A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, DETERMINING THAT THE
PUBLIC CONVENIENCE WOULD BE SERVED BY THE
ISSUANCE OF ALCOHOLIC BEVERAGE CONTROL
LICENSE TYPE 48 FOR PRETTY FACES NIGHTCLUB
LOCATEDAT 150 SOUTH INDIAN CANYON DRIVE WITHIN
CENSUS TRACT NUMBER 9414 (CASE 5.1551 PCN).
WHEREAS, Pretty Faces LLC, Applicant, has submitted an application to the
California Department of Alcoholic Beverage Control (ABC) for issuance of a Type 48 (On
Sale General Public Premises) alcohol license in conjunction with the operation of a
nightclub and cocktail lounge use located at 150 South Indian Canyon Drive, Census
Tract No. 9414, Zone R-A; and
WHEREAS, the California Department of Alcoholic Beverage Control (ABC) has
determined that there are 11 existing on -sale alcohol licenses issued within Census tract
number 9414 while only two (2) such permits would be allowed based on population in
the County and the census tract in which the applicant's premise is located; and
WHEREAS, the California Department of Alcoholic Beverage Control (ABC) has
determined that there is an "undue concentration" of alcohol -related licenses in the
' Census tract number 9414; and
WHEREAS, pursuant to Section 23958.4(b)(2) of the State of California Business
and Professions Code, the City Council may determine the public convenience or
necessity would be served by the issuance of the requested license; and
WHEREAS, the Applicant submitted an application to the City of Palm Springs for
a resolution of convenience or necessity, Case 5.1551 PCN, for the addition of a Type 48
liquor license within Census Tract 9414 for the proposed nightclub/cocktail lounge use at
150 South Indian Canyon Drive; and
WHEREAS, The proposed liquor license would serve the public convenience or
necessity based upon the following:
• General Plan. The site is located within the Central Business District
designation of the 2007 General Plan Land Use Element, which states on
Page 2-7: "The CBD serves as the main activity center and cultural core of
the community... theaters, museums, retail, and other entertainment
venues are encouraged." The proposed nightclub use is in harmony with
the goals and policies of the General Plan as follows:
o . Policy LU7.1: Encourage a diversity of high -quality commercial uses,
attractive to both the resident and the visitor, including retail,
entertainment, cultural, and food sales in appropriate areas of the
City.
o Policy LU10.4: Accommodate a broad range of uses Downtown to
meet the needs of both residents and visitors and to stimulate both
daytime and evening activity.

o Policy CD30.3: Encourage uses that maintain extended evening
hours and support nighttime activity in the downtown.
• Section 14 Specific Plan. The Section 14 Specific Plan identifies the site
as Resort Attraction, which is intended for large-scale resort hotel
complexes, hotels and major commercial recreation attractions integrated
with retail and entertainment facilities. The prior use was as a nightclub and
the area is consistent with surrounding use including restaurants,
nightclubs, cocktail lounges and retail shops.
• Compatibility. The project site is located on a Major Thoroughfare, South
Indian Canyon Drive, near the center of the Central Business District. The
project site is 3.51-acre in size, and it is adequate in size and suitable for
the proposed use. The sale of alcoholic beverages as part of a nightclub
will contribute to diversifying products and services the area has to offer to
local residents and visitors. The approval of the PCN will add to the
attractiveness of the new business.
WHEREAS, on March 23, 2022, the Planning Commission found the proposed use
met findings necessary to grant a Conditional Use Permit, Case 5.1551 CUP, for the
proposed nightclub operation and imposed conditions of approval to ensure the use is
compatible with the surrounding area, not detrimental to other uses in the Resort
Attraction district and protects the public health, safety and welfare; and
WHEREAS, on June 30, 2022, the City Council at a noticed public meeting,
considered the PCN application including the staff report and all written and oral testimony
provided in conjunction with the application.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the public convenience would be served by the issuance of
Type 48 (On Sale General Public Premises) liquor license in conjunction with the
proposed nightclub/cocktail lounge use located at 150 South Indian Canyon Drive,
Census Tract No. 9414.
