Minutes of the Regular Meeting of the City Council
of the City of Palm Springs
Pursuant to Assembly Bill 361 this meeting was conducted in part by teleconference.
CALL TO ORDER:
A Regular Meeting of the Palm Springs City Council was called to order by Mayor Middleton
on Thursday, December 15, 2022, at 5:40 p.m.
PLEDGE OF ALLEGIANCE:
Boy Scout Troop 262 led the Pledge of Allegiance.
ROLL CALL:
Present: Councilmembers Geoff Kors, Christy Holstege, Dennis Woods; Mayor Pro Tern
Grace Elena Garner; and Mayor Lisa Middleton
Absent: None
City Staff
Present: Teresa Gallavan, Interim City Manager, Jeremy Hammond, Deputy City Manager;
Jeffrey Ballinger, City Attorney; Brenda Pree, City Clerk and Monique Lomeli, Chief
Deputy City Clerk were present at Roll Call. Other staff members presented reports
or responded to questions as indicated in the minutes.
PRESENTATIONS, PROCLAMATIONS, AND OTHER NOTICES:
JR Roberts with an update from the Palm Springs Plaza Theatre Foundation
ACCEPTANCE OF THE AGENDA:
By consensus, the City Council agreed to accept the agenda with no items removed for separate
discussion.

1. CONSENT CALENDAR:
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to approve the consent calendar with the removal of none.
A. FINDINGS TO CONDUCT CITY COUNCIL AND BOARD, COMMISSION, AND
COMMITTEE MEETINGS VIRTUALLY UNDER ASSEMBLY BILL 361
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to find that the City Council has considered the circumstances of
the state of emergency during a proclaimed state of emergency, and state or local officials
have imposed or recommended measures to promote social distancing, and as a result, the
Palm City Council and all of Palm Springs Board, Commission, and Committee meetings
may be held by videoconference, in accordance with AB 361
B. APPROVAL OF MINUTES.
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to approve City Council Meeting Minutes of November 28, 2022.
C. STAFF AUTHORIZED AGREEMENTS AND PURCHASE ORDERS FOR THE
PERIOD OF OCTOBER 1 THROUGH OCTOBER 31, 2022, AND NOVEMBER 1
THROUGH NOVEMBER 30, 2022.
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to receive and file the report of Staff Authorized Agreements and
Purchase orders.
D. REJECT ALL BIDS FOR THE AIRPORT COMMON USE PODIUMS — BONO
CONCOURSE, CITY PROJECT NO.21-28
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to:
1. Reject the bid received on November 15, 2022 for Airport Common Use Podiums Bono
Concourse, City Project No. 21-28.
2. Authorize Staff to rebid the Project.
E. SECOND READING AND ADOPTION OF ORDINANCE NO. 2073 AUTHORIZE
ANNEXATION NO. 26 TO COMMUNITY FACILITIES DISTRICT NO. 2005-1
(PUBLIC SAFETY SERVICES)
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to:

Waive the second reading of the ordinance text in its entirety and read by title only;
and adopt Ordinance No. 2073 entitled, "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AUTHORIZING
THE LEVY OF SPECIAL TAXES IN A COMMUNITY FACILITIES DISTRICT,
INCLUDING CERTAIN ANNEXATION TERRITORY IDENTIFIED AS
ANNEXATION NO. 26, TRACT MAP NO. 37935 INTO COMMUNITY
FACILITIES DISTRICT NO. 2005-1
F. ADOPTION OF A RESOLUTION DECLARING THE RESULTS OF THE
NOVEMBER 8, 2022, GENERAL MUNICIPAL ELECTION
MOTION BY COUNCILMEMBER HOLSTEGE, SECOND BY COUNCILMEMBER
KORS, CARRIED 5-0, to:
Adopt a Resolution No. 25076 entitled, "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PALM SPRINGS, CALIFORNIA, RECITING THE FACT OF
THE REGULAR MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022,
DECLARING THE RESULT AND SUCH OTHER MATTERS AS ARE PROVIDED
BY LAW."
2. OUTGOING COUNCIL MEMBER COMMENTS
COUNCILMEMBERS KORS AND WOODS GIVES THEIR FINAL COMMENTS AS
CITY COUNCIL BOARD MEMBERS.

3. OATH OF OFFICE ADMINISTERED TO NEWLY ELECTED PUBLIC OFFICIALS
Dr. Oscar Chamudes administer Oath of Office to Jeffrey Bernstein. Former Mayor Odom
to administer Oath of Office Ron deHarte.
4. INCOMING COUNCIL MEMBER COMMENTS
Jeffrey Bernstein gave comments and thanks. Ron deHarte gave comments and thanks.
5. APPOINTMENT OF THE MAYOR AND MAYOR PRO TEM
Motion to appoint Grace Garner as Mayor — Motion by Councilmember Middleton, second
by Councilmember Holstege, carried 5-0.
Pursuant to Resolution no. 24593, appoint Grace Garner to serve as Mayor and Jeffrey
Bernstein to serve as Mayor Pro Tern for the terms ending December 2023.
Former Mayor Middleton administers Oath of Office as Mayor to Mayor Grace Garner.
Motion to appoint Jeffrey Bernstein as Mayor Pro Tem — Motion By Mayor Garner, second
by Councilmember deHarte, carried 5-0.
