I currently own and operate a successful “adult oriented men’s club” in Los Angeles, CA. I also own property at 531 E Industrial Place in Palm Springs. This is property is currently zoned CM (Commercial Manufacturing) and meets the “Adult Use” criteria to operate per the new ordinance. The Tahquitz Creek wash runs several feet behind and separates my property from new residential homes under construction (less than 500 feet). I respectfully request you consider adding a waiver process, due to the unique characteristics of the cities industrial area. In addition, not all “adult use ordinances” are equally the same. I operate a private membership club and request the use be under spas and clothing optional hotels not as sex clubs. I offer privacy just like the hotel and spas noted in the ordinance. A 90-day residency is in direct contrast against the foundation of this city as a resort destination. It seems quite unenforceable unless time clocks are installed at the airport where non-locals would be required to clock in when they arrive and clock out upon departure. Additionally the city should consider employing ICE officers at all major roads into city to record when non-resident owners enter and leave the city. This will ensure that 90-day residency requirements are met. Clearly these resolutions are ridiculous, just as a 90-day residency requirement. Additionally the discrimination against any couple (each individual not allowed to permit a maximum of one VR) is a violation of a California protected class. Finally I’m don’t know why further regulations are necessary, appears the current ordinance is working fine as council members stated. Please do not reply directly to this email. 11/10/2022 Public Comment Item 3A November 10, 2022 Palm Springs City Council 3200 East Tahquitz Canyon Way Palm Springs, CA 92262 Dear Council Members: The progressive revisions proposed to the Palm Springs Adult-Oriented business ordinance make a good start to keep pace with other jurisdictions including Los Angeles, San Diego and San Francisco. My concern is that the even with the revisions, the definition of an ‘Adult Sex Venue’ is so broad that it still includes my private life and personal spaces. The last sentence states that ‘The above notwithstanding, an “adult sex venue” is also any place which that represents itself to any person or group of persons as a place for persons to engage in specified sexual activities” By that definition, inviting someone to my home for intimate time is a violation. The LGBTQ+ community is already under pressure from all corners and to have verbiage that would enable arbitrary consideration of my private property to be an ‘adult sex venue’ goes too far. I request the final sentence be removed, or that the language be clarified to make it clear that noncommercial venues, such as private homes, are not included. Attached please find my recommendation for a revised ‘adult sex venue’ definition. Thank you so much for your help. November 9 2022 City of Palm Springs Manager, Mayor Middleton, Council Kors, Woods, Garner, Holstege: I object to any change or modification to the ordinance of 1995. We need not change to allow Adult Sex venues, outlets or the like in this city because: 1. The city currently is understaffed for Peace Officers.. any sort of sex club..'hard or soft on any level' (no pun intended) ought to be allowed in this city at this time. 2. By changing ordinance now with so many, many real problems and issues in the city concerning crime, trespass, the fact that the local police force is unable to respond to calls from residents now for incidents of concern be it disturbances, gun shots, trespass, theft, burglaries, drunk or stoned drivers or speeding. This is a very bad time to run our police department to more disturbances that surely will happen with the proposed allowable long laundry list of permissions. 3. Please table and close this matter. This is objectionable when this city needs to focus on many much more important matters such as actually doing something about cleaning up the city, making it safer, taking the vagrants away from downtown or around venues that exist. 4. Please focus on clear ordinances to house, provide services to veterans who are homeless or living in awful substandard places. Help low income seniors.. I call to try to help seniors yet ALL of the low income, affordable housing has a wait list of 1-2 years or longer for a one bedroom and 3+ years for a two bedroom. 5. City staff today farms out work product yet you propose opening a can of worms like this that will take focus away from backlog of city services for such that will over burden not just police but planning, building dept staff and enforcement. 6. In 1995 the current ordinance was in place for good cause. There is still good cause to maintain this ordinance 7. The city is not able to keep up with current services, permitted building projects sitting for months and years . 8. The proposed changes are objectionable as well with18 year olds permitted where alcohol is not served. A nude club allowing teenagers is wrong. And you do not specify teenagers may not imbibe in cannabis or the like or may not smoke cigarettes, etc. #14 page 16. 9. The fact that a room can be subrented multiple times in a 12 hour period..this just smacks of whore house, brothel. Palm Springs is not the Nevada bunny ranch and we need not have anything of the sort within city limits. This is wrong per #1. - 3 less than ten hour room rentals with sub rented multi times allowance. 10 In 1995 AIDs caused horrific deaths in the hundreds of thousands. Allowing this ordinance is an opportunity for AIDs to kill many more. Then Monkeypox is at issue with its contagious spread. 11. We can anticipate the same kind of spectacles pouring over and out onto city streets from Adult Sex clubs, lounges, cabarets too. 14. Age limits must be 21 and over..just as in buying liquor, cigarettes, pot. A distance of 1000 feet from one another, from schools, churches, senior or low income type residential or commercial venues ought to be enforced if this absurdity proceeds. 15. Proprietors, staff with sex or drug misdemeanors or felony record must not be allowed to own, apply or work there, period. City police must run full background checks on all applications. Proprieters must run background checks on all who work or perform at the adult sex operations. If anyone affiliated in any way has a sex, drug related misdemeanor or felon record, they are fined and permanent stay away orders issued so that they must stay away at least a mile from the establishment and not be permitted in the area. 16. to take away parking, to take away HC to allow on Hwy 111 at some point is all wrong too. Personally, I think overall that this will negatively influence the city and that this city ought to deny any such change in the current 1995 ordinance. This is overall a bad ordinance. The city leads are here to provide a safe, healthy place for residents. We are a small town. We need to leave the Adult Sex scene to larger cities like San Francisco, Los Angeles, San Diego. Table the changes, close the matter. Or next election, place this up for public vote, consideration for all citizens to choose whether they wish Palm Springs to be a healthy resort with focus on our great weather, outdoor healthy activities centered around walking, hiking, golf, tennis, swimming and fine dining. Or do we cater to Vegas style, dark side adult sex, brothel risky, red light district crapola. This is not Art, this is sex trade explicit. All due respect. This proposal is wrong.
