A RESOLUTION OF THE ARCHITECTURAL REVIEW
COMMITTEE OF THE CITY OF PALM SPRINGS,
CALIFORNIA, APPROVING FINAL DEVELOPMENT
PLANS FOR THE CONSTRUCTION OF 130 SINGLE
FAMILY RESIDENTIAL UNITS IN PHASE 2 OF THE
MRALON PLANNED DEVELOPMENT DISTRICT 290
LOCATED AT 801 SUNRISE PARKWAY (CASE 5.0982-.
PD 290).
THE ARCHITECTURAL REVIEW COMMITTEE FINDS AND DETERMINES AS
FOLLOWS:
A.Avalon 1150, LLC, Owner ("Applicant") filed an application with the City, pursuant
to the Palm Springs Zoning Code (PSZC) Sections 94.04.00 (architectural review) of the
Palm Springs Zoning Code, for the approval of final development plans and construction
of 130 single-family residences within the Miralon Development located at 801 Sunrise
Par kway ("the Project").
B.On April 8, 2021, the City Council adopted Ordinance No. 2042, amending
Section 94.04.00 of the PSZC to reassign review of Major Architectural Review (MAJ)
applications from the City's Planning Commission to the City's Architectural Review
Committee.
B.On May 11, 2022, a public hearing on the proposed final development plans was
held by the Planning Commission in accordance with applicable law.
C.On July 5, 2022, the City's Architectural Review Committee held a public meeting
in accordance with applicable public law. At said meeting, the Architectural Review
Committee carefully reviewed and considered all of the evidence presented in
connection with the Project, including, but not limited to, the staff report, and all written
and oral testimony presented.
THE ARCHITECTURAL REVIEW COMMITTEE RESOLVES:
Section 1: On May 5, 2004, the City Council adopted a Mitigated Negative Declaration
(MND), for the Miralon project, the MND which is the controlling environmental
document for the project disclosed all known environmental impacts associated with the
project. Pursuant to Section 15162 of the California Environmental Quality Act (CEQA),
a determination was made by the Planning Division that the project will not result in any
new additional impacts beyond those that were previously identified and addressed and
that adequate mitigation measures had already been incorporated into the project.
Based upon the record, on May 11, 2022, the Planning Commission determined that the
project will not result in any new additional impacts beyond those that were previously
identified and ad dressed.
