HomeMy WebLinkAbout25064RESOLUTION NO. 25064 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, LIMITING THE MAXIMUM NUMBER OF PUBLIC MEETINGS THAT CITY LEGISLATIVE BODIES MAY HOLD ON THIRD PARTY APPLICATIONS WHEREAS, California Senate Bill 330 (Chapter 654 , Statutes of 2019) ("SB 330 ") added Section 65905.5, and limits cities to a maximum of five hearings in connection with the consideration of a proposed housing development project where the application is otherwise deemed complete ; and WHEREAS , the City Council desires to streamline the administration of all matters (i .e., not just housing development projects) before the City Council and its subordinate bodies , including , but not limited to , its boards , commissions , committees , and subcommittees (whether standing or ad hoc) (its "Legislative Bodies"); and WHEREAS, Legislative Bodies sometimes continue consideration of particular matters before them to future meetings, resulting in additional delays and uncertainty in the consideration of submitted matters ; and WHEREAS , the City Council desires to limit the frequency with which matters are continued , delayed , or otherwise deferred by its Legislative Bodies , where such matters' applications are otherwise complete. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the foregoing Recitals are true and correct and are incorporated herein by this reference . SECTION 2. The following Policy is hereby adopted : A. It is the policy of the City Council that the City's Legislative Bod ies shall not conduct more than three (3 ) meetings on a particular matter before them without reaching a final disposition on that particular matter. For purposes of this policy, a rejection of a matter, whether on the merits of the application or on account of any procedural deficiency(ies) in its prosecution, shall constitute a final disposition . B . For purposes of this policy, the term "meeting" includes any meeting (as defined by the Ralph M . Brown Act), public hearing, workshop, or similar meeting conducted by any City Legislative Body with respect to a matter submitted by a third-party, whether such meeting is held by ffle City Council , the Planning Commission , or any board, commission , or arly other hearing officer or body of th e City, or any committee or subcommittee thereof. Resol utio n No. 25064 Page 2 C . This policy applies to every matter before any City Legislative Body that has been initiated by application or request of a third-party . This policy does not apply to any matter that has been initiated by City Council , City Staff or any City Legislative Body . D. Violation of this policy shall not serve to invalidate any action of the City Council or any other City Legislative Body. Nor shall any violati on of this policy either create or confer any right or remedy in or upon an appl icant, complainant , third party , or any other member of the public . Instead , this policy is an expression of the City Council's desire to minimize the number of meetings that third-party applications will be subject to . E. This po licy does not limit , and the City Council reserves , any and all rights of the City Counci l to call up before itself any matter then pending before any Legislative Body . F. Nothing in this policy precludes any third -party app li cant from agreeing to add iti ona l meetings , as otherwise limited by this policy. SECTION 3. This Resolution shall take effect immediately, and shall app ly to all third-party applications deemed complete after July 1, 2022 . ADOPTED THIS 27TH DAY OF OCTOBER, 2022 .
