HomeMy WebLinkAboutPC - RES NO 6923RESOLUTION NO. 6923 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING CASE NOS. 5.1561 CUP, 22-036 LUP A CONDITIONAL USE PERMIT AND A LAND USE PERMIT TO WAIVE PARKING REQUIREMENTS, TO OPERATE A COFFEE SHOP/ COCKTAIL LOUNGE USES LOCATED AT 180 EAST PALM CANYON DRIVE . THE PLANNING COMMISSION FINDS AND DETERMINES AS FOLLOWS: A.CRA Management, LLC. ("Applicant") filed a Conditional Use Permit application (Case 5.1561 CUP) with the City pursuant to Section 94.02.00 of the Palm Springs Zoning Code (PSZC) to establish and operate a coffee shop / cocktail lounge consisting of a 34-seat business operating from 7:00AM to 11 :00PM daily in a commercial tenant space located at 180 East Palm Canyon Drive, Zone C-1, APN: 508-346-012. The Applicant has also filed a Land Use Permit application (Case 22-036 LUP) pursuant to Section 94.02.01 of the PSZC to waive parking requirements for the change of use for the existing medical office to a coffee shop / cocktail lounge. (These applications, Case Nos. 5.1561 CUP, and 22-036 LUP are collectively referenced herein as the "Project".) B.Notice of a public meeting of the Planning Commission of the City of Palm Springs to consider the Project was given in accordance with applicable law. C.On September 14, 2022, the Planning Commission held a public hearing to consider the Project in accordance with applicable law. D.The proposed Project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"). However, the Project involves negligibleexpansion of an existing hotel restauranUbar use of offering public service. Therefore, the project is Categorically Exempt as a Class I exemption (Existing Facilities) pursuant to Section 15301 of the CEQA Guidelines, and the preparation of further environmental documentation is not necessary. E.The Planning Commission has carefully reviewed and considered all the evidence presented in connection with the hearing on the project, including but not limited to the staff report and all written and oral testimony presented. F.Pursuant to Section 94.02.00(8)(6) of the Palm Springs Zoning Code, the Planning Commission finds the following as it relates to the Conditional Use Permit: 1.That the use applied for at the location set forth in the application is properly one for which a CUP is authorized by this Zoning Code;
