' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, ADOPTING A
NONDISCRIMINATION POLICY FOR ANY PROGRAM OR
ACTIVITY FUNDED IN WHOLE OR IN PART WITH
HOMEKEY FUNDS PROVIDED BY THE CALIFORNIA
DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT
WHEREAS, the California Department of Housing and Community Development
released a Notice of Funding Availability on September 9, 2021, amended on January
14, 2022 and on May 5, 2022, to make funding available to local public entities to
develop a broad range of housing types by converting including, but not limited to,
hotels, motels, hostels, single-family homes and multifamily apartments, adult
residential facilities, manufactured housing, commercial properties and other existing
buildings to permanent or interim housing.
WHEREAS, the City of Palm Springs and the County of Riverside submitted a
joint application for HomeKey 2 funds on January 28, 2022, for the development of an
adaptive -reuse and new construction interim housing project that aims to quickly house
formally homeless individuals and families and transitional age youth while also
providing on -site supportive programming;
WHEREAS, the California Department of Housing and Community Development
awarded the City of Palm Springs and the County of Riverside a HomeKey 2 funding
award in the amount of $19,059,202;
WHEREAS, a Standard Agreement between the California Department of
Housing and Community Development, and the City of Palm Springs and County of
Riverside was fully executed on January 18, 2023;
WHEREAS, as a condition of the Standard Agreement and receipt of HomeKey
grant funds, the City of Palm Springs and the County of Riverside are required to have
In place a formal nondiscrimination policy for any program or activity funded in whole or
in part with HomeKey funds;
WHEREAS, the City of Palm Springs wishes to adopt a nondiscrimination policy
in accordance with HomeKey funding requirements for any program or activity funded in
whole or in part with HomeKey funds,
NOW THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS:

SECTION 1. The Recitals set forth above are true and correct and incorporated herein
by reference. I
SECTION 2. The Nondiscrimination Policy for any program or activity funded in whole
or in part with HomeKey funds as stated below is hereby adopted.
"Nondiscrimination Policy For Any Program Or Activity Funded In Whole Or In Part With
HomeKey Funds:
No person shall, on the grounds of race, color, religion, sex, gender, gender identity,
gender expression, sexual orientation, marital status, national origin, ancestry, familial
status, source of income, disability, age, medical condition, genetic information,
citizenship, primary language, immigration status (except where explicitly prohibited by
federal law), arbitrary characteristics, and all other classes of individuals protected from
discrimination under federal or state housing laws, individuals perceived to be a member
of any of the preceding classes, or any individual or person associated with any of the
preceding classes, be excluded from participation in, be denied the benefits of, or be
subjected to discrimination under, any program or activity funded in whole or in part with
Homekey funds.
Any program or activity funded in whole or in part with Homekey funds shall comply with
the requirements of the Americans with Disabilities Act of 1990, the Fair Housing
Amendments Act, the California Fair Employment and Housing Act, the Unruh Civil Rights
Act, Government Code Section 11135, Section 504 of the Rehabilitation Act of 1973, and
all regulations promulgated pursuant to those statutes, including 24 CFR Part 100, 24
CFR Part 8, and 28 CFR Part 35."
SECTION 3. The City Manager or designee is authorized to take all actions necessary
to implement this Resolution.
