Franchise Agreement
•Modifications necessitated by passage of SB 1383
and additional services required for organic waste
collection
•Rates and agreement modifications discussed at
City Council meetings of 5/26, 6/16, 6/30

SB 1383 Requirements –Residential
•The City must provide service for organic
materials in addition to trash and recycling
•Organic materials include green waste and food
waste
•All containers must be color coded and labeled
Proposed Rate Increase
•Additional services required by SB 1383 will
result in additional costs to provide these services
•PSDS prepared a rate proposal to address the
additional costs
•The City engaged an independent consultant
(Sloan Vazquez McAfee) to analyze rate proposal
•Reduction in base residential rate (from $26.61 to
$25.93) accepted by Council at 6/16/22 meeting

Franchise Agreement Modifications
General changes made to add best practices, eliminate
ambiguity of existing agreement, address statutory and
regulatory updates –other changes include:
•Scope of Agreement (Section 4.2)–Modified to address
community composting
•Scope of Collection Services (Article 5)–Modified to
include additional services required by SB1383
•Extraordinary Rate Adjustment (Section 10.5)–Limits
conditions for adjustment requests

•Insurance Requirements (Section 11.11)–Increased
insurance coverage required by City
•Performance Review (Section 12.6)–Section updated to
require review in 3 years, additional review permissible
•Liquidated Damages (Section 12.7)–Added new
liquidated damages section relative to SB 1383
implementation

Discount Program
•PSDS has offered to donate $25,000 annually to
the program
•Program qualifications based on the CARE
program –200% of federal poverty level
•Applications will be reviewed/approved by
Sustainability staff
•PSDS will credit account for approved applicants

Residential Organic Waste Recycling
•September 1:Organics carts are being delivered
to our temporary assembly site at the City of
Palm Springs Corporate Yard on Civic Dr.
•September 6:Cart assembly begins
•September 19-30: Carts (with guidelines
attached)are distributed to customers
•October 3:Collection begins community-wide
