Washington Blvd. #1005, Commerce, California 90040 / T: 323.889.4348 / www.bizfed.org April 27, 2023 Palm Springs City Council 3200 E Tahquitz Canyon Way, Palm Springs, CA 92262 Subject: Food Delivery Services in Palm Springs (Item 3C) To the Palm Springs City Council: On behalf of the greater Los Angeles Business Federation, also known as BizFed, we are writing today to urge the Palm Springs City Council to not move forward with a permanent price control on food delivery. BizFed is a massive, diverse grassroots alliance that unites and amplifies the voice of businesses large and small. We represent over 420,000 employers and 5 million employers in the greater LA region, many of whom are restaurant owners. Price ceilings sound attractive because they appear to be no-cost assistance to struggling restaurants, but it is precisely the small restaurants and their workers that will be hurt the most. By implementing a price cap, fees will be transferred to consumers. Consumers, more sensitive to price changes, then place fewer delivery orders on restaurants. This reduced demand will in turn cause more cutbacks and layoffs. In the end, everyone loses. Price controls like this also set a dangerous precedent for the entire business community which is a concern to us and our members. With the pricing models available to restaurants, a price control is not needed and will have the unintended consequence of limiting options for restaurants to opt in for more services and marketing from delivery companies. Food delivery platforms are empowering restaurants to stay in business, keeping their workers employed, and providing supplemental income to delivery drivers. Grand Suite 3310, Los Angeles, CA 90071 Date: April 27, 2023 Subject: Item 3C - Food Delivery Services in Palm Springs To the Palm Springs City Council: On behalf of the Latino Restaurant Association, I write to express our opposition to the creation of a permanent price control on delivery commissions in Palm Springs. The Latino Restaurant Association represents hundreds of Latino-owned restaurants in California. We promote, support and educate restaurateurs and small business owners to ensure the equitable economic growth of the Latino restaurant sector. Based on our experiences working directly with and on behalf of minority-owned restaurants and California’s Latino community, we believe a permanent price control would restrict restaurant choice. The fees restaurants choose to pay for delivery services are voluntary and allow for flexibility for restaurants in selecting the services that best suit their business needs. This customization sets up Latino businesses for success in an increasingly competitive industry while paying for the services they actually need. We are deeply concerned about the effect consumer price increases will have on small Black- and brown-restaurants who cannot afford their own expensive marketing campaigns and delivery services the way large chains are able to. Finally, as prices increase and orders fall, folks who rely on app-based food delivery platforms for supplemental income would be negatively impacted with reduced earnings. For these reasons, we respectfully request you do not move forward with a permanent price control on delivery services. While well intended, we believe this is the wrong approach to assist struggling restaurants. We are deeply concerned that price controls in this highly competitive market will hamstring its ability to continue helping keep restaurants open, their workers employed, communities safe, and offering accessible part-time work throughout the state. We have seen the effect that flexible work opportunities such as those offered by food delivery services have had -- uplifting good, hardworking people. For low-income communities of color, low barrier-to- entry earning opportunities are vehicles to help earn an education, support their families, save for a rainy day, and achieve a better quality of life. In addition to providing flexible, good paying work that fits around their schedules, food delivery services are helping to keep businesses afloat during a time of extraordinary pressure on the restaurant industry. Stifling food delivery platforms during unprecedented demand for such services hurts our communities. The negative impact of price control policies on businesses and consumers are made clear throughout history and in cities in California and across the country today – higher prices on consumers, reduced demand for delivery, fewer orders at restaurants, and more livelihoods unnecessarily lost. As was confirmed by the Progressive Policy Institute’s study, price controls result in higher prices, longer wait times and poorer services for customers, fewer orders, and less revenue for restaurants. Interfering with prices in competitive markets may appear like a no-cost solution to the very real struggles the restaurant industry is experiencing. In practice, it takes little time to begin weakening the market on all sides, including an already reeling population of consumers, workers and restaurant owners. As costs of operation shift to consumers, especially low-income consumers where even a dollar or two increase can be cost prohibitive, demand inevitably falls. 04/27/2023 Public Comment Item 3C This is not only a detriment to the food delivery platforms; it hurts workers, restaurants and consumers that rely on these services. Arbitrary caps on the commission food delivery platforms may charge are misguided and shortsighted, poised to unintentionally add unnecessary strain on the entire restaurant industry and their workers, food delivery platforms and their workers, and Californians trying to make every dollar stretch. We must refocus our efforts and double down on ways to directly aid struggling restaurants and workers, not manipulating markets in a way that will actually hurt them. Although the intention is good, we believe this is not the right approach to help struggling restaurants. We are deeply concerned that in this highly competitive market, price controls may hinder food delivery platforms' ability to keep restaurants open, retain their employees, ensure community safety, and provide accessible part-time work opportunities throughout the state. We have witnessed the positive impact that flexible work opportunities such as food delivery services have on hardworking individuals. For low-income communities of color, earning opportunities with low barriers to entry can help them obtain an education, support their families, save for a rainy day, and achieve a better quality of life. Intervening in competitive markets' prices may seem like a cost-free solution to the challenges faced by the restaurant industry. As operating costs shift to consumers, particularly low-income ones, where even a small increase can be financially burdensome, demand decreases. Imposing arbitrary caps on food delivery platform commissions is a misguided and short-sighted approach that may unintentionally add unnecessary strain on the entire restaurant industry, its workers, and Californians trying to make ends meet.
