HomeMy WebLinkAbout25025RESOLUTION NO. 25025 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM - SPRINGS, CALIFORNIA, ACCEPTING THE FIRE DEPARTMENT'S REPORT ON COMPLIANCE WITH STATE INSPECTION MANDATES ; WHEREAS, the California Health and Safety Code requires fire departments within the state of California to annually inspect buildings, public or private, that are utilized as a school, hotel, motel, lodging house, apartment house, certain residential care facilities, and parcels, in the High Fire Severity Zones (HFSZ) within their jurisdiction; and WHEREAS, inspectors focus on compliance with building standards and other regulations imposed by the State Fire Marshal and on public safety and fire prevention; and WHEREAS, pursuant to Senate Bill 1205, Section 13146.4 was added to the Health and Safety Code in 2018 to require local fire departments to perform annual inspections and report compliance information annually to its administering authority; and WHEREAS, in accordance with Senate Bill 1205, the Fire Department hereby submits this report on its compliance with the state inspection mandates to the City Council for review and approval; and 'WHEREAS, the City Council of the City of Palm Springs intends this Resolution to fulfill the requirements of the Health and Safety Code regarding acknowledgment of the Palm Springs Fire Department's compliance with sections 13146.2 and 13146.3. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the foregoing Recitals are true and correct and are incorporated herein by this reference. SECTION 2. The City Council acknowledges and accepts the Fire Department's submission of an annual report regarding the inspection of certain occupancies, including schools, hotels, motels, lodging houses, apartments, certain residential care facilities, and parcels, in the High Fire Hazard Severity Zones pursuant to Sections 13146.2 and 13146.3 of the California Health and Safety Code. SECTION 3. The City Manager is authorized to execute all necessary documents associated with the compliance report. SECTION 4. This action is not a "Project" as defined by the California Environmental Quality Act (CEQA) because it involves organization or administrative activities of the 'government that will not result in direct or indirect physical changes in the environment, pursuant to CEQA Guidelines § 15378(a).
