The number of very large street vending operations appearing in the city lately are a general health and traffic concern, but I am writing primarily about a vendor who has set up just off the sidewalk on Ramon across from my park, Ramon MHP (1441 Ramon). The vendor has a large operation with two serving tables, 3-4 people working, and tables for customers. The vendor sets up operations at about 6PM, serves customers until about 2AM, and spends about an hour taking down. I know all of that because the music and then noise from cleaning up disrupts my evening and keeps me awake. The proposed regulations do not address noise. While I am encouraged that the regulations might shut this vendor down or significantly reduce their size, I do believe it important to also address noise. The music from a street vendor should not disturb nearby residents or be much louder than similar nearby restaurants. Street vendors are not following the same stringent health, safety, and tax ordinances that “brick and mortar” business do in Palm Springs. This gives these temporary, pop-up enterprises an unfair advantage and cheats our community out of safety and tax revenues. Palm Springs restaurants and “brick and mortar” vendors follow the City and County health codes. They are regularly inspected for compliance and fined for infractions. Street vendors and food trucks largely arrive at night when no City inspectors are on duty to monitor street vendors for compliance. Street vendors provide no restroom and sanitation facilities. Their customers are left to use the bathrooms within our local businesses, or the few public restrooms provided by Palm Springs taxpayers. Street vendor food operations often present public safety and health hazards because they cook with open propane or gas flames, which alone create serious unmitigated fire hazards, but additionally, the vendors fail to safely manage their exhaust emissions and pollute our community with their smoke, smells and particulates. Street vendors often create public safety and nuisance issues because they block sidewalks with their equipment or customer lines and take away parking spaces supported by “brick and mortar” business taxes. It has always been the case that our restaurants and retail businesses strive to prosper during our destination’s peak seasons so that they may be able to survive in the slower months while providing local jobs and important community attractions and amenities all year or nearly all year long. Street vendors, on the other hand, show up when our destination is most ripe for capturing the greatest amount of visitor dollars. While we are discussing dollars, our local businesses pay state and local sales taxes, property taxes, payroll taxes and employee benefits and rents. Who is monitoring taxable receipts, payroll taxes and employee benefits on these street vendors? To whom are they paying rent? Local businesses are also the leading supporters of Palm Springs charities and civic events. I live in Ramon Mobile Home Park off sunrise and Ramon. One of the busiest intersections in palm springs yet we have had a pop up taco stand for more than a month now. What started as a tent has now Segwayed into 3 tents. Now with tables chairs and lights as well as music so loud I can feel the base while in my living room not to meet hearing it Calls by numerous other neighbors to police and nothing happens. Why is this allowed in a city that doesn't allow good trucks yet this taco stand with no parking or running water is up and running nightly. I have little doubt that very close to every business on Palm Canyon Drive between East Granvia Valmonte and Camino Parocela would prefer you did not permit street vendors selling both food and merchandise. SB 946 does not permit you favor one product over another not give any preference whatsoever to brick and mortar businesses over street vendors, commerce is commerce under SB 946. This means to avoid likely litigation all commerce including bars and restaurants using public sidewalks and parklets as well as street vendors would need to be banned. That said, you do have an opportunity to regulate street vendors using Time, Place and Manor to which any and all commerce may occure along Palm Canyon Drive. This clarifies that during special events, Pride, Villagefest and Parades, street vendors must be a minimum of 25 feet off Palm Canyon Drive. Your proposed regulations cover both roaming carts and stationary vendors, it seems wrong to ban a stationary vendor from using a table. A table could look far better than a cart or merchandise on the sidewalk. I believe a far more important issue to address is the maximum area a street vendor may occupy. If you permit street vendors on Palm Canyon Drive between Granvia Valmonte and Caming Parocela it would be my recommendation to limit any street vendor to a space not exceeding four feet by eight feet in total area. Currently restaurants are permitted to use umbrellas and other shade devices despite the fact that in most cases these structures block visibility of the storefront and signage next door. In our climate it is a health and safety concern to prohibit street vendors from any shading of any kind. We recognize the need for restaurant customers are in the “furniture zone” of a sidewalk, that same need exists when a street vendor is in the “furniture zone” of a public sidewalk. Vendors like the food vendors setup at various locations raise an issue of vehicles using undeveloped lots for parking which is prohibited in Palm Springs due to PM-10 dust regulations. Lighting should be included in any new ordinance, currently many have strings of LED light glaring, I’m sure Flinn Fagg could come up with a no glare lighting standard. 11/28/2022 Public Comment Item 3C I am pleased the City of Palm Springs is including a minimum six feet open and unobstructed sidewalk at every location to accommodate ADA requirements and needs of our disabled community. Several of the current food vendors currently leave closer to 24 inches open space. The six feet should not include the area customers stand, but rather six feet clear and open sidewalk. Additionally bike lanes are being used for parking at a minimum of three food vendors and that should be addressed in any ordinance. It’s important to acknowledge the City of Palm Springs has recognized that a minimum of six feet unobstructed space is needed to prevent obstruction of the public right of way. This acknowledgement means the restaurants reducing public right of way to less than six feet clear and open space free of customers, sales and waiting customers should be outside the area reduced in width by way of a business using public property. Please know I plan to pull a street vendor permit for the downtown area, however, fully accept any ban on all commerce within 25 feet of Palm Canyon Drive in the greater downtown. I have a couple of potential concepts, one would be a fixed location in front of Destination PSP selling mid-mod tees and similar merchandise, the other being a fixed location near Crystal Fantasy selling jewelry and gemstones.
