use of loud power tools. Night work will also require temporary outdoor lighting, which may impact adjacent properties. Furthermore, approval of night start times would be contingent of Steve P. Rados, Inc. cooperating with City Staff and the community in responding to any issues. However, with the use of shields and screening, impacts to residential properties should be minimized. City Council Staff Report June 5, 2023 -- Page 3 Approval of Night Construction Start Time ENVIRONMENTAL ASSESSMENT: In accordance with the California Environmental Quality Act (“CEQA”) Guidelines Section 15302 “Replacement or Reconstruction”, Class 2 projects consist of replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Therefore, Staff has determined that the City of Palm Springs Wastewater Treatment Plant Digester No. 2, Gas Flare and Filtrate Pump Station Improvement Project, City Projects No. 20-25 and 21-07, is considered categorically exempt from CEQA. The stainless-steel cover parts are scheduled to arrive in late June. With the expected high temperatures in the summer, night shifts would allow us to work around the high heat that will cause the stainless-steel lid to expand in the day time creating greater challenges with fit up and final product in the day heat. This will also provide cooler and safer working conditions for our welders during the continuous welding operations. We will implement welding shields/screens to prevent any light pollution to the nearby residents. We will also eliminate the use of loud power tools and equipment in the night hours by performing this work with the day shifts. We anticipate the welding operations to be continuous for approximately 5 to 6 weeks. See attached site map with location of welding operations in proximity to surrounding residents.
