Hi Grace-- We are voting residents of Palm Springs and are extremely concerned over fractional home ownership that has crept into our city. Companies like Pacaso, Cohana, and the many more that are sure to develop, (if the City allows), have nothing beneficial to offer Palm Springs. Their effect is to degrade neighborhoods by their nature of different owners taking possession for 2 weeks, leaving to allow other owners arriving for another two weeks etc. The stability of our neighborhoods depends on owners (or long term renters), knowing and relating to each other. Fractional ownership is the antithesis of this. We beseech you and the other council members to do the right thing and to protect our neighborhoods and our city by not allowing this type of business to take place in our residential neighborhoods. Staff told me that it was best to show up after 10 AM to avoid the initial rush so I showed up at 11 AM with 3 file boxes….only to be directed to an new location on Ramon across from the car wash. Cars were queued dangerously onto Ramon with no traffic control. I was informed that it was a PS Realtor Association shredding event and they weren’t able to accommodate any more of the City’s constituents….what a fiasco! The VLPNO Board voted unanimously at our April meeting to ask the City of Palm Springs, its elected representatives and ONE-PS to vote in favor of the complete elimination and blockage of the fractional property ownership model used by Pacaso and any other entity to operate within the City of Palm Springs. In addition, the VLPNO Board respectively requests the City undertake any necessary actions to revoke the deeds currently issued by/to Pacaso and others and to the fractional owners of the single- family homes within City boundaries. VLPNO believes the single family home ownership model which for generations has been the mainstay of single family home residential zoning throughout our country is under attack from all directions. This is especially true in our own neighborhood. The home ownership model utilized by these fractional real estate agencies such as Pacaso is just another example of this assault. 1. The very concept of residential, single-family home zoning is diametrically opposed to the multi-family ownership model used by Pacaso’s time- share/tenancy in common concept. Pacaso and other real estate agencies sell fractional ownership in homes zoned for single-family use to as many as groups of 8 homeowners. By definition, 8 homeowners is not a single-family homeowner. Cities across the country have zoning for hotels and multi-family use. 2. The Pacaso model is more suited to commercial zoning. Pacaso converts houses into LLCs. Pacaso then sells shares of these ‘corporate’ houses to multiple investors. The Pacaso model makes these properties part of a corporation. However even then it is not a direct match. Single-family zoning is meant to be just that: use for a single family. The inclusion of multi-family ownership in single- family zoned areas will irrevocably change the character of those neighborhoods 04/27/2023 Public Comment Non Agenda Item – making them less of a residential neighborhood and more of a commercial zone. 3. The costs associated with fractional ownership homes outweigh any benefits. Any financial benefit from property taxes and potential tourist type spending in Palm Springs would be offset by increased infrastructure usage, and the degradation of neighborhood quality of life. Palm Springs does not receive any TOT taxes from fractional ownership homes homes. On the surface, the fractional ownership model seems like a ruse to circumvent TOT taxes and STR rules/regulations. Furthermore, there is no way to prevent fractional ownership homes from being leased to non-owners. (Thereby losing potential TOT revenue.) There is no marketing benefit to the City or its residents for increasing the density in residential neighborhoods: in fact the opposite is true. The failure of the City to protect single-family homeownership and the quality of life in single family home neighborhoods will be viewed as a negative. No income and no marketing benefit equals no upside, only downside. 3. We are aware that the City is considering an appeasement, or a negotiation, whereby the City will grant approval subject to certain conditions including an agreement to abide by the rules governing short-term rentals. We want to be very clear on this point. There should be NO NEGOTIATION between the City and Pacaso. 4. Anecdotally we all know that many of our long-time neighbors and/or friends are leaving or have already left Palm Springs for other cities in the desert. Many are or have been quite clear about their reasons for doing so. Other cities in the Coachella Valley are doing more to protect and enhance the quality of life than Palm Springs is doing. Allowing fractional ownership within Palm Springs is one more step away from our desirable residential character and one step closer toward commercialization. We are also keenly aware of concerns that Pacaso might sue the City of Palm Springs if its proposals are rejected. We as residents of the City of Palm Springs will not be intimidated. The City of Palm Springs should not back down from doing what’s right for our residents just because of litigation threats. Many other cities in our desert have already voted to decline Pacaso’s ability to operate within their boundaries entirely. We’re asking our City to do the same. Hello, I attended yesterday’s Oasis del Sol Neighborhood Annual Meeting and asked you about the pedestrian controlled signal at Sunrise & Tamarisk which was included as a recommendation (with low priority) in the City’s 2021 Pedestrian Plan. I’ve been in touch off and on with Francisco Jaime, Senior Civil Engineer, and he has been very responsive. You confirmed yesterday what he has been telling me consistently… that due to its low priority there is no projected date for implementation of the recommended signal at that corner, and it seems it won’t be scheduled any time soon. It appears that the pedestrian fatality at that intersection wasn’t sufficient to move the project ahead relative to its priority. My husband and I are seniors and walk our dog, Louie, to the park every day when we stay at our condo in Sunrise Oasis. Walking to the signalized crosswalk at Tachevah is just not feasible given the distance (the park is less than a mile away & it adds an extra 1.5 miles to the round trip). I’m hoping that we can get Oasis del Sol Community members involved to ask the City to reconsider, so that we can walk directly to Ruth Hardy Park without literally running across Sunrise & risking our lives. Those cars really zoom by! I would appreciate any advice as to how to move forward with asking the City to act more quickly to install a signalized cross walk at Sunrise & Tamarisk. Although Smart Cities are being touted as “Sustainability” and “Equitable” and “Convenience,” Smart Cities are not being accurately described for what they really are - they are mass surveillance cities, which remove any sense of individual privacy. In fact, a euphemism for “smart cities” could be called “surveillance.” This means that these California cities will deploy surveillance technologies powered by automatic data mining, facial recognition, and other forms of artificial intelligence at a scale never seen before. As you know urban surveillance is a multibillion-dollar industry, with these cities readily handing out money to contractors and nonprofits and creating new divisions in the city government to build the smart city industry and maintain it. While “smart cities” have been described by proponents with soothing promises of greener energy solutions, lower-friction mobility, and safer streets, the honest fact is these cities will be supercharged surveillance that encroach on free speech, privacy, and data protection. And, the facial recognition and related technologies at the scale that smart cities will employ are extremely worrisome. Moreover, the deployment and integration of surveillance technologies, such as sensors and biometric data collection systems - electronic, infrared, thermal, and LIDAR sensors form the basis of the smart grid. They do everything from operating streetlights to optimizing parking and traffic flow to detect crime. Therefore, these cities will become a veritable thicket of video surveillance. Identity collection devices will become commonplace, exploding across public and private spaces. Can you imagine a world where you’re watched every second? I hope you don’t want this for our city. While we do have these technologies now, we don’t have them at the scale that Smart Cities employ. I am asking that you dismiss any of these forms of surveillance in our city.. I am asking that you remember a time when privacy was valued. I am including an article that I ask you to read. I know that many of the council members in other cities are approving everything with a rubber stamp that has to do with Smart Cities, but I wonder if they are really considering the future they are creating for us residents? I am expressing my extreme concern about these other California cities and am asking that you and the council members not make Palm Desert a Smart City. I know I’m just a regular person, but I needed to express myself to you. You appear to be very reasonable and “Holistic. Surely, it cannot be your dream to bring this massive surveillance state to Palm Desert. Smart Cities are the “shiny new button” that are being touted as the best thing around. However, there appears little thought for the implications smart cities bring and nobody would vote for digital prisons if they understood how vast the surveillance will be in smart cities. As previously stated, I know that money is being handed out like water and many of those who represent us are caught up in the euphoria of being on this new trend, but I can’t help but think this Pandora’s Box is going to bring great regrets in the future. I’ve done considerable research on this, using my own free time because I care about the future of Palm Desert and the Coachella Valley. April 19, 2023 Grace Elena Garner, Mayor Palm Springs, California The Honorable Grace Garner: Re: Proposed Golf Course conversion – Mesquite Golf Course, Palm Springs I am writing to the Palm Springs Manager and Council to express my concerns on the current state of the Mesquite Golf Course. My biggest concern is that it appears that the Oswit Land Trust is not following the Golf Course Conversion Ordinance, and I want to ensure that this is followed. The Golf Course Conversion Ordinance has been ignored, and there has been absolutely no consultation with the impacted residents immediately bordering the Mesquite Golf Course by Oswit, and that the Conversion guidelines are being ignored by Oswit. This is not acceptable. I was very encouraged when you first put in the Golf Course Conversion Ordinance a few years ago, but now am very discouraged that it is not being followed in this circumstance. Why is this happening? I understand that Oswit is planning to convert the Prescott Preserve back to a desert/wildlife preserve, and encourage the breeding of coyotes and other predatory animals in the heart of Palm Springs. My second largest concern is the safety of the adjacent residents and their children/pets. Regarding the coyotes, encouraging birth and life in the middle of Palm Springs is not safe, period. Coyotes will become territorial of their home, and will begin to attack more and more. In fact, I previously witnessed a coyote attack, and kill, a large egret from the pond on the former golf course right in front of me. This was very disturbing. Is this something you want the residents and visitors to Palm Springs to remember about your city? Coyotes have always used the Mesquite Golf Course as a corridor, but by encouraging breeding you are encouraging them to stop and take up residence. I don’t believe the Wildlife Conservation Board and authorities, and the City, wants this to happen. Also, the weeds that are growing, and now dying, in the former golf course along Farrell and the bike path are not being cut. Optically, this looks really bad and I don’t believe it is the impression you want to give to Palm Spring residents and tourists. 04/27/2023 Public Comment Non Agenda Item This property that was formerly the Mesquite Golf Course is extremely important to Palm Springs given its location in the City. You, as leaders of our city, have a wonderful opportunity to make sure this conversion is done properly, with all the appropriate consultation. There are many residents affected by this change, and they should be consulted with any proposed plans being brought forward by Oswit before anything is done. All I ask is that proper due diligence is done, which I believe the Golf Course Conversion Ordinance provides if followed, and that the existing litigation before the Courts between the Mesquite HOA and Oswit is resolved before any approvals are given.
