HomeMy WebLinkAboutPC - RES NO 6932RESOLUTION NO. 6932 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALI FORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A MUL Tl-FAMILY RESIDENTIAL USE IN THE C-1 ZONE; A TENTATIVE PARCEL MAP FOR THE PURPOSE OF A THREE (3) UNIT CONDOMINIUM; A MAJOR DEVELOPMENT PERMIT APPLICATION FOR THE CONSTRUCTION OF A THREE­ UNIT CONDOMINIUM ON AN UNDEVELOPED 14,810-SQUARE FOOT PARCEL; AND AN ADMINISTRATIVE MINOR MODIFICATION FOR THE REDUCTION OF THE FRONT AND SIDE YARD SETBACKS FOR THE DEVELOPMENT NAMED "EDEN PALM ESTATES" LOCATED AT WEST VIA OLIVERA DRIVE, SPLIT ZONE C-1/R-2 (APN 504-270-002) (CASE NOS. 5.1562, TPM 38400, 3.4326 MOP & 7.1655 AMM) THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS: ) A.William Eden, Owner (collectively, "Applicant") filed a Conditional Use Permit, a Tentative Parcel Map, a Major Development Permit Application, and an Administrative Minor Modification (Cases 5.1562, TPM 38400, 3.4326 MAJ and 7.1655 AMM), with the City of Palm Springs Planning Department, pursuant to Sections 92.12.01(0)(18) (Conditional Use Permit); Subdivision Map Act 66474 (Tentative Parcel Map), 94.04.01 (Development Review) and 94.06.01 (8)(3) Administrative Minor Modification of the Zoning Ordinance for the construction of a new three-unit multi-family residential condominium complex located at West Via Olivera Drive, Split Zone C-1 & R-2. (APN 504-270-002) B.On October 26, 2022, a public hearing on the application to consider Case each of the above development entitlements was held by the Planning Commission in accordance with applicable law. C.The proposed project is considered a "project" pursuant to the terms of the Cal ifornia Environmental Quality Act ("CEQA") and has been determined to be categorically exempt pursuant to Section 15303(b) of the CEQA Guidelines (New Construction). D.The Planning Commission has carefully reviewed and considered all the evidence presented in connection with the project, including, but not limited to, the staff report, and all written and oral testimony presented. E.Pursuant to Section 94.02.00(8)(6) Conditionai Use Permit requires the approval authority to evaluate the application and make fin dings for conformance to the five criteria and the Planning Commission finds:
