Y N r� <IFOCN�P• Thursday, April 21, 2022 Minutes of the Regular Meeting of the City Council of the City of Palm Springs Pursuant to Assembly Bill 361 this meeting was conducted by teleconference in addition to in - person public access to the meeting location. CALL TO ORDER: A Regular Meeting of the Palm Springs City Council was called to order by Mayor Middleton on Thursday, April 21, 2022, at 5:30 p.m. PLEDGE OF ALLEGIANCE: Mayor Middleton led the Pledge of Allegiance. ROLL CALL: Present: Councilmembers, Christy Holstege, Geoff Kors, Dennis Woods; Mayor Pro Tem Grace Elena Garner; and Mayor Lisa Middleton Absent: None City Staff Present: Justin Clifton, City Manager; Teresa Gallavan, Assistant City Manager, Jeffrey Ballinger, City Attorney; and Monique Lomeli, Interim City Clerk, were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. City Council Minutes April 21 2022 REPORT OF CLOSED SESSION: The Regular Closed Session of the City Council of April 21, 2022, was called to order by Mayor Middleton at 3:30 p.m., with all members present. The meeting convened into Closed Session to discuss the following items as listed on the Regular Closed Session Meeting Agenda: CONFERENCE WITH LEGAL COUNSEL — MATTERS CREATING SIGNIFICANT EXPOSURE TO LITIGATION, Pursuant to Government Code Section 54956.9(d)(2): Three (3) matters that, under the existing circumstances, the City Attorney believes create significant exposure to litigation. CONFERENCE WITH LEGAL COUNSEL — DISCUSSION TO CONSIDER INITIATION OF LITIGATION, Pursuant to Government Code Section 54956.9(d)(4): Under existing facts and circumstances, there are four (4) matters the City Council has decided or may decide to initiate litigation. APPROVAL OF A PURCHASE ORDER TO STANTEC CONSULTING SERVICES, INC. FOR CONSTRUCTION MANAGEMENT SERVICES IN AN AMOUNT NOT TO EXCEED $295,810 FOR THE BOGERT TRAIL SEWAGE LIFT STATION, CITY PROJECT NO.18-18 MOTION BY MAYOR PRO TEM GARNER, SECOND BY COUNCILMEMBER WOODS, CARRIED 5-0, to: 1. AWARD A CONSTRUCTION CONTRACT TO ELECNOR BELCO ELECTRIC, INC., A CALIFORNIA CORPORATION, IN THE AMOUNT OF $511,706 FOR FOR THE TRAFFIC SIGNAL INSTALLATION, SAN RAFAEL DRIVE, AND AVENIDA CABALLEROS, CITY PROJECT NO.20-33 MOTION BY MAYOR PRO TEM GARNER, SECOND BY COUNCILMEMBER WOODS, CARRIED 5-0, to: Award construction contract to Elecnor Belco Electric, Inc. (Belco), a California corporation, in the amount of $511,706 for the Traffic Signal Installation, San Rafael Drive and Avenida Caballeros, City Project No. 20-33. 2. Authorize the City Manager or his designee to execute all necessary documents. H. WAIVER OF FEES RELATED TO THE PALM SPRINGS CULTURAL CENTER USE OF THE DOWNTOWN PARK FOR AN OUTDOOR SUMMER MOVIE SERIES MOTION BY MAYOR PRO TEM GARNER, SECOND BY COUNCILMEMBER WOODS, CARRIED 5-0, to authorize the City Manager to waive associated fees in the amount of $4,186 for the Palm Springs Cultural Center's use of the City's Downtown Park for the outdoor summer movie series. APPROVE MEMORANDUM OF UNDERSTANDING ACCEPTING GRANT FUNDS IN THE AMOUNT OF $486,222 FROM THE STATE OF CALIFORNIA DEPARTMENT OF JUSTICE TOBACCO GRANT PROGRAM MOTION BY MAYOR PRO TEM GARNER, SECOND BY COUNCILMEMBER WOODS, CARRIED 5-0, to: 1.
