HomeMy WebLinkAboutPC - RES NO 693111 RESOLUTION NO. 6931 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, FINDING THE PROPOSED FINAL DEVELOPMENT PLANS FOR 191 SINGLE-FAMILY RESIDENTIAL UNITS TO BE BUILT OF 40-FOOT AND 45-FOOT WIDE LOTS BY AVALON 1150, LLC, WITHIN PHASE 2 OF THE MIRALON DEVELOPMENT, TO BE IN SUBSTANTIAL CONFORMANCE WITH THE PREVIOUSLY APPROVED PRELIMINARY PLANNED DEVELOPMENT PLANS AND THE MIRALON DESIGN AND LANDSCAPE GUIDELINES FOR THE MIRALON DEVELOPMENT LOCATED AT 801 SUNRISE PARKWAY, ZONE PDD 290, SECTION 35. THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS: A. Avalon 1150, LLC, ("Applicant') has filed a Final Planned Development District application with the City pursuant to Section 94.03.00(E)(4) of the City of Palm Springs Zoning Code to construct a total of 191 single-family residential homes on 40-foot and 45-foot-wide lots within Phase 2 of the Miralon development located at 801 Sunrise Parkway, Zone PD 290. B. On May 5, 2004, the City Council adopted a Mitigated Negative Declaration MND; approved Tentative Tract Map 34148 and Preliminary Planned Development District 290 for the development of 1,150 residential units. C. On July 22, 2022, the Planning Commission at a public meeting set up a subcommittee consisting of two members of the Architectural Review Committee (ARC), and two members of the Planning Commission to have an initial review of the proposed Final Development Plans for the 191 single-family homes to be built on 40-foot and 45- foot-wide lots within Phase 2 of the Miralon Development against the Preliminary Development PDD Plans and the Miralon design guidelines. D. On September 21, 2022, the subcommittee met with the applicant and their team. At the meeting, the subcommittee made favorable comments on the plans and provided additional comments and directions to the applicant resulting in changes and revisions to the plans. E. On October 12, 2022, the Planning Commission reviewed the revised proposed Final Development Plans at a public meeting the for the 191 single-family homes within Phase 2 of the Miralon Development against the Preliminary Development PDD Plans and the Miralon design guidelines. F. The Planning Commission has carefully reviewed and considered all the evidence presented in connection with the meeting on the project, including but not limited to the staff reports, all written and oral testimony submitted by the applicant, and all written and oral testimony presented. Section 94.03.00(F) — Criteria and Findings... requires that the Planning Commission shall not approve a final development plan unless certain findings are made. THE PLANNING COMMISSION HEREBY FINDS AS FOLLOWS: Section 1: In response to the criteria in Section 94.03.00(F) of the Palm Springs Zoning Code, the Planning Commission finds that: 1. The final development plan is insubstantial conformance with the preliminary development plan. As indicated in more detail in the staff report, the proposed final development plans are consistent with the originally approved preliminary development plans and the Miralon architectural and landscape design guidelines, with respect to use, density, design, style, materials, colors, and other development standards. The proposed 191 new homes will be constructed on 40-foot and 45-foot -wide lots that were previously created when the City Council approved the tract map for the project in 2004. The final map of this phase was recorded in 2006. The site plan and the tract map layout will remain the same. 2. The final development plan is in substantial conformance with al/ other associated entitlements for the development, and As designed and proposed, the final development plans are in substantial conformance in terms of the proposed residential use, density, design, style, materials, colors, and development standards of the Miralon architectural and landscape design guidelines as approved in the preliminary planned development district plans. The conditions of approval for the overall Miralon project calls for single -story buildings at the perimeter of the property and two-story buildings on the interior; the proposed 191 homes will be adhering to this requirement. 3. The final development plan incorporates all modifications and conditions to the preliminary development plan as approved by the City Council The proposed final development plan has incorporated all the conditions and development standards previously approved by the City Council. All previous comments from the Planning Commission and the subcommittee at the preliminary development review process have also been incorporated into the final development plan as well. Therefore, when evaluated against the Miralon design guidelines and conditions from the preliminary plans, the proposed final development plans for the 191 homes meet all the required findings for a substantial conformance. Section 2: An Addendum to the MND was previously prepared which finds that the proposed Planning Commission Resolution No. 6931 October 12, 2022 5.0982-PDD 290 Final PDD Plans for 191 Single -Family Residential Units by Avalon 1150, LLC Page 3 of 3 project will not result in any new significant environmental impacts or substantially increase the severity of previously identified significant impacts as compared to the previously approved project. Furthermore, the Addendum concludes that none of the conditions described in Section 15162 of the CEQA Guidelines calling for preparation of a subsequent MND or Environmental Impact Report have occurred and therefore the Addendum to the MND is appropriate to satisfy CEQA requirements for the proposed final development plans within Phase 2 of the Miralon development. Section 3: NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the Planning Commission finds that the final development plans for the proposed 191 single-family residential units to be built on 40-foot and 45-foot-wide lots within Phase 2 of the site by Avalon 1150, LLC, are in substantial conformance with the preliminary planned development district and the Miralon architectural and landscape design guidelines.
