HomeMy WebLinkAbout24970RESOLUTION NO. 24970 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL DOCUMENTS RELATED TO THE ACQUISITION AND OPERATION OF 3589 McCARTHY ROAD IN PALM SPRINGS, INCLUDING, WITHOUT LIMITATION, THE MEMORANDUM OF UNDERSTANDING BETWEEN CITY OF PALM SPRINGS AND COUNTY OF RIVERSIDE AND THE CONTRACT SERVICES AGREEMENT WITH MARTHA'S VILLAGE AND KITCHEN, TO ESTABLISH A LOW BARRIER NAVIGATION CENTER. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY FIND AS FOLLOWS: A. On November 4, 2021, November 18, 2021, January 13, 2022, and January 27, 2022, the City Council had discussions regarding establishing a low barrier navigation center at 3589 McCarthy Road, Palm Springs (Navigation Center). B. The City Council desires to purchase 3589 McCarthy Road for the Navigation Center. C. The County of Riverside has agreed to provide the City funding for the Navigation Center. D. On January 13, 2022, a solicitation for letters of interest was released for potential operators for the Navigation Center. Martha's Village and Kitchen was the only operator to provide a proposal to the City. E. The City is the lead agency for the acquisition and operation of the Navigation Center. In 2019, the California Legislature passed, and the Governor signed, Assembly Bill (AB) 101. AB 101 contained the Legislature's determination that "low barrier navigation center developments are essential tools for alleviating the homelessness crisis in this state and are a matter of statewide concern and thus applicable to charter cities." AB 101 (2019) makes low barrier navigation centers, such as what is proposed by the City and County at 3589 McCarthy Rd., a use by right. Pursuant to Government Code section 65660(b), added by AB 101, CEQA does not apply to any action taken by a public agency to lease, convey, or encumber land owned by a public agency, or to facilitate the lease, conveyance, or encumbrance of land owned by a public agency, or to provide financial assistance to, or otherwise approve, a low barrier navigation center. Therefore, because these funding agreements and the acquisition of 3589 McCarthy Rd. are for the purpose of approving a low barrier navigation center development, no further environmental review is required by CEQA. Resolution No. 24970 Page 2 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby approves: A. The Memorandum of Understanding between City of Palm Springs and Count of Riverside, for the purchase of 3589 McCarthy Road, for the Navigation Center; B. The Loan Agreement for the Use of American Rescue Plan (ARPA) between City of Palm Springs, for the purchase of 3589 McCarthy Road, for the Navigation Center; C. The Contract Services Agreement with Martha's Village and Kitchen to Operate for the Navigation Center. SECTION 2. The City Council hereby authorizes and directs the City Manager to execute, and make any modifications approved by the City Manager and City Attorney for the following: A. The Memorandum of Understanding between City of Palm Springs and County of Riverside, for the purchase of 3589 McCarthy Road, for the Navigation Center. B. The Loan Agreement for the Use of American Rescue Plan (ARPA) between City of Palm Springs, for the purchase of 3589 McCarthy Road, for the Navigation Center. C. The Contract Services Agreement with Martha's Village and Kitchen to Operate the Navigation Center at 3589 McCarthy Road. D. A certificate of acceptance for the acquisition of the property at 3589 McCarthy Road, Palm Springs. SECTION 3. The City Council hereby authorizes the City Manager to take any and all actions, and execute any other documents, necessary to apply for grant funding and purchase and operate the property located at 3589 McCarthy Road, Palm Springs, for the Navigation Center. SECTION 4. City Staff is directed to file a Notice of Exemption for this Project.
