A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING
CASE 5.1524 CUP AMND; AN AMENDMENT TO A
PREVIOUSLY APPROVED CONDITIONAL USE PERMIT
FOR A COCKTAIL LOUNGE/ NIGHTCLUB USE IN A CLASS
1 HISTORIC SITE KNOWN AS THE J.W. ROBINSON'S
BUILDING (HSPB #84), A MUL Tl-TENANT BUILDING
LOCATED AT 333 SOUTH PALM CANYON DRIVE. (CASE
5.1524 CUP AMND)
THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS:
A.WHEREAS, Sec ondary Source Productions, LLC, dba Reforma Palm Springs
("Applicant") filed an application with the City pursuant to Section 94.02.00 (Conditional
Use Permit Amendment) of the Palm Springs Zoning Code proposing an expansion of a
previously approved cocktail lounge / nightclub use in a multi-tenant building located at
333 South Palm Canyon Drive, Zone CBD; and
B.WHEREAS, on April 28, 2022 the Planning Commission approved Case 5.1524
CUP, a conditional use permit for a cocktail lounge / nightclub use at 333 South Palm
Canyon Drive; and
C, WHEREAS, a notice of a public hearing of the Planning Commission of the City of
Palm Springs to consider Case 5.1524 CUP AMND was given in acco rdance with
applicable law; and
E.WHEREAS, on September 28, 2022, a public hearing to consider Case 5.1524
CUP AMND was held by the Planning Commission in accordance with applicable law;
and
F.WHEREAS, the proposed conditional use permit amendment is considered a
"project" pursuan t to the California Environmental Quality Act ("CEQA"). The Planning
Commission has evaluated the project under the guidelines of CEQA and determined it
to be exempt from further analysis under CEQA as a Type 1 (Existing Facilities)
Categorical Exemption; and
G.WHEREAS, the Planning Commission has carefully reviewed and considered all
of the evidence presented in connection with the project, including, but not limited to, the
staff report, and all written and oral testimony presented.
