A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, DETERMINING THAT THE
PUBLIC CONVENIENCE WOULD BE SERVED BY THE
ISSUANCE OF AN ADDITIONTIAL ALCOHOLIC
BEVERAGE CONTROL LIQUOR LICENSE (TYPE 20) FOR
THE PILOT TRAVEL CENTER LOCATED AT 6605 NORTH
INDIAN CANYON DRIVE, WHICH IS WITHIN CENSUS
TRACT NUMBER 445.24 (CASE 5.1278-PCN).
A. Pilot Travel Center, LLC, Applicant, has submitted an application to the California
Department of Alcoholic Beverage Control (ABC) for issuance of a Type 20 (Off- Site
Consumption) alcohol license as an ancillary use to a retail market as part of a service
station and truck stop located at 6605 North Indian Canyon Drive, Zone HC, Section 15;
and
B. The California Department of Alcoholic Beverage Control (ABC) has determined
that there are seven (7) existing off -sale alcohol licenses issued within Census tract
number 445.24 while only one (1) such permits would be allowed based on population in
the County and the census tract in which the applicant's premise is located; and
C. The California Department of Alcoholic Beverage Control (ABC) has determined
that there is an "undue concentration" of alcohol -related licenses in the Census tract
number 445.24, and
D. Pursuant to Section 23958.4(b)(2) of the State of California Business and
Professions Code, the City Council may determine the public convenience or necessity
would be served by the issuance of the requested license; and
E. The Applicant submitted an application to the City of Palm Springs for a resolution
of convenience or necessity, Case 5.1278 PCN, for the addition of a Type 20 liquor
license within Census Tract 445.24 for the existing retail market as part of a service station
and truck stop located at 6605 North Indian Canyon Drive; and
F. The proposed liquor license would serve the public convenience or necessity
based upon the following:
• General Plan. The site is zoned HC (Highway Commercial), land RBC
(Regional Business Center) designation in the 2007 General Plan Land Use
Element, and the site is in the northern part of the City adjacent to the 1-10
freeway. The proposed use is harmonious with the objectives of the
Regional Business Center in that it focuses on servicing residents and
mostly travelers, visitors and tourists along the freeway corridor and north
Palm Springs. The proposed sale of beer and wine sale for off -site
consumption as an ancillary use to the main service station and retail
market is consistent with other service -oriented land uses found in the City
and similar uses close to the highways. The addition of beer and wine sales
will be desirable as an added source of revenue generation to the City's
general fund. The proposed addition of a Type 20 liquor license is in
harmony with the goals and policies of the General Plan as follows:

o Policy LU7.1: Encourage a diversity of high -quality commercial uses,
attractive to both the resident and the visitor, including retail,
entertainment, cultural, and food sales in appropriate areas of the
City.
o Policy LU12.1: Promote the development of high -quality regional
and freeway serving land uses that generate a sense of place and
arrival into the City at the interchanges of Gene Autry Drive and
Indian Canyon Drive with 1-10.
• Compatibility. The project site is located on a Major Thoroughfare, North
Indian Canyon Drive, adjacent to the 1-10 freeway. The project site is
approximately 5.4 acres in size, and it is adequate in size and suitable for
the proposed use. The sale of beer and wine as part of an existing retail
market as part of a service station will contribute to diversifying products
and services the area has to offer to local residents, travelers, and visitors.
The approval of the PCN will add to the attractiveness of the existing travel
center.
G. On June 8, 2022, the Planning Commission found the proposed use met findings
necessary to amend an existing Conditional Use Permit, Case 5.1278 CUP, to allow the
sale of beer and wine for ff-site consumption and imposed conditions of approval to
ensure the use is compatible with the surrounding area, not detrimental to other uses in
the surroundings, and protects the public health, safety, and welfare; and
H. On July 28, 2022, the City Council at a noticed public meeting, considered the PCN
application including the staff report and all written and oral testimony provided in
conjunction with the application.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the public convenience would be served by the issuance of
Type 20 (Off Sale General Public Premises) liquor license in conjunction with the retail
market as part of a service station and truck stop use located at 6605 North Indian Canyon
Drive, Census Tract No. 445.24.
