Senate Bill 897 (SB 897)
•Signed into law on 9/28/22, effective January 2023
•Applicable to all cities and counties (incl. charter cities)
•Further codifies that Accessory Dwelling Units (ADUs) be broadly permitted by local jurisdictions and subject only to objective standards
•City’s existing ADU ordinance became null and void upon effective date of SB 897 for non-compliance

SB 897 Changes
•Cannot deny any ADU permit for non-conforming lots/buildings, buildings with outstanding violations, or unpermitted structures unless they present a public health/safety threat
•Requires that the reason for any denial of an ADU be outlined in writing with applicants allowed to remedy their applications and obtain approval

SB 897 Changes
•Maximum ADU height increased to 18 feet within ½mile of transit stop and 25 feet for attached ADUs
•Indicates that there are no parking requirements forADUs proposed in new development
•Clarifies that junior ADUs are permitted withinattached garages and may share bathroom with theprimary residence
•Prohibits enforcement of any unpermitted ADU unlessthere is a threat to public health/safety.

Urgency Ordinance
•The urgency ordinance will provide interim standards for ADUs in accordance with the changes to State law that superseded the City’s existing ADU ordinance
•This will ensure continued local oversight of ADUs, in accordance with the City’s regulations and State law

Regular Ordinance
•Spring 2023: A regular ordinance will be considered by the Planning Commission and City Council to further refine applicable development standards as needed to effectively implement State law
•The urgency ordinance will be rescinded once the regular ordinance takes effect
